COPA Credibility Kaput

Two years later, an agency that didn't even exist, using "evidence" that none of its non-existent investigators ever saw, has completely dynamited any imaginary "credibility" they may have had, confirming every suspicion that they were put into place simply to railroad coppers:
  • Chicago police disciplinary officials have ruled that an officer was unjustified in the fatal 2015 shooting of a baseball-bat clutching 19-year-old and an innocent bystander.

    The Civilian Office of Police Accountability determined that Officer [...] unjustifiably shot Quintonio LeGrier and 55-year-old Bettie Jones while responding to a domestic disturbance on the West Side on the day after Christmas two years ago, according to documents obtained by the Tribune through an open records request.
Did the Department rule the shooting justified? Not that that means much in light of past rulings.

The States Attorney refused to press charges. That means a lot more.

Corp Counsel attempted to properly sue the estate of the deceased seeing as how it was his actions that led to the death of a bystander.

Hey Special Ed. You used to have a halfway decent reputation on this job. You gave it all up for a job you never applied for and sold your soul for a monetary pittance. How about pretending you're the cop you used to be and do the right thing. Disavow this entire charade and cut COPA off at the knees. There is nothing unjustified about this shooting - you know it, we know it, the Department knows it, even Kim Foxxx knows it. What happened to Bettie Jones was a horrible tragedy, but the blame lies entirely at the feet of LeGrier and his actions. Resign if you can't stick up for the troops.

To the FOP, this ought to be a rallying cry to a vote of "no confidence." Apply it to COPA and their non-existent "transparency." They are a political construct to bring about political outcomes to politically unpleasant shootings, even those complete justified under local, state and federal laws. Apply it to Special Ed if he doesn't do the right thing and continues to exhibit the spinelessness that has marked his entire tenure. And apply it to Rahm - attack his already weakened political standing in the forgotten communities, not the one he panders to incessantly. Fuck him.

And finally, to the police readers. Everyone out there thinking that if you just do everything "by the book," within the constraints of General Orders and follow the law as written, this isn't a game. This isn't 1970, it isn't 1980 and it ain't 1990 or 2000 either. COPA can make their pronouncements without having first hand knowledge of the scene, without applying even the basic nuts-and-bolts of the Use of Force model, completely disregarding State Law and United States Supreme Court rulings to come up with a political solution - an appeasement. We hope the message that Rahm is sending is getting through loud and clear.

Why are officers doing more than is required is mind boggling. Just answer your calls give report if needed and arrest on signed complaints if need be. They are asking for event numbers for positive community interactions, what has policing come to? It’s a shame. Tact in a majority of districts is almost reverse seniority average has to be 4yrs on. Let’s see those guys from the use of force training that are coming to the district roll calls explain this.

I;ve been loading the tribune comment section with my disgust of this ruling. If you can, please also write comments on the story. The level of hate being directed at the police is beyond belief.
FETAL! BE and STAY FETAL within the guidelines so as not to be fired. Do nothing but answer your call, write paper and only arrest on signed complaints. Gotta write a ticket. Write the State Statute. Long form anything you can if circumstances require action and it can be employed. Hit the station bathroom 10 times a day. Make sure you take your half hour lunch. Watch a stop light in plain view for time between radio jobs. Police presence is police action even when positioned to watch cars go through an intersection. Obey every traffic law that exists when traveling slowly to your assignment.Wave at the teens on the corners and porches and just smile. Wave at people that run out waving at you and give them a big smile. Follow every fucking, stinking General Order that exists and kill the department with going by the book. Do not stop anyone for any reason. Lay the fuck down but still do what you absolutely MUST do so you are not part of a police action. FUCK THOSE SPOTS and be a man rather than one of Special ED's kids. Stay safe and go home to your families by being FETAL!!! Fuck special employment on all levels. If you need overtime, bring in a State Charge TVB at the end of each tour. FUCK THIS CITY, FUCK rahm, FUCK SPECIALED and FUCK COPA CABANA.

