Redefining "Use of Force"

We had a bunch of fun with the term "deescalating" earlier this year. It gave rise to the "De-Escalante" nickname foisted upon the interim Supernintendo.

Then we heard Eddie "Never saw nuthin" Johnson praising the officer who used a Taser to take a police shooter into custody. If the officer was aware that the subject had dropped his weapon, then the Taser would be a viable option, but you better be damn sure to have a copper with a gun backing you up to drop the assailant if he wasn't following directions.

But then this was brought to our attention. A concerted effort to rewrite the entire Use of Force paradigm, starting in that bastion of leftist thought and action - California:
  • Government is looking at a proposal for creating a statewide “use of force” policy for law enforcement. The creator of this project is talking to politicians and the media, special interest groups—but REFUSES to talk to law enforcement officers, to hear their concerns. This is an attempt to politicalize law enforcement—to make them an arm of the State instead of protection for the public.

    “Ironically, one key PERF’s proposal on use of force calls for peace officers to “consider how the public will view the action” before deciding to employ force. Let’s apply that PERF concept to our invitation for Mr. Wexler. “How will rank-and-file peace officers view Mr. Wexler’s refusal to discuss the PERF guidelines before audiences of rank-and-file deputies and police officers?"
That underlined portion right there - that is going to get police officers killed. And PERF (the Police Executive Research Forum) is obviously a bunch of ninnies who pretty much never spent any more time on the street than they had to. Otherwise, they'd be taking input fro the people who are going to have to live, or die, with their stupid uninformed crap.

I am retired CPD. During early morning hours, I occasionally go into a lakefront park after closing at 11 PM and encounter feral youths who from over 7-10 yards away ask me stupid questions that in my CPD experience are a prelude to a robbery if not worse. You would be amazed that in several such incidents, when these predators see a laser dot dancing on their chests, they flee and perhaps soil their panties.

QUESTION: While iron sights should be mastered, why doesn't the CPD allow officers to equip their weapons with zeroed-in lasers? I firmly believe it would pose one hell of a deterrent. Also, in my encounters, no paperwork and all happy endings.

Even a predatory moron would realize that he is only nanoseconds away from fatal gunfire when he sees that red (or green) dot dancing on his center mass (or his face/head).

PERF, never spent a day on the street. They have never spent anytime on the street. if they did, it was at 1060 W Addison, for a day game.

As a citizen, I am outraged at how poorly the CPD is being treated. I work in labor, my job depends on me DOING MY JOB. My bosses are dicks, but they know my job is vital.

I would like to propose a counterbalance to PERF. This will be called NERF. NERF will require that "justice involved" folks consider local laws and regulations, safety of others, and consequences of their actions before committing a crime. NERF will also ask that parenting become a priority along with school and getting jobs. See? PERF and NERF will help make this the utopia it should be. Maybe not.

The idiots in California and elsewhere that want this type of policing better get use to coppers taking a real super duper snails pace slow roll to whatever the energency is. In short if you are getting robbed, raped, shot at, assaulted or battered and the police may have to use any type of force to save your pretty little ass and this policy is in effect then don't expect the police to hurry to your emergency. MOST people back up and support the police. I certainly do. I wish that all the cops that have been stolen from Lakeview to police the ghetto (who hates you and doesn't want you around) would be returned to our area. Lakeview residents/taxpayers support the police. We want you around. We want you to be safe and go home to your families at the end of your tour.

Not a cop but I work in the IT industry. As a warning, please do not send any disparaging comments on text or emails. There are many other cities where they are busting cops using texts and emails against them. Be warned. Those emails and texts can be kept forever. I know because in our line of work we are ordered to turn over the backups when it is asked of us.

Each of the unions should vehemently oppose Johnson's statement that the use of a taser was correct, unless he can better define how and why that force option was used. We've had about 6 cops shot so far this year. We don't get this bullshit about force straightened out quickly we are going to have a cop or two killed this year over fear of litigation or hesitation to do the job.

Don't forget, the LAPD officers who were arrested and convicted over Rodney King, were following the use of force policy of the department and the department training officers testified to this at their trial. They were not guilty in the state trial but guilty in federal court.

Here is your answer, they allow a laser sight on a taser, but won't allow it on a gun. The department is backwards and are all idiots. I have used a taser sight on offenders and you should see how they calm down, back up, then comply. They won't use it on a gun BECAUSE IT IS TOO INTIMIDATING. End of story.

SEASIDE — A police officer in Seaside, Oregon, was fatally shot as he was serving an arrest warrant Friday night, authorities said.

The 55-year-old suspect, who was shot by another officer, also died.

Clatsop County District Attorney Josh Marquis on Saturday identified the officer as Seaside police Sgt. Jason Goodding, 39, who joined the police department in 2003.

Authorities say the shooting happened Friday night in downtown Seaside as Goodding and another officer were attempting to arrest a man wanted on a warrant for felony assault.

When the man, identified as Phillip Ferry of Seaside, wouldn't show his hands, the other officer used a Taser on him, Marquis said. While the Taser seemed to incapacitate Ferry, "it didn't do much more," he said.

The suspect went down on the ground. When Goodding tried to subdue him, Ferry pulled out gun and fired once. The other officer returned fire, shooting the suspect, who later died at a local hospital. The second officer was not hurt.

The Department does not allow laser sight for several reasons.

Chief among them is a lack of balls. Laser sights are damn intimidating. And we don't want to ruffle the feathers of the poor criminal class. City and Department fail to understand that intimidation can be a great control tool. No injuries.

Carried a laser pen on patrol for a few years. Turned a few situations around into safely resolved.

