How About a List?

  • The white University of Cincinnati police officer who shot unarmed black man Samuel Dubose during a traffic stop has been indicted on a murder charge, a prosecutor announced Wednesday, saying the cop "purposely" killed the motorist and "should never have been a police officer."

    In announcing the charge against officer Ray Tensing, Hamilton County prosecutor Joe Deters lambasted the cop over the July 19 death of Dubose, 43, saying the fatal shooting was "the most asinine act I've ever seen a police officer make."
Pardon us, but that sounds a bit prejudicial to the "fair trial" rule of law. We assume that Joe Deters has proof of the hiring process, the standards of Ohio for qualifying officers, and a list of "asinine act(s)" to compare this one to?
  • "He wasn't dealing with someone who was wanted for murder, OK? He was dealing with someone who didn't have a front license plate," Deters said of Tensing, who joined the university force in April 2014. "I mean, this is, in the vernacular, a pretty chicken-crap stop, all right? And — I could use harsher words."

    He added that even if Dubose was starting to "roll away," the officer should have just let him go.
If this is such a.....how did he put it? "chicken-crap stop," then why did the legislature pass the law in the first place? Police are pretty much obligated to stop people who are breaking the law and maintain the standards set by the elected representatives. The words "Law" and "Enforcement" pretty much appear in the job description, unless they've been removed recently? And we imagine the prosecutor is going to regret uttering the thought that if someone starts to "roll away," officers should just let them go.

How about the states attorneys, prosecuting attorneys, or district attorneys in every one of the 50 states provide police a list of offenses that certain people don't have to obey or comply with? That would make everything simpler for everyone, wouldn't it? We wouldn't have these incident popping up with the potential for so much misunderstanding and violence when everyone is supposed to be equal before the law, right?

We'll even help start a list:
  • strong armed robbery in Ferguson and not be stopped
  • sell loose cigarettes in New York and not be stopped
  • drive without a front license plate in Cincinnati
  • loiter on street corners, flag down cars and sell dope or sex
  • resist arrests, lawful or not, based on street lawyer experience or rap lyrics
  • pretty much any gun offense on the streets of Chiraq
That being said and the unedited video not being shown by the media, an intelligent person cannot even make an educated guess as to what fully transpired. Yet the prosecutor has already condemned the accused to "purposefully" killing a motorist, claimed the entire hiring and training regimen suspect (thereby attacking all police officers of this department), and cemented this as the "most asinine act" in the history of policing, tainting any jury within a few hundred miles of Cincinnati.

"Railroading" doesn't even come close to describing this.

Watch the video press conference of this jag off. You'll want to throw up in your mouth. Policing is finished. Add to the list carrying a pellet/bb gun that looks real as hell in Ohio, we should just lignite those calls too. Have the callers/victims check for us if its a real gun or fake and get back to the dispatcher.

Our President, You Know Who, has a whole host of laws that he ignores and has instructed those agencies under him to ignore. Also,certain portions of U.S. Constitution are ignored or disregarded whenever it is convenient to do so. Orders from federal judges, just ignore them. Maybe POTUS is setting the tone and an example for the rest of the population regarding obeying the law.

Over the past 20 years, Dubose has been charged more than 75 times in Hamilton County. Most of the charges were indeed non-violent: driving without a license, joyriding, having windows tinted too dark, misdemeanor drug possession. An assault charge in 2013 was dismissed. He’s faced eviction seven times, and he had his license suspended indefinitely in January by the Ohio Bureau of Motor Vehicles. DuBose has been charged with driving without a license more than 13 times between 1995 and 2009, according to court records obtained by Cincinnati’s Fox 19. He has also been charged with driving while suspended eight times from 2005 and 2011 and with failure to display a proper a proper license plate on his vehicle four times between 1995 and 2009. Dubose had more than 75 offenses charged to him over his lifetime.

