Voting Day for Pensions

  • Gov. Pat Quinn Monday championed a landmark pension-reform deal and vouched for its constitutionality as he and legislative leaders frantically prepared for what the governor called “the most important fiscal vote” lawmakers will ever make.

    The House and Senate were poised for Tuesday votes on a package designed to rescue Illinois from its $100 billion pension crisis, but it seemed clear hours ahead of that expected action that the votes would be extraordinarily close despite an aide to Senate President John Cullerton, D-Chicago, saying the “end is in sight.”

    The adrenaline-packed day, which even included at least one political dirty trick aimed at Quinn and sympathetic Republicans, was likened by some to “World War III” because of the fierce combat going on out of public view.
This bill does not affect Chicago Police or Fire Pensions. However, Rahm has stated in no uncertain terms that it will be used as a framework, model or road-map to "reform" Chicago's equally disastrous situation.

And to that end, we certainly hope that the rumor in our comment section about the FOP President, Board of Directors and lobbyist not being in Springfield today is only that - another in a series of false rumors begun by opposition candidates in the upcoming election.

I'm reading all the bullshit about how this legislation doesn't include us and that's why Shields isn't going downstate. Is this guy so fucking dumb that he doesn't realize the impact it could still have on us? I also thought we were part of the we are one coalition. Nice show of support for our union brothers and sisters.

Guess it's not one of his priorities. The fop board meeting must be more important to his reelection plans. WTF

For the record everyone here thinks that Donahue is our only lobbyist. You are all incorrect. Mark O'Toole who work's for the law firm FORAN, O'TOOLE & BURKE are actually our lobbyist for FOP 7. He is well respected and been representing us for some time now. Mike Shields is way out of his league in Springfield and has no clue which legislative branch is on what side of the Capitol. Mark O'Toole is our lobbyist and something we should be aware of Officers.

I'm happy Rahm is celebrating about Illinois pension reform. I would be the first to sign up for what the state workers are getting. Let's see, I get 1.5% simple interest COLA from age 60 to 80, the "reform" state pension gets 3% COMPOUNDED on a portion of their salary then 1.5-3% simple interest on he rest of their salary. They have to wait from 1-5 years for their COLA to kick in while I have to wait up to 10 years, then my COLAs stop at age 80. None of our members have ever gotten compounded interest, ever. They also pay 1% less into their pension funds bringing them down to 5-7% of their salary while I pay 9.125%. Our average retirement age is 57.8 years old, obviously guys that retire at age 50 are few and far between, making us work longer won't fly because of maximum age limits on our job and the current average age of retirement is already high. Keep celebrating Rahm because when you try to use the states reform plan as a blueprint, you are giving the Chicago Firefighters a very nice increase! The STATE LAW has the city by the balls, don't fall for any of the scare tactics. Most of the negative posts on here aren't even from firemen, but from Rahm's spin machine.

It will affect us no doubt,rahm and the criminal crew are licking their chops waiting to hurt first responders! The casino bill for Chicago will fly through as soon as pension passes, so they can use that money not to fund pensions but to fill family and friends pockets! Wish Zach Fardon new U.S. Attorney steps up big time indictments for the elected criminals and the Daley crime empire need to be dished out!

On another note in some other threads read about the unit union rep giving out free tickets to Christmas parties, for the retirees, I called fop to ask for free tickets but was told to "see the rep" think about all the units and fop buying 10 tickets to each not attending just letting reps give them away as the working copper pays her/his share! Another waste right mike?

Yes, and the federal bankruptcy judge in Michigan ruled that pensions are not exempt from bankruptcy . That dooms the retired city employees in that city to a pension of less then50% of what they were entitled to. And, there is a prominent law firm in Chicago which is advising that each pension fund stands alone and when it is out of cash it is out of cash with no obligation for the city to keep it going. The federal judge said that the unions were a " stone wall" in Detroit , something which influenced his decision. Bad times on the horizon in this country for government employees. And, we will not get any sympathy from the citizens who feel the pensions are too generous.

