Open Post

The usual (and expected) reactions from all segments of Chicago are easily located in the news links over on the right.

The verdict was a disappointment on many levels, not the least of which is every officer from this point forward will be judged (and convicted) on a shot-by-shot basis.

During the Iraq war, did you ever have the unfortunate experience of watching the news when a US or allied pilot was shot down over enemy lines? Enemy soldiers would take the pilot’s body and beat it to an unrecognizable pulp and then parade and even drag the body across the city for all to see. Men, women, and children came out in throngs to celebrate and cheer the savage scene.

That, my friends, is happening right now before our very eyes. The body that is on display is not just van Dyke’s. The body being dragged through the streets is every good and honest police officer. The battle is over and the enemy has won. I dare say they are winning the war.

I’m not a police officer, but I stand with you all. And there are many of us who stand with you. We are dismayed, saddened and angry. To you SCC, to all officers, to Jason van Dyke and his family, may God be with you.

As hard as Herbert tried, I think he was in over his head. It’s sad to think with the FOP and the insurance policy to protect van Dyke, there weren’t enough funds available to pay for an A+ team. Let’s be honest. Herbert was a C+ or B at best.

Stop and think, how much more did the state spend on their case than FOP/van Dyke spent? I wouldn’t be surprised if the final bill for the state is 3 or 4 times what van Dyke’s final bill.

Keep all this in mind when you make a risky decision. "How much funding would be made available to protect me???"

So if this situation happens again do officers just stand around and wait until a citizen gets injured in some way and then take action? This way at least an officer can say he was defending someone’s life. Or are we supposed to just taze him and hope that doesn’t kill him?
FOP needs to have a press conference and warn the public that we will no longer be taking a pro active stance anymore in these situations. We will just wait til someone gets hurt then react.

Since this is open post...if you’re in serious need of legal representation, seriously consider someone other than Dan Herbert. He may be a nice guy, may have been the police, etc...but he is not the guy you want if your job, or your freedom, is in jeopardy.

Just my two cents, I think this was seen at first as a property crime, then, secondly, since after the first shot, he was down on the ground, not fully getting up. Then the fact he had a knife, was not shooting at him. But, I get nervous, for coppers and citizens, do we need to be hurt before we can shoot? Does someone else need to be hurt before we shoot? How do we deal with the shooter in Rogers Park Neighborhood, cops will worry about conviction if they shoot. But police must still serve and protect. How to reconcile the two?

Dan Herbert has done a lot of food for coppers with beefs and police board stuff but he shouldn’t have touched this trial. A seasoned trial attorney had a good chance. Dan put his whole life into this and I thank him for that. Not knockin him one bit and I hope he continues to help coppers on the administrative stuff but this case was unique and needed a one of a kind attorney. They need an appeal for the change of venue and the decision which was based on opinion as stated by interviewed jurors who “thought” a lot of things, not based on law but hunch. Please FOO reach out to state FOP to fund awesome attornies to appeal all of this. The entire world of policing in this country depends on it. It needs to start with motions before sentencing to appeal the verdict in itself in that it wasn’t based on the law.

You cry tears of joy over the conviction but never tears of outrage or sadness when children are gunned down? 10 people killed, 20 shot every day and not even a word, and no call for justice. Does it only matter or count when it's an officer? Is the reason you care so much is because it fits your insane narrative that all white officers are racist? You can't have it both ways.

