As Feared

  • Two felony weapons charges were filed Wednesday against a man who was being chased by two Chicago police officers before they were fatally stuck by a train on the Far South Side earlier this week, officials said.

    Edward Brown, 24, of Chicago, is charged with aggravated unlawful use of a weapon and reckless discharge of a firearm, according to the Cook County state’s attorney’s office. He was scheduled to appear for a bond hearing Thursday at the Leighton Criminal Court Building.
And we all know what a deterrent those charges are. We've all seen UUW offenders in the lockup mere days after getting out on a previous gun charge. Cook County "justice" has often been a joke, but under Crimesha it has become farcical.

Remember when they used to charge criminals if an officer had a medical emergency during a foot pursuit? Or when the actions of the offender could be proven beyond a reasonable doubt to have caused injury to responding personnel? You'd think firing a gun in a populated area would provoke a police response, and therefore fleeing into a zone of danger would be chargeable under the law.

Nope.

Agg discharge and he can be charged with murder. This is only reckless discharge so is not able to be upgraded to murder. For agg discharge you MUST have a victim or witness who WILL say they were being shot at so you can’t charge agg discharge without a victim. Reckless discharge can have a state victim as it’s just discharging the gun. It was charged appropriately in my mind and that’s after being a detective for 22 years. Reckless discharge is NOT classified as a forcible felony or one that may cause gbh to a person.. agg discharge has potential to cause GBH. So now you can only hope for a few things.. at indictment he will be charged with numerous felonies including felony disorderly conduct, felony reckless conduct etc. so, if found guilty a good judge is needed who will find him on all charges then sentence him CONSECUTIVLY and not concurrently so he can get anywhere from 16-30 years consecutive depending on how many he is charged with and what he is charged with.

I'm retired now but I've been in that room many times. I can only imagine the state insisting that it's two separate incidents and the train striking the officers was only an accident. I'm sure the detectives put up a good fight but the state has the last word. The state ignores the fact that the officers were only there IMMEDIATELY due to the offenders actions. Now I use the word immediately understaing the fact of electronic time lapse (shot spotter, 911 call, time to dispatch) but that's as immediate as an officer can get to while working on the street. Can anyone there chime in if it went down that way?

This is a tragedy on many levels. Two officers that had their lives taken from their family, friends and co-workers because someone feels the law doesn't apply to them. Another example of a felon defeating an arrest. Drop the gun...Stop. This doesn't happen! We all know very well that if the offender was killed by the train. The officers would be in jeopardy of losing their jobs, being charged criminally and a huge settlement would be on the way to the family. The City would just pay the offenders family a large sum of money and get rid of the officers involved. How screwed up is the thought process. Defeating an arrest of a fleeing felon. Those words don't mean anything any longer. JVD is the prime example that the State Law that is supposed to protect us all is not a Law any longer. I know the family will receive help from many different organizations, but it seams to me the City should be writing a big check to each of them at the levels that they approve for the offenders that die.

As for myself I am going to pray for the families of the 2 officers. I am going to find what i can give up financially to help the officers families.

Unfortunately, the Illinois Felony Murder staute does not allow for this person to be charged with any murder related crimes. No forcible felony was being committed at the time of this incident.

Yes, I absolutely would like to put 2 bodies on him and hope that he never sets foot outside of prison for the rest of his life. His actions are the direct result of two police officer's deaths. If you think otherwise, please quit.

You know what else people do when they commit crimes? They run, they fight police, they commit more crimes; they put the rest of society in danger by the very virtue of their freedom. And if you, as a police officer, attempt to take that freedom away and are killed while doing so, then I would also want that person to be in prison for the rest of their life.

Yep, every time I come into possession of a new firearm, I make my way over to the rail yard where commuter trains carrying hundreds of people to and from work go by every 25 minutes or so. So when I'm testing that newly acquired/found gun, the chance of an accidental discharge or errant shot would be sure not to hurt anyone. Some public defender came up with that line of bullshit. But God forbid an offender of color be held over before getting his electronic monitoring bracelet and I-bond, even if his actions resulted in the death of two police officers.