Update, and it's official: JUDGE: DETROIT ELIGIBLE FOR IMMEDIATE BANKRUPTCY PROTECTION, DETROIT TO REMAIN UNDER BANKRUPTCY COURT PROTECTION, JUDGE SAYS

As somewhat expected - though hoped against by many Detroit union workers - Judge Steven Rhodes appears to have confirmed Detroit is eligible for bankruptcy protection (after pointing out that the city's accounting was accurate and it is indeed insolvent) making this the largest ever muni bankruptcy.

JUDGE RHODES SAYS HE WILL ALLOW PENSION CUTS IN DETROIT'S BANKRUPTCY, DETROIT JUDGE: NOTHING SEPARATES PENSIONS FROM OTHER DEBT

The city will now begin working toward its next major move - the submission of a plan to re-adjust its more than $18 billion in debt - including significant haircuts for pension funds (possibly 16c on the dollar recovery) and bondholders. With Detroit as precedent, we can only imagine the torrent of other cities in trouble that will be willing to fold.

Say what you want, Rahm holds the trump card. It is called bankruptcy. The judge in the Detroit case just commented that Detroit should have filed years earlier. The pensions will be cut drastically now.
All Rahm has to do is find a friendly bankruptcy judge. Shouldn't be hard to do in Chicago. Just think of all the money the advisors, banks and the like would make off a chicago bankruptcy. It could be in the billions.

Judge rules Detroit may reduce pension benefits as part of bankruptcy case

Detroit was officially deemed bankrupt by Judge Steven W. Rhodes in U.S. Bankruptcy Court in Detroit on Tuesday, according to a court news release.

Mr. Rhodes also ruled that Detroit may legally reduce public pension benefits under Michigan state law.

After a two-week trial to establish the city's eligibility for protection under Chapter 9 municipal bankruptcy code, Mr. Rhodes agreed with Kevyn D. Orr, Detroit's state-appointed emergency manager, that the city should receive protection from lawsuits or other actions that could get in the way of reducing debt and cutting pension benefits.

Mr. Orr filed the city's bankruptcy petition on July 18, listing debts totaling about $18 billion, including a combined $3.5 billion of liabilities for the $3.4 billion Detroit Police & Fire Retirement System and $2.77 billion Detroit General Retirement System.

“Under the Michigan Constitution, municipal pension rights are contract rights. Therefore, because the State of Michigan authorized the filing of this case, municipal pension rights in Michigan can be impaired in this bankruptcy case, just like any other contract rights,” according to a summary of Mr. Rhodes' ruling in the court release.

Not a rumor, Mike and Mark are at 1412 W.Washington Blvd. they are at the all important Board meeting arguing about Bill Dougherty being dumped from the FOP office as a field rep. They would never have dreamed of moving the Board meeting so that they could go to Springfield for the most important vote in 20 years. Priorities them and their income first. Sorry to say we, our contract and pension are not even a blip on Mike, Bill and Marks radar.

Not as easy as it seems. Chicago still has a property tax base that can be increased. Chicago still has an option of a city income tax and other means of raising funds plus it has an income producing downtown area.

Lets not forget the judge also said this regarding the pensions


The city says pension funds are short by $3.5 billion. Anxious retirees drawing less than $20,000 a year have appeared in court and put an anguished face on the case. Despite his finding, Rhodes cautioned everyone that he won't automatically approve pension cuts that could be part of Detroit's eventual plan to get out of bankruptcy.

Now be a good boy and release the actuarial data regarding Chicago Policemen and Firemen and their mortality rates.

The same actuarial data the city has insisted on sitting on for more than 20 years because it might cast Police and Fire in a sympathetic light...

You'll have the answer to you question once the city shares the actuarial data in the spirit of full disclosure so that an adult conversation about "retirement at 50" can be had without the need to gin up public sentiment against people doing a job that everybody else swears is easy and doesn't take years off your life.

Our victims and FD patients wait a little longer for our old legs to climb stairs (no more running) and stop their old man from battering them (on his own accord of course because 60 is a bit old for fighting) and don't mind getting dropped by a 60 year old medic losing grip on the stretcher. That's the spirit!

It was the deal agreed upon, and the state politicians were the ones who wrote and approved it all in the 80s and 90s.
Now the economy has changed and suddenly then state doesn't want to devote funds to sustain their contribution once again. It would require cutting in other areas.
You watch- the same will happen now in every city and pension fund if this crap is allowed.

