SeeBS Picks up Story

  • The price to pay for shoplifting in Cook County has changed. But as CBS 2’s [...] reports, some in law enforcement worry it could actually encourage thieves to break the law.

    When caught on video, brazen shoplifting makes headlines, but a good number of these crimes are often committed by one-time offenders for minor amounts. They end up with a felony record for life, and the paperwork bogs down the system.

    “There will be a concerted effort to change policy, but changing culture takes time,” Cook County State’s Attorney Kim Foxx says. In a letter circulated to law enforcement agencies, her office says it will not approve felony charges unless the stolen property is valued at more than $1,000.

    That is despite a statewide felony retail theft threshold of $300.
Someone forgot to tell SeeBS and Kimesha that it isn't her job to decide what the threshold for charging is. That's the job of the State Legislature, and the Legislature has decided it's $300. Her job is to take the evidence collected and make the best possible case. The felony charge is the starting point.

And if you don't think that shoplifting/retail theft isn't going to skyrocket, just look at what happened when the Department decided to stop pursuits - every single day, we hear subjects fleeing at high speed from traffic stops, knowing that we can't chase for it. When you reward bad behavior, you get more of it.

just arrest one and you will find four or five "I VOTED" receipts in their pockets and purses. Sort of like a GET OUT OF JAIL FREE CARD.

So don't go working a side gig as store security trying to stop shop lifters. You could be set up for a trap. Some goof steals a $50 pair of jean and wrestles with a store cop (who is CPD). That will get it on their own video and it is ghetto lottery time. The store will say it is not policy for personnel to engage in physical altercations with alleged shoplifting suspects or "no comment".

If any of those liberal high-line stores made campaign contributions to Kimmie Foxx they should demand their money back.

Indirectly related.....remember the post a few weeks ago about some M/1 police officer in CPD human resources who was caught on tape bragging about eliminating M/2's that resided in Mt. Greenwood area from the hiring list....well looks like that post was complete BS and never happened because nobody knows anything about it.

I'm telling you, put some people with shotguns by the doors. Someone takes something and tries to run out - shoot them. AND, in honor of Richard J. Daley who was never a fan of looting, the intent MUST BE, "Shoot to Kill!"

If they make it out, wounded or not, they can have the merchandise.

If you need 10 shoplifting incidences before you "qualify" for a felony, then you must need to have at LEAST 30 "Shoplifter" incidences before you are charged with ANY gun violation.

Those 30 MUST occur as separate instances AND must be within ONE year. If you shoot 4 (or ANY multiple amount) in one incident, it only counts as ONE shoplifter incident. (Make sure you understand that nuance)

At the beginning of the year, the count gets re-set to ZERO incidences.

Of course, ANY gun violation (like you did not have a valid FOID card) will only be a misdemeanor AFTER the first 50 occurrences (within one year of course), and you have up to 80 occurrences (within a quarter - NOT a full year) before you would be even considered for ANY felony charges.

These are the new Kim FOXX "Crazy Law Statutes" coming out in her next round of Bizarro Law for Chicago.

Felony Review is a fiction. It exists nowhere in the criminal statutes. It is merely an agreement between the police and the State's Attorney's Office. It began under State's Attorney Bernard Carey as a way to stem the flow of unprovable cases into the criminal justice system. It has now been bastardized into the felon favoring mess that it is today. Instead of helping the police make cases it is now used to keep victms from having their day in court. Recently, more times than not the pursuit of justice comes to an abrupt halt in the hands of a first year prosecutor who has never even spent a single day in a felony courtroom.
This system is now broken beyond repair-and when the State's Attorney can arbitrarily change the laws it wishes to follow it's time for the police to end this poison process.
It would be interesting to see how many of this years shooters have felony rejections in their background!

So if the States Attorney or a Judge does not follow the law, what do we as citizens call that? I call that malfeasence of office. I call that offical misconduct and what the chief law enforcer of the county is doing is unlawful. So those who are responsible for maintaining the law when people like Kimm obviously break the law have to get to work. They have to follow the law and apply it to Kimm. It will never happen because of the Precwinkle effect. Evans will not say a word about it. Madigan will not touch her (neither of them) so the only hope is the fed will take exception to her "law enforcement" and discuss the matter with her.