And that moron who lives on North Monticello with his social media comments on this tragedy ought to be throttled.

The whole point is that the offender can not be charged with the officers death, I Imagine the engineer was interviewed about what he saw before the officers were struck and in addition the train cameras along with the body cameras were viewed and if it is determined they were just walking/running on or by the rails before they were struck then it is an accident. If the cameras show that they were actively chasing the offender before they were struck then he could be charged in their deaths....apparently the video shows something that we are not aware of but it wasn’t enough to charge the offender with the officers death.

Things are really bad on swat. It’s hit or miss if we get a rifle that works. We hardly train and when we do it’s horrible.
It’s obvious our team is in very bad shape. We are being threatened not to reveal what is really going on over here. Now we are rotating watches every period. Not what I signed up for.

What is going on swat?

-Malfunctioning rifles because they are at least 20 years old.
-Ten rifles issued to us that would have malfunctioned, like the one did at Mercy.
-Lieutenant that has been promoted beyond his capabilities.
-Number 2 that made 250k last year and is the one of worst operators on the team.
-OT initiatives that do zero but check a box.
-Poorly trained Instructors that lead to poorly trained swat officers.
-Hardly any training because we the new guys have to rotate and man three watches.
-Poorly maintained equipment and now the team is missing at least 10 firearms that were loaned to us by ERPS.
-Back stabbing between team members concerning overtime initiatives.

What your saying about the accountability statute in this case is just plain wrong. The claims of the FOP in this instance are not consistent with the law. It sucks that these officers and their families or not getting some sort of justice from this tragedy, but the Felony Murder rule and the law of accountabilty just do not apply with the circumstances as they are now known. We can only blame the law as written, we can’t blame those who carry out its enforcement.

Yes I do want this offender to be held accountable. Just like I want every other offender held accountable. Just like the police are accountable. Actions have consequences. His actions, firing a weapon, resulted in a police response which resulted in their deaths. He needs to be held accountable. Police don’t patrol train tracks. They were up there investigating “shots fired.” Like other posters pointed out if the “offender” was killed by the train while police were in pursuit they would want the police fired, charged and there would be a pending lawsuit. But somehow we’re supposed to accept that this was a terrible accident and the offender didn’t mean any harm. This kid is going to end up with possible probation for actions which resulted in death of two people. Unfuckingbelievable.

At this point, I'm beginning to like the idea of a foot pursuit policy including factors when to terminate it. Society doesn't stand behind us. Yes I would like to see him in prison for the next 100 years! It’s called making an example of someone, like what is being done to police officers across the country. Why weren’t the 10 found to be defective prior to the Mercy incident?. Doesn’t SWAT have an armorer who checks them out? Were they test fired and did they jam?

Then shame on the Police Department releasing the press info that this guy was charged in connection to the two officers that died. Either he had something to do with it and charge him accordingly or he didn’t so it’s not related.

Had a bad knee Injury while wrestling with guy trying to place him in custody, said injury put me out of work for almost a year. Felony charges denied, misdemeanor resisting arrest. Even the judge was baffled as to why this wasn't felony resisting after watching the BWC.

Not agreeing with the logic but if a guy is beating his wife and the police are called and arrive on the scene. As they exit their car they get hit by oncoming traffic. Does the guy beating his wife get charged with two counts of murder with your logic if the guy wasn’t beating his wife the officers would be alive. You being a long time white hat, if you pulled over a speeder and stepped out of your car to write the citation and were struck and killed by another motorists, would the driver you pulled over be charged with murder.

Two very different situations with very different circumstances than what occurred on the RR tracks.

The wife-beater question can be written with more serious elements making it a situation where the wife-beater could be charged with the death of a police officer. Does the wife die or is near death? Does the wife beater flee? Is he armed? Is the police officer struck and killed by a vehicle while actively pursuing the offender and/or murderer? Is Crimesha in a good mood or a hater mood? Did she get a call from Bullshrinkle telling her to leave it alone? Lots of things come into play.

With the white hat question, as written, the motorist is not eligible to be charged with the death of the police officer.
