Another Reopened Case

Here's a previously ruled Justified shooting opened for political reasons:
  • [DS], who has been in the 018th District for 18 years, needs our help. He is in a no pay status currently and IPRA is trying to fire him for a shooting that happened just over three years ago which was deemed justified at the time. Here's a brief synopsis:

    [DS] was assigned to the tactical team in 018 and was working with the area detectives on an armed robbery crew that was creating havoc in the district. While on a surveillance of one of the offenders homes in the suburbs, offender pulled into his driveway and exited his vehicle. The decision was made to take the offender down and [DS] and other detectives converged on the scene. Offender saw what was about to happen and jumped back into his vehicle. Offender then proceeded an attempt to drive over [DS] and another detective at which time [DS] fired 3 times striking the offender. The offender succumbed to his wounds. An immediate investigation by the department ruled the shooting justified and IPRA at the time concurred.

    Fast forward to present time and IPRA gets a new Chief Administrator who decides that she is going to re-open numerous shooting investigations due to the Laquan McDonald shooting. [DS] finds out his shooting is to be one of them. In January [DS] gets promoted in the first class of detectives only to find out that he is being taken off the list and being put in call back due to IPRA's re-investigation. IPRA's re-investigation concludes that [DS's] first two shots were justified and the third was not. Superintendent Johnson weighed in and stated that the shooting was justified while IPRA went to a three person review of the Police Board who sided with IPRA. 2 weeks ago [DS] was put in a no pay status and has to go in front of the full Police Board sometime this year.
Did you get that? In a rapidly evolving, violent, loud, dynamic situation, some armchair assholes from IPRA dissected a shooting that took maybe 2 seconds to unfold and determined that the first two shots were justified and a third shot was unjustified.

And how pray tell did they determine this? What if the first and third shots were the justified ones? Hindsight is supposed to be 20/20, but a cop doesn't have that sort of luxury in a highly fluid situation with a guy trying to run over multiple officers with a car.

Special Ed seems to have made the determination that it was a justified shooting, as IPRA did three years ago, but was overruled by political actors operating in a political environment looking for a political outcome.

This finding is crap and ought to be treated as crap. The FOP should be loud and outraged about this and the superintendent might want to think about the fact that Officers are going to see this three-year delay as a witch hunt for scalps.

The officer is going to have to put a civil suit in on COPA!
plane and simple if you can file a suit against a detective you sure as hell can file a suit against a COPA hack who want to play Monday morning quarter back.

If you wait for FOP they will tell you to chill and just hope you don't go to prison.

Put some thought in it 10-20 people did the 1st investigation and someone now is saying they were all wrong? multiple exempts signed off on the case originally mow nothing?

This is ridiculous. I shot a pit bull that was gnawing on my leg a long time ago. I thought I fired 4 times; further investigation revealed I fired 12 times. DS should get his job back, his promotion, back pay, and a giant fucking apology

Im going to take a guess that this case has been reopened because there is a civil case pending. Im also going to guess there was testimony either through a deposition or actual courtroom testimony that contradicts prior statements.

Armed robbery .... a forcible felony offense, and in addition to his escape attempt being a violent crime, should his escape actually occur, then more lives would be in danger, but the third shot was "not justified"??

Where do they come up with this stuff......

Remember this - every situation that you involve yourself in can reach the point where you might have to shoot someone ! Now i signed up for this job knowing that was a possibility what i did not sign up for was that those few seconds of chaos would get picked apart by some Monday morning quarterbacks resulting in me getting fired ! I've got just over 4yrs on and the 1st and the 16th are the only things important to me ! This city is creating a generation of cops that are gonna be totally out for me , myself and I and nobody can blame them !

The officer involved, [DS] has spent his entire career devoted to quality police work, and a ton of that! He has spent the last several years actively assisting Area Central detectives in closing many cases of robbery and other violent crimes. He was on a recent list to be sent to Detectives Class, but due to this sand-bag by IPRA he was taken off the list.

I have known [DS] over the years in the 018th District, and he has a stellar reputation among all, for arresting dangerous offenders and keeping our community safe. For IPRA to re-open a justified shooting, three years later, sends chills throughout myself, and every honorable officer in the CPD.

