End of the Sworn Affidavit?

  • Amends the Uniform Peace Officers' Disciplinary Act.. Provides that a sworn affidavit or other legal documentation is not required to file a complaint against a peace officer (currently, a sworn affidavit is required). Removes a provision referring unsupported complaints containing false material information to the State's Attorney. Effective January 1, 2017.
So no sworn affidavit, a completely sane provision that cut down on false accusations by magnitudes.

And no referral of False Complaints to the State's Attorney for prosecution under the perjury laws.

The usual cast of police hating Chicago democrats are writers, sponsors and co-sponsors.

If it passes, any scumbag can level any accusation against you and IPRA will be investigating it, and when they "Not Sustain" a few, you'll be placed into the Personal Concerns program anyway and you'll have to do counseling, see a shrink, answer all sorts of questions because of the "red flags" put in place to dissuade you from doing anything proactive.

Is everyone getting the message yet?

If they thought that the Police Department was becoming "fetal", they haven't seen anything yet.this will cause any copper with a brain to put it in neutral. They are telling the criminal element it is ok to lie on the police and don't worry about it because we won't let you be prosecuted for lying. Are the inmates running the asylum or what ?

I am one of the ones out there still working. Save the lecture. As someone who was put in the behavioral program years ago for unfounded and not sustained cr s I can promise everyone in the ghetto this will stop any of the guys out there still being proactive for good. So if you live in one of those areas call yor senator and demand they vote no. Or don't and suffer the consequences.

My non-LEO opinion: The false material information provision is just filler waiting to be "bargained away" in exchange for keeping the affidavit non-requirement intact. Classic scumbag personal injury lawyer tactic - come in with an unreasonable two-part settlement demand but later drop one part and suddenly look more "reasonable". These politicians are low-lifes and are determined to interfere with law enforcement every which way they can.

If this occurs than two things are going to happen. The first thing that occurs is a great amount of complaints are going to be issued. The second thing is IPRA or the next agency will be over run with complaints. As it is now IPRA can't keep up with the amount of complaints that they receive now with the amount of man power thats assigned. That's one of the reasons why complaints take so long. Throw out the the affidavits then they will not be able to investigate all the complainant that are issued. Rumor has it that moral at IPRA is just as low as in the Department. Many of the Investigators are upset that their cases are being reexamined. The investigators are fearful that they will be terminated on cases that they classified as justified or not sustained. Watch tiny dancer to use old cases, such as the one where the two Officers used a take down on a robbery offender to use as a excuse to disband IPRA for a different agency to investigate Misconduct. What most Officers don't understand is IPRA is governed by a very lengthy city ordinance. The mayor's hands are tied to a certain extent. If he disbands IPRA the city ordinance governing Investigations of Police Misconduct also becomes voided. He then can write a ordinance that is easier to discipline PO for infractions. Another rumor: The new Chief Administrator/ corporation counsel wants to impose a quota on sustained cases. One more nightmare: wait until the new States Attorney is sworn in. The best advice is to stay fetal. If you have not by now you should in the next coming months.

IPRA has told several officers that they are stripped of their police powers. IPRA does NOT have the authority to strip police officers of their police powers. Furthermore IPRA has no State CERTIFIED lead homicide investigators, so by Illinois law they cannot take over any police shooting that involves a death. IPRA regularly violates our contract and the law! The Lodge is aware of eight officers that have been strip of there police powers so far. If you have been stripped or informed of any contact, appointment as a witness or any interview/interrogation by any agency or lawyer, contact the Lodge immediately! Don't go without a lawyer with you! The Lodge has already started a class action grievance for the eight stripped officers.
IPRA is going over 400+ police shootings from the last eight years where the assailant was killed by the police.

I know of gangs that used the complaint system to slow down officers that were damaging their gang. This stopped when the affidavit was introduced and they were furious about it. I went in as a hard charger and exited as a fetal employee. When I was questioned by supervisors
as to my obvious lack of production following my graduation from PCU I simply told them that I had

That's all fine and good, but it won't prevent the main problem of you having to take the complaint without having to meet the accuser at all.

My brothers and sisters, always check the arbitration box. After a few years and numerous losses in arbitration the city will be losing so much money they will adjust. The losing side has to pay the arbitrator. This city and state continue to sign into law stuff that does not jive with federal labor law. They will lose constantly.

As far as the affidavits go, they were useless anyway. Name one person arrested and charged with the felony it should have been. I gift wrapped one early in the process and presented it to the Department. I was told they would never prosecute them and warned not to do that again. I am a bomb thrower, but I have a family to support. I am not suicidal. Lesson learned.

Los Angeles had the affidavit as a city ordinance. The city council struck it, an iliana rozensweig led the la ipra forward with some success. She was hired to run ipra here, and discovered the chicago affidavit was part of the fop contract, and could not be stricken by law. With the affidavit in place, she was a miserable failure, and had to quit. Her career in ruins, she went to Europe to study art. That is what the affidavit, protected by our contract, did. This is an attempt to deny the police officer a constitutional right that every citizen has.the next thing will be to pass a law denying constitutional protection to our earned pension rights. Gone with the stroke of a pen.