Need to cut the Ohio prosecutor some slack. He has a certain powerful minority to placate, and he is probably trying to avoid full scale rioting, looting, burning and raping in the streets over this incident. Black Lives Matter in modern society much more than some minor traffic law. This officer's judgement, and sense of proportion is so lacking that he should not even be in law enforcement. Unfortunately, the officer is probably going to pay for his lack of judgement with a long prison sentence.

Finally, a list is coming out? I've been waiting for this list a long time. Just make sure it also lets us know when and if we can defend ourselves from an armed assailant and how we're suppose to defend ourselves. Like is there a balancing act we need to do. You know, like if I shoot first it's going to cost me and my family this amount. But if I wait till I'm shot dead it will only cost the city this amount.

How about this as an idea for the city and its' inhabitants. Like taverns and alcohol sales; let the registered eligible voters decide whether their precinct will be "wet or dry" (police service or not). By doing this we let the people have their voice. Specific details could be worked out if such a plan caught on and then resources could be redistributed to those areas who desire police service.
I am only being half sarcastic and would like to see some response to this idea. Anyone?

Spot on SCC. If Officer Wilson, after almost being disarmed by the unarmed Gentle Giant, was allowed to put the car in drive and go grab a cup of coffee, he'd still have his job, Ferguson wouldn't be burned to the ground, and the Gentle Giant would still be "enrolled" in College this fall.

But according to the rules of his job he couldn't.

Since lawmakers make the laws and don't like it when white cops interact with certain segments of the population, simply pass a law that allows a cop to just walk away. Pulled over for speeding/weaving//talking on the phone and officer X didn't realize you were of a protected class until he walked up to the car? Sorry Sir/Ma'am, I was unaware of your race until just now, no need to show me your license or proof of insurance and despite the smell of alcohol on your breath, you are free to continue on your way.

It is my hope that one day, people will be judged by the content of their character and not by the color of their skin.

Just another example of the rules society are establishing for the police. If someone is running away or attempting to flee in a vehicle, they are not a threat and the police should just let them go. Do not fire unless fired upon, after all it may only be a toy gun with the orange tip removed. All police that violate these rules and end up killing someone, who will than be called a victim, will be prosecuted. These rules are being pushed from media outlets such as CNN to radio personalities such as Mancow. They Monday morning quarterback every high profile police citizen incident often calling the police criminals. The result of this is the depolicing of America. The ground rules are being established. How are you going to respond as a police officer? The way you do may put your families lives and your own freedom in jeopardy. Remember dogs seldom get cr numbers, or are named in law suits, and they retire with the same pension as you. Who is the dummy?

Black people have decided that if they do not want to obey a certain law or a Police Officer they don't have to. And society, the newsmedia and now the politicians are aiding and abetting them in that. Set the actual shooting in this matter aside and you will see that this once again begins when another black person decided that he didn't have to obey a traffic law or Police Officer. When a Police Officer tells you to exit your car, you exit your car. If the law says you must have a front plate on your car, then exhibit a front plate.

In civilized society we have levels of government. We have those that write the laws, those that enforce those laws and those that must obey those laws. The enforcement of those laws is not negotiable on the street. That is what the courts are for. And until black people learn that, these types of incidents will continue. If we are going to boast that we are a nation of laws, then we all must follow the law. To do otherwise makes us no different than Somalia, Yemen or any other shithole you can think of.

The "Fuck the Police" mindset, aided by the newsmedia, politicians and certain segments of society are just as responsible for this incident as is the Officer that pulled the trigger.

OK - I am sure some Liberal will jump on this and write that doesn't mean the guy should have been executed, but come on, his whole demeanor was evasive and being non-cooperative.

Would YOU trust him if you pulled him over? A huge judgement call that most people would fail. Let him go as he hit the accelerator? As long as you were not in the way - yes. BUT, those second-guessing the cop were not there.

Plus, the media talks about this story every news broadcast, but few have even talked about Planned Parenthood selling baby body parts as if they are the Victory Auto Wreckers for abortion clinics - need some parts, we got 'em.

