Out on Bail, Out of State

  • An Uptown man who has been awaiting trial for multiple weapons cases in the North Side neighborhood has died in rural Calaveras County, California, after he jumped from a moving SUV that had been used in the robbery of a large marijuana shipment, according to media reports.

    Donter Essex, 29, was free on bond while awaiting trial in Chicago for two separate gun charges in Uptown. Now, it looks like he took his criminal show on the road while Cook County’s wheels of justice turned.
Correct us if we're wrong, but one of the conditions of bail is to not leave the state, especially in the case of a felony charge. You'd think with Class X felony charges, bail might be a tiny bit high, but no.

The California report is a marvel of understatement:
  • The robbers sped off in the pot-filled van and several other vehicles, including a Range Rover that was driven by Essex. Minutes after the robbery was reported, a local deputy saw a caravan composed of vehicles matching those used in the robbery.

    When the deputy and the California Highway Patrol tried to pull Essex over, the Chicagoan accelerated and then “exited out of the Range Rover while it was still traveling at a high rate of speed,” according to the report. Essex was pronounced dead at the scene, and robbery evidence was found next to his body.
We certainly hope there is in-car camera video of this event and it ends up in a highlight real somewhere. But how did he even make bail on these charges?
  • Back home, Essex has been awaiting trial for throwing a gun onto the roof of an Uptown Dunkin’ Donuts while being chased by police. He was charged with Class X felony armed habitual criminal; felony unlawful use of a weapon by a felon; two felony counts of aggravated battery of a police officer; two felony counts of resisting police; and misdemeanor resisting arrest. A “friend” posted $10,000 for him to go free awaiting trial.
Nice system you got there Tommy, Timmy, and Toni.

This is amusing without a doubt. It would only be better if they found a CCSP ankle monitor on his dead broken ankle in California which makes me wonder, just how far away from Cook County do those things track people and what is the farthest point point dude has been tracked. Anybody know?

Crooked Cook County, who knows, probably has a furneral fund for those bond.
It’s all about apologizing, understanding and forgiveness, understand.
The fambly will likely file suit for CC letting that boy out of jail without offering him some sort of program to enter to help him with his disabilities. So that $10 G is retainer seed money and likely your Corrupt Cook Co States Atty already provided a preferred law firm with the particulars to represent the estate.

Habituous Corpuscles - bring forth the body and let the CC Cornoner confirm the demise of the boundless urban terrorist.
And upon confirmation, purge his welfare entitlement and remove his likeness from the Chicago voter registration.

all want to see these Df's out on bond for these gun cases because in all likely hood they are a lesser of a nuisance within the confines of the Cook County jail and Circuit Court of Cook County courtroom case load docket...

I don’t know Illinois law on bail (I’m in Florida), but usually bail is forfeited for a failure to appear, but being dead is the ultimate of “Unavailability”. I ve never have someone die out of state while committing another felony.

I think this is a great case for a prosecutor to try to get the bail forfeited.... even if he doesn’t ultimately win, the facts of the case will make the courts squirm, and maybe it will advance the cause a bit.

Motion to forfeit will depend on conditions of release set by the Court, including any paperwork given to defendant or the guy that posted bail.

If this was a bail bond situation, the surety is at risk for full amount, not just premium paid.... they then can go against guarantor, who typically has to show collateral for full amount.

Ultimately bail bondsman or someone has to sign to get him out, and their liability depends on wording as well.
