Undercharging Again?

Question from a suburban copper:
  • Are city officers being told by ASA to initially only charge 1 felony, with other felony charges added when offender shows up to court? This is going on now in the 4th dist, Maywood Courthouse. We are guessing its so the offender wont seem that bad in bond court and get a lower bond if any at all.

This is true. Called in a felony theft plus a burglary to auto and the ASA stated only the felony theft charge would be approved and the burglary to auto can be added in court.

Yes, this is common. Only the most serious charge is approved and the rest get added on-usually at the grand jury, but also at branch court. It makes it easier for everyone involved, plus, the most serious charge is already approved, so the additional charges are just “filler”anyways

Yes, this is how charging works, you get the most serious charges approved then everything else is added on later.
Similarly, that is why detectives will only have the watch commander put the approved felony in the charges section of the arrest report.
That stack of other misdemeanor complaints that some officers want added are a waste of time and are literally just thrown in the trash.

Yup, if you’re lucky to get approval, it will only be for the 1 felony while “they can add the rest in court later”. I know everyone here will be very shocked, but they almost never do. So if you get a guy with a stolen gun, you will get Agg UUW and the stolen gun charge will never be approvednor heard of again. Same with defaced serial number on a gun. That’s just off the top of my head from personal experience. I’m sure other coppers guy infinite more examples.

This has been happening on search warrants. They say they will add the other felony charges at grand jury but then look at you like your stupid when you ask where the other charges are at grand jury. They also will not test all of the narcotics to get the higher charge for example, say you get 120 grams of heroin and use the charge of over 100 grams, they will only test 70 grams and lower the charge.

I have heard of ASAs in FR trying to justify a theft charge over a robbery by saying a class 4 is higher then a class 1. That is the level of stupidity we are up against. OR that is how stupid they believe we are.

You are requesting charges based on your established PC. Their job is approve/reject/CI. Ask for an official rejection of each charge that they can justify. The sitting SA Foxxxx loves to tell the news, the police department didn’t seek higher charges.

This is how charging works IN COOK COUNTY. In a lot of depts across the country, the WC approves felony charges and the case is reviewed by the prosecutor's office before the probable cause hearing.

Yes this is the slippery slope. Charge one felony, they have a option of adding on later, but rarely do. The 1st step is to assist CCSAO/Judges in keeping a lower bond. 2nd as the case proceeds if the want to reduce the 1 felony in exchange for a misdemeanor guilty plea, it does not appear as bad. Then when the victims complain about all the crimes, why only this charge, the CCSAO tells the victim the Police didn’t charge him with that. As usual these days, they blame the Police.

As long as Kim Foxx is the States Attorney, nobody associated with the CCSAO is a friend of the Police. CPD or suburbs

I’m also in maybrook. Who the f cares? I’ve had numerous asa’s and private attorneys tell me this is the worst courthouse in cook county. We have judges here who make the judges Cpd has down at 26th st look like Supreme Court nominees. I only show up here bc it’s the easiest ot and you pretty much never have to testify bc they plead everything out. This county is toast so who the hell cares what Kim foxx’s office does anymore.

This is common in Chicago; charges are added at Grand Jury during indictment. Complaints aren’t screwed that way.

And that was answered. The most serious charge is the one that is approved. Do you not know that there are different classes of felonies?
The point was that once the most serious felony is approved, some coppers do not understand that misdemeanor charges are not worth the paper they’re written on. Some coppers think that the more charges the better.
Example: if charges of armed robbery are approved, what is the point of also charging theft, or simple battery?

If you do not understand that, perhaps you shouldn’t comment

Just for grins...this is how it works north of the cheese curtain...

Officer makes arrest at night and writes up arrest sheet and turns in reports. In the morning the court officer collects the reports and rap sheets and takes them to the DA who reviews them, prepares a criminal complaint with the charges and the defendant has his initial appearance in the afternoon where bond (no 10% -- cash or signature) is set. Very streamlined system. Other than in a major case, the only time the on-call prosecutor is brought in is if an officer needs legal advice or a warrant (and that usually takes 60-90 minutes).

Sorry guys, nothing conspiratorial here. Same with Kim as it was with Anita & Dick. One charge gets approved and then several get added after. Ask an ASA to see the charges on any of your gun cases and there will be UUW/F twice (gun & bullets), and several versions of Agg UUW. Plenty to complain about on review but this isn’t one of them.
