Finally, Some Guidance

We've been begging for this for years now - a list of rules, laws, ordinances and societal norms that certain "communities" aren't going to be expected to follow. That way, we can get away from all this "profiling" nonsense that pervades the liberal progressive leftist narrative of the day.

Now a court in Massachusetts has begun the arduous process of listing those actions that all you naughty police should refrain from considering based simply on the color of one's skin:
  • Black men who try to avoid an encounter with Boston police by fleeing may have a legitimate reason to do so — and should not be deemed suspicious — according to a ruling by the Massachusetts Supreme Judicial Court.

    Citing Boston police data and a 2014 report by the ACLU of Massachusetts that found blacks were disproportionately stopped by the city's police, the state’s highest court on Tuesday threw out the gun conviction of Jimmy Warren.

    [...] In its ruling, the court made two major findings: The justices said police didn’t have the right to stop Warren in the first place, and the fact that he ran away shouldn’t be used against him.

    On the first point, the court said the description of the break-in suspects’ clothing was “vague,” making it impossible for police to “reasonably and rationally” target Warren or any other black man wearing dark clothing as a suspect. The court said the “ubiquitous” clothing description and the officer’s "hunch" wasn’t enough to justify the stop.
Tie this into Cook County's great strides in reducing prison sentences by bonding everyone who can write their name, electronic "monitoring" everyone else, allowing offenders with multiple gun charges to go to "boot camp" (in violation of sentencing laws), permitting felony shooters to plea to lesser charges, time served, day-for-day credit, etc, etc, etc...

"Totality of the circumstances" doesn't mean a thing any more in Massachusetts - coming to a state near you.

On the flip side of this seems that vice lords, gds, fours, Kings, saints etc have been handing out death sentences at a rate way higher than the current incarceration rate.

The Catered-To Constituents and their
Progressive Liberal supporters should
push HARD to overturn "bad laws" and
court rulings that "targets" a protected
demographic so that we, The Police can adapt and be
in compliance without being on the business
end of Departmental Discipline from suspension
to termination, Civil/Criminal Litigation

this city.

Back-Off.
De-Escalate.
Stop being so fast to slap handcuffs
on peoples and folkses.

"safe space" by standing on your toes
and blowing saliva in your eyes while
loudly telling you how he's going to beat
YOUR ass/follow you home from work and

"The officers showed admirable restraint."

VS.
"The Officers took appropriate Police action."

Protect yourselves and each other.

Many years ago, in a seemingly different universe, my partner and I ran down a M/1 yute right after a strong arm robbery was committed. When caught and asked why he ran from the police, he calmly and simply said, "cause that's what we DO". Nice to see nothing has changed after all this time.

It's been said before but I honestly think the time has come to let the black communities police themselves. It's not worth it anymore. The level of non-compliance in these areas is ridiculous. So lets just leave them to their own demise.

P.S. make sure you run with your hands up, if you are shot even if you put your hands down, the officer will be charged. Just site the Tulsa case. Proactive policing is over!

if a white guy runs can the police stop him? yes, that's a serious question. Reasonable suspicion is an objective standard. Would a reasonable man see the running as evidence that a crime is afoot? No, for a black man, but yes for a white man? Or is it no for a white man also? What about an Asian man, was that addressed?


The U.S. Supreme Court said in Illinois V. Wardlow (2000) (a CPD case)


The Supreme Court stating that fleeing in a high crime area at the sight of police is enough to create reasonable suspicion. Indicating that reasonable suspicion rest heavily on normal human behavior, stating that flight at the mere sight of police is a sign that there exists reasonable suspicion that criminal activity is afoot.



The only issue I see is whether the Boston case occurred in a high crime area. My personal feeling is - who cares if it's a high crime area. If someone in Winnetka sees the cops and flees he's probably dirty too. It's just a stop they are justifying, a 2 min. encounter, not an arrest.

Some 30 minutes after the crime was reported, Officer Luis Anjos was driving in his police cruiser when he spotted Warren and another man, rolled down the passenger-side window, and yelled, "Hey guys, wait a minute."

Rather than talk to the officer, the court said, "the two men made eye contact with Anjos, turned around, and jogged down a path" into a park. They were apprehended after Anjos called for assistance.




I have been told by a Pilipino cop that he can't be accused of profiling because he is not White.

Fetal Frank here SCC. I want to thank all the politician on the left and citizens of the west and south side for my salary and new attitude. For the past year to the day I have turned in zero activity at the end of my tour. ZEROES!! I should have been "fetal" years ago. I get in my squad car and grab a coffee. I drive around the west side waving and smiling. Less stress and I make 100k a year. One hundred thousand dollars to turn in zeroes. I've been threatened by meritorious blowing Sgts. Even a couple of Lts and Captains. They even split me up from my partner for 12 years. Still coming in with zeroes. Hold the line boys and girls. You can't get fired or go to jail for not coming bringing in activity. You can go to jail or get fired for chasing hot cars, foot chases, wrestling with dope dealers or even a traffic stop. ZEROES equals HEROES!! Hold the line.

Thomas Sewell made an interesting distinction some years ago related to "profiling" that someone might consider using in this type of incident. He said that while "racial profiling" may happen it is more likely that police and others use "behavior profiling" when they make decisions in the field. It is the behavior that attracts the attention to a person, not necessarily their race. Acting suspicious or like a thug gets someone "on the radar". Trying to running away is a suspicious "behavior" that more than likely indicates they are trying to hide something, etc. The recent case in Hagerstown where police pepper sprayed a female who was uncooperative after a traffic accident is a case in point. Her unwillingness to cooperate ultimately revealed that she was carrying drugs in her backpack. The asshat judge doesn't seem to understand that coppers use their experience when dealing with this sort of thing. They don't just look for "dark clothing" but their "hunch" is based on years of dealing with the same sort of people over and over. Must be nice to know how it's done when you've never done it in the first place.

An explanation of "disproportionately" would be nice. If you work in an all black area it would make sense that you would be stopping black people...
