Eighty-One Months

  • A Cook County judge on Friday sentenced ex-Chicago Police Officer Jason Van Dyke to more than six years in prison for the murder of 17-year-old Laquan McDonald in 2014.

    Judge Vincent Gaughan sentenced Van Dyke to 81 months in prison, only on the charge of second-degree murder. Gaughan chose not to sentence Van Dyke on the aggravated battery charges, which carried more serious time and cut Van Dyke a serious break.

    With good behavior, Van Dyke would serve about half his prison sentence.
And right on cue, the usual suspects are up in arms, demonstrating promptly and thoroughly their complete ignorance where the law is concerned.
  • Activist Will Calloway, who played a role in bringing the now infamous video of the shooting to light, said: “It’s a slap in the face to say black lives don’t matter in this criminal courthouse.”

    “We want to heal . . . We want to be able to create better relationships between law enforcement and the black community,” Calloway said.
No you don't. Stop lying. No one cared about this kid until there was the possibility of a payday - which Rahm gave up to the tune of $5 million. Politicians across Chicago flocked to offer their carefully crafted opinions that they believed would garner them the most votes from the perpetually aggrieved. He was a Ward of the State because no one in the family or community could be bothered to step up - one of thousands currently bouncing through the system. How many times did McDonald overnight at his uncle's church? How many times did Calloway offer him a bed? Mom didn't even bother to show up in court.

Van Dyke was sentenced no better and no worse than a few hundred individuals who were convicted of similar charges. But he'll be used as often and as pathetically as Burge was - a constant boogieman used to frighten children and maintain the chasm of mistrust sought after by innumerable activists and politicians for their own financial and power-grasping ends.

That being said, be very very aware and vigilant over the next few days, weeks, even months. There are going to be incidents and provocations. We'd suggest extra special attention up north where the spree killer struck twice executing pedestrians on the street. Being fetal doesn't mean being ignorant of your surroundings.

SCC, I penned this after reading the Trib article about the jurors a few days ago and thinking about the Officers and everything else going on.


We are Doomed!

I watch a dog and pony show today. And it makes me angry.

And in the end we lost a man. We threw him under the political mess.
His family is now scarred, his friends deserted him. His profession was ruined.
All because he did something that he thought he was the right thing to do.

And all because a kid who decided he was invincible and could do what ever he wanted to do.
This kid died at the hands of this man and now became a martyr.

So now we lost a kid who was not smart enough to want to live any longer.
And we lost a man taking action when he should have walked away and let someone else handle it.

To look at this and say this has not effected me is wrong to say. It has messed me up. And probably others.

I was not there. But,

May god have mercy on the kid. Because that’s the Christian thing to do.
May god look over this man in the path he must travel now. Since everyone must get a second chance.
And may god direct me in the path of doing what is right when it is my time to make a decision?

When I was young I was invincible. But with age I have become fearful......

Although he’s going to serve at least two years, maybe less considering time already served, this was the best case scenario. If he would have gotten only probation the “community”, I’m sorry, piece of shit assholes, would’ve protested, rioted and raised hell. Now these activists won’t be able to put their names on anything because JVD was sentence to prison. Speaking of which, this isn’t going to be a full 81 month sentence. I give it until 2021 for him to get out and try and get his life back to some kind of normalcy. Guarantee you that he moves the fuck out of this god forsaken city.

Another win is the judge stopped that bullshit of a charge of Agg Batt per shot...please what a joke from the start.

How did Sheriff Dart get away with firing Van Dykes wife on the first day of training in the academy to become a jail C/O. Has she filed a suit? That is blatant discrimination.You can't penalize someone because they are related to a convicted felon. Dart should know better, he's a lawyer right.

If you have a family with kids, the first thing you do at the start of the tour is tape a picture of those kids on your dashboard and then start your tour. Drill it through your skulls what matter's. Stop chasing in cars and on foot. Glance at those faces throughout the tour, it might change your work perspective.

Once again we will be inundated with calls of justice and reform. None will offer that same mentality for the hundreds murdered each year or the thousands shot in this city. When those things happen we are met always with a "that's not the point" argument by those who lack common sense or are blinded by truth. We will hear about Van Dyke for the next 3+ years and how he "got away" with murder despite only being found guilty of second degree murder which normally for such an offense with no background would carry probation. However, cops are unfortunately on a different playing field as everyone else at 26th and California but you wouldn't know that by reading the headlines which dare to scream of unfair treatment but not for the reality but for the fantasy world in which these journalists all live.

I don’t care what anyone says. This is a resounding victory for JVD. He got very lucky. We can all say that he shouldn’t have been charged which may be true. But fast forward to reality.. he did. He and his family and most of us believed he was going to be sacrificed to anywhere from 30-60 years for this at 85 percent on the agg bat sentences. Instead he’s out in exactly 3 years due to second degree murder being only 50 percent and he has about 4 months time served now. He will be out in 3 short years. Wow. Wow. Wow.

This is a great week. I would like to thank both judges for being fair and following the law. Neither caved to political pressure and that’s not easy in Chicago. I hope everyone who agrees with them will make sure to vote next time and don’t let them lose their jobs because of this.