This place is so fucked up by the people who are supposed to be holding the trust of the public it is truely amazing. Two more years and I'm gone. A minor amount is $40-$50, not over $300, so someone stealing a minor amount isn't being charged with a felony as SeeBS wants everyone to believe. The only person being charged with a felony for taking $40 worth of merchandise is the habitual criminal with multiple convictions. At least pretend to try and give accurate accounting of the process.

Once again, The Peoples Republic of Cook County is an entity unto itself. (Except when they want state or federal funding.) So once again, retail businesses will be discouraged from operating in Cook County, because the standard for those who prey upon them will be less than if they operate elsewhere. Yet, this is nothing new for those of us dumb enough to reside in this shithole. Consider that we already have an Unstated Rule for Aggravated Battery. Anywhere else in the State of Illinois, if you take a baseball or other blunt trauma instrument and beat someone it would automatically be an Aggravated Battery, Felony. In Du Page County you would probably go to prison. However, in Chicago, the Assistant State's Attorney, would have to do the following: 1. Run the victim's Social Security number, to see if they have a record. (Especial if the victim is White. If you are Minority you are expected to have a record if you are over 12 yrs. old) 2.The Suspect/Offender must be interviewed by the ASA. If the Offender is more articulate than the Victim, well that works against the victim. Though it is difficult to be articulate if you just got beaten with a baseball bat 3. Is the victim on Life Support? If the victim is not on Life Support, or disfigured by the beating, the ASA will refuse to charge Felony, and will only grant a Misdemeanor! (Exceptions being if the Victim "knows" somebody.) Hence, in the Peoples Republic of Cook County, there is a Pre-Trial, Pre- Preliminary Hearing. AND ALL OF THIS MEANS THAT IN COOK COUNTY, ESPECIALLY CHICAGO, YOUR LIFE'S VALUE IS DIMINISHED. YOUR LIFE IS WORTH LESS THAN ELSEWHERE IN THE STATE. Most folks think it is like T.V. with dedicated prosecutors, when in fact it is not. T.V. is entertainment, Democrat Politics Chicago is Very Different, and only entertain to a few. I saw a draft of the new aggravated battery to police order the CCSAO is about to release. Felony review can only approve charges if the offender performs two piledrivers, three DDT's, or three stone cold stunners on an officer.

Yes, I do agree that the threshold for felony charges is set too low. It is $2000 in many states. The idea of 10 felony convictions for an approval is laughable. But, that said it is the job of the legislature to make the law, not the executive branch. It seems that this is a standard tactic of progressives to just ignore any law that they don't agree with. I wonder what they would say if the republicans started to do the same thing, It is a bad precedent and a slippery slope, but in accordance with what Preckwinkle has stated many times, that ther are way too many black/brown in jail. The solution, make some crimes unchargable. I think that Orland Park is now really upset because their shopping areas are prime targets for every shoplifter in America. Best Buy now has a policy of not even stopping shop lifters. No one wants the confrontation.

President Obama is letting out repeat drug offenders and Kim Fox will be letting everyone in Cook County out, except police. She plans on filling the empty jails with all the bad police.
What police know is that the retail theft trade fuels the drug trade which fuels the murders. At first I felt sorry for the honest minorities who will be affected most by these changes but then I remembered "You voted for these people." What's the over / under on how long it takes before those shiny new stores in Englewood close up because of shoplifting losses? Retail is an incredibly low margin business. Making $300 the threshold for felony charges was intended to deter shoplifting by making the penalty painful (at least for those who care about such things). By pretty much eliminating any significant penalties for shoplifting, people who normally might think twice about lifting something will likely be more tempted to give it a shot. And that now becomes a county-wide problem. If the losses are severe enough, retail businesses won't be able to survive and will move to places where they can actually receive the protection of law. Fewer sales means lower tax revenue.