So now "Da Komunity iz satisfied"; not on your life! This verdict in essence said that the use of a firearm against a knife, by police, is not justified! NONE OF THE 16 SHOTS WAS APPARENTLY JUSTIFIED IN THE MINDS OF THESE 12 CITIZENS TO DUMB, TO AVOID JURY DUTY! So does the officer have to be cut or stabbed before the firearm is justified? And then, must the injury be lie threatening, or just life altering. Perhaps, the female officer in 015, who took a beating, causing permanent damage, is what is expected of police these days. Remember, she said she did not shoot for fear of the Media and what would happen to her family. So if an unarmed assailant, who is bigger and stronger than you, is on the verge of beating you into a vegetative state; he cannot be shot by police, because he is Unarmed? The verdict today has set a dangerous precedent for police service. Oh, and what about the Blue Wall of Silence? Jason's partner's quoting Jason's alleged statement about possibly having to shoot this guy, was the deciding factor for at least two of the jurors. If there is a Blue Wall of Silence, the copper, testifying under immunity would not have said what he said. AND I HOPE HIS ATTORNEY TOLD HIM THAT THE IMMUNITY AGREEMENT DOES NOT NECESSARILY MEAN HE WILL GET HIS JOB BACK. And finally, consider that there was no Sergeant or lieutenant on scene. Is it possible to see Vandyke as taking control and attempting to Stop a situation that had the potential to be out of control? The harshness of this conviction exceeds reason. Meanwhile, Rahm and every Exempt, who covered up the video, walks free! THIS THEATER OF THE ABSURD HAD NOTHING TO DO WITH JUSTICE, THIS WAS ALL ABOUT POLITICS, AND HUMAN SACRIFICE. VANDYKE WAS SACRIFICED ON THE POLITICAL ALTAR OF RACIAL POLITICS. AND ANYONE OF YOU WEARING A STAR COULD BE NEXT. You have no friends, especially amongst the public. Ofc. Van Dyke was tried and convicted in the court of public opinion long before this cast even went to trial.

He didn’t have a chance for a “fair trial “.

I never comment on this blog but today marks a very sad day for law enforcement in this city. This verdict gave me an extremely sinking feeling and sickness to my stomach that I have never experienced. Van Dyke never had a chance, he was found guilty months before the trial. The jurors were totally ignorant of the evidence and what goes through in a split second life/death situation that a police officer encounters. I believe this case will set a new precedent for how police officers will be judged.

Van Dyke represents each and one of us. What is extremely difficult to accept is that this can happen to anyone in law enforcement. It has unfortunately happened to poor Van Dyke, I can not imagine what he and his family are currently going through.

Van Dyke was 100% sacraficed by the politicians to appease the community. It really makes me sick that this is the time that we live in.

If you can, help his wife and kids. I believe they have an account at the credit union.

1. But for Law Enforcement Officers, the riff raff would no longer possess the animating factor so vital to their riff raffings. Aka, they'd be fucking dead. I know I certainly hate to judge someone else on the job when I wasn't there but that video was damning. McD wasn't moving towards anyone in any real threatening manner when he was initially shot and then he appeared to keep getting hit by shots when prone on the pavement. It would depend on what Van D says was going through his mind and he apparently didn't sound convincing (I didn't see the testimony). I saw no apparent reason for the shooting at that time. Knock him down with a car door or something. It always appeared to be a bad shoot and appearance matters.

Monitor Zone 10...I guarantee within 24 hours there will be some less than 5 years otj asshole chasing some ghetto jerkoff for some ghetto bullshit. If we all stopped doing ANYTHING proactive and just did the bare minimum that is required of us by law and general order the city officials and citizens will see just how dangerous it is to not support us. According to the juror interviewed, he did what he was trained to do. Translation - the department trained you to respond in such a manner that will make you a convicted felon facing years in the joint! I hate to say it coming from the blue family but he sealed his fate by testifying he contradicted what the video shows. Poor judgement by one officer will lead to the loss of what 4 others too for trying to justify his actions. Both sides are at fault. The kicker is 13 years and he failed but still not learning to keep his mouth shut and refrain from comments like we are going to have to shoot this guy

What I noticed from today's "celebratory march" (obnoxious mob) that obstructed people trying to get home from the downtown area was the finely printed signs that had the website caarpr.org. This is the Chicago Alliance Against Racist And Political Repression. These signs were held not by "poor souls" but by people who knew what they were doing. It seems they are sponsored by the Crossroads Fund 3411 W. Diversey which gives out grant monies to all kinds of activist groups in Chicago and promotes progressive community change. It is unclear where they are getting their money as they don't reveal that information. Remember this when you are putting up with these groups at demonstrations because they know who you are but you don't know who they are.