I hope our unions prevail in court. If not we are done. Because these people will keep attacking our pensions.

Mike Shields main objective has always been pensions. Now that the State has dealt with there Pensions we can see how the city deals with ours. Mike Shields opinion and voice will not even be heard when the Mayor and City Council decide how to deal with us. Shields has no chance with Rahm. Mike Shields saved the the city 20 million dollars by not getting paper work in for our contract. 20 million dollars is quiet alot of savings for the City. Our Pension is in trouble and the way the State dealt with there pensions is a road map for the City to take and Rahm will screw us. So did our FOP President Mike Shields. Do not re elect Shields. He is the a devil in sheep's clothing and he is running around in his underwear.......

Sgt class starting Monday, will use them for window detail over Christmas and Navy Pier on New Years. one issue why they want them to stay at PO status till after December is so they can't sell back bfds and pdays at sgt pay rate. Also they want them out there with ppos and if they are sgts they would get the .75 hours time each day. HR will extend training long enough to prevent paying them as sgts.

CNBC just had a news segment on the Detroit bankruptcy. A judge ruled that retired city employees pensions should be treated the same as any other general obligation. That means pensioners are taking a haircut.

Rahm may love to try this tactic here, but Chicago still has plenty of commerce , unlike Detroit. It may happen here in 30-40 years..but I'll be dead by then.

A motion that was introduce at Tuesday's Board Meeting by Retired Police Officer Bill Burns regarding a 90 day grace period for Retired Officers to pay a set fee for past dues in arrearage for the privaledge of joining the FOP again as a member in good standing was voted down.
A roll call vote was called and each board member present voted yea or na. The motion failed.
What really pissed me off was the way Rich Aguilar went on about fairness to those who have been paying their dues since retiring.
Well, that is true there are those who have paid since retiring, however, would it not serve the FOP wisely to allow those retired PO'S to regain their loss of FOP membership while helping the FOP financially going forward by the collection of those fines and future dues??
We all make bad decisions in life, hell, a good number made mistakes Re-electing Rich Aguilar to the current board.
Please SCC, would you inquire and print the results of the Board Members vote on this motion so all of the membership can see how retiree's stand with this board.
Stop the grandstanding Rich, you'll be retired very soon and I hope this treatment never happens to you.

I am so tired of the talk regarding the plight of Chicago and "Detroit". Detroit was a 1 industry town and when the auto and steel industry went kapootz so too did the workers, residents, and quality of life. Chicago is NOT.

Chicago lost its' steel industry and the population demographic changed on the Southeast side of Chicago was the result. You can see the after math in the 4th and 5th Districts. The rest of the City went unaffected. If anything, the Southeast side is open land and ripe for another industry.

Chicago now skims from the property taxes and slushes about 650 million dollars a year into a TIF fund that is used to reward the loyal Democratic businesses and Aldermen. This money belongs in the General fund and not in a Democratic Holiday Piggy Bank.

How much does Chicago's Sanctuary Status cost the City? Fair question if we are discussing bankruptcy and cutting pensions for senior citizens...Maybe close to say at least $500 million on the low end annually. Have you seen the UNO schools lately? Wowser. This is only one wasteful liberal program.

The city will never file bankruptcy because it CAN'T. It has still too much revenue to cry poor. The TIFS and Sanctuary $ would have to be disclosed.

If Rahm does not want to be fiscally responsible and raise taxes to cover the bills his people generate and that are gobbled up in the urban jungle, because of an asinine campaign promise, then so what. That's on him and his Napoleanic finger waving management style.

I congratulate FOP and Shields on being part of the PENSION effort that causes the city to pay their $600 million dollar fair share payment in 2015 and so on.

I congratulate FOP and Shields on amplifying the mistake that Jimmy Ade and the Sgt's union almost made, in contract negotiations, eventually getting it voted down 9 to 1.

I am not happy about the "letter" debacle but I can see that our pensions are way more important that a 2% retro check. What good will a $1000 check do me when I have to work an extra 5 years. Smell the coffee?

