These bottom-feeders are "sure-thing" operators - they don't lose often at all:
- A federal lawsuit on Thursday accused five police officers from Chicago and Glenview of conspiring to lie under oath at a court hearing late last month, only to be caught by a judge after a video taken from a squad car contradicted their testimony.
One of the Chicago narcotics officers had asked the two Glenview officers to turn off their video cameras so the traffic stop would not be recorded, but one of the officers failed to do so, according to the lawsuit.
The lawsuit alleged that the incident – first reported in the Tribune on Tuesday -- exposed a broader “policy and practice” by Chicago police “to pursue wrongful convictions in drug cases through untruthful testimony.”
“The biggest casualty in the war on drugs is the truth,” attorney Jon Loevy told reporters at a press conference at his Near West Side office.

The only reason it was put in the news is because loevy filed the suit... He always does this. Puts the story on the news and files the suit the same day with a press conference or soon after to get public opinion on his side and pressure the city into settling quietly and quickly. If the lawsuit was never gonna be filed the video or story would have never hit the news. The incident happened almost a month ago. Loevy put the story and video out and that's it. Goldman referred him to loevy so he gets his cut. All lawyer crap

I don't think there is much $$ here really. A guy with a pound of weed escaped prosecution because of shady police work. The camera shows the officers recovering the weed from out of the guys car. He was committing a crime. The drugs were not planted. The guy was not incarcerated for any substantial period of time. He bonded out the day after his arrest. Who knows. I just don't see him getting anything. Just my opinion so no need for all the ""hey dumb fuck" responses I'm sure people will write.
Strong rumors of multiple officers and a few sergeants stripped and indictments for various rule violations and laws ignored stemming from videotaped street stops by outside units assigned to 010/011/015/025. Several street and traffic stops staged and recorded. Guys, don't let the pressure to perform get your fired or thrown in jail.

The comments made by some people in the previous post regarding this are just absolutely horrible. I am not saying the officers involved in this didn't screw up, or better yet screw themselves up by doing something the way its been done before and made a bad choice. It is real easy to second guess another copper based on what you see on the news or read in the paper. No one in that video put the pound of weed inside the vehicle. How the officers wrote the paper and how they got into the car is what they will have to deal with. This was not an "innocent" citizen "framed" by Police. I read a lot of hypocritical comments on here regarding these types of situations. And by that I mean I read in other posts, "coppers" slamming the suntimes, tribune and all news media for their biased reporting as well as the ignorant and anti-Police responses in the citizen comment sections of those news sites. Also slammed are the judges and defense Attorneys. But you will respond with statements like, "Fuck 'em", "they get what they deserve", and my favorite "I hope they go to prison". All based on information coming from the very people you hate. Did any of you read the case report? Was their alleged lying based on the traffic offense? What was said to the driver? And as far as the comments regarding all this for a weed pinch, is that all this was? Or maybe was this OFFENDER involved in a lot more than the pound of weed found in his vehicle. If any of you can answer any of these questions from personal knowledge, or from the testimony heard in court, then by all means go ahead. But if it's based only on what the news tells you and the video they show without the Officers explanation, please stop and let this play out. Each and every person on this job at one time or another has made a bad decision, or done something they wished they hadn't. If you say no then you are either lying yourself, have never done the job, or haven't been doing it long enough. I only hope and pray that those making these comments don't find themselves on the other side of the coin. Stick together for God's sake and stop acting like these guys planted the dope or went around robbing dope dealers. Cause when it is you named in the paper, I will be willing to bet you will say "I wish people knew what really happened"

To all those trying to defend the police in this incident, here is what I want to know. Why didn't the 5 cops involved report the incident exactly as it happened? The worst that would have happened is a finding of no probable cause at the preliminary. They would have got the dope off the street, hurt the defendant in the pocket, and had a clear conscious and went back to work.
But they lied to a judge, and no matter how you slice it, it was still perjury. There is no way out of these cops getting punished. They can't back pedal, they can't write their way out, because the perjury already happened. (Although, any of the 5 point can flip and point the finger to lessen their penalty.)
And please don't tell me all 5 were confused or forgot how it went down. Nobody buys it, nor did the judge.

