Judge Gets it Correct

  • In a stunning decision, a Cook County judge on Thursday acquitted three Chicago police officers of all charges alleging they lied in police reports and conspired to cover up the controversial 2014 police shooting of 17-year-old Laquan McDonald.

    The case has been seen as a referendum on a so-called code of silence within the Chicago Police Department designed to protect fellow officers from accountability for wrongdoing.

    In her hourlong ruling, Associate Judge Domenica Stephenson blasted the evidence presented by prosecutors as weak, speculative and totally lacking proof of any crime.
Detectives document what they are told by witnesses. Witnesses - especially in a dynamic, fast moving, widespread scene - have different perspectives (they weren't all standing behind the same camera), and documenting those different perspectives is neither a conspiracy nor a code of anything.
  • Attorney Todd Pugh, who also represented Walsh, slammed the prosecution evidence.

    “They say a grand jury will indict a ham sandwich, and that’s what happened in this case,” he said.

    “This case is about perspective,” Pugh said. “It wasn’t about a video that was shot and reviewed hundreds and hundreds of times days later. It was about what people saw on the scene at that moment, and no video captured the perspective of the police officers in this case.”
Somewhere between five and ten exempt members reviewed all of the same evidence this judge did and ruled the shooting justified...before political pressure turned it into a football.

I knew the officers were going to be acquitted (I wish I could search and find what post I posted under that said they were going to be acquitted when the dog and pony show started) That whole case was about administrative procedures possibly being violated which should not have led to criminal charges. Good for the officers!!!

"You Cops got away with it THIS time but..."

No... A bunch of people witnessing an event and
yet a bunch of people can be marched to the gallows
and hanged according to the Chicago Model of Retributive
Justice for daring to differ in how they describe having
witnessed the event in question.

This "Police Conspiracy" nonsense was nothing more
than a diversionary tactic to "prove" the case for
"Police Reform."

Without this... The progressives and "Tha Communerty"
will have to desperately latch on to something else
to "prove" their case.

JVD deserves a new trial because the first one
was such a shameful sham seeing as how Rahm,
McLawEnforcementGypsy, Steak-Head Ed and the rest of
the exempts were allowed to avoid being made
to sit in the hard and uncomfortable chair
of examination for multiples of hours.

I hope everyone who is happy with this verdict, and sadly I know it is not all of us, will now help support "Minnie". She is going to (and already has) come under attack from the real racists of this city, the black activists. It made me sick to hear them on the news tonight, several of them, all calling for investigations into the Judge because things did not go their way. They sure were happy when things went their way several weeks ago - and not a peep came from anyone on "our" side. We accepted it, noted it and STILL went out and did the job.

Sadly, I can not recall one news report about how Gaughan treated JVD, especially the BS when JVD's family was threatened, or anyone calling for press conferences to denounce VG. Clearly, in my mind and from what my eyes saw and ears heard, VG talked down to everyone that would, could or was supporting JVD's case... I have no doubt that tomorrow morning we will hear about JVD getting 20-30 years, unheard of for ANY other offender in the Cook County Court System with similar charges, but after today V. Gaughan will make sure he has those Black Activist's backs and JVD will be crucified.

To be clear, I am not trying to make a judgment on the guilt or innocence of JVD, that has been down - I am just saying that I have no doubt in my mind the verdict will be severe and not reasonable or similar to anyone else charged with similar charges of 2nd Degree Murder & Aggravated Battery, you can bet on it. There will be hell to pay for those 3 political pawn cops being charged and found not guilty - or the people and folks will riot.

Funny thing, these same Black Activists, the ones we never see on the news when dude is killing dude at a record pace, well these same folks, or people, they are the ones who are now taking on a renewed interest in the R. Kelly fiasco. Yet, not one, not one dammed report, article, story or blurb about who was the Judge who presided over that sexual predator and pedophile case.... Why?

So when they come and bitch, protest and try to destroy Judge Domenica Minnie Stephenson's character I hope that my family in Blue will step up and send a Tweet response, a letter to the Editor, make a phone call to a news station or radio station, and support Minnie. I know I will.

Finally, just because I am on a rant and my alcohol has not stopped me from putting fingers to the keyboard yet, will Susan Mendoza be working as hard, or even harder, on stopping that Code of Silence that DOES exist in City Hall. I mean, at least as much as she will work hard on the "perceived" Code of Silence on the CPD. Surly Susan and Toni both knew for years about Ed Burke and his penchant for accepting bribes and payoffs to get passed around to the "upper class" people. Yet they remained silent on it. Why? Guilt by association, maybe? Better yet, I am certain it is because it was and is guilt by action - they both had their hands in Ed's pockets and good graces because they both though that old prick would never be caught.

