Hefty Judgement
- A former Chicago Police sergeant who served nearly four years in prison before he was acquitted of rape has won a $4.5 million judgment in a lawsuit against his accuser — and he’s vowing to recover whatever he can from the woman.
In 2011, John Herman won an appeal of his 2007 conviction for aggravated criminal sexual assault and was released from prison. While he was behind bars, though, the city paid his accuser $1.5 million to settle a lawsuit that she brought. After he won his freedom, Herman sued the woman. And on Tuesday, Cook County Circuit Judge Gregory Wojkowski awarded him $4.5 million.
Herman said he intends to collect as much as he can from the woman, who now lives in Texas. “I want the clothes on her back, her kids’ backs and her grandkids’ backs. For what she did to me, I don’t care,” Herman said.
So does that $1.5 million come off of the running total that assorted groups quote against the Department every time the City Council approves a settlement that could easily be beaten if the city lawyers would actually try a case - instead of it ending up in assorted political pockets as contributions from plaintiff law firms?

I hate to say it but this guy really made a bad decision. He had 20 years, sgt and 42 years old. He was in the drivers seat. As reported by the news he is now driving a truck to make a living. Now pension and he just started paying into SSI. Wife gone! House gone! All his business is out there!!! Spent time in jail with dirt bags!
I only wish this would never repeat it self but, other guys will go down the same road.....

Now free but fired from the department, a department that refuses to reinstate the sergeant or to consider the sergeant as retired status. The Illinois Supreme Court stated that no reasonable person could look at the evidence and find this man guilty.

I worked the watch with John in 002 before he made Sgt. and have to
share one of the funniest things that I ever saw at winter formal inspection.
The watch had fallen in wearing the reefer and was standing at attention with the helmet, raincoat and blouses on the floor in front of them when in walks Area 1 Deputy Chief Johnny Corliss to give us the once over. He makes his way down the line, stands in front of Herman and takes a look and and sees that Herman doesn't have his blouse laid out in front of him. Old Corliss says to Herman "where's your summer blouse officer" and with that, Herman unbuttoned his reefer and shows Corliss that he is wearing his blouse underneath his reefer. Corliss stands there in amazement for a second, starts to shake and cough and although only halfway through the inspection, he walks out of the room while just shaking his head. Corliss never made another appearance at one of inspections and Herman was promoted shortly thereafter. Don't know if he was merit or not. Those were the days.
I worked with Herman in 006. He was always a loose cannon.
Lesson learned if your married don't mess around with crack whores on 79th street....yuk!

Well, hopefully the SGT's association will assist him in suing the City and County. Also, how about the bosses who decided to railroad him? Maybe the IAD investigators who took orders from above to "get him" should also be looked at.

I was working in 006 the day this happened. Herman was a goof. Not a good guy, but, he did not deserve what he got. We don't treat murderers like the department treated him. He got sandbagged by the Department. Her lawyer and the media show up like 10 minutes after she walks into complain. I think he was definitely dealing with this woman, but off duty. She probably asked him for cash and he told her to fuck herself so she came up with this scam. I don't remember the Lieutenant, but the Captain was Vaklavik. he was real shaky. The Lieutenant took Herman in the office off the desk, called the union and read him his rights which the Lieutenant got in trouble for. The Lieutenant told the brass if he was being ordered to detain Herman in that office and no allow him to leave hit meant he was under arrest and he needed to be read his rights. They literally took Herman's clothes, so I can see why he would say he wants the shirt off her back. The lieutenant went to OSCO I remember, and bought him some sweat pants and sweat shirt so he would have something to wear. The Department was going to give him a paper gown.

If he's innocent I'm glad he's iut, but he was a goof from day 1. While in the academy he'd go to Madison street during lunch and play with the hoikers regularly. His mother got a CR on him for burglary and was strongly pushed not to get criminal charges against him.He was arrested and charged previously for battery and rape against his wife, for God's sake. And throughout his career he constantly was playing with street hoikers on duty. I don't know all the specifics with this case, but there is something very wrong with the guy.