I am totally numb to the daily cop-bashing stories, videos, and commentaries offered daily as a sign of a totally broken society, and will not watch, listen to, or read them. And a copper will be offered up for the masses every once in a while, justifiably or not, to satisfy the masses and allegedly keep the peace. Officers, don't be that copper. Look how far the parked car is in front of the offender's vehicle during the traffic stop, then where it is when the officer falls down.
The officer was dragged, which is deadly force, thereby making it a justifiable shooting. This state's attorney should be fired & sued.

Society is about to realize that it is cheaper for a police officer to get killed or injured, than it is to defend themselves. For example, officer shoots someone, cost a few million dollars. Officer gets killed, funeral cost what 10 grand. Society is about to realize this, and will disarm a portion of the police. In the country I was born in... Only specialized units and the ranks above corporal are allowed to carry weapons... Everyone else has a baton.

Just look at the CPD crew that did the drug traffic stop in Glenview while being taped by Glenview Police in car camera.

I wish we can get video of the Judges, prosecutors and lawyers in court.

Wait till he finds out how many exempt staff have been allowed to Lie during interviews and they were allowed to keep job and still be promoted. Remember Billy Joel Concert at Wrigley Field and the Airport incursion.

So do not lie during shooting investigation, but its OK to lie during all other investigations right Garry?

"Officer Survival in Current Times -- How to Effectively Manage Your Shift While Avoiding Personal Injury, Litigation and Media Scrutiny "

-No street stops
-No traffic stops
-No traffic pursuits
-No foot chases

The end result of an officer initiated chase never has justification in the eyes of the public and/or media. Even If someone is shot in front of you, give a description of the fleeing offender, direction of flight, and attend to the victim until EMS arrives.

-Respond to calls in a timely manner, but without the use of emergency equipment. That means obeying all traffic control devices, posted speed limits, and rules of the road. Exception is when assisting a fellow P/O

-Write reports whenever possible, for whatever reason. Many are satisfied with a report over an arrest. If a supervisor compains, you're following general orders. Consider each report an additional lunch period.

-Personal and lunch, every day.
-Gas up your vehicle, every day.

-Only arrest upon signed complaints. Exception is Domestic Violence.

Congratulations! You've effectively limited your negative reaction with the public and have made it through another shift withoug being injured, sued, or lambested within the media.

" chicken crap stop" is in the eye of the beholder. If you live in a big city, then maybe yes because you see so many violations and have so many hot calls that you might not bother. But, move to the burbs and you will see the police will stop you for just about anything.But, the way things are going, if I was a police officer today I would only answer calls and not stop people for minor traffic violation and as a writer stated, arrest only when someone else signs complaints.Being pro active is great and shows concern and dedication, but you must realize that if something goes wrong the media will make you name a household word in short order and an ambitious prosecutor will make their reputation on you. it seems that mayors think that when cops are indicted they can avoid riots in their towns. All they are doing is prolonging the inevitable.

When will we all understand what is going on the overall picture of society. Do not enforce laws the community will not stand behind you on. Do not use force that the community terms unnecessary in hind sight. We have enough examples by now...don't you think? Do not endanger yourself or your family unnecessarily. If someone is resisting arrest, let them go. Tell the complainant that there are at least two other ways to have their day in court. They can summons the individual or ask the State's Attorney to indict them. Then give them the number to the State's Attorney's office. Remember, State's Attorney's are indemnified...we no longer are. Do your job, take the report...be kind...be helpful...be the administrator they want us to be...push the paper and let them do the work and take the risks. Yes we took an oath but the oath is a two way street. Even though the slogan is "To serve and Protect", the community has misinterpreted the term SERVE in my opinion and PROTECT is no longer allowed.