The use of Chicago Police as scapegoats and pawns in Rahm's Political Game is SHAMELESS! Van Dyke was left in Limbo, until Rahm was assured a second tern, and now Rialmo is being fed to the wolves so that Rahm can boost his image and Black vote. Because the lawsuit that Rialmo filed against the estate of the bat swinging Le Grier, made Rahm's donors in the legal community realize that they may have to split those large City settlements, with the first Real Victims, in this case that would be Officer Rialmo. But let's take all this one step further; we have many Specialized Units in the Chicago Police Department, such as SWAT, which is highly trained and specialized. Perhaps Fathead Ed should consider reviewing how many of his officers have degrees and advanced degrees in psychology and experience in working with mental health patients. I think, that there are several if not many Officers who worked with the mentally ill, before becoming police officers. Instead of wasting these Officers on District Enforcement; wouldn't it be better for the City if these officers' talents were used in addressing specific mental health issues and patients? If we can have SWAT available 24/7; why can't we have Crisis Teams North, West and South to address the issue of handling Mental Health calls. A review of the number of Mental Health calls handled each year, in specific Areas should be undertaken and the feasibility of such Teams as a practical response to this issue should be considered. And somebody needs to show COPA some photos of what a bat can do to a head, or other parts of the human anatomy. In the Real World, a baseball bat wielding mentally ill person, who has just forced his father to hide in a locked room, is a Threat warranting Deadly Force if words cannot stop him. Be careful, don't be the next victim of Chicago's Political Corruption. Police have become the "Victims" in "Shitcaga". Baby "G"

The Chicago Police Department has IAD and of course, COPA to handle complaints against officers. Who do we call to complain about COPA?

As far as Ed goes, why not obtain a CR number against him for embarrassing the department and failure to take action? Shit, the damn department has so many rules and regulations, somebody start posting Ed's violations of the Rules and Regulations so retired guys (such as myself) can march down to IAD and get a CR#. Many will poo-poo the idea of obtaining CR#s against the Number One guy on CPD, but Ed is the same boat as the rest of you active duty guys when it comes to PUNITIVE DAMAGES. One copper getting hurt because coppers are scared to react? Ed and his new kidney will be in Deposition Hell while in retirement.

COPA and ED's failure to take action is going to get a copper(s) killed. The punitive damages won't bring back an deceased officer, but "Failure to Take Action Ed" is going to get wind of this post and he's going to make a phone call. Not to COPA and tell them to cut the BULLSHIT. It'll be to the legal department asking if there's really a chance he can face punitive damages.

When Johnson was Chief of Patrol he spoke to our roll call about this shooting and mentioned how the officer was being unfairly targeted due to lawful actions. He further added they were protecting him by allowing RR to work desk duty out of the location of his choice. The now Superintendant Johnson has 90 days to make a recommendation, and does anyone doubt it will be for anything but termination?

Give "them" what they so badly want - nothing proactive. Let those self-cleaning ghetto ovens do what they do best. Respond. Drop paper. Call for the ambulance when necessary. Make the proper notifications. Arrest on signed complaints only. Lather, rinse, repeat. Don't jeopardize your livelihood, assets, sanity and possibly your freedom trying to save an ungrateful segment of society from itself.

This same scenario could easily happen to anyone of us in patrol. This officer was dispatched to a domestic and quite possibly the worst scenario unfolded. Staying fetal is advisible in today's political climate, but how exactly do you avoid this? You can't. Everyday coming to work is hoping you're not involved in the next COPA sacrifice

Its always been the Monday morning quarterbacking by critics, media and political panderers that frustrated me about this job. Someone from the sidelines who second guesses after the fact those few moments, seconds of panic and fear that a police officer has to respond to. They've watered down the defense of "fear for one's life" and in the process cheapened the value of a police officer, as if he were some replaceable commodity, not worthy of being alive, in spite of what he encounters every day. Especially those unknown assignments, when routine calls go off the rails, when those him or me circumstances of life and death are in front of him/her and a choice has to be made, instantly.

The fact of the matter is these critics aren't there. They don't feel what you feel, they have the luxury of disecting the decisions you have to make about whether or not you will be alive in a split second. These are people who read a report, who watch tv crime shows, who have never, and never will walk in your shoes to face what we face every day. These are people that make me want to puke.