SCC: The defense attorney approached the ASA and asked for a deal, saying he has video that doesn't match the report. ASA refused. Now, why would the ASA not view and or prep these Officers with a video she knows exists? and why did she need 5 Officers to testify to a traffic stop (for only a pound of weed)? I'm skeptical about this ASA's actions (subornation of perjury if knew false testimony was being presented? knows they leaving for defense work and wants to F*&@ some coppers?) What is the ASA's story?

That stop could have gone absolutely right. If the offender refused a consent search, get a dog (exterior search only). The dog alerts, you write an affidavit for a search warrant based on the other investigative activities and the dog. If you have PC, a judge will sign the warrant and you seize the contraband and arrest the offender (or indict him later). It is easy, but it takes a lot of time to do it right. It is the ONLY right way to work. If the excuse is "I don't have time to do all that." then go back to patrol and chase the radio like most coppers do. Really what you are saying is I don't have the intelligence level to do my job properly. And if that's the case, find another job all together.
Shortcuts equal lies and lies equal police officers becoming convicted felons, going to prison, losing their families, and never amounting to anything in life.

Sad part is Glenview coppers are going to be fired and the CPD coppers will probably be saved because of their clout.
CPD coppers will probably be suspended for 60-90 days..... and life goes on.......

Stay away from narcotics arrests altogether,the drug business is nothing but trouble and a complete waste of time.
It doesnot matter what arrest you make, review your reports, your preliminary hearing testimony and anything that is recorded via car-cam'. You can justify your actions as long you document them and testify to them. If you lose the case on probable cause thats easier to go home to than what these officers are facing.
Back in the 60's I was told by some of the best P/O's I ever worked with and some I did not to stay the fuck away from the drug shit ie: getting warrants raids etc. and never work vice.
I wasn't there, but have been around awhile and seen my share of narcotic arrest. The officers made a mistake and on the job mistakes happen all the time. No evidence was planted, nobody was coerced, and nobody was wrongfully detained. This incident in question occurred in less then a minute, is it possible that one or a few of the officers smelled and saw the weed then handcuffed? The dealer admitted to possessing the weed. Sounds like at that point review the video (GPD had to know there was video, they sent it to the defense) and if you see discrepancies, covering your CI, or protecting your means of obtaining your information is that important, toss the case! That is also the job of the ASA! That is why CI management is critical! This all could have been avoided. I hope 5 Officers don't lose there jobs for this and then have to come up with a way to pay punitive!! Video is all over, consider yourself ALWAYS being filmed, let's use it to our advantage!
Maybe they really didn't remember the incident accurately. Maybe someone in the group influenced their memory of what happened. But they are all on the opposite side of where they want to be.
That's why it is so critical to document things in reports to help refresh you memory.

Putting a dangerous criminal with a heads up on a crime being commited does not automatically mean in custody to be transported to te station. It means he legally detained for an amount o time to perform an investigation. Cuffs are on as he was a target and known violent offender as per his previous arrest. They didn't just randomly pull over this car. The had info from a ci which gives them enough reasonable suspicion. You coppers on this blog are so quick to condem just like the media whores. Let this play out. I have been to deps and court w lovey and lovey plenty of times. The take cases on media and public opinion. I have won three times and the the 4th they got a settlement just to pay their legal fees. So it ain't automatic. This firm is just as criminal as the people they represent.
Our jobs calls for us to enforce the laws, reguardless of what we think of them. When we choose to break laws i.e perjury, we do irreparable damage to our profession. Do the job right and sleep at night.

The damn things should mandated by state law not to be able to be turned off, not just for the citizen's protection but the PO's too.