If you personally don't like Shields that is your problem. I have yet to see another candidate more learned on our pension issues than Shields. This is the ball game people!

The arbitrator will ultimately decide our contract regarding benefits and schedule of pay. The last contract sucked and so did the one prior, so will this one. But it will be enough to keep pace and get me closer to retirement.

So stop acting like dummies and pay attention to the pension.

Mark Donahue and Bill Dougherty's hand picked State Representative from the 19th ward Fran Hurley voted for pension reform and against labor today. So Mark Donahue could not lobby one single representative today. Mark and his band of followers have screwed us for 12 years now.

Although this bill had nothing to do with Chicago Rahm will use it as a blueprint for future reform bills.

Did you happen to see the Angelo and Dougherty people there? Because I was told that they were there too.

Although Billy is back on an a beat care after 12 years of the good life his followers were trying to do a SECRET BALLOT to continue to give Billy D5 pay for an additional 3 months. Now this is second hand but I heard that Shield's at least made all of the votes roll call votes. No secret deals for Billy to get another 30k of our money. So it failed. After 12 years of D5 pay he needed a handout?

Could someone who was there please post the votes for who wanted to give Billy Dougherty(screw a vet today?) 30k of our money? And any other votes they held today on any other bills.

The City got a pension holiday from the Teacher's Union. In exchange, the teachers got numerous consecutive 7% raises. And the union president got essentially an exempt pension. The exempt portion, above the teacher's pay, was paid for by Daley. Who do you owe your allegiance to? The teachers or Daley who just gave you a $100,000 plus pension.

So the teachers got a number of 7% raises paid for with their own pension money. It wasn't paid into their pension fund, it was paid directly to teachers in the form of raises. So really, they were and are collecting pension funds early. How will the pension funds calculate that when the day of reckoning comes? Pension money paid out as salary.

That was another of that genius Mayor Daley's whiz kid financial moves. Daley must have looked at Detroit and thought he could do worse, and he did.

And brother Bill, big shot banker, big shot commerce secretary, presidential chief of staff, has this mentally retarded brother for mayor of Chicago and Bill declares him a great Mayor.

That moron would bankrupt a lemonade stand. He had absolutely no business being in charge of the finances of a large American City. The man is just plain stupid. Lot's of people are glad of that, they got to loot the City treasury.

Yes, Michigan does have the same exact wording in its constitution that Illinois has to protect pensions. Michigan has long been the leader in protecting the rights of public employees. Most of the arbitrators of public sector grievances came from Michigan as they had the first law to allow public sector union contracts. Get a grip and read up on what is coming. The federal judge in Michigan clearly quoted the Michigan constitution in his decision and stated that the state constitution does not trump federal law. this matter will end up at the US Supreme court.

You are so wrong my friend, please become better informed before you criticize someone for not being better informed. Read the federal judge's opinion. It stated that pensions are a contractual obligation that is not entitled to "heightened protection", that is the protection provided by the state's constitution which is considered the strongest state constitution in the country protecting pensions. The wording in Michigan's and Illinoi's constitution are virtually the same. The floodgates are opened and will be opened even further if this ruling is upheld on appeal.

What really pissed me off was the way Rich Aguilar went on about fairness to those who have been paying their dues since retiring.
Well, that is true there are those who have paid since retiring, however, would it not serve the FOP wisely to allow those retired PO'S to regain their loss of FOP membership while helping the FOP financially going forward by the collection of those fines and future dues??
We all make bad decisions in life, hell, a good number made mistakes Re-electing Rich Aguilar to the current board.
Please SCC, would you inquire and print the results of the Board Members vote on this motion so all of the membership can see how retiree's stand with this board.

I have continued to pay my dues as a retiree and I am able to vote in the upcoming FOP election.Ten years retired.... $400.00 paid. Thank you very much!

As a retiree I do not think it is fair that a 'White Shirt" or a brother in a blue shirt, that did not keep up his membership, should be allowed to rejoin without paying a "back" dues.

The FOP instituted a policy under the guide of the Late Great Tom Skelly in which these older guys and gals were allowed to return to the membership for a small amount that would not "crush" there pocket book.