The prosecutor McMahon was very humble too after the sentencing when speaking to the media. He didn’t preach about the injustice of the criminal justice system or whine how JVD should have been charged with the 16 aggravated battery counts. This guy wanted 90 years for Van Dyke!

Although I do agree, this is a victory for JVD. His wife recognized this gift and thanked the judge for his leniency.

Preckwinkle openly stated that this incident is not the first time a chicago police officer killed someone and got away with it. This lady definitely is not on the side of the police, specifically white police officers. I know this positions will appeal to some in the black community, but I firmly believe that most people do not feel that way.

All things considered I think Officer Van Dyke got as good a sentence as was humanly possible. But my concern is -- can he survive in an Illinois Prison?

Even if he only has to serve half of the 81 months, each day is going to be a day with a target on his back from the inmates. There has to be a long line of losers doing life and who have nothing further to lose who'd like nothing more than to be the guy known for taking out the 'killer cop'. And spending 40+ months in 'segregation' doesn't sound exactly ideal either. Oh well, best of luck to Van Dyke on that.

I find it kind of funny that Patti Blagojevich had to stick her two cents in on Van Dyke's sentence compared to her hubby's, and that Officer Van Dyke can be out on parole sooner than Blago. It's still my point of view that if she still wants to be mad at someone or something, she has to look no further than her dear old daddy, Aldercreature Dick Mell.

It was Mell who got the ball rolling with the Feds wire-tapping hubby when Mell made that public rant on the City Council Floor that Blago was involved in a corrupt Land Deal (over a Landfill iirc). That rant perked the Feds ears up and that got them the wire-tap. If Mell had kept his mouth shut, Blago never would have been investigated.

Hmm??? I wonder if Patti sends daddy cards at Christmas, his Birthday, or Father's Day. LOL

Anyone else see the activist in the courtroom trying to direct the State's deaf guy witness to where Vandyke was sitting so he could identify him in court? Deaf guy could ID Vandyke and said he couldn't see, so judge lets him get up and look around. While hes standing there looking out into the gallery activist revrun Greg Livingston gets caught by the judge motioning to the deaf guy and pointing to Vandyke. The judge had him removed from the courtroom and detained by a sheriff, but after the break let him back into the courtroom with the rest of us. I was hoping he"d hit him with contempt and lock him up, but I knew that was only hope. Livingston is such a piece of shit, and you see the lengths these assholes will go through to get a cop. They do their own criminal acts and call it their justice.

As a teacher I saw 100s of LMc's. Their eyes are listless and dead. Parent, mother, uncle, cousins are nowhere to be found. LMcs go home to greased covered empty homes, with no toilets, soiled beds and no clean clothes.

Like most progressives, the “usual activists” are only interested in whipping up the mob.

“The community” doesn’t mistrust the police because police officers occasionally shoot and kill a few members of their “community”, they mistrust and hate the police because activists have told them - over and over, since they were born - that the only reason they are poor and stupid is because white people are keeping them from being successful, using the police to “keep them down”.

That’s why the arguments and claims of the activists and “community organizers” don’t make sense - you don’t know the subtext that underpins them. Once you realize that the core belief of “the community” is that their lives would be wonderful if only white people stopped oppressing them, THEN it all makes a sort of sense. It doesn’t matter how hard or gentle the police are, it is the very fact of their presence, as “tools of the oppressor” that makes them a problem.

If I could make a modest suggestion: do as “the community” asks - take crime reports, ask for witnesses, collect evidence, but DO NOT pursue, arrest or investigate. If “the community” wants to stop black-on-black murders, they can walk the murderers down to the station.

The Judge was sending US a message. He knew very well that Rahm, McCarthy, Johnson, Lightfoot, Alvarez and a slew of others should have been tried and convicted as well. JVD was wrong with the subsequent shots, but Judge Vaughn was not going to let JVD get thrown under the bus for 100 years. Keep those body cameras on and when a boss gives you a direct order to lie, cheat and steal, call your FOP rep and document heavily.

A police officer that was trying to do what he believed proper at the time, with an armed, irrational and violent offender that was non-compliant was criminally charged and sentenced to prison. I must admit, the first things of which I thought after the announcement was Jason Van Dyke, his wife and family and then Blago. I think being a Chicago, Illinois resident and a sideline observer, there is nothing unnatural about having the two well-publicized trials and outcomes simultaneously pass through your thoughts. That said, try and cut Patty a break. Yes, she is a pushy, bossy, mouthy and salty-tongued woman, who probably deserved to have a mandated vacation, too, but she is just trying to get her husband released. In reality, nothing Blago did was deserving of a 14 year sentence. If talking bullshit before and/or after being charged is an aggravating circumstances, I know a bunch of pooches that were deserving of life sentences. Blago has already served more than half of an unfair sentence. They should let him go for cripes' sake. And, Patty did not have anything to do with conceiving the sister. Thank Mell for that one.