Shoplifting, as it exist today, is a very serious problem. Many people, think of shoplifting as the juvenile that sticks his favorite toy under his shirt. The hungry person, who needs food. to feed his family, etc,etc,etc. Anyone in the industry knows this is not what we are addressing here. Shoplifting in this City, and I suspect others, is a "Constant". In many areas it has become a "Sporting Event"! Let's All Run In, Grab as Much as We Can, and Run Out. The Jewel Store, I shop at is Wide Open! People eat, and drink food, they will never pay for, while shopping. Anyone who has ever worked security at a store, knows how much of a problem this is. Many Shoplifters, are on drugs. Many fight with the security guards. Many have needles on them. Truth is : Many Stores feel its cheaper to include these costs in their budget, and pass them on to the consumer, then deal with lawsuits etc.
In my opinion, Many people feel it's part of their entitlement. Hey, spread the wealth around.

The press must really believe the whole good boy that stole one time and fell by the wayside pitch. I had an adult M/W caught trying to steal a couple of items worth $1,000 together. Not one single prior arrest. Explained why he did what he did. It was stupid and didn't justify his attempt to steal but he was clearly not a real criminal we should be concerned with, just a moron who actually admitted right away what he did and turned out to be one of the most pleasant and non-complaining prisoner I have ever seen. Felony Review, to our utter amazement, actually approved felony retail on them. None of the coppers working thought he needed a felony despite the amount. I called just to check the box. We get to the prelim and the state wants to give him a break. I told them right off, with no hesitation, I have no problem with whatever break you wanna give him. People really believe this a guy stole a candy bar and got 5 yrs. stuff. 1st time guns and dope won't get you 5 yrs. but a retail will?!?!? Ha.

Cook county States Attorney's office is the best defense attorneys around. They always want to blow cases off and they always have. The years past they would never approve felony charges is the proceeds where a food item. Like these thieving rats are Hungary. Well I guess they where Hungary for their drugs and the answer was stealing food items for resale to get drugs. But the ASAs from the surburbs were too stupid to figure that out.

And once again another promotion class delayed due to politics. A class of detectives was to start on the first week of January. City hall wanted a certain number put in, the department needs a bigger number because Not enough merit selections that they want in the first class wouldn't get put in so the department requested a bigger class so they can get a bigger percentage of merit selections. Rahm throws up his hands and sends a big FU to the south side alder woman, the south side boss who doesn't know the chain of command and the department by delaying the first class from the first week of January until an undetermined time. They can't go too much longer without putting a class in so I'm guessing mid to end February so they are out by summer but gotta love the politics of merit picks. Glad they all got it from hard work and dedication.

When reporting a loss or value of item taken, you are supposed to use the invoice wholesale price. Not the selling price. The wholesale price is the merchant's actual loss.

So that TV set with the $999.95 price tag might really only be about $500.

The mark-up on jewelry is even bigger. 3 to 4 times selling price. But their insurance premiums are real steep.

QUESTION: What is Probable Cause for a felony? How does it differ from Probable Cause for a misdeamnor? Can anyone show where in any statute, State or Federal, where there is a difference?

The Illinois Retail Merchants Association is already pissed off at the Preckwinkle and the C.C. board over the soda tax. If they can show losses from that and from increased shoplifting they should take these goofs to Federal court for failure to protect and perform their duties.

Pull their campaign contribution on them and go Republican.

See if Michael Bloomberg or George Soros will make good their losses.

I for one don't care misdemeanor or felony. I still get to be off the street for a minimum of 90 minutes. It's like an extended lunch and personal. The paperwork part is easy. I don't take this shit personally. I really don't care anymore what you charge them with. I will take a retail theft arrest over a few domestics any day of the week.

So the state statutes state that $300 is the threshold for felony theft.
Kim decided that in Crook County the threshold should be $1,000.00 and you need 10 prior convictions to consider an upgrade.

Making theft something less than criminal has not served us as a society. No, theft is not "petty". It is serious. Indeed, even at three hundred bucks, it is deadly serious. After all, some people will defend their bicycle, because it is their only means to get to work - and people do have the right to defend their property.

This rise to a thousand dollars, as nefariously raised by someone who is not authorized to raise it in the first place and pointed out as such, is just another attempt to strip people of their right to defend their own property, especially every day property like a PHONE!

See it yet? Stealing a PHONE these days is an easy felony charge because almost all smartphones are worth more than, well cost more, than 300 bucks.

Could it be that the prosecutors just don't WANT to do their JOBS? Could it be?