I learned during this trial that this department is full of individuals who only care about themselves. I especially would like to thank those officers that testified that they didnt shoot because they didnt feel threatened, is it true that maybe you didnt feel threatened because you had no intention of even getting g out of your car and handling your own job? Is it tru that this incident with Laquon McDonald went on for quite some time before Van Dyke showed up? Why didnt you lazy POS s get out of the car and handle your business? How can you say that the verdict was a disappointment? There was only one verdict to be had, based on that video. I'm actually surprised that the jury did not go for 1st degree murder and official misconduct as well. Officers have to understand that the days of making every police shooting 'justifiable' are over.

ANY copper who has been in a shooting in the past 10 years should be worried the way cases are being re opened..,. This could have happened to anyone of us...they just hit retired homicide detectives with punitive a few months back.

Jurors comment that VanDyke should have stayed in his car and not “escalated” the situation. So because he didn’t cower he’s guilty of murder? Wow prayers to everyone at CPD. Hopefully an appeal is in the works. The fire breathing bitch prosecutor and biased judge should ensure another go at a fair trial. I guess we can assume that every gangbanger will now be prosecuted by shots fired? Right!

Ever since this blog has been up and running I can count on one hand how many times I've posted something, but with today's verdict I feel I should. For the past two days I've worked 3 hrs o.t awaiting this verdict and realize I'm benefiting from this all while Jason in essence is fighting for his life and my biggest decision is which box to check, money or time. I can't in good conscience take this money. No matter what you think about the number of shots fired, the fact of the matter is is anyone of us could get thrown into a situation like this where the outcome isn't in your favor and your thrown to the wolves. I figure the amount of money I made these past two days is around 330.00 which I will donate to the Van Dyke family and I hope some of you will follow suit.

We have been relegated to 3rd class citizens. Would any normal citizen even have been brought in for questioning if they shot a crazed knife wielding man that was coming at them? No fucking way. They’d be applauded and treated as a community hero. Yet JVD get murder conviction and a ruined life. I’m tired of being treated less than a normal citizen. We don’t even realize how much power we have if we just stick together. It’s time for us to start sticking up for ourselves. Whatever that takes. I’m sick and tired of the way things have headed the last 5-10 years. We need our unions to do something drastic. Organize something that will remind the citizens just how important we are and if you fuck with us for trying to protect you, it is not a good idea.

The verdict is an affirmation by society of the hidden philosophy of politicians that it is easier to fire, jail, or bury a Policeman rather than defend them.

Adjudication is not only to be accepted but more importantly interpreted.

Do not trust: the department to defend your police action/investigation, the prosecutors to consider the perils of your vocation when charging you, or a trial to judge your time constrained police actions with anything but hindsight.

Use of Force is violence. Violence is never photogenic. Non-compliance will not be explained as a death by misadventure. Non-compliance is a cultural flaw you alone must mitigate flawlessly to avoid your (others) termination, incarceration, or injury/death.

We are lucky to have gained wisdom from our work whereas victims must pay for it in their pain. We know Evil walks our Earth and are willing to confront it. Because of this fact, the public needs us more than we them.

I’m a Fillmore guy. The fact that JVD got convicted is vaguely interesting to me. When the jury comes back in that amount of time you knew it was going to be guilty. What pains me is watching his wife and knowing what his family has to deal with this for the rest of their lives...and for what...some ghetto bullshit that happens day in and day out. Nobody, family on down, gave a flying fuck about LMD until he was dead and became a paycheck... or a SJW war cry. JVD and his family are fucked because some ghetto POS did standard ghetto things putting the fall guy to be CPD. Another precedent has been set: from this day forward every offender should be charged with agg batt for every bullet wound in the victim. That includes if the victim is also dead! If the state says they can't charge agg batt because the victim is dead and there is a murder charge, tell them to go fuck themselves and charge them just like Vandyke. Detectives and their bosses especially must put full pressure on the Asa and demand it. If they refuse, then the union should be on the news everyday showing the disparity in the way an officer can be ridiculously over charged.

I’m amazed that you guys are raging angry about the verdict when JVD got a jury that his defense picked. It was a diverse jury that had absolutely no M1 representation, and included an aspiring p.o. This was no OJ Simpson murder trial jury. These were working class tax paying peers of JVD. Unfortunately the defense could not overcome the dash cam video, and the fact that their client was not credible to this jury. Guys we have got to be smarter. Even a change of venue would not have gotten a not guilty verdict - hell the jury gave him a NG on the one count and that made sense so they were asleep.

