Fetal - By Law

You know the "stay fetal" movement that has been percolating for the past few years? The old timers preaching to the young'uns that to keep your sanity, paycheck and job, the wisest course of action was to disengage from a community that wants only to sue you, take your house, and get multi-million dollar judgements against you? We weren't joking.

Now look what has been introduced in the Illinois legislature (THIS IS NOT A JOKE):
  • Short Description: CRIM PRO-QUESTION W/O ARREST

    House Sponsors: La Shawn K. Ford

    Hearings: Judiciary - Criminal Committee Hearing Feb 26 2019 3:00PM Capitol Building Room 118 Springfield, IL

    Synopsis As Introduced
    Amends the Code of Criminal Procedure of 1963. Provides that a peace officer shall not stop any person in a public place based upon an officer's inference from the circumstances that the person is committing, is about to commit, or has committed an offense as defined in the Code. Eliminates a provision requiring an officer to provide the person with a stop receipt that provides the reason for the stop and contains the officer's name and badge number. Makes conforming changes. Effective immediately.
Did you catch that? No, not the part about eliminating the stop receipt. The part where conducting a Terry Stop - the most basic of all police work, defined by the US Supreme Court and recognized nationwide as a lawful police action - is completely disallowed. A receipt isn't necessary any more because ALL STREET STOPS WOULD BE OUTLAWED BY STATUTE.
  • you see someone hanging out in a known narcotics hotspot, fitting a given description, engaging in conversation with passersby, exchanging small objects for green slips of paper? No stop allowed;
  • you observe someone with a burning piece of rolled up paper on a CTA platform, expelling a whitish vapor from their mouth, and discarding the paper onto the ground? No stop allowed;
  • you see someone standing with their hands up in the air, while one or more persons rifles through their pockets, removing phones, wallets, other property? No stop allowed
Your observations as a police office would now be invalid according to LaShawn K. Ford's House Bill 0186. The Terry Stop would be no more. "Fetal" has been written into this bill and has already passed from First Reading to the Rules Committee on to the Judiciary - Criminal Committee and is currently awaiting action in the subcommittee.

Illinois politicians have to be among the stupidest people alive, and LaShawn Ford wins (hands down) the "Too Dumb to Breathe Unassisted" award for 2019.

If police work isn't dead, it will be if this passes. And even if it doesn't pass, guess what the prevailing attitude of the legislature is and which direction it's headed? Save yourself, your job and your freedom.

Liberal/progressives do not want the police to interfere with common criminals. In the future all policing will be against dissidents and enemies of the state/government. An armed robber is not an enemy of the state, a conservative is.

Well, I for one would NOT be surprised to see the Illinois legislature pass this. The brightest of them can’t add two and two without using their fingers.

If it DOES pass, just stay in the station and wait for calls, like the Fire Dept. Heck, just move into the fire station - the food is pretty good!

It will be a lot cheaper to put up a wall around Chicago and build a City Prison like in the movie - Escape From New York.

Eliminate the Chicago PD completely and go with Cook County Sheriffs only to police the walls - nothing inside the Wall. A LOT of MONEY SAVED!!

ALL neighborhoods would be "Jail", except Downtown. Downtown would only have access through certain railroads and CTA trains that would have no stops, except outside the city and into downtown - NO neighborhood stops.

Chicago would be "Chicago" only in downtown - the rest would be Chicago Prison. Midway and O'Hare would be part of the City and not the Jail part, of course. Police would ONLY serve the City part and be cut down to about 1,000 jobs.

The more you think about this, the "Smart City" idea for Chicago should be exactly that - a City Prison.

Save money in the Billions every day. This way it could be a Sanctuary City as well -- inside the Wall.

Farfetched??

Hey- this way every Alderman is like a crime lord over his or her district and in reality, does not sound to be too far from what it is today - except the framework is more formalized.

If anything, wards would be taken over and we would get that reduction in Aldermen that many talk about to "save money for the city". Wards would be overrun and be taken by those Aldermen who are power crazy. Maybe we could get it down to 10-12 wards? A BIG WIN for those who want to cut bloated spending- a lot less Aldermen and staff to pay.

Tom Dart is no Lee Van Cleef so we would have to get a real Sheriff(Warden) who is a real prick to run the Guards - but that would be easy.

Build that Wall!!

Didnt Ford get charged a few years back by the Feds, how does this guy still have a job? Illinois will elect anyone.

If the Supreme Court already made a ruling and Ford is attempting to create new law that sidesteps the Supreme Courts ruling, couldnt that be easily challenged? How about the FOP, seems like a police related issue.

