Is This a Concern?

We haven't utilized the benefit so we're unaware of Don O'Neill playing politics with it:
  • I have become aware of a situation that I believe effects many police officers. if one utilized fmla they lost that amount of time in seniority. Hence this effected furloughs, special employment, ot, etc. This is no longer being done. I contacted Kilmer, who essentially blew me off.

    I am going to file a grievance, but I think there might be a class action suit against Don Oneill and the city. I just dont think that many effected by this know that this is no longer being held against members at least for last 2 years.

    I need this to get out so we can have our seniority restored and maybe even hold city financially resposible for our losses. I know I personally missed out on many special employment days as a result.
This FOP has noticeably reticent in confronting Don O'Neill's abuses of the Contract. If we recall, Dean Angelo either went to school with O'Neill or had some similarly close relationship. We also seem to recall he said it was a good thing and would benefit the membership because of the nature of the relationship. Sadly, but predictably, this seems not to have been the case, and there's still the rumor of Dean Jr being made "merit" on an upcoming list.

UPDATE: Not FLSA - FMLA. Family and Medical Leave Act. 12 weeks (corrected - thanks to those pointing it out) of unpaid leave whereby the employer maintains your health care coverage and keeps your position open.

Yes, you go in no pay status and take a voluntary leave of absence. Result, you lose that time.
Same as if you take a leave of absence for a job, education, etc.
No controversy here.

ONeill was Dean Sr's little league coach also was Dean's cousin's FTO. It's become clear that Don runs the FOP operation and some are jumping ship. Some of the guys in FOP call ONeill for advice!!! WTF? As far as the merit promotion: Senior told Junior, "Begin advertising you scored #63 on the Dic's exam". Junior had his merit interview on Dec 5th.

Only thing Dean does is sell insurance to us fucked retired copper' and waits for the bonus round money to roll in. FOP does nothing for any current or retired copper'. Period. Not a word from those crooks. The local FOP needs to be thrown out and soon. Start pulling you dues. Many a copper knows that FOP is useless and sleeps with the hall to no end.

Elections coming up. Same batch of characters will be running most of you will not know many of them because they are retired.

Use some commons sense and don't vote for anyone who does not worry about body cameras,ISR,drug test, promotions and seniority.

and at least send in the ballot.

Oneil is protected by governmental immunity. Sorry. Unless you can overcome the immensely high burden of showing willful and wanton recklessness you cannot sue Oneil. Decisions that are within the discretion of his position are protected. Next

Be glad you still have a job. This is what amazes me about this generation. You took a whole lot of time off. You were granted a nice benefit by being allowed to take time off and your co-workers carried you. Now you want more and expect us to give it to you? We covered you while you took off and were glad to do it. THAT is enough.

IF there is someone out there that has a story of the current officers of FOP Lodge 7 actually helped them, I would love to hear it, because this current crew is definitely keeping a very low profile.

FMLA does not allow for 12 months leave. It allows up to 12 weeks. It can be used all at once, or in pieces throughout a rolling 12 month period. It can also be used intermittently for a chronic health condition, like migraines or even gout.

FMLA is 12 weeks not 12 months - there may be contract terms extending in CPD. In private industry your "senority" does not accrue when on FMLA. Just your position is kept for you.

I believe FMLA only allows 12 weeks of time off. The department has different types of leaves we can take that don't impact seniority. Do we actually know for certain that the employees in question were really on FMLA. I don't work in HR but do know that each leave of absence including FLMA is unique to the individual. Sometimes mistakes happen and someone screwed up the paperwork process. I don't know how this would impact the employee or the department. I would get all my facts straight before accusing the Director of a wrongdoing. Just because you become aware of something you consider wrong doesn't always mean that is the case. If anyone knows of specific individuals then they should identify them. Perhaps you could request a FOIA on LOA /FLMA codes from HR and Finance and then conduct an audit to identify discrepancies. I would at least go this route before causing unnecessary drama.

They been watering down the seniority part of the contract for a long time. This is nothing new, but taking the City to Court would be a great stating and ending point. Bosses at every level try to get around seniority; they say its unfair to the new officers etc..... Years ago I started documenting this type of attack on seniority and even threatened to sue when my special employment was threatened by a Lt. who said, the new people are being affected. He (Lt.) back off totally when he was shown that his actions were being documented. Please don't just talk about suing these jagoffs, do it.