If you look around lately this isn't just in the ghetto anymore. Laying off these animals has now caused them to move deeper into the communities our families live. Letting them sell all the dope they want and kill all they want is probably a more irresponsible and immoral comment then how these guys wrote the paper. Don't ever get confused about the fact that what "they" do in the street does affect our families in some way. The bangers dealers and killers no longer fear us or anything law enforcement related anymore. And while on I'm my "soapbox" I'll say this. Some of you make comments about taking an oath or being moral and honest and then follow it up by saying don't do shit, let them sell and kill all they want. Yeah I think this dept is in a lot more trouble than a few guys turning the story around to make the PC fit.

To the Citizen who says if the camera isn't on you are hiding something. Some of these cameras don't work, shut off on their own, etc. To those who think this whole case looks strange, wait until we get more info before passing judgement. I hope any citizen, or juror, if it gets to that point, does the same thing.
Maybe narcotics unit, organized crime unit and all these other ones should specifically ask for young officers who really believe saying there from these units means there super cops, or since they can take home a unmarked car and not use there own, that there entitled to, cause there super cops, or keep asking for cops that want to really believe there doing something better than officers say from patrol, because when you make all those arrests for a bag of rocks or even a pound or kilo, that really makes a dent on the multi billion dollar drug trade, and it really hurts the leaders of the cartels (?). It's so funny hearing these guys say it's better than answering calls!? , when there are 6 officers standing around on a warrant that's a failure most of the time, patting there backs and high fiving. The Officers involved fucked up. I was employed with CPD for 5 years. And left to the Feds after seeing how fuck up the department can easily at times. I tell all my friends to be careful and not to risk their career for some street thug. To lie about the circumstances surrounding this event was stupid. They could have easily developed probable cause to enter the vehicle. Now they will be sued and possibly lose their jobs. The CPD doesn't need cops like this on the job. They fuck it up for everyone else. There's no such thing as a secret. Your buddy will tell on you to save his ass!!! Do the right thing every day and go home and sleep good at night.

If a street stop gets tossed at a motion to quash arrest/suppress evidence, so be it but it's never ok to lie to change the facts of that street stop. This isn't a case of the defendant getting away with it because of some flaw in the Cook County justice system, it's about officers lying under oath and potentially violating the 4th amendment to the Constitution. In this day and age, you have to work under the premise that there are cameras everywhere and will record your every action....

I agree with you 100%. As far as I'm concerned, It all comes down to training and leadership. I have worked with people who haven't picked up a law journal, ilcs, or department publication since they graduated the academy and it shows. This isn't a part time job at 7-11, have a little respect for the career and for god's sake how about not wearing your gym shoes, hat backwards and gun hanging out of your belt when you show up for court.

Sounds like you didn't have the clout to make it to organized crime. From my experience having worked in OCD long ago --everyone in OCD especially narcotics have a heavy phone call. It is not what you know but who you know. You have officers that should not be working in many of these specialized units but because of his or her clout the units are full of unqualified officer working in a position that may be unqualified for. It is not hard for an officer to do what is right but many officers in OCD seem to have a problem walking the straight and narrow. For some reason the mindset of a majority of these officers is that they are untouchable and can do or say anything to anyone. This include what is written in reports the problem I have seen with reading many case reports and arrest reports is that many of these dope arrests seem to be preprinted or scripted. The dope is always recovered from the same spot in the vehicle (I.e the center counsel or the cup holder and always in the officers view) I can't tell you how many scripted narcotics case reports and arrest reports I have read that said the same thing over and over. I just shook my head and said at some point this will come back and bite the officers in the ass. I always take detailed notes and my reports never look the same. All the defense needs to do is subpoena the officers previous dope arrest and case reports to see the similarities. We learned in the academy to take detailed notes of what transpired on our stops and arrests. You transfer what was written in your notes to the case and arrest. Not hard at all because you are stating what really happened. These officers took a pound of dope off the street and disrupted business for a local thug. That is great I just don't get what was so hard about writing about what really transpired or why they needed to turn the camera off. Not cool at all. This is the real issue here. Why did the officers need to deviate from the truth. I don't really feel sorry for these officers or the sergeant. I think they deserve what they get. Communicating what transpired is not that hard to do. This is policing 101 and if the officers can't do that then they need to find another position within the department. I agree with some of the other posts. It is time to clean house and cut down narcotics and some of these other clout heavy units in OCD.

