Prosecutor Fired

Anita is very angry:
  • A Cook County prosecutor was fired Monday for allegedly giving false testimony in a case against a man charged with shooting a Chicago Police officer in 2012 — raising the possibility key evidence could be tossed out.

    The mother of suspect Paris Sadler made a secret 30-minute audio recording of her interview with prosecutors the day after Officer Del Pearson was seriously wounded in a shooting on March 19, 2012, officials say. Pearson underwent more than five hours of surgery to save his life after a bullet severed an artery. He was chasing Sadler, who was suspected of violating a curfew, police said.

    Assistant Cook County State’s Attorney Joseph Lattanzio — who took statements from witnesses after the shooting — was fired Monday. He is accused of lying recently on the witness stand about a written statement he took from Sadler’s mother on March 20, 2012.
Hopefully, this doesn't screw the entire case against Officer Del Pearson's assailant.

This sucks, J-Lo was a great guy and a very good SA when he was working at Special Prosecution. I hope the case works out for Del, but if it does not, at least Del is alive. That is what matters most.

Ot- picked up a new pistol from a gun shop in Darien. Walked in wearing sunglasses and here's this shithead I locked up for uuw/agg. discharge 2 years ago. Standing in from of me, carrying (ccl!!) and purchasing an assault rifle! I was buying a sw 38 airweight for od pocket carry. He turned looked at me and said "nice gun boss, I gots one like that". I didn't say shit, took a deep breath and looked away. Jagoff didn't recognize me but it was tough not to ask how the fuck he was able to get the license. Shithead with him pulled out his wallet to show his foid to handle the guns and I saw a circuit court employee id right in front. Hmmmmmn...

No longer can u wear the ballistic nylon duty belt with cargos and a plain black vest cover. You now have to have a molle vest in order to sport the nylon belt.

Are you serious? I'll check the orders when I get back from my RDO's, but now I need to buy the molle vest if I want to continue to give my surgically repaired back some relief by wearing the nylon? I wonder if everyone at R&D is as dumb as they come off with these changes, or if they're too scared to voice an opinion because then they might be shipped back to a district. I guess the bright side is that nobody can ever figure out the proper uniform configurations. Sorry, rant over.

The recording made of the prosecutor by that woman was made in violation of the eavesdropping statute and is therefore not admissible in any proceeding of any kind:



(720 ILCS 5/14-5) (from Ch. 38, par. 14-5)
Sec. 14-5. Evidence inadmissible. Any evidence obtained in violation of this Article is not admissible in any civil or criminal trial, or any administrative or legislative inquiry or proceeding, nor in any grand jury proceedings; provided, however, that so much of the contents of an alleged unlawfully intercepted, overheard or recorded conversation as is clearly relevant, as determined as a matter of law by the court in chambers, to the proof of such allegation may be admitted into evidence in any criminal trial or grand jury proceeding brought against any person charged with violating any provision of this Article. Nothing in this Section bars admission of evidence if all parties to the private conversation or private electronic communication consent to admission of the evidence.

Not only that, but the recent disclosure of the recordings in court might themselves be a separate violation of the eavesdropping statute by defense attorneys. This offense would not be subject to the original statute of limitations on the recording itself, since here the disclosure itself is a new crime:


Sec. 14-2. Elements of the offense; affirmative defense.
(5) Uses or discloses any information which he or she

knows or reasonably should know was obtained from a private conversation or private electronic communication in violation of this Article, unless he or she does so with the consent of all of the parties.

Is the dept. paying for the new vest cover they now require? I just bought a new vest and cover and I'm not spending another dime for some new frivolous uniform change that some paper pusher made up to justify his/her existence. And I'm not going back to wearing the leather duty belt which adds more unnecessary weight and screws up your back. Fkn dept has much bigger issues to worry about besides uniform bs!

