Why the Courts are F#$%ed

Here's how the Cook County Court System operates....and probably 99% of people don't pay attention enough to realize what's going on:
  • Michael Gentry has received two year’s probation for burglarizing a Wicker Park home in August 2017. Notoriously, Gentry was located by police because he took time to stop and masturbate in a nearby gangway after breaking into the home, according to prosecutors.

    Judge Lauren Edidin approved the plea deal that reduced Gentry’s charge to attempted burglary. His sentence will run concurrent to another two-year probation term that he received for head-butting a glass window in the Leighton Criminal Courthouse last year.

    A Wicker Park resident called police around noontime August 13, 2017, after he saw Gentry enter his home and steal an iPad in t But instead of he 2000 block of West Le Moyne.
That isn't "attempted" anything. He successfully entered a dwelling and successfully completed a theft, i.e. Burglary. But instead of getting prison time, where he might actually be deterred from committing additional crimes, he gets probation... and is free to commit more "attempted burglaries."

Well how about on paydays we attempt to pay asswipe judges like this and see if they get the message! Yeah like that has any chance of happening in CROOK COUNTY COURT!

So anybody know, under the criminal code of cook county, just how many actual burglaries get plead down to attempt and just how many attempts do you have to have before you go directly to jail do not pass go...LOL...its a game right!

Does anybody know if they have had murders that they plead down to attempt and gave probation? That shouldn't have happened but WTF if they give probation or supervision on an actual burglary, I would say its possible using that mentality!!!

I don't think that Burglary for the sole purpose of financial gain is what this creep's motive was. Him masterbating in a gangway right afterwards could very well be because the whole point of the Burglary was because of some sexual hangup. Some sex offenders start off like this until they eventually break into homes and commit rape and sometimes murder. Hopefully I'm wrong.

Meh—JVD’s goose is cook. Alan Dershowitz said he looked at the case and in case of using LQMD had a knife and JVD feared for his or other offices safety; does not justify 16 shots or shooting him while he was on the ground.

But JVD could blame the department for shit training and shit work environment that failed to provide the option to seek proper mental care... if Alan Dershowitz is telling you to play these cards— I would do exactly that— and have all the assholes from Ram to Escamonte give testimony at the trial... maybe Ram would pull a few strings to have this relocated to a better venue

Burglary? If a resident is present in the residence, at the time of the illegal entry and subsequent unauthorized removal of property; isn't that a Home Invasion, which is a Class X Felony? Is this unexplained and unwarranted leniency part of the Restorative Justice theme, that there are too many people of color in American jails and prisons? Even Quitter Rahm's wife showed this leniency, when she refused to aggressively pursue the prosecution of her son's dope dealer. It appears that this is some sort of Democrat Party White Guilt, most prevalent in Cook County, which is run by Black Democrats. I am quite confident, that if this had taken place in DuPage or McHenry County, the sentences would have been consecutive, and long term. If there was ever a reason to be armed while residing in Chicago, this case is a Clear example. With cops intimidated to the point that they are reluctant to stop anyone, and Courts reluctant to incarcerate felons; citizens are on their own for protection and justice! Identified by victim and DNA at scene. Rock solid case. My guess is the victim did not want to testify in court and they had to make this plea deal. If the victim doesn’t show up at trial they are forced to nolle the charges and it’s basically a not guilty.

Ole boy ripped off that iPad and took off, but had attended church just a few days ago, and had a bit of a moral dilemma regarding the theft. So while he paused to reconsider, he noticed a hot girl in the neighborhood and decided to rub one out to set his mind straight...

And then the cops showed up and arrested him. If only they'd given him a few more minutes, he'd have put the ipad back and all would be right in the Universe again...

Fortunately the Judge saw the Light and decided to give him probation. Now he can go on to finish Rocket Scientist school without a black mark on his record.

The democrat strategy is a sword with two edges.

The democrat mentality is that their strategy cuts only in their favor, as in, a single edge.

This single edge is the equal application of the law, as enforced, upon all events of a crimnal law violating nature occuring.

The adjudications subsequent to the equal enforcements of said criminal law violations are rendering the democrat strategy effective, only as long as the enforcement of criminal law remains equally applied.

The demcrat strategy is rendered nulled and void when law enforcement, utilizing discretion of office, cease enforcing violation of criminal law on a situational basis.

Three theoretical examples:

1. Verified by criminal history mutt is found deceased. Tentative apparent cause of bodily disconecction by violent means. Determination: Case closed. No further law enforcement action required.

2. Dispatched to Shots Fired. Upon arrival, multiple gunshot victims present, both deceased and not yet deceased. Further inquires produce little to no informations deemed helpful to advancing investigation. Determination: Case pending further developements.

3. 911 call center receives multiple reports of shots fired. Dispatched arrive, search area designated, observe nothing significant to dispatched purpose, return to beat patrol. Determination: 19p.


Regadless of what events have actually occured, the edge of the sword the democrats think does not exist, the edge that cuts the democrat deep, is the edge that the consistent application of law enforcement discretion can supply.

The citizens will provide the sharpness of that edge.

Those who do not, will remain future slaughtering potentials.

Those who do, will be the edge of the sword that cuts the democrats to shreds.

The law enforcement officer is the decider and determiner of this.

Always.

I pinched a guy for car burglary once. He fit a description the witness gave and when I stopped him I saw the items, ID'd by the victim, in the bushes near his feet. At the station he bragged about how breaking into cars was his specialty, as his sheet attested to. The judge let him walk. In his mind the fact that I didn't see the shit in his hands was "reasonable doubt" and he didn't find his incriminatory statement credible. Remember that next time your car is broken into.