On another note, I am asking every worker to never say the word "pension" again. Say "EARNED" in front of it. "EARNED pension", "EARNED pension rights", etc.

Lastly, if it gets to the point that the FOP cannot protect our constitutional rights, we have a problem. We would be better off giving our dues money to a private law firm and fight in a federal court.

This is great for the Police.This one action will stop the drip drip effect on all of you and move right to the flood.With this being removed 90% of CPD will be put on desk duty will being investigated for some bullshit made up charges and the city will really see what happens when they allow the benchwarmers to dictate the rules to the starters! You all should hope they allow the anonymous phone tip in there also to quicken where this is all going.

Go and file a report on the investigators and complain about head of IPRA and let's say alderman that "drive recklessly". If it looks like them and they catch beef and the complaint is wrong, oops. My bad. No penalty though- we can just freely accuse with impunity! Let's get the ball rolling.

Amazing. There will not be one good Officer without some type of complaint against him on his record. Are all the attacks on the P.D. by the political machine an effort to get Officers to leave in some way so that no pension will have to be paid to them?
Nothing else makes sense. Its got to be the money. Is turning the violent minorities loose on the general population with no police control an option elected officials are really considering? Do democrat officials believe minority criminals will not attack them because they're democrats?

Attacking those that stand between you and criminal violence is madness.
Stay safe Officers, I don't know how, but stay safe.

Dispatcher: you did what? 760: repeats last statement. This went on and on and on. 762 (out of breath) Dispatcher: 762 go ahead. 762: Squad this dog is being totally uncooperative at this time. My partner almost crash the squad car as he drove at this point laughing so hard. 760... Dispatcher (kinda of laughing at this point) 760 go ahead. 760 I need crime scene tape out here for my squad car and let's get the street blocked off!! You get the point, this went on and on and on and on. All these young new copper in this district and these are their leaders. And these type of leaders go all the way up to the top. As long as we have "leaders" like these guys, nothing constructive will change on the department.

This should be its own thread. Cause they did same think 2 weeks ago with a fake SVIP. No problem with taking all procautions til you verify its real - But even after they realized it was a bogus call - all of them couldn't wait to chime in on the radio. One of them was still setting up a mobilization point long after the other one said it was bogus. Then the Sgt still calling for an ambulance to stage after the call was bogus. Instead of trying to hear yourself talk - listen to the radio retards.

Need to find a lawyer to sue these assholes for making a false accusation, slandering the name and reputation of the officer within his/her workplace and in the public venue. Even if these mutts have nothing, the mere chance they later win the ghetto lottery will pay off for a cop with a lien on the assholes.

Good for you Sarge. Years ago as a Sgt I backed my guys and took serious heat from the black community but most of all
from TH the worst and most racist superintendent CPD ever had. Well the brick was very heavy and TH and his IAD friends came after me for everything and anything. Finally they thought they had me with a CR# that had accusations that I did things even though I had documentation and witnesses I was out of town at the time. Well fast forward to present days and I'm happily retired with 75% of Sgts pay and you know I have respect for myself and the respect of the people I worked with. The CR# was brought up against me as I retired and it felt good to know that I was in the KMA club and beat them all. I will outlive TH and I keep the bond money available at all times because when that piece of shit dies I will visit his grave and it won't be to put flowers on it. Stay safe Sarge and watch your back.

the only reason why a judge has not allowed cities in Illinois to remove the fact that the police get a pension, pretty much is because they know they will sign away their own pension when they do it... but it is coming, you will see

Boy the bad news continues. Used to be the drug dealing gangsters used to just have to pick up a phone and they could bring heat on cops who were fucking with their boys. Then they came out with the affidavit system and at least made them leave the hood to come up with their bullshit. Now its back to the same old ways only this time they hold a ton of power over the Police cause ANY CR will be counted and the officer profiled and fucked with. Right or wrong.

Ive concluded that all this Rahm fucker cares about is holding power so his mob can cash him which will allow him to one day cash himself out. To do do he knows he has to cater to a community not only not very bright but also convinced by years of propaganda they have been "wrong" by the PoPo. Officers should contact their Stae Senators and Representative. Demand that they vote no to any changes in existing Sworn Affidavit Law. Officers should also contact FOP demanding they do the same

This is exactly why Donahue and his crew had the sworn affidavit provisions made a part of our contract. Even if the state law is changed, our contract protects us.

Great job, Deano. You fire Donahue as our lobbyist in Springfield, you kick him off of the legislative committee, and kick him off of the political action committee. Great moves. We would have been aware of any movement in this direction months ago if you would have left him in place.

The FOP hasn't submitted,proposed, or challenged any legislation for the past two years. Great job boys! I'm sure Rahm and Rauner are thrilled that you knocked Dougherty and his team out of the box.

I know of gangs that used the complaint system to slow down officers that were damaging their gang. This stopped when the affidavit was introduced and they were furious about it. Furious enough to reach out to a dirty politician? Absolutely. I also think people underestimate the influence of cartel drug money in this city and state.

The Black caucus has deep roots in Chicago's street gangs. Add to that the Chicago Alderman in these gangster areas. THEY have to stand up and let the gang leader have their chair when they meet.