I don't think anyone believes a dope pinch big or small makes a dent in the drug trade. Door dealers do more than sell dope ya know, they also rob, rape,kill and shoot at the Police. So maybe locking one up for awhile keeps them from hurting you or someone you care about. It is real easy to second guess another copper based on what you see on the news or read in the paper. No one in that video put the pound of weed inside the vehicle. If any of you can answer any of these questions from personal knowledge, or from the testimony heard in court, then by all means go ahead. But if it's based only on what the news tells you and the video they show without the Officers explanation, please stop and let this play out. Each and every person on this job at one time or another has made a bad decision, or done something they wished they hadn't. If you say no then you are either lying yourself, have never done the job, or haven't been doing it long enough. How would she risk her license if she viewed the video and then reviewed your testimony at a pretrial conference. Do it all the time and they do it to see if there are any inconsistencies prior to trial.

I wasn't there, but have been around awhile and seen my share of narcotic arrest. The officers made a mistake and on the job mistakes happen all the time. No evidence was planted, nobody was coerced, and nobody was wrongfully detained. This incident in question occurred in less then a minute, is it possible that one or a few of the officers smelled and saw the weed then handcuffed? The dealer admitted to possessing the weed. Sounds like at that point review the video (GPD had to know there was video, they sent it to the defense) and if you see discrepancies, covering your CI, or protecting your means of obtaining your information is that important, toss the case! That is also the job of the ASA! That is why CI management is critical! This all could have been avoided. I hope 5 Officers don't lose there jobs for this and then have to come up with a way to pay punitive!! Video is all over, consider yourself ALWAYS being filmed, let's use it to our advantage!
I agree The ASA knowing the video existed should have prepped the officers. They do that to avoid and inconsistencies and discrepancies which are not lies but possibly the wrong recollection of the incident.
Because of the circumstances of the arrest, none of us know what they testified to in court and the impact it had on the case. Thought they were making a big deal about the handcuffing. That could have been sor safety and nothing to do with initially observing the drugs.
No one should be a Monday morning quaterback on this case unless you know all the facts.

Just meant "in general" that an ASA isn't going to risk losing their credentials for a cop. I just can't blame the ASA for any of this. All 5 cops knew there cameras and they didn't even take it upon themselves to view the video the day of the arrest, before writing their paper. When getting prepped, Why didn't the 5 cops inform the ASA there were cameras and that there could be a video? Maybe because they were hoping and praying the whole time that the video would never surface?
Also meant that once found to be in violation of rule 14, one cannot ever make a arrest or testify in court or write a police report for a total of 7 years. There is no way and no reason an investigation into this incident would taken 7 years. But let's say it did...it would not be considered time served for those 3 sitting down at the 911 center during those 7 years. The 7 years punishment would begin once "found guilty " per se. The department doesn't allow long term light duty anymore for legit cops, so why would they let these 3 be desk dollies for 7 years?
I'd be embarrassed to ride with anyone who works like these guys. That being said, I have now lost my ability to smell or see anything that has to do with drugs. The drug war is over and we still just lost 5 of us to it. We have better things to.

People in 189 get addicted to the "unit" lifestyle...the car, the ducks, the being carried on the A&A's for days, while not actually being there. The being able to conduct your personal business on the clock, with a dept car,running on city gas. Eating wherever you want, for as long as you want. The getting a search warrants signed at 10am, then, getting lost the rest of the day, coming back at 1800, then executing the warrant...for the O.T. Once you get used to that, you never want to go back to patrol. Funny thing though, it's not until they're forced back to patrol, as I was, that they realize how much pressure they lived under in 189. And once we've re-adjusted to district life, aint no way you could ever get us to back to a damned unit. This no pressure, 4 & 2 thing, aint a bad deal. Sadly, Unit 189 has been the ruin of many a copper. And these won't be the last. Thank God I'm outta there...with my job and dignity still intact.