Fuck it, after that I just started going to the hole with the rest of the watch.

I recall back in my college days I had a professor of criminology who told us that burglary and sex are often intertwined. He talked about burglars committing sexual acts or defecating inside the victim's homes . I thought that this was funny and I doubted him. That is until I came on the job and saw it first hand for myself.

Isn’t a burglary upgraded to a robbery, when someone is home? If the occupant is injured, it’s a home invasion! How many case reports were changed to criminal trespass, or theft from building? How many burglaries were not processed by E.T.s? It’s basic crime killing 101.

The blame for this rests with the ASA!!! ASA reduce the charge to move the case off the docket. The judge goes along on the plea deal. This is the direct result of a ASA who do not want to try cases. They are afraid of their own shapes. The ones who weren't, tried cases and enforced the sentencing laws. Unfortunately, they were "asked" to leave by FOXX and company.

Alan Dershowitz is most certainly an expert in the law, you have to give him that. The question is "has Alan Dershowitz ever been in a comparable situation". Those of us that have served our country in war and those of us who have been in a comparable situation on the street, know just how fast one can empty a fully loaded 9mm clip.

There is a term that explains exactly what happened that evening. It's called "in the heat of battle". When a Policeman fires at an offender, it is NOT a thought process, you revert to your training and act!

Some of you remember when we trained shooting at Soldier field.? (1970's) We were told to put the expended rounds in our pocket, so as not to litter the venue. That is until they started finding dead Policemen and Troopers with 6 empty brass casings in their hand. Most of us at that time carried revolvers.

THEN they attempted to retrain us to just let the brass fly! Too little to late, under extreme duress one doesn't think, the brain reverts to previous training, as in this situation!

Remember that term LEO's: "IN THE HEAT OF BATTLE". I've been wrong before (lots), please just keep that term in mind, it just may make the reasonable doubt we are hoping for in this upcoming trail.

I caught a Burglar on a Construction site, He had the property in his car trunk and burglary tools,He had 50 prior arrest's including 6 felony conviction's,He pleaded guilty to attempt and got a year on house arrest.

I believe we have a judicial problem starting at the very top, Chief Judge Tim Evans, he orders judges under his command to do such things as lower bonds. When judges refuse they are removed from bond court. However in cases such as this the prosecution, under Kim Foxx presented this deal to Judge Edidin. In Cook County rarely has a judge refused a plea deal agreed upon by both the state and defense.

This has been a common practice since Foxx took over. Reduce charges to a crime that does not require jail time, have the defendants plead guilty, and give them another probation. This avoids black/brown people in jail (Preckwinkle self admitted goal), show a high conviction rate by a new states attorney (will be a platform that Foxx runs on in her re-election bid), and it looks like a incompetent ASA can quickly dispose of a case with little work. EVERYONE WINS EXCEPT, the good hard working people, the tax paying people, and the VICTIMS of these criminals.

KEEP VOTING DEMOCRAT and this is what you will keep getting.

Why? The states attorney is the one who suggests this plea deal. The judge then goes along with it 99.9% of the time. This is done because the state may have a weak point in their case or they simply want to avoid a trial and the time spent to conduct one. Not the judges fault in this case

A vehicle was stopped for a traffic violation (PC). During the stop, the man reaches to an specific area where gun and drugs were located later on in plain view. Proubable cause was found in in court hearing. But in the trial at 26/cal, The man is found not guilty and the asa said the officers did a great job testifying, and said because the officers did not see the man holding the gun he is not guilty, when he was making furtive movements towards that area as he was attempting to conceal what officers feared to be a weapon, and it was a weapon and controlled substance, but who in their right mind would hold a gun as the officers approach, the man did what most criminals do hide the evidence. Judges at 26/CAL are throwing away all cases like they don’t care. I keep hearing more officers loosing their cases (good cases). And when they are found guilty they get probation, supervision, house arrest, but no jail time. what’s the point of police doing their job?

Why is everyone so upset. You all know there are too many people of color in jail now. So the have to let them go. Your job is to see that no more people of color have to face any judges. See how easy it was to fix that problem. Look the other way, turn the other way and be sure to obey all traffic laws. No chasing in cars or on foot. God forbid never pull your gun. Just slow roll fill out reports collect checks. The pen is mightier then the sword so bury them in paperwork.

What about a judge who informs an offender with a warrant when he exits the court room, the police will be waiting out there to arrest him. The judge said he felt he needed to disclose that to the offender. He didn't want the offender to think he was getting jumped when the police arrested him. He even told the offender that the police are probably waiting around the corner. Branch 23-2. Wouldn't this put an officer's safety at risk? Guess the judge didn't care about officer safety. Outrageous.

I don’t see how you blame judges when it’s the State’s Attorney office reducing the charges. Judges can’t prevent the state from reducing or dropping charges. Talk to Kim Foxx. Prison isn’t a deterrent for any of these mutts that have already been in. They have a recording studio, pizza parties, cable tv, etc. All prison does is keep them in a place where they can’t break into houses.

And I’m fine with that. Start making jail a real cheap operation to run. Eliminate the food luxuries. Instill mandatory, not optional, work duties. No TV. No internet. No recording studios. We could open up all the closed wings of the jail and fill it up. Same with the prisons. Make people serve the entire time, for the actual crimes they commit. Only then MIGHT jail be a deterrent. But at the least this filth will be off the streets.

If I am correct, many years ago part of the statute of Burglary included the phrase "under the cover of darkness." No, that is common law burglary. Statutory burglary does not nor did ever require this element. See Ohlin, 2016 and Dressler, 2012.

Not in Illinois. Was never part of the Illinois statute
