Q. If you swear to uphold the constitution as part of your job and the the President suspends the constitution...then what?
We get to do anything we want because the constitution has been suspended?
Since we are under this so-called state of emergency with a declaration of war on terror since 2001 the constitution is basically been suspended.
We have no right to speedy trial
No right to see the evidence and face our accuser.
No habeas corpus.
No right to privacy.
No free speech
No freedom to assembly.
None of it is guaranteed not even the right to bear arms! Politicians are picking and choosing who the laws apply to -- who gets constitutional rights and who doesn't..and it you're not on the right list sad day for you!
Congress is working on a bill to decide who is a journalist and who it not so that they can go after bloggers and deny journalist their right to protect their informants for example.
This last 9/11 there was a 2 million biker memorial ride to DC, many combat vets riding to honor the fallen in NYC. Wash DC denied their permit.
I mean the lists go on and on..
So what is being upheld -- not the constitution. Some will of a tyrant is being upheld perhaps because the constitution has been suspended. All they have to say is that you are a suspected terrorist and it's game over.

Huh? No offense, but what are you talking about?
-- a) There isn't any "state of emergency" now or since 9-11-01 happened.
If there was then FEMA and/or the U.S. DOJ (depending on date) would be running the country as the US Congress would be suspended, and Martial Law would have been declared with federalized Troops in the streets.
-- b) There isn't and hasn't been a "declaration of war". Not 'on terror' or anything.
Congress is the only body in our government that can 'declare war', and congress hasn't done that since 1941 when it Declared War on Japan then subsequently Germany and its allies, like Italy.
What Congress did do in 2001 was pass a 'Resolution' giving Bush the power and authority to respond militarily to the terrorists hiding in Afghanistan and 'other places'. Not having a true Declaration of War is why things got so fucked and still are fucked up with 'the war'.
-- d) The constitution certainly is not "basically suspended".
If it was there'd be Martial Law, there isn't, see 'a'.
-- e) "The War on Terror" -- is bullshit, it's a politically correct meaningless phrase. Terror is a tactic, you don't fight wars against a tactic, or tactics. The only War we have is against Jihadist Islamic Radicals, but saying that might hurt someone's feelings.