Guess what? The bosses won't be able to tell you to make stops. They will have to concentrate their efforts on getting bus & park checks. This will be like that tv commerical where the bank is getting robbed and the people tell the guy dressed up in the bank guard's uniform, "Aren't you going to do anything", and he replies, "Oh I am not a bank guard, I am a bank monitor." Give them what they want, do nothing, it will get interesting over time.

time to put the bunks and kitchens and tvs and workout rooms and a nice brass pole in the district stations. maybe elevators for the chubbys. only come when called by the munnity. maybe have the bell system too so you know how many p.o. s are needed on a call. respond, code and get back before the food gets cold. give the peoples what they want, the customer is always right. the bwc s turned out to be a goodthing, on call reactive policing might actually be a great stress reliever. the politicians and police brass dont want anyone arrested, the courts dont want to try anyone and the jails dont want any inmates. as a bonus the revrunds and media might finally take a shine to you. hopefully after working out and taking a nice steam, having a great sit down meal instead of some fast food crap and watching a couple hours of sitcoms followed by a nice nap with your own my pillow, you might feel like pouring concrete or building garages like the firemen. dont fight it. embrace that pod next to your bed. the future is here. be the change!

La Shawn Ford is just what the citizens of Illinois wanted, another "Useful Idiot" in the legislature. He is what the Progressive Democratic Party wanted. Congratulations Democrat's. You wanted one Party to control our State and now you have it. Every State Office is held by a Democrat.

Well now that you have total control of our State, what are you going to do with it. Will your Democratic hacks in Springfield allow the proposed Bill to be made law? You can't blame Republicans anymore. You own it. The drive by shootings and killings in Chicago and elsewhere will explode. Much of your voting base will be killing each other.

Should this Bill pass, as well as your progressive taxes, gun control, sanctuary state/cities and out of control spending you guys will be very lonely. If you think you saw people fleeing this State as quick as they did in the past several years, you ain't seen nothing yet. You better get cracking and get more illegals to replenish the voting base in order to make up for the increased body count.

If Jaba the Hut spent $171 M of his own money to win (buy) the Governor's Office he can surely write a check for all the fleeing tax payers in order to make up the difference.

This crap and I hope it’s not true, but I worked 12 years on midnights since 30Apr01. Your driving alone, with a person that has no time, a Copper you’d rather not work with, and so on. The Job is a hard job. The Civilian that believes we spend all our time in D&D I’d love to discuss that topic with them.
Recently I heard “EVERY TIME” a Copper draws he/she has to fill out paperwork. If that’s true the Essential Service that’s already dangerous will be that much more dangerous. Who’s gonna cover my Beat while I’m writing why I feel I’m in defense of my Life. When I first got on the deal was draw when you feel it’s a necessary. Maybe you saw something the others didn’t. It was something I never thought about so as to make drawing one’s weapon reflexive. This was taught in 026 by the way. Cleaning, field stripping, practice with snap caps so your draw comes out like a professional. Off target, off trigger, but God Forbid it’s on target, on trigger I don’t want a trivial extra thought in there.
Remember that cat lover Fed Weiss? Outdoor roll call in 006 and he heads for the hills? We were duped cuz he was as much a Street Cop as “Irion Mike” Ryan.
The Police Officer shouldn’t be questioned as to why he drew his weapon. It’ll hurt those I truly respect, The Street Copper.
Robert Plant a few years back brought a guitar in Guitar Center for tuning. GC called A/3 to simply report it. He spoke of his OWN Country taxing him at an absurd amount if he graces the shores while his Wife was sick and his five year old boy was fighting for his Life which eventually lost.
C/O Kenny was Bono’s guide when Chicago had U2’s Day. They are the exact same age. Kenny, as decent as he was, couldn’t name one U2 Song.
We invited Them, not the other way around. You’d think just one U2 Song, but nada.

There are hundreds or thousands of bills introduced into the state legislature every year that go absolutely nowhere. A few of these bills get passed in forms that are completely different than what the original text said. You can't get excited about this kind of nonsense. It's just plain not going to pass.

This is not a lot different than the bills that NRA Affiliated Congressman introduced into the House of Representatives every year to Force all states to accept all other states concealed carry licenses. The fix is in. They know it will just quietly die eventually but in the meantime they can use it as a red meat issue.