Case is shot. The majority of good evidence won't be brought in now including anything that resulted from the "consent to search" which was the arrest of the offender and clothing. All of that is going to be excluded now and there is a motion in November to quash the arrest and it will be granted... Even if the judge feels the pressure and denies the motion it's a slam dunk appeal. This case is finished... I don't really blame this states attorney though, I blame the over zealous coppers and supervisors who did what they did first and decided to have it cleaned up later. In the end guys, you all screwed del by doing it the wrong way... Now, as we always say, and one of the big shouting matches that took place that day is that you don't do anything until the detectives get there!!!! That has always been that way and always will be that way when it comes to police shootings.. But, the Cowboys were having the glory boy moment and every white shirt there had a better idea and wanted to be the guy who was in charge... They were all jockeying for position to say they got it done. Well, to the tac teams, sat teams and gun teams I hope you learned something here.. And to the tac teams who were given medals and awards just months after this happened I hope they were worth it and all the pictures of yourselves on Facebook showing the medals off was cool because you just blew a case of a copper almost getting killed and made a ghetto rat who will be out by Christmas and will go home and be the next ghetto town hero... Maybe he did recognize you but didn't want you to think he did. Did he make smalltalk with everyone or just you?

I have a similar story. Two years ago we go to a gun range. I see four gang bangers. I know two of them from my district. The other two had all sorts of Four Corner Hustler tatoos on them. All four of these street thugs were good shots. It was downright scary. They were even practicing level one and level two malfunctions and then shooting- with perfect accuracy.

Any of those cases involve police officers? You notice that Anita doe not look as hard to prosecute her employees as she does police officer who screw up? Will the attorney be disbarred? I know Anita will go after an officers FOID card. Will the Attorney be on the County do not hire list?
I know the media trolls have little education in these matters and believe whatever the press release states. Will the AREAS strip search everyone as soon as you walk in the interview rooms since all these scholars seem to have accident of recording people while being spoken too?

Overall, most ASA's are decent. but some in felony review were lazy assholes. Best one was a case I had, the ASA wanted me to do a supp on a witness interview we did 8 months prior. ASA wanted me to add a statement the witness did not make. I told the ASA I would do the supp, but would document the statement added was what the ASA remembered and not R/D. ASA did an immediate moonwalk. I always based my reports from factual evidence and would not lie or embellish any report. Many Coppers don't realize if you are impeached on your statements in court, all your previous and future cases would suffer. Remember lying on a report, which is an official court document, can get you charged with contempt and official misconduct. Better to always tell the truth and lose a case, then lying and losing every case. Judges have very good memories. Many of my cases where they wanted to suppress evidence or statements could have went either way. But being honest no matter what will sway the judge to rule in the states favor. Last it is easier to be consistent in testimony than testifying to lies.

JL was very honest ASA. How can he be fired for testifying to the best of his memory something that happened 3 and 1/2 years ago. He can't be prosecuted because the tape is inadmissible in any trial against him. The police that are being prosecuted for perjury is based on a squad video - not secret recording that violated eavesdropping law, and that is a very weak case. Tough to prove perjury.

In law, the Latin concept is "Falsus in uno, falsus in omnibus". That translates to false in one thing, false in everything thereafter. If the the court uncovers a lie, then all other testimony must be taken (at a minimum) with a grain of salt. It builds a strong foundation of reasonable doubt.

Not a detective and not a white shirt... I wrote it and stick to it. Not merit anything and proud of it. I go to work and do my jobs and enjoy myself. You see son, on this job the detectives are the brains of the operation. Detectives that come out on police shootings are usually the best the area has so it can be done properly... So, like I said before, and what my 26 years of experience on this job has taight me is that you wait for the detectives before you do anything!!! Another young pup who wants to bash and and not listen. You see, if you listen to people you learn things... But no, you wanna come up with quick snarky comments about some detective that's merit... Secure your scene, set up a perimeter, start a search and wait for the detectives to do anything such as going into a house where an offender or key evidence is... 9 times out of 10 they will go in with us and ensure it is done the right way so it won't have to be cleaned up so much afterwards... Such is the case here. Lesson over... Now go back to sucking your thumb and watching power rangers kid

But everybody did it right, but you probably werent there or have no idea how to be a police officer go pound your chest on how you would have done it better.

How about you use some of that VRI that you suck down constantly to buy new gear? You mean, using VRI money to actually buy work-related equipment instead of funding everything else? You have no clue, I was at the scene and did not witness any cowboys. You like many others on this job are full of Monday Morning advise which comes from a lack of knowledge and information. I think the officers at the scene handled the job well and even got a search warrant (signed by a Judge). So please keep your stupid comments to yourself and with your crew of Monday Morning QB, which are in abundance in this department. The police did their job, we have no control over the States Attorneys.