Not doing the job is not an option - you have to do it smarter and with greater restraint. Forget about all the guns, learn verbal judo, deep empathy, and how to strategically employ CPD orientated Jedi Mind Tricks.

I will be retiring in January after starting my career on June 16, 1986 with absolutely no C.R. Numbers, my stripes intact after ten years as a sgt with the same revolver I brought from a retired copper, and a smile on my face.

Too bad the Crook County Criminal Justice system will not judge weapons offenders on a shot by shot basis.

My opinion: I will win on appeal. 16 shots of Agg Batt and no Off Misconduct.
Hopefully Herbert and his team can also win on their change of venue motion.
I hope they subpoena every news stations interviews with every juror, those people convicted on emotions and not the law. Just listen to them answer some of those news media questions.

The state's attorney and jurors said he should have just stayed in his car. Just going to stay in the car until called. Work like firemen. Only answer calls.

I want to see what happens Sunday at the Marathon. On Friday CPD allowed protesters to block one of the most critical intersections in the city during the height of rush hour and did nothing. If they show up for the Marathon and try to block it, especially in several places along the route, I wonder what CPD will do? After all, you don't have to obey the law in Chicago.

THIS CASE WASNT PROSECUTED BY COOK COUNTY ASAS. This was a group of specially appointed ASAs who are from Kane County and Winnebago Countty. Charging per shot was unprecedented and doubtful it would be adopted as new charging practices by Cook County ASAs.

I have family who still live in the city including elderly parents in Edison Park, a brother in Norwood Park & cousins in Jeff Park. You could tell by the way the judge treated the attorneys which way he wanted the verdict to go. He was nothing less than a condescending prick to Van Dyke's attorneys, especially Herbert.

Caught the interview with the FOP President, he said it was disappointing and will be appealed. Not sure on what grounds? perhaps denying Van Dyke to move the case out of the county.

All the coverage I watched nobody really had an opinion on how much time Van Dyke will serve, seems to be a pretty big range. From what I understand he will do the time associated with second degree murder conviction will be served concurrently with the aggravated assault counts.

Be safe CPD and thank you all for the jobs that you perform under the most difficult, stressful circumstances, my hat is off to you.

Ever since this blog has been up and running I can count on one hand how many times I've posted something, but with today's verdict I feel I should. For the past two days I've worked 3 hrs o.t awaiting this verdict and realize I'm benefiting from this all while Jason in essence is fighting for his life and my biggest decision is which box to check, money or time. I can't in good conscience take this money. No matter what you think about the number of shots fired, the fact of the matter is is anyone of us could get thrown into a situation like this where the outcome isn't in your favor and your thrown to the wolves. I figure the amount of money I made these past two days is around 330.00 which I will donate to the Van Dyke family and I hope some of you will follow suit.

When I first saw the video I thought to myself, Man this guy's in trouble. But after the thousandth replay on the news, and the constant flashing of the little dirt bag in his cap and gown, the reality that this could be any one of us sank in. Bottom line is I wasn't there, I didn't experience that flash of a moment, the instant in time where a determination that something had to be done. And unless you were there, you're really not in a position to judge.

The other reality is that this family, accepted the $5 million from the city, without a lawsuit and the alderman all went along with it. Supervisors and administrative rank all signed off on it as a good shooting. And in the end, to save their own asses, they kicked VanDyke to the curb. All this political correctness, including a Judge who didn't give a change of venue to his chastising VanDyke for attending to threats made against his wife and child are things we shouldn't forget, ever.

The game is rigged and in that context, VanDyke truly got screwed. And nobody outside of this job will ever realize that.

I want to say first that I support cops more than anyone. I think you have a crap job and have to make very hard life or death decisions in the spur of the moment. I think the ACLU consent decree regarding Street stops was disgusting and the main reason why crime is up. I also can't stand Kim Foxxx and her light-on-crime mentality which is the dead opposite of what we need to be doing.