Uhhhhhhh, as you said SCC, it literally makes it illegal to stop anyone. If I see a guy shoot a guy in the face, I still can’t stop him the way this is written. My inference from the circumstances, me turning the corner east bound, seeing person A holding a metallic object to person B’s head, then seeing a flash from the metallic object held by person A, while also hearing what R/O believes to be a gunshot. Person B then collapses, there’s blood everywhere, people are running and screaming. R/O, given the circumstances, believes that person A has just shot person B in the face in violation of illinois criminal statutes, but given state law recently passed, R/O is not allowed to stop person A. Brilliant. I’m down for this. Since it’s illegal to stop anyone, we can’t arrest anyone. Which means all these shit head judges, states attorneys, and public defenders can all go suck a dick and sit in the unemployment line like they deserve. They dont do shit anyways. I love this bill, I vote YES!

In the future, we will no longer be Chicago police but Chicago security guards. Chicago security guards will be paid half of what the old CPD 1835-2019 use to make , no pension, less benefits. Use of force, not allowed if someone tries to attack you, you have to run.
To me the future doesn’t look bright. I love being a Chicago police officer. I know a lot of verterns will say I should leave and go to another state. But it’s not just this state this is happening all over the country. What is with America and all of these anti law and order politicians. Why in society do we have leaders supporting the criminal element and this type of non sense. Where will America be in 5 years 10 years and etc !!! I don’t even want to have kids because I don’t see a bright future for my kids. Like always please everyone stay safe and make it home to your family, friends no matter what!!!

Everyone take a frickin deep breath. Just like anyone can file a lawsuit against anyone - you can sue a hamburger - it doesn’t mean the lawsuit has merit or that it won’t be dismissed for whatever reason. Same is true in the legislature. Any legislator can file a bill to do whatever stupid idea he or she has - doesn’t mean it’ll pass both chambers and be signed into law by the governor. Procedurally, if a bill is sent to a subcommittee, it’s a very strong indication it’s going nowhere. In fact, most bills filed are done so with no intent of passing it but instead to cynically use in their next campaign ad or brochure. Rep. Ford is running for mayor and if he has any chance (arguably none from my standpoint), he must maintain his “base.” That is the “community” or whatever else you may wanna call it. By sponsoring this bill he can now go to the black electoral and say “look what I did - I sponsored a bill that would ...blah blah blah.” With no intention of actually passing it. Smart politicians manipulate the system to their advantage. Everyone else should be smart enough to differentiate what’s actually going on. Btw there are enough law and order legislators in the current general assembly to make sure something like this doesn’t actually pass.

I hope this passes because 1)Yeah, give the people (or folks) what they want, 2)as with Terry vs. OH, it likely wouldn't pass SCOTUS muster (based on current composition) due to the reasonableness clause in the 4th amendment, thereby making the IL legislature look like the incompetent fools they are, and 3)the 14th amendment is clear that all the rights, privileges, and immunities contained in the Federal Constitution apply to the states as well.

From the 4th: "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated".
Each of the examples cited above easily pass the reasonableness test.

Mr. Ford's biggest financial backer? The teachers union. Wonder why so many Chicago kids are unemployed? In 2012, he was charged with bank fraud but escaped by pleading guilty to tax charges. And he chairs the committee on Financial Institutions. Wonder why the state is so screwed up.

Will Detectives be able to contact people to follow up on crime? Most case reports say time to contact, any. Now they need a law to outline how merit promotions are given to stop all that clout driven non sense.

You are correct in a sense that state laws can be made more restrictive that federal laws when it comes to criminal statues like as if federal law states that legal speed limit is 70, a state can make its speed limit 60. I’m pretty sure a state cannot change a Supreme Court ruling.

Provides that before a peace officer is permitted to carry a firearm in the unit of government in which he or she is employed, the peace officer must either: (1) live in the unit of government in which he or she serves; or (2) complete 200 hours of specified work or training. Provides that the unit of government shall require each peace officer employed by the unit of government before entering upon the officer's duties to have a liability insurance policy. Provides that the public shall have access to all documents concerning promotions, which documents are subject to disclosure under the Freedom of Information Act. Provides that each peace officer, before discharging his or her duties as a peace officer, shall sign an affidavit declaring that he or she will report all unethical and unlawful conduct of other peace officers immediately to the internal affairs division of the department. Provides that the exclusive representative of a peace officer bargaining unit may not enter into a contract or collective bargaining agreement with the department that permits unconstitutional conduct by peace officers. Amends the Illinois Police Training Act. Provides that the minimum standards for police academies shall include 20 hours of race relations training, acquaintance with the youth residing in the unit of government in which the officers will serve, when discharging a firearm, the avoidance of the use of deadly force except when necessary to protect the life of the officer and on methods of using less than deadly force to disarm a suspect. Provides annual 20 hours of training of peace officers in race relations and constitutional methods of the use of force. Amends various other Acts to make conforming changes.