Do whatever you can at this time to support [DS] and his family in their hour of need. [DS] is one of the last of a breed who was willing to sacrifice his personal well-being for the protection of the citizens of Chicago. If [DS] is allowed to go down without the support of the CPD and the FOP, then the fight against everything evil in Chicago is already lost!

Why are they opening old cases that were already investigated and ruled as justified. I think that cop should sue the dept & ipra supervisor for re-opening a case that was already done. It seems they are just trying to screw working ofiicers up. Hey ipra why don't you investigate the Lt cheating scandal along with all these messed up exempts that have no moral compass/ethics getting triple merits in an unfair merit process.

These civilians hasn't received enough training to investigate an illegal parking ticket, how in hell are they investigating and making decisions on policing-related shooting? They couldn't identify a crime scene if they were standing inside the red tape lol! If they were to recover anything at a shooting they couldn't inventory it although they're the investigating unit to police shootings. Wait unit the civilian investigators come on your crime scene. For the most part the civilians who makes the decisions on police shoots has had less than one week training on Lead Homicide Investigations

I'm all for it as long as the taxpayers don't have to pay taxes for 24 hours, then since the agreement was broken, some pay taxes and others provide a service in exchange for the taxes, no more taxes can be collected until a new agreement between the taxpayers and the service providers is negotiated.

The Police Board are a bunch of Tiny Dancer's political hacks. Tiny Dancer stacked the Board with a bunch of police haters. This is a result of Garry McCarthy complaining to Tiny Dancer that every time he tried to fire an Officer the Police Board over ruled him. So Tiny Dancer put people on the Board who have no problem firing Police to further Tiny Dancer's political agenda. Why anybody does anything is beyond me. Everyone should be laying low. Consider that the Superintendent, who is in fact appointed to a clearly Political Position, because all Exempt are political appointees; yet Fathead Ed himself, sided with the officer and they end played Ed. to nail this cop. Today the suntimes stated this about our pension: That dubious distinction went to the Chicago Police Annuity and Benefit Fund, which had assets to cover just 25 percent of its liabilities in fiscal 2015, down from 26 percent the year before.

This case will absolutely create fear in every active officer's mind. Every previous case will be reviewed and if possible you will be indicted. The superintendent cannot help you. FOP is silent and useless. Too bad this case is news today. If it broke two weeks ago it would have a major effect on Angelo's election results. And IMHO has Un-Fucking-Constitutional written all over it. That is, if Police are still citizens of the USA and as such have constitutional Rights and protection just like every fucking Illegal Alien has that's managed to invade the country. Ergo:
--- 1) Reopening the investigation after the Officer was cleared in the first one puts the officer in Double Jeopardy -- a 5th Amendment Violation.
--- 2) It's Public Knowledge that this 'new' IPRA will be looking at Police Officer conduct in a completely different manner. Going after an officer for the slightest infraction, weighed against Police and Pro the anti-police 'social Justice' activists. While not a new 'law' per se, it sure is a new way.
------- 2a) And applying this New Way to old resolved cases is: Ex Post Facto (after the fact). And that's been Unconstitutional since Article One, Section Nine, Clause Three, of the constitution was ratified on September 17, 1787
------ 2b) Applying this 'New Way' of looking at new cases is okay, but you can't 'go back.'

As such, I'd drop the hammer on these anti-police assholes with a Lawsuit in Federal Court for Civil Rights Violations seeking 'gazillions' of dollars in damages.

Lastly as far as Maggie O'Grady that woman is great she not only knows the pension board, she also helped immensely with the removal of our health insurance and was a big help straightening it out! Dean made 1 yes 1 good hire and that is her!!

I'm not the police, but read this blog because its informative. If the States Attorney's Office is doing this to the Police, then the question in my mind is what in the hell are they going to do to a civilian defending him/herself in a deadly force situation? I don't know the complete answer, but an Ex-ASA who just resigned after Foxx was elected said, the new States Attorney is totally racially motived. First this motivation is aimed at white Police Officers and anyone else not black. It appeared to him they want more whites arrested and prosecuted for just the numbers, in a word, affirmative action through prosecution. He told me, he use to think it would be a bad idea for someone involved in a shooting to leave the scene. Presently he said it might now be a good idea if you can. He was an insider and said the States Attorney's Officer with Foxx is not police friendly. These rotten cheating lying bosses are urging officers to expose themselves to more contact with a police hating public which can quite possibly and most probably lead to more incidents of this type. But the bosses are insulated from any liability as they sit in their offices with their hands clasped behind their heads and their feet on the desk.