The officer, with financial help from FOP, should file a civil lawsuit against COPA for slander or defamation of character. Bring suit against each COPA investigator personally so they can be held liable, Maybe COPA should be looked into, to make sure they base their finding on scientific facts and evidence that is beyond any doubt, and not the eye witness account of police hatters.

Tribune story has more details on COPAs findings. Copa states that the officer wasn't in danger of being struck and that he fired from as far away as either bottom of porch or edge of sidewalk. Using Google earth, even if officer is at the gate, that is only about 6 feet from a bat wielding assailant. Yet copa states a "reasonable officer" would realize he's not in danger from this distance. Message to copa: you were never a police officer so how do you know what's reasonable and secondly, 6 feet away with a bat isn't that far. One step forward and your skull is being used as batting practice. So they are lying about how far the officer was from the offender. Copa also mentions the tazer and that the officer let his qualification run out. I know personally that trying to qualify some years is impossible. Range out of ammo or shut down leads to qualifications going past due dates to re up in timely manners. Secondly, why does this matter? According to copa, and our orders, a tazer can not be used on a subject who is on an elevated surface. By COPAs own findings, offender was on the top of the porch. Now I'm not a genius like copa members, but if he's on top of the porch, and the officer is at bottom, then isn't offender elevated? Therefore, by order, the tazer is not a possible force option here. But copa is not interested in rules, just being a political machine to Rahms whims. And speaking of Rahm, the old code of silence comes up. Odd since the mayor used the police department to cover his son buying weed. Guess the code and copa only work when it's in Rahms best interest. Police, your lives,are expendable. Take a bat to the head. Your life doesn't matter. That is the message of this copa charade.

The interesting here is that COPA, in it's finding states: "We find a reasonable officer in Officer Rialmo’s position would not have believed he was in imminent harm of death or great bodily harm at the time Officer Rialmo began firing his weapon."

How can COPA, a non-police agency, staffed by civilians and without input from sworn officers, make a determination as to what a reasonable police officer would or would not do in a specific situation? This is the inherent problem with COPA. They are tasked with applying the standard of what a reasonable police officer would or would not do in a given situation, but it is absolutely impossible for the investigators to make this determination without police experience or outside testimony from sworn officers.

The closest comparison would be a medical malpractice civil case. The standard of care that a judge or jury must apply is "what would a reasonable surgeon do in a similar situation." Typically, in such a case, expert surgeons would be brought in as witnesses and testify under oath, and the finder of fact would base their determination on the evidence presented. Unfortunately, it appears the police are not to be afforded this basic legal necessity.

This is the inherent flaw of staying fetal -- you can avoid traffic stops, street stops; but there's nothing you can do about the calls you're dispatched to. And this job grows more and more difficult, especially on patrol where seemingly everyone has a diagnosed or undiagnosed mental illness.

I don't know, is it better to avoid proactive police work but hope you're not the next person dispatched to a potentially deadly UOF incident? Especially with copa at the helm. Or proactively police, maybe earn yourself a spot as the TVB squad on tact, and avoid all these volitile situations on patrol?

Six good police officers and supervisors did it all by the book.
Six police officers charged with Murder.
Two years of hell, and they were finally acquitted.

I won't go as far as to say that, Francis.
Gray wouldn't have died if he were properly secured in the van, and he wasn't.
He wouldn't have sustained a broken neck if he had been properly secured, and he wasn't.
There wasn't enough evidence to put the blame on any one person, so all were acquitted without adequate proof of guilt.
I'm willing to bet every prisoner transported NOW is properly secured in all transport vehicles.
While I'm glad that none of the officers were convicted and sentenced, there were some issues concerning
Gray's transport that were/are troubling, and it doesn't take a genius to know that.

- LeGrier was a tallish, lanky stud. Easily had a reach of 30", give or take an inch or two.
Regulation baseball bats can be up to 42". Doing the rough math shows a +/- SIX FOOT assailant advantage for death or GBH to be a reasonable fear for the officers. I'm not even factoring in LeGrier likely closing the distance via advancement at some point during the brief encounter. Whether weapon was discharged from the base of the porch, middle of sidewalk or even the parkway is irrelevant in the eyes of a REASONABLE PERSON. If any of the UNREASONABLE COPA morons claim otherwise, I'd be happy to debunk the scenario they've fabricated via recreating same.