Would it be possible for someone to make a call to the National FOP and see if anything can be done about the current administration at the Lodge 7 FOP. Or at least state your displeasure?
The National Lodge at least had the stones to back Trump and voice their displeasure with hillary.
I'm a member of PBPA so I don't have a lot of firsthand knowledge of the local FOP but if its as bad as it sounds, it might be worth a phone call.
This politics of this job from the outside are ridiculous enough. There shouldn't be this much bs from your own union, too!

I recently retired who is running? The only person i can see at the top of the ticket is Marty Preib, don't know him but do know he has incredible "testicular fortitude" and speaks out no matter what. Or the never ever forgotten "Seiser" as # 1 or #2 on ticket as Seiser does run it!

I think the answer is in the question....The employer maintains your healthcare and "keeps your position OPEN"....This does not mean you get to keep your seniority.....and rightly so. It's a leave of absence and therefore, you lose seniority by taking it.

This is the time of year when many officers are facing personal demons and struggles. It is imperative that all of you take care of each other. If you think your partner is having some type of issues don't be afraid to talk with them. Seek help for them if you feel the issue may be something that might cause them to take their own life. Officers need to stick together more than ever and look out for each others mental well being.
Take the time to tell those that love and care for you, how much you love and care for them. Your family can be the one thing that keeps you sane on this job! Don't forget to hug them and let them know how much they mean to you.
To all of you working during the holiday season: Stay safe! Enjoy the precious time with your family and friends! Put aside minor differences and remember what the holidays are all about. Most importantly have a Merry Xmas and a Happy New Year. You all deserve the best and keep in mind that the majority of citizens still do realize they need you to maintain that thin blue line. FLMA (12 wks/yr) protects your employment and could affect Vacation time to accrue but not your Seniority, Career Service or Date of Appointment...UNLESS YOU ARE A PPO which could be a Management decision. Only Suspension affects seniority for retirement purposes.
The law is somewhat vague and arguable, a specific attorney could decipher better determine that grievance.
It's HR that's known to play with the rules, especially when it comes to D'Oneil bottom line annual report to Rahm.
Its a valid concern but hardly an FOP matter, in that they may not want to pay attys hourly rate to follow up on one complaint.
Keep track of your unit seniority list on I-Clear, it should still show App date and Car Serv dates and that's where your watch & furlo status determines all your mentioned concerns.

iT'S A VOLUNTARY LEAVE OF ABSCENCE. That means that you don't accrue additional seniority while you are on leave. you don't loose anything. It is made for new parentss or people helping family members with medical issues. There is nothing hidden about it.

Who's gonna pull the freedom of information act for the detective ranking ? See who scored what to get a head of the 1st class in order to see exactly where the merit guys land.. Its pretty clear that merit has ruined this job and city so nobody will be bragging about accepting a merit promotion..

I think the point is until the last few years if use used fmla you lost seniority. Ok fine. But that is no longer being done, and po's who have lost senority did not get it back, but if you use fmla now you don't lose seniority. The city did not make things right with those that lost it.

You're in essence takeing a leave of absence from your position. Your not getting paid , your not on the books. So yes you loose the time off in seniority. You're not technically working. It's not some giant conspiracy . It's the correct way. So people with a seniority date of 4 most behind you will pass you in seniority if you're off 6 months on FMLA. That is the correct way.

This is true. Very few questions get answered on your first call. They call O'Neill and he decides how things go. O'Neill talked Dean into furlough by watch, screwing the recruits out of duty availability, the bulls*t 15% comp time allowance and coming to a hospital bill to you changes in the health insurance that include more coming out of your pockets when you use the insurance. Ask Dean about it at the meeting next week. Thanks Dean and Don O'Neill!

True. Where I work you can take 15 minutes of FMLA if you get a migraine. It's a management nightmare if you get an abuser.

That lawsuit was swept under the rug by Dean Angelo and Greg Bella. Check the court files. The lawsuit was going forward and when Dean won the election with Bella's support Deano agreed to drop the suit. The suit was dropped in the summer of 2014, months after Deano was elected. Bella to this day has never explained to the board or anyone about what happened to the $200,000. You can blame Donahue and Davis for signing the check, but they have explained their roles, Bella has not. Why would Angelo agree to drop the lawsuit and then give Bella a $60,000 party time job in the office? See if you can get an answer at the next meeting.

When representing coppers you have to leave your ego at the the door but not your balls or your brain. All Ag-u-liar Dougherty ever had eas ego.