In this current political environment of police which hunting here in Crook County, for the sake of your own sanity and self-preservation, the only rational option is to simply report to work, get the car, answer your calls and cut paper, and go home at the end of the tour. At least that course of action can minimize your chances of liability and a Federal case.

We all signed on knowing the risk to our skins. We are not scared of that. We knew about that part of the job. But what was a shocking surprise to most was the degree to which your actions can lead to you being liable in a financial sense and the risk to your own liberty. Simply for trying to do the right thing and enforce the law and protect people that need protecting.

shame on these selfish and disingenuous cuck bosses who either don't see this, or do recognize it and are urging officers onward in spite of this situation. Knowing full well that the full burden of political Fallout from an ugly incident will fall on the police officer working the street.

it's getting to the point I can't even stand the sight of these rotten bosses. They are not your friend, they are not there to help you, they're only there for themselves. I heard FOP did everything they could for this individual and the other two involved in a different incident out south, including drafting a report to the Sup that was delivered to him. The Sup did not go along with the IPRA recommendation based on this very report. I am bewildered at how clueless many are and it is getting worse. Is there double jeopardy in an employment situation? I don't think so. Certainly not involving the 5th amendment as some have mentioned here. This is an employment situation and the amendments rarely come into play. The officer will have to rely on the union contract in this matter and ultimately a review by the courts. But if this is true, that the first two shots are OK but the 3rd shot is not, WOW, that is unbelievable unless the offender had his hands up or something along those lines. I am sad for what has happened to the city and to the police department since Rahm and the progressives have taken over.

Its our own fault , we elect union guys who don't care and sell out the active and retired membership like clock-work election after election. How many times have you heard the union guys say they will attend roll calls and inform members of current affairs only to never see them ecept at election time. Decertify the fop and get a real union with a real labor lawyer to hammer out the contract and issues at hand. Fact - in other major depts. an officer or exempt is immediately assigned to desk duty until the investigation is closed. they don't get striped, they don't get placed in a no -pay status. In looking at the case on the IPRA website, there is no video available.
Who knows if there is a video of this incident.

If there is no video, how the hell did IPRA determine that the 3rd shot was unjustified?
And, what gives IPRA the authority (little to no investigative training, no knowledge of police operations, no knowledge of police shootings, training, etc)
What gives IPRA the authority to determine whether that 3rd shot was justified or not?

As much as many of us have slowed down to almost a hault- you were the SAME P.O.S. 5-10 years ago saying the same thing. Guys like you were never the police, never wanted to be either. I don't do any proactive police work anymore, but i will be the first guy there if someone calls for another car. If a gangbanger flashes a gun at a cop driving by and they decide to foot chase, i will be right behind my coworker as well. If that means otherwise just sitting in a hole for 8 hours just going to my calls so be it. I bet when your out with your friends and family you tell them about all the "war stories" about working in a ghetto district, when in reality you hid in CAPS/commanders office/front desk.

I used to be a real worker, loved arresting the bad guys with about 3,000 arrests but I'm done. I've seen enough, read enough, that I'm now going to take a desk spot when it opens up. I found myself in a very similar situation. My case was closed in my favor, then years later "re-opened" in no-pay status. For 16 months. 16 months of zero pay, zero health care. Well, the bills still come in. I lost my house with 2 years left on the mortgage , and realized how easy it is to run afoul of the law. Things like ipass balances lead to a suspended DL. Car insurance is very difficult. I couldn't even renew my damn library card to use the computer to look for a job. The fallout is what gets you. I got reinstated with back pay only to use it to pay the lawyer, but my once perfect credit is now ruined. A chicken wire vagrant hotel was a real possibility- if I could afford it. I was too proud to take charity, but found myself at a food pantry justifying bread and milk. So from now on, I won't get mad at people sleeping in the lobby.