This all said, I just find it very difficult to justify what Van Dyke did. Shooting him once? Sure. But all those times? I don't know. I'm not saying the verdict was fair and I'm certainly not saying I can stand here and tell you what it's like to have to shoot somebody. But several other officers who were there did not feel a need to shoot. That has to be kept in mind.

Flame away if you will but that's my feelings on it. I will definitely be watching future developments though and I really hope it doesn't turn into a precedent where every officer is put on trial simply for using their firearm. But there has to be a fine line between letting cops do their jobs and punishing those very few who do use excessive force.

Initial poll of jury at end of trial was 7 guilty, 3 not guilty, 2 undecided. Magically within maybe 5-10 hours of deliberations all jurors were a concensus guilty. these charges mean guilty beyond a reasonable doubt. Five jurors suddenly became absolutely sure that jvd was guilty after a short deliberation. Two weeks of testimony, 40 witnesses, videos, defense and prosecution statements at trial. Were these jurors burned out and just said fuck it, he's guilty. Only they know.

Herbert is a good guy but in way over his head. That 3D video was idiotic. It actually hurt the case. Surprised that McMahon didn’t take advantage of it. Watched the arguments and can’t say that anybody was very good.

The Agg Batt will only become an issue if the sentences run consecutively. They won’t. The counts will merge. My prediction on sentence is low double digits 10-12 years.

I truly feel horrible for JVD and don’t feel any sympathy for Laquan or his family but I have to say this. Maybe those “lazy” coppers realized that the work environment had changed. There’s nothing wrong with buying time when dealing with a wacko and we do have to think what consequences our actions can lead to. This is not nor wasn’t a job in 2014 where you go out there gung ho and “take care of business” unless you wanna spend the rest of your life in jail. I remember years ago several squads were following a guy most likely on pcp walking in the middle of Western all the way from 14 district Division to 12 district around Jackson waiting for someone with a taser. We all still have jobs and our freedom. You cannot blame other officers for the actions of JVD. I never knew JVD so I’m not commenting on his style, but every district seems to have some po’s that have hard time with impulse control and seem to think that every situation needs to be handled immediately with force.

I am extremely bothered by reading some of the comments here on this post. I know there will always be varying reactions to various topics, but i find it very disturbing that many members of the CPD are defending Van Dyke til the very end and carrying on as if this is an outright miscarriage of justice. This is just as cringe worthy as watching a BLM protest over a justified police shooting that was caught on tape. It brings a sense of complete illegitimacy on the part of this blog and some of the comments downright disturbing. I understand that Van Dyke is a considered a brother in blue, but this is like watching a news clip of a mom describing how her son is such a good good boy while holding his 8th grade graduation photo after her son has been accused of a terrible crime. The video proved it all. I think if Van Dyke shot Laquan once or twice there wouldnt be the outrage, but to continue shooting after he was lying on the ground was complete overkill. Hunters dont even kill their prey with that much verocity. Stop defending this guy. The jury spoke and its time to move on.

Unfortunately for Officer Van Dyke the judge will make an example of him when it comes down to sentencing. From what I understand about the sentencing as it currently stands the second degree murder conviction at this point is moot. The aggravated battery charges carries a minimum sentence of six years and can go as high as 30 years.

The judge I felt was totally biased towards the State Prosecutor in his rulings and his general demeanor towards the defendant's attorneys.

My guess is Officer Van Dyke will receive a minimum sentence of at the very least 10 years. I think it will be in the 20 to 30 year range, and Officer Van Dyke will have to serve 85% of that sentence. He will most likely be in his sixties when released.

Be safe as possible CPD, and thank you for the job you all perform.

I don't think the defense lawyer had any impact. After listening to the jurors being interviewed, it was obvious they were not following Illinois law regarding police use of force. The one older white guy even stated "de-escalation" as to what Van Dyke should have done. Proof of how stupid they were is the fact they thought not even the 1st shot was justified. Case should get overturned on appeal due to him clearly being in compliance with Illinois statutes, and Supreme Court case Graham vs Connor.
What hurt Van Dyke was his statement to detectives, his testimony, and the absolute stupidity of the jury. How the hell can they possibly think zero of the gunshots were legal and justified?