I must admit, the first things of which I thought after the announcement was Jason Van Dyke, his wife and family and then Blago. I think being a Chicago, Illinois resident and a sideline observer, there is nothing unnatural about having the two well-publicized trials and outcomes simultaneously pass through your thoughts. That said, try and cut Patty a break. Yes, she is a pushy, bossy, mouthy and salty-tongued woman, who probably deserved to have a mandated vacation, too, but she is just trying to get her husband released. In reality, nothing Blago did was deserving of a 14 year sentence. If talking bullshit before and/or after being charged is an aggravating circumstances, I know a bunch of pooches that were deserving of life sentences. Blago has already served more than half of an unfair sentence. They should let him go for cripes' sake. And, Patty did not have anything to do with conceiving the sister. Thank Mell for that one.

Don't be so hard on Dan Harbert's legal skills based on the results of this case.

There are very few attorneys who have experience in defending police for on-duty police shooting because it happens so rarely.

The JVD case was a loser from the the time McDonald hit the ground. There is no way to sell the public the idea that a subject lying on the ground is an immediate threat. If the firing stopped when he went down that would have been the end of it.

The verdict is pretty much reasonable as is the sentence.

What I took away most from the sentencing was that fact that every white male police officer is accused of being motivated by race for every police action they take. White male police officers are in the cross hairs of the media and the black community. I'm not sure that a white male police officer should dare work with another white male. If I were a beat car, I'd try to partner with a black officer to eliminate the race card. After watching the prosecutors parade out people who were previously stopped by JVD and listening to them lie and impeach themselves over and over again, I just think why put yourself through this. If a white male officer was truly motivated by race, he would not be able to drive 5ft without stopping someone. It's totally ridiculous. Honestly, white male officers should probably have all the inside spots and desks spots. The community doesn't want us in their neighborhood or alive for that matter. Our current leaders just feed the fire and have done nothing but promote the demonization and hatred of male white police officers. Finally, if you match this description, you'd be a fool to be proactive.

Yeah really, Jerry Joyce does have several realistic proposals. He doesn't pander, he doesn't talk about his wife used to being on the job, he's lived here his entire life and doesn't carpetbag from one state to another. He doesn't try to be all things to all people. Joyce has been active on the southwest side giving time to charities, schools, preventive programs. Paul, wanted to be governor, then he wants to be mayor, then he wants to Philadelphia, or New Orleans or Haiti. If his vast experience resolved issues, I'd say fine, but those places are still screwed up. But vote for whoever you want. But last time I looked, pandering was still illegal in Illinois. Let's take this a little further. As a beat officer and as a tactical officer, I like many, have had false beefs made against me. Drug dealers get beefs hoping their cases will be tossed or that it may keep the same officers from stopping them again. Even on a parking ticket, someone made up a beef. Now I'm not saying any and all beefs are completely false but It happens and it happens to officers throughout the city. They adopted the signed affidavit to try to address it however, this was met with protest that people may then be afraid to come forward. I'm retired and don't know if they pulled the signed affidavits or not but at every turn they ignore the reality of being the police. Not only should there be signed affidavits, any and all witness interviews should be audio recorded and those recording be given to lawyers representing the accused officers. There are no consequences for those who make false allegations, period. Yes, I know I'm a dreamer.

I'll vote for the guy who actually attempts to remove the residency requirement. I can not wait to get out of this shit hole they call Chicago. Are we the last remaining major city that requires officers to reside in it?

I think you need to wake up and realize that all of these mayoral candidates have to live in the city, so do you really think they are going to let you move out.

If you listened to the Proano appeal you would realize how incompetent he is . Darren O’Brien did a nice job, but those 81 months were decided before sentencing day. Judge Gaughan did his homework and already made up his mind and rationale behind it. He was reading off a brief and gave legal precedent along with reasoning why aggravated battery with a gun was added and second degree murder charge stayed. Same as when the verdict was read at the conspiracy trial. Judge spent and hour going thru every charge and reason for a not guilty verdict. She had 2 continuances so she could write her brief. Those things are t decided at the last moments. Gaughan took a 5-10 minute recess to probably make minor changes or adjustments and then returned to read the sentence

The judge is no friend of the police if he was he would of allowed a bench and found him not guilty. Forcing JVD to have a jury
trial in cook county was not fair. And Hebert was the wrong person to represent JVD, why would you let him testify, he was a terrible
witness and by testifying he talked himself into jail. We saw a good judge shred the states case against the officers charged with
conspiracy. Judge Gaughn needs to be gone, made JVD pick a jury and Hebert’s inexperience showed, JVD should of been found
not guilty. A real judge would of given him probation because after all if you did nothing wrong why do you need to go to jail to be rehabilitated. All these mayoral and professional politicians want people out of jail not in jail.

The administration that you love so much just endorsed Ed Burke. Why would this administration endorse a criminal under indictment " keep voting for these morons and see what you get.

I agree with some of your points. JVD should’ve not been put in the stand. He was an awful witness for himself. His hotheadedness was broadcastingly noticeable. Staring down the female attorney didn’t help him either. The judge would’ve slammed him.