- New Years Eve will be upon us in two days. How many tactical Hair Gels will be crouched in alleys and breezeways at the stroke of midnight waiting for those on-view shots fired? I'm confused. COPA says he was not near offender at time of shooting based on where casings landed? I shoot a lot and if not for the booth walls deflecting casings back at you, casings could travel 5 feet easily. When I shoot outside they fly even farther if they bounce on rock or concrete. I smell something funny here and I don't think it's the po leez. Let's see the pics of the scene. I think a good forensic expert could get to the truth.

Read the entire COPA investigation last night, all I can say is wow. Be careful out there boys and girls, it doesn’t matter if you followed state law, inculpatory evidence and their perception of their investigation is all they are looking at to hang you. Know that they will dissect the decision you made in a tremendously stressful and chaotic millisecond with hundreds of pages of analysis down to inches or what step you took and when while being approached by a violent offender. Also note if you go to a scene and a subject approaches you with a long metal object that object is not a deadly or dangerous weapon “per se”. If your depiction of what happened changes in the slightest as you recover from the life changing and adrenaline filled event then you are lying and none of your account is credible. However a witness account from hundreds of feet away of an individual who was out partying all night and stated he was with a friend, who it was subsequently discovered had not been on this earth for several months, will conversely be taken into account to prove your unjust actions. Once your testimony is deemed not credible due to inconsistencies in your perception of the events, elements of your account will be labeled as not possibly occurring despite the fact there were no other witnesses to prove or disprove that fact. If no one saw it but you, it didn’t happen. If your partner saw or perceived something differently than you your accounts will be deemed not credible. If you have the same account as your witness every step will be taken to prove that you colluded and conspired to hide evidence or obstruct the investigation. If another witness did not see the events take place their account of what they “think” happened will be cited in the investigation to prove or disprove your actions. Lastly in this type of investigation your actions and guilt or innocence of the charges at hand are based on a simple “preponderance of the evidence” basis and not the “beyond a reasonable doubt” standard. Your career, assets, livelihood, financial well being, reputation, safety and possible freedom may come down to the standard of “more than likely”. In a court of law all of the alleged facts can be disputed by your counsel. Here the alleged evidence against you is made public and your side of the story will not be heard. If you think this is not railroading someone with less rights than the average citizen see if a defense lawyer is allowed to publish his defendants detailed account and their exculpatory evidence proving innocence for the court of public opinion to see. It won’t happen, but transparency is apparently one sided. This post is for information purposes only and does not claim guilt or innocence of involved parties as all of the facts are not fully evident. Watch where you step.

Folks, although this is very disturbing, far worse is yet to come for street cops that are put in harms way every day. COPA is a fire breathing dragon that will scortch the CPD. I saw the news report the early morning of the shooting around five thirty AM I believe the two girls interviewed were the daughters of Mrs Jones and they told the reporter that Mr LeGrier came down the stairs swinging a bat. After that initial interview never saw it again on the news because it doesn’t fit the news biases against the police hope the officers attorney can get a copy help in his defense,some getto lottery lawyer probably told them to dummy up. this shameful

Simon and Garfunkels song "the Sound of Silence" is playing in my head now. Its because I'm also thinking of our union and it's leadership, or lack thereof.
Because I'm contrasting our union against the NYPD union and the aggressive, "stick up for the troops" tactics their president employs. The socialist Mayor DeBlasio also employed an anti law enforcement agenda to endear him to the low info voters, and which ultimately led to the blood of slain officers on his hands but the NYPD boys, God Bless them all, didnt cower or back down or remain silent, the went on the offensive, and their courageous actions in the days following the murders of their brothers and sisters made me proud to have been the police for 31 years.

And they didnt stop there. Their union President has mobilized a squad of officers to follow DiBlasio around on his campaign trail across the country with billboards setting up protests to make sure that the people of these other states know just what kind of a despicable person he is. These officers are not masked or attempting to conceal their identity in any way. Do they fear reprisals? Perhaps. But they also know their union and its leadership will fight tooth and nail for them.
Something that our union has no stomach for.
The silence is deafening.