I’d like to see Kim fox, phleger, rahm emmanuel, judge gauhan, and the 12 jurors on JVD’s trial try to take someone like laquan mcdonald into custody. We pay police to control the uncontrollable and sometimes they have to use deadly force to do so. JVD is guilty of being a police officer, a good shot, and white. It was a good shoot. He was sacrificed for politics and social justice bullshit.

“In a stunning decision” proclaims the first line in the newspaper article. Stunning to who? The judge took a great deal of time to review all the evidence and apply the law(something the Van Dyke jury did not do) and came to the only lawful decision a reasonable person could come to.

Brave judge doing the right thing and clearly detailing in her findings The legal and factual basis for her ruling. Of course the usual preachers and politicians want her investigated because they say the court is now corrupt. Nothing more then a lynch mob. Oh wait you can’t use the word lynch. It’s racist. And if the police just stood around and let McDonald continue in his rampage and kill someone, then your criticized for not doing your job. Preachers, go investigate your parishioners and your community and you will find not only the real code of silence but the root cause of the violence in Chicago. No family supervision, gangs, drugs etc. but then again your church baskets may go empty because we are not dumb enough to believe you don’t sleep with the gangs. Why else won’t you cooperate with the police investigations when one of you children is a victim of gang violence. The real code of silence is all yours.

So three Officers, a bench trial and experienced trail lawyers result in a not guilty. Too bad JVD did not get the same advice. I truly feel as though a proper defense would have resulted in a not guilty for JVD. JVD should have never went jury trial, the jury had him “convicted of SOMETHING” even before the trial started, they even said so in their post trial interviews. To not realize this is a huge mistake that may cost JVD his life.

The exempts who viewed the tape...who Got Together and viewed the tape agiain and again...whose only concern was how to keep their jobs and continue their ascent ...should be held accountable. Not sure how you can say that. The judge pretty much gave Herbert's closing argument as her verdict, though that shit did not play in front of a jury. The difference is bench or jury, and who the judge is. And lawyers only take a bench trial when they know the judge will acquit. Has ANY lawyer EVER lost a bench trial for a CPD police officer in the last 20 years? I don't think so. How can that be? Someone might want to ask Herbert and JVD why they did not take a bench trial. If Herbert had these guys judge, JVD would have walked.

Just stop. It was the right decision. But the prosecutors were not from the Cook County’s states Attirneys Office. They were appointed special prosecutors. Just like the Van dyke prosecutors were special prosecutors and not part of the CCSAO.

I find it humorous that the special prosecution team consisting of Ms Brown Holmes and Mr Ron Safer lost this case. Both are former us attorneys. She was a states attorney and a circuit court judge for 9 years. HA HA HA HA HA - YOU BOTH SUCK! (hope they took this case just for the money because they didn't do their job very well)!

The State's Attorneys today are all from other coutnies -mostly Kane county and one from Winnebago. JVD was well served by Darren O'Brien, who has a brilliant command of the law. Judge Gaughn adopted Darren's arguments and sentenced only on the 2nd degree. JVD will likely be out before the appeal is done, which Darren and his partner are handing. By the way, JVD would be out with time served if Herbet had asked for him to be on electronic monitoring. He should have looked down the road and at least have seen this as a possiblity.

Judge Vaughn made mostly the best out of a bad situation with the JVD sentence.
Unfortunately he didn’t get probation but he’ll be back with his family in about 3 years.

And just about all of the mayoral candidates are out there saying that JVD should have gotten a lot more time for "murdering that poor young black child".....only McStreetlights said the judge decided, let the city heal......even Vallas decried the "light sentence for murder".....

That " poor young child " was a throw-away kid, like most of the criminals that are out there creating murder and mayhem.......where was the Rev back then? Did he ever take the kid in? Sure he read a letter from the dead kid.....he hardly knew LM, he couldn't speak of any personal knowledge..... And did da momma ever (even once) show up at the trial? This kid had 8,700 pages of DCFS history......that's his whole life even as short as it was.....so why did Momma get the 6 million?

Friend of the Police Vallas?? Look at his statement disagreeing with the Van Dyke sentence, stating he should have gotten more time. Typical bullshit politician, he has lost twice and he will lose again. McCarthy had the most positive statement of all the candidates, has my vote. I believe it has to do with being convicted, not being in custody. I’ve seen plenty of prisoners who were in custody because they couldn’t make bond or held without bond appear in court with civilian clothes Theory is you are presumed innocent until convicted so if you are wearing jail outfits at trial it could be viewed as prejudicial

Kid works in Mayberry, suddenly Vallas is going to correct all the problems at CPD. Section 8 gets him some votes, saying Van Dyke deserved a much harsher sentence gets him some votes, hell say 3 cops shouldn’t have been charged based on that evidence, that walks the line, gets you a few more votes.