The two men at the FOP board meeting that stood up to this are right in doing so.

Keep up your lies, your hopes and dreams of courting the retirees keep in mind, any retiree who has had hardship or has sought reinstatement has been readmitted to the FOP. Also keep in mind we are talking of only very few members who have sought reinstatement. The purpose of your lies are to create more votes to win the election for Shields. At the board meeting even the retirees could see what was going on. I being one of them, remember a lot of us retirees have children and friends still on the job and we have seen what you have done while being in your position. You will be voted out Shields and your minions.

the city pension shortfall is close to $10,000 for each person that lives in the city. the state shortfall is something like $15,000 per person that lives in the state. that means everyone that lives in Chicago owes about $25,000 to state and local government retirees(not including incidental pension debt from Cook County and other governmental units).

you really think that you can extract that much additional tax revenue from already pressed taxpayers?

Humm , Mariam Santos was an Angel in disguise that Daley fucked over because she wouldn't let that prick touch our pension. But , that Asshole found a way to set her up and permantetly get her out of Chicago politics. All of the Daley Ass lickers holding their hands out were glad to see here go. Remember prior to 2000 you can work as long as you wanted. The 63 mandatory retirement age was put in place by the Little IP Daley. He wanted to get rid of the highest paid po's so he put this in place. So actually the mandatory retirement age has only been around for a little over 10 years. I do not want to stay until 63 but, I really can give a s?@t if another po wants to stay, it does not make a difference to me.

You have no idea of what you are talking about. 63 has been around for at least 50 years and was only temporarily changed in 1983 because of the federal ADEA act that included LOA's That act was later amended and in 1988 the city changed it back to 63. Following is a paragraph from a lawsuit by a CPD retireee that basically explains it Additionally there was a rumor that the city waited from 1986 to 1988 to bring back the age of 63 because Townsend was the 1st deputy and over 63 and would have had to retire if the city implemented it in 1986. He retired a few years later and the law was changed


To fully appreciate the issues in Thompson, it is important to consider the history of the imposition of a mandatory retirement age for Chicago police officers. Prior to 1983, the mandatory retirement age for Chicago police officers was 63. In 1983, the Age Discrimination in Employment Act of 1967 (ADEA) was applied to state law enforcement officials. As a result, the mandatory retirement age for Chicago police officers rose to 70 years of age, the maximum age to which ADEA protection applied at that time. In 1986, the United States Congress amended the ADEA to allow state and local governments to reinstitute a mandatory retirement age. In response, the City in 1988, reinstituted a mandatory retirement age of 63 years of age for police officers.

You are probably right. They vote on the contitution every like 20 years, but maybe they can add amendments. Only one question about the amendments. Representatives and state senators would vote on amendments, why wouldnt they have added an amendment to change the state law of "not diminishing the pension" if it was that easy. They are being criticised for this vote and by voting for the amendment, they would have taken away any legal challenge

You are right, I was wrong, they can add an amendment. But it is harder to than a majority vote of the legislature. Both the state house and senate have to aprrove it by 3/5 vote, put it on the ballot and 3/5 voters who vote on the amendment have to approve it or the majority of the voters that voted in the election


SECTION 2. AMENDMENTS BY GENERAL ASSEMBLY
(a) Amendments to this Constitution may be initiated in
either house of the General Assembly. Amendments shall be
read in full on three different days in each house and
reproduced before the vote is taken on final passage.
Amendments approved by the vote of three-fifths of the
members elected to each house shall be submitted to the
electors at the general election next occurring at least six
months after such legislative approval, unless withdrawn by a
vote of a majority of the members elected to each house.
(b) Amendments proposed by the General Assembly shall be
published with explanations, as provided by law, at least one
month preceding the vote thereon by the electors. The vote on
the proposed amendment or amendments shall be on a separate
ballot. A proposed amendment shall become effective as the
amendment provides if approved by either three-fifths of
those voting on the question or a majority of those voting in
the election.
(c) The General Assembly shall not submit proposed
amendments to more than three Articles of the Constitution at
any one election. No amendment shall be proposed or submitted
under this Section from the time a Convention is called until
after the electors have voted on the revision or amendments,
if any, proposed by such Convention.