Officers need to actively fight the COPA clout machine. I don't mean sit at home and beg for FOP to get them a lawyer either.

As many Detectives know anyone can be sued. You sit in on interview or inventory a video from Burger King and you can be fired.

So who is to say you can't file a lawsuit against COPA investigators?
On another note a lawsuit is currently floating through which has a DISTRICT attorneys investigators being sued. THEY AINT LAWYERS it falls under FED law federal law 42 U.S.C. 1983, which states that "…[e]very person" who acts under color of state law to deprive another of a constitutional rights shall be answerable to that person in a suit for damages," and provides a means for those wronged by government officials to file suit in federal court.

Keep in mind that DAN Herbert lawyer for the FOP doesnt do FED lawsuit.

Preponderance of evidence = more likely than not.

RR says he sees QL swing bat.
Nobody saw him NOT swing the bat.
TL sees bat raised but looks down and does not have him in sight at moment he is to have swung.

Reasonable person deduces he probably swung the bat, having NO evidence to refute the claim.

COPA determined RR lied and TL would have seen him swing if he did.

430am Christmas night violent subject advancing on PO from his house to a distance within 10ft holding (or swinging) a bat -

Normal person deduces bat may be used as weapon.

COPA determined bat is a sporting good and without any further indication of its intended use, is harmless within 10 feet. What's more disturbing is they take into account his path of retreat was unobstructed. WE HAVE NO DUTY TO RETREAT, in fact it's quite the opposite.

This shooting, with today's taser order and force mitigation order, would be MORE justifiable. Elevated position - no taser, advancing armed subject, no time to employ principles of force mitigation.

This totally sucks.

Not a cop but served in the military. When we stood watch deadly force was authorized. I never had to use it but I did see some shit go down with the Marines. The Marines guarded our submarines when they were being loaded with missiles. It did not matter if you were a member of the crew, if you cross the yellow line, that was your ass plain and simple. One asshole decided to test the Marines. Wrong choice. They beat his ass bloody. Now let's apply the same rules here. Some fucker comes at a cop with a bat, knife, dog, or in a rage. Deadly force is authorized period. You cannot talk a person down. Take their ass out. Period. End of fucking discussion. As a former Homicide Detective I believe that this shooting proves on glaring fault with the FOP and how they handle Police Shootings. the fop should send out EXPERIENCE LAWYERS TO ADVISE THE SHOOTING OFFICER and what I mean by experience lawyers I do not mean the jackoff attorney that is representing Janson VanDyke. After reading the tribune article if the article is true(????) then I think that before the Officer gives his statement he should have been made aware of the conflicting statements. I am not suggesting that an attorney can 'MAMAGE" all the statements but he/she can get all the facts and circumstances correct so the shooting officer's memory reflects the incident. This shooting is another example of having a cooling off period just like the FBI has(24 hrs. cooling off period). The FOP should immediately request a meeting with the head of COPA and he Superintendent and clarify when a Officer can and can not use deadly force.

Thankfully and gratefully retired after 30 years. This is so sad and sickening.

While CPD may not have been perfect, it was a decent and honored department. A few bad apples to be sure. What department doesn't have those? (Other than the FYI which covers them up)

People with no knowledge, experience or interest in police operations are sitting in judgement of split second life/death decisions. And flushing careers.

Chicago is doomed.

If the officer is fired, the move to defend the police might not be a bad idea. If no one is doing any police work, why spend the money?

This assignment should have been handled by City Mental Health Department.

There is no head of COPA. The Chief Administrator, the First Deputy and the First Deputy's replacement all quit between May and October. It is a rudderless, out of control agency. Also, someone asked if the COPA investigators ever fired a gun. Have you seen their photos? There's a couple who might have military service in their background, but the rest look to be deserving of an I.R. number or will be needing a diaper if they ever hear a loud report. Fuck COPA, 9.5 and SpecialEd.

I think that you might be right on this. It seems that COPA is becoming bigger then its britches and might just run away with the train. Any attempts to curb them will result in the organization going to the media. Stopping on duty officers and chastising them on their driving is a telling sign. I think everyone knows what their recommendation will be in this double homicide and what the superintendent will do and what the police board will do. It is appeasement to the hoards crying for police flesh