Now that is excellent advice officer! My brother was putting out a fire the other day 5400 block of south halsted and he noticed 4 young coppers standing outside he asked them "wheres your car its hot out'" 1 copper told him "we are dropped off walk the complete tour from 51-55 and halsted, maybe the super could put some of these young officers on the west end of 008 you know where they are respected and could go into a store and get a cool drink. Already called the alderman's office hope others call also, its ridiculous all the resources given to the non-taxpaying areas that don't want to be policed,and the total lack of coppers allocated to where they should be at! 4 coppers no car to cool off in (I know if the air works), really a pathetic thing to do!

While most states give you Peace Officer status, your institution of higher learning will state that they can terminate you w/o any rights that are given to municipal/county/state officers.

First: Do not become a police officer. If you're looking for a job do something else. Be a parole officer, firefighter, etc. Whatever you do, do not become a police officer in america. There are other jobs that have pensions.

Black people have decided that if they do not want to obey a certain law or a Police Officer they don't have to. And society, the newsmedia and now the politicians are aiding and abetting them in that. Set the actual shooting in this matter aside and you will see that this once again begins when another black person decided that he didn't have to obey a traffic law or Police Officer. When a Police Officer tells you to exit your car, you exit your car. If the law says you must have a front plate on your car, then exhibit a front plate.

In civilized society we have levels of government. We have those that write the laws, those that enforce those laws and those that must obey those laws. The enforcement of those laws is not negotiable on the street. That is what the courts are for. And until black people learn that, these types of incidents will continue. If we are going to boast that we are a nation of laws, then we all must follow the law. To do otherwise makes us no different than Somalia, Yemen or any other shithole you can think of.

The "Fuck the Police" mindset, aided by the newsmedia, politicians and certain segments of society are just as responsible for this incident as is the Officer that pulled the trigger.

At no point during the stop did the officer order him to step out the vehicle. He did order him to take off his seat belt, but he never ordered him to get out the car. The officer simply just attempted to open his door.

No one ever got in trouble for just answering their calls. Despite all of the writing on the wall though most officers still don't get it. Their ego is too huge. Their inflated ego is more important than their family's well being. I don't have one iota of sympathy for this officer or anyone else who is proactive. Call me an asshole. Funny , As I grew up there certain places we just didn't drive thru at night . Do to the fact that they enforced the traffic laws and vehicle codes with a vengeance. Imagine that and they all had a low crime rate as well.......... Didn't matter what color your skin was , you didn't measure up you got a ticket or towed. And there was no loitering no "hanging out" on the corner no wandering down the middle of the street and not moving for cars......... Instant enforcement. Guess the fuck what......... Son of Sam killer in New York, David Berkowitz, was caught (1977) because of a parking ticket written near one of the scenes. Detectives went through every parking ticket issued in the vicinity of every killing. Bingo, they got him. Anyone ever says parking tickets don't mean shit is wrong. Now that was good old fashioned police work.

The account I read had the Trooper, a by the book guy, did everything according to Hoyle. The car McVeigh was driving supposedly had no plates. The Trooper stayed back, behind his squad car door and ordered McVeigh out of the car. McVeigh had a pistol in a holster. The trooper disarmed him and put him in the back of his squad car. McVeigh was charged with traffic offense and a weapons offense. McVeigh was still in the lockup three days later, near to being bonded out, when the FBI identified the guy who was wanted as McVeigh and saw on the FBI computers that he was in custody. The FBI put a hold on him.

He was ID'd by a clerk from a motel in the OK City area. He used an alias. Great police work.

What about the idea that a suspect fleeing in a 2 ton vehicle is using deadly force against the public.
There are enough innocents that have died due to fleeing suspects to support this theory.

So is deadly force unjustified to stop a suspect from using deadly force against the public?

If the fleeing suspect is stopped before any harm comes to the community, isn't the public safer?

In that case, we don't even have to consider the question of was the officers life in danger, the public is in danger.

Yes, this is a very politically-incorrect thought, but what would the families of those who have been killed or maimed by fleeing suspects think about the use of deadly force against the suspect, before the suspect used deadly force against their family?