If your going to charge an officer with 16 counts agg battery its a witch hunt and overcharging so see if states attorneys will charge a criminal with each round. Involuntary manslaughter and maybe official misconduct is what he should of been charged with. FOP should demand that in officer involved shootings they require 3 days for an officer to make statements like the FBI not in two hours of the incident. I think JVD got caught up in the whole thing and couldn't stop himself.
Yes, you shoot to eliminate the threat. At what point was he no longer a threat? Once he went down, the shooting should have stopped. Could have always resumed shooting if LMcD actually tried to get up and attack. JVD would not be where he is today if he had realized that or if his partner had tried to stop him.

This is the Chicago Alliance Against Racist And Political Repression. These signs were held not by "poor souls" but by people who knew what they were doing. It seems they are sponsored by the Crossroads Fund 3411 W. Diversey which gives out grant monies to all kinds of activist groups in Chicago and promotes progressive community change. I am still shaking my head about how Daley's nephew can get a change of venue but Jason couldn't. This had more pre-trial publicity. I only watched some of the trial but he should not have testified. The jurors also agreed.

I once was on a jury trial for a dui with a death involved. We were all on the fence until the defendant testified.

Hopefully, when it comes to sentencing the Judge has them run concurrent.

This was a Political conviction, plain and simple. When I saw the video the first time I saw a guy running down the street then reach into his right side pocket and remove something and then flick that something (knife) to an open position with his right hand. He did not throw the knife away, it was there in his hand. It appeared to me that this guy was getting ready for battle not to surrender. I saw the video through my police eyes, the jury saw it through filtered (by politics) eyes. I don't know what else to say. This guy was ready to fight with his weapon, the knife. I do not believe the jury was properly advised on how to see this situation after hearing the interviews after the conviction. They were supposed to see this through Van Dykes eyes or put themselves in Van Dykes shoes that night, not anyone else's. What the other officers saw or felt was irrelevant because they weren't there face to face with the guy with the knife. What I did hear from those jurors that gave interviews afterwards were democrat political catch phrases, "De-escalate" anyone remember that term? The political machine is alive and well in this city and fed itself with a good man who did exactly what he was trained to do.

Three & One and 1st Place in the NFC North. And rightfully they **could* have been 4-0 if not for a lapse in secondary coverage on a couple of the Packer's plays late in the 4th quarter.

I won't guess if last week was Trubiskey's 'breakout game' but he finally hit receivers, who finally got open -- could the Buc's defense really suck that much, or are Da Bears Receivers that good?? For now I'll go with the old adage: 'Never look a gift horse in the mouth'.

One thing that does appear to be an undisputed fact; The Defense friggen Rocks! Kalil Mack's energy has upped the play of everyone on the defense, so IMHO he's worth every penny he's getting.

BUT!...comparing them to the '85 Bears is a little premature at this point. However keep in mind that in the early part of the '85 season, the defense wasn't dominant like it was at the end of the regular season and into the playoffs.

One last thing, note how the Penalties are now mostly going Da Bears way than in the past. They're much fewer and when they are called aren't at critical times. False Starts, Pass Interference and Defensive Holding don't come close to how they were called in the 'losing years'. This was the same in '85.

On the scene of a shooting and only one officer fires does this call into question the legality of the shooting? Best advice just stay in you squad and don’t get out expect for lunch, personal, or going home. Expect this to happen again .....

Not everyone in the OEMC is a piece of shit. I saw the verdict somewhere else so I didn’t witness the cheering, but I believe we know who they were. Most of us have your backs and feel JVD got screwed. Stay frosty and safe.

A question: Was Mr. Van Dyke's police log/calls for that day ever in court?

I'm asking because I used to live in the 008 and the officers were short handed always going to call after call.

LaQuan McDonald was in court that morning the day he died. Seemingly he was always finding crime and had no life of stability at home since there was on home. I can't imagine showing up to a police call involving him...

It's really scary out here and i worry for my blue family. I worry for this officer in prison surrounded by the very people who hate police. Then if he comes out of prison, he will have a felony on his record.


My heart goes out to all of you.