I have known and worked with John in two different districts over the years.
Don't care if he in fact raped her or not. He first lied about having any sex with her until the DNA tests came out - her DNA on his baton, etc. At the very minimum this guy is a scum bag for having sex with some crack whore while on duty - and his lawyer called him a strong family man, what a laugh. How about the Sgt that drove home the girl after she had a domestic with her boyfriend, returned to her apartment with booze had sex with her and she then killed herself while he was in the bathroom. Then there's the two P.O's who picked up the girl in Wrigleyville and drove her home at which time they thought it was a good idea to double team her in her apartment until she sobered up and chased them half naked out of her building into their marked squad. Wake up people, all these people belong off the job if not in jail.
Keep in mind that was actual Detectives investigating the case.

Joe Vaclavik. Have not heard his name in a long while. Not a bad guy and quite intelligent, but he might have been happier in private industry, not a police department.

I have no personal knowledge of him, other than crossing paths with him a couple of times on the job and hearing the tales of his escapades as spoken by others, but I would bet he was molested as a child. It seems he has exhibited one of the classic PTSD behaviors of an adult who has survived, but never revealed, having suffered repeated instances of child molestation. If so, the guy had a very tough childhood, one that negatively changed his personality from what it was to become to what it did become. But, what do I know? I pushed a beat car for 35 years. Actually, I take it back. You see and learn a lot of things in 35 years of viewing and experiencing the human condition at its best and at its worst.

Herman's reputation preceded him. He was a disgrace to every working police officer. Herman was one of the reasons many people in the hood disrespected the police, as every rat in the hood also knew of the uniformed officer who was banging crack whores. He did not operate in a vacuum where his behavior was his alone. Herman's behavior sort of gave Herman's reputation to all uniformed officers in those communities.
He doesn't even deserve the title "officer." he was a "person" who wore a police uniform but didn't do a police officer's job. People like him who wear the uniform are a disgrace to the honest, hard-working officers. no working police would want to spend a tour of duty with some jag who spent his time looking for sex with whores instead of doing police work.
You can argue that many officers cheat on their spouses with ghetto whores, but just because they aren't caught doesn't mean they are everyone's favorite person on the watch to work with.
Many at the time knew herman was railroaded, but why oh why didn't he just admit at the time he did it instead of lying about it? once you get caught in a lie, your credibility sinks. It seems to me that the judge and the prosecutor did what the department should have done and that was to get him off the CPD job.
If the department had the balls back then to fire him, he never would have gone to jail (at least not like he did). If some supervisor, going back to his days as a PPO, had disciplined or fired him, he may never have gone to jail as a disgraced officer. It's a shame that our academy has an almost zero-failure rate.
It took him some years but I'm glad he's out of jail, because he didn't do the crime. I hope he gets some money back from the crack whore. but I'm not sorry he's off the job, and after reading the stories from his former colleagues here on the blog, I hope he doesn't get back on the job.

If I remember correctly, the Det's actually did a great job. Clapps railroaded Herman in court. The Det's brought out the fact that the Ho said something like "Gimme $2000 and this all goes away!" and Clapps suppressed it in court.
And since you're on the rant on who fucked up... Just think, if Herman didn't do what he did in the first place, NONE OF THIS WOULD HAVE HAPPNED...
If she is a Texas resident, good luck collecting the judgement. Great place to owe money. If you have cash put it in a house, file homestead, pay taxes on homestead, file bankruptcy. No $$ limit on value of homestead. And judgement cannot be filed against homestead. Also cannot attach wages to satisfy judgement. She ain't no dummy.

no certificate of innocence and no law suit against the city or the county. Read today's Tribune. The state had a case on him for solicitation for murder on his accuser but never pursued it. I believe they still can

Didn't he file suit against the State? They filed false charges, prosecuted him for a crime he didn't commit and incarcerated him. He got 4/5 million he'll never collect (I'd settle for blowing her head off) he should claim at least 20 million from Big Brother.

yes that is true, but it was not a one time occurrence with this "lady". It was stupidity at its highest. Rest assured that if you are going to your girlfriend/boyfriend house while on duty and playing around you will be fired.