Some PDs did put them on the guns of their transit police.

Also the laser can cause eye injury.

Justice - involved. I was justice involved when I took a sworn oath and patrolled the streets. I was one of the few in my northside district who was actually shot at while on duty.

So, I'm not sure if anyone else's district has had this yet, but we were surprised yesterday by the sudden arrival of a civilian employee working behind the district desk without fore warning, handing out radios, being trained on AIRA, having I-clear access, not to mention the equipment, old shotguns, rifles. This person has access to all of our computer systems, employee information, leads, ect. All the access we have. No badge, no oath taken. A 3 week stint in the academy. Doing more with less I guess. Did they not learn their lesson three years ago when police officers homes were being burglarized and weapons taken, turns out the source was a civilian with login credentials?! In this current era of no accountability and police hatred, we now have people that have unabated access to not only the computer systems, but the actual police station. Un-fucking believeable.

As much as I agree with you that there can be bad citizens with access to our info, remember we also have police with access to our info. You think it doesn't happen, well it has. I worked in 007 in the 1990's. There was a P.O. named Aaron Gibson who worked lock up. He stole my info and many other officers personal info and took out credit cards in our names. He racked up many thousands in purchases. He hit me up for $10,000 in charges. He was arrested, convicted and fired. He has since died but he was an example of a piece of shit officer. So yes assholes and thieves can be the P.O. you sit next to at roll call.

As much as I dislike rahm and would like to blame him for everything, but how do you blame him for a ton of African American blood for not providing the proper protection. I work in 007. A 3 mile by 3 mile area. We have more manpower than the largest white districts. We have cars up the ass. we have outside units, outside agencies, mission cars, tact cars, gang cars, vri, boxes, missions. You can't drive 2 blocks without seeing another cop. Yet with all this manpower and police people are getting shot and killed. You can't blame the mayor, the superintendent, the commander, or the officers on the street. Nothing(and that includes useless boxes, missions and the bullshit VRI)will stop dude from killing dude if he wants to.

Please read all you can on PERF and CALEA standards they want and are currently implementing for all law enforcement agencies. Its frightening. I don't know why so many of the posters here think that revising use of force policies is a 'democrat' thing. I know many republicans who dislike the police and feel that they hold too much power in their hands as well.

Don't forget that good 'ol conservative Iron Mike Ditka (through his lawyer) had plenty of criticisms for the state trooper who arrested (and handcuffed) him for DUI many years ago. It's not all just libs who have a known dislike for authority.

There is an article called "LAPD Reform: The Beginning of the End" and it is a must read. It is another look into the PERF philosophy. One part of the article actually had me stare at the screen with my mouth open for a few seconds. Check it out below.

"The Michael Brown incident should have never occurred PERF surmised. Yes, Brown was walking in the middle of the street after committing a violent robbery and yes Officer Darren Wilson drove up to him (not knowing the robbery occurred) and asked him to get out of the roadway which caused Brown to attack Wilson and the ensuing altercation would end in the use of deadly force.
The question was recently asked at a PERF Meeting on how Officer Wilson should have handled this violent felon.
It’s simple they stated. Wilson should have never approached him walking down the middle of the street. It was that initial encounter that ultimately caused the use of deadly force."

I don't know the exact number, though it wasn't all that high in the past. But, whatever number it WAS will be changing rapidly in the current climate. The anti-police frenzy has been whipped to a gale force wind in the last two years and people are leaving in droves like never before.
Never heard so many people planning to get out the day after they have their 20yrs in and lock in a minimum pension. Time to save your life, freedom and future and just get out of policing.

Massad Ayoob (who is as pro-police as one can get) reviewed the PERF recommendations: "The Perf 30 And Police Use Of Force Part I", "Part II Where Perf Was Perf-ect", "Part 3 Perf Too Fuzzy For The Fuzz", "Part 4 Perf-idy", and "Part 5 The Perf-etrators".

Even Mas noted that there are some good things in the PERF report - along with some egregiously bad things. He endorsed 20 of the 30 recommendations, derided 6 as vague or meaningless, and denounced 4 as flat-out dangerous and wrong.

As much as I dislike rahm and would like to blame him for everything, but how do you blame him for a ton of African American blood for not providing the proper protection. I work in 007. A 3 mile by 3 mile area. We have more manpower than the largest white districts. We have cars up the ass. we have outside units, outside agencies, mission cars, tact cars, gang cars, vri, boxes, missions. You can't drive 2 blocks without seeing another cop. Yet with all this manpower and police people are getting shot and killed. You can't blame the mayor, the superintendent, the commander, or the officers on the street. Nothing(and that includes useless boxes, missions and the bullshit VRI)will stop dude from killing dude if he wants to.

As much as I dislike rahm and would like to blame him for everything, but how do you blame him for a ton of African American blood for not providing the proper protection. I work in 007. A 3 mile by 3 mile area. We have more manpower than the largest white districts. We have cars up the ass. we have outside units, outside agencies, mission cars, tact cars, gang cars, vri, boxes, missions. You can't drive 2 blocks without seeing another cop. Yet with all this manpower and police people are getting shot and killed. You can't blame the mayor, the superintendent, the commander, or the officers on the street. Nothing(and that includes useless boxes, missions and the bullshit VRI)will stop dude from killing dude if he wants to.

agreed. Didn't this whole accountability start with Jody Weiss? When CLine was the boss you never had all this bean counting did we? It always seemed silly to me. How can you blame the Superintendent for the homicide rate? or the Mayor for that matter?

You CAN blame the mayor for ordering the CPD not to enforce the law.