Amends the Unified Code of Corrections and the Sex Offender Registration Act. Deletes provisions that the detention, arrest, or conviction of a person based upon a database match or database information is not invalidated if it is determined that the specimen was obtained or placed in the database by mistake.

Lets think of this from the liberal's point of view: If the suspected criminals need to give consent to be arrested, an extension of this proposed law as would be logical to soon come, then all the hardship of arresting persons would be less since there would be less arrests. Nice!

If there is no consent to be arrested, no arrest can occur. Prior to that, a law such as this idea from Ford just makes sure that no police work can be done hence the likelihood of fewer arrests even being considered will result. Sweet!

With no arrests, there will be no crime! No crime means a happy and safe world with unicorn magic rainbow farts! Global warming can also be solved and all hate and harm will vanish too, somehow.

A couple people have pointed out that just because a bill is introduced does not mean it is going anywhere. That's true, and in this case, it probably is an effort by Ford to impress his base (he apparently honestly believes he has a chance in the mayoral race). However, the mere fact that this got introduced, and the fact that there are no doubt some legislators who think "great idea--we should do that" is terrifying. The Dems have a supermajority in the house and senate and own the governors mansion for the next 4 years. This is the type of shit that could (could, not will, but could) get through. All bets are off at this point, and any citizen who is even remotely concerned with public safety issues should be very worried about this.

My kid just got hired by CFD and will be in the class starting March 1st. He told me that out of the 85 recruits present for final processing 11 of them are currently CPD and another 4 coppers from outside agencies. I’m retired CPD after 32 years and this number seems high to me. He told me that out of the 85 recruits present for final processing 11 of them are currently CPD and another 4 coppers from outside agencies. I’m retired CPD after 32 years and this number seems high to me. Even back in the early 70's, we had three guys quit the academy after we had purchased all our uniforms and firearms. They were called for the CFD and happily left O'Brien Street behind.

Absolutely, States can give their citizens more rights Tha the federal constitution, weed ticket law forbidding arrest would be one examole. See Michigan v Long.

You are correct in a sense that state laws can be made more restrictive that federal laws when it comes to criminal statues like as if federal law states that legal speed limit is 70, a state can make its speed limit 60. I’m pretty sure a state cannot change a Supreme Court ruling.



States do it all the time. See Michigan v Long. It's covered in the academy.

Not true, see Barron v Baltimore and The Stockard case, the Bill of Rights was not applicable to the States, parts of the Bill of Rights are not still applicable to the States even after selective incorporation (such as grand jury indictments).

I disagree with you. Outside of cook county and especially outside of Illinois, life is different for law enforcement. There are numerous states where police are respected and supported. Avoid major cities and look at smaller towns or even state agencies.I retired from CPD and traveled the country. Visiting towns outside of cities seemed like a different world. Police are supported. You can remain fetal in Chicago and survive. Or take a chance and look for other opportunities.

More than likely the ASA. They hold their cases until the last minute. Wasn’t a court given at your last court appearance in the case
Had it happen to me a few times, watch commander excused me
Easy was to handle it is to call the ASA and explain the late notification and ask them to get a continuance. They are good about that especially if it’s a late notification. Also if the ASA doesn’t complain there is no court deviance

The reporter on Tonight, wrote a book on R Kelly and said he is the worst mass sexual criminal in Chicago history with a documented 48 victims on the South side of Chicago and even more in other states. He keeps getting away with it. He pays off the mothers and even now has underage girls with him along with their mothers. And, he said NY state is investigating Kelly and Foxx refuses to cooperate. I suspect he will beat this current case. The video is very old, one victim refuses to cooperate.

great advice. It goes against everything that I stood for in 34 years of service, but in today's climate it is a smart thing to do. It was often said during my time that the only cops who get in trouble are those that are trying to do some work.

I'm late to the party but this would be great.
I don't think Ford realizes this works both ways.
Sure the police would not be able to stop members of the "community" from committing crime.
But the police also could not stop armed citizens from dealing with the "community".
I think it would be a fair trade.
As it is "community" members either walk or get probation.
There wouldn't be much of a change if you stopped catching them before they were later released.
However once word got out that the currently law abiding victims of these jack offs could take care of business, I think the problem would take care of its self.
