Department Turns Its Back

  • Chicago police Officer Brian Warner took a seat in the center of the hushed room and waited, the only sound the wail of sirens 16 floors below in the Loop.

    Eight years ago, Warner shot a suspect dead after being wounded in the shoulder and was placed on full disability for PTSD, rare in the department.

    Now the Policemen’s Annuity & Benefit Fund of Chicago was taking a look at his case. It had held three hearings over eight months marked by contentious questions, heated answers and some confusion about PTSD, remission and whether Warner could return to light duty.


  • Weeks later, still raw from the pension board’s action, Warner learned even more devastating news. While he was on disability, the department moved to fire him because a search of the suspect had failed to find the gun.

    The decision was made four years ago but no one told him. Then-Superintendent Garry McCarthy signed off on the termination less than two years after personally handing Warner the Award of Valor on a stage with Mayor Rahm Emanuel.
Well that's a great way to instill confidence in the men and women of the Department that even if you act heroically, if COPA and the Department can find a procedural error in your actions, you'll be facing thirty-pending over what should (more likely than not) be a training issue.

I could understand if this was like some classic
NYPD cases, where investigators found the

Yeah, yeah, I got back pain but my doc. told me
gentle exercise was O.K. What were the fucking
bar bills? Alcohol goes together real good with narcotics.

things on the battlefield. If they should develop
bodily or mental problems the easiest thing is
to crumple them up like a piece of paper and
throw it in the trash (if they can get away with
it). All the forces have recruiting. The NFL actually
pays the government for jet fly-overs. The goal is
to lure in more suckers. Wash, rinse, repeat.

PTSD was not acknowledged by the U.S. Military until 1980, and there can be no doubt that the day is coming when it will be recognized in law enforcement. One may argue that police service may not be as intense as military combat,but the challenges and experiences of a police career extend far longer than any individual soldier's exposure to combat. A soldier goes on patrol for a portion of his/her deployment. NO SOLDIER GOES ON PATROL FOR TWENTY PLUS YEARS; but cops may! And in the current political, and race divisive environment that is 21 st Century America; the police officer has become the "Enemy", and the hostility is not letting up. The high rate of police suicides,alcoholism and drug abuse is a reflection of the toll that the experience of policing is taking on police officers. It is one thing to deploy to another country, and see carnage and mayhem, in which case one can disassociate mentally from that circumstance. Cops see carnage and mayhem, in the place they call home. It is naive to think that anyone can be exposed to what police experience, without sustaining at least emotional damage. Perhaps the concept of 20 year careers is archaic. Whatever the ultimate outcome, Police PTSD will be the Agent Orange of the 21st Century. Stay Strong, it is not getting better. Baby "G"

I don’t know anything about this case but I do know there is a major problem with the fraud in the disability claims. So this guy can’t even answer a phone or work at some desk? Is he able to drive his car? Run erronds, cut grass/yard work, travel etc.? There’s a function for him somewhere on the department.

I like where the Superintendent said you are culpable for your partner’s searching! If the officer died who didn’t search and the officer who searched lived. Could the searching officer be changed with a crime for letting the criminal keep his gun that he was concealing. This is getting to be a high stakes job! I want to finish out my time 99 so I’m not culpable for anyone but me! This job totally blows!

Absolutely fucking sickening! And if they peeled off his 5 shirts and 2 pairs of pants IPRA/COPA would beef that the officers conducted a totally intrusive strip search they were not entitled to perform without a warrant. Anyone remember the two tact officers in the 010th district that were shot by an arrestee in their back seat? Happened in the late 80’s or early 90’s if I remember correctly. The bad guy gets arrested, transported, processed and put in lock up. He wants to help himself and says he has info on a drug house. The officers take him out of lockup so he can show them the house. He’s handcuffed and put in back of tact car. He pulls the gun he had on him the whole time and kills both officers in the car. Both officers were rightly given full honors funerals and their stars placed in the honored star case at 35th Street. How is this any different?

How many other Policemen have been used up
and cast aside over the years in similar such fashion?

Why is it that CPD working conditions are equivalent
to conditions in tyrannical tinpot dictatorships?

Police Stations that are open and notorious
upper respiratory ailment and cancer clusters...

Decrepit and obsolete equipment.

Dearth of training as a means of "achieving
efficiencies," aka stealing allocated/budgeted monies
and spending it on graft, political lick hitting and pandering.

You know... All the shit that points to the
ongoing narration that it is The Police who
are the source of all that is wrong with Chicago.

So the Department, in order to escape it's duty
and responsibility has actively sought to label
this officer a sullen malingerer and chronic
malcontent who's "not playing team ball" by
taking a STFU about having PTSD...

"If we cave to THIS guy, We might be on the hook
criminally and civilly for all the other Coppers
we fucked with and/or forced off the job whether
for medical reasons."

As well these funky bastards SHOULD BE.

There's your REAL Code of Silence.

The "apparatus" is a living and breathing thing and it WILL
do whatever is necessary to protect, perpetuate and propagate
itself much to the grief and aggravation of MANY good men
and women.

And yet the department feigns concern when
Policemen climb inside a bottle or worse still,
kill themselves because the ugly shit they've seen
over the years is oozing under the doors in their
mental and emotional closets where they shove said shit
and push the door closed just so they can get up and try
to function the next day...

The sin and shame that this is.
The rank and utter hypocrisy too.

Nobody has a compelling interest in trying
to do what's right other than the front line
Policemen themselves.

Now get out there and build that community trust that all the
willfully and joyously ignorant usuals are noisily and relentlessly
banging off their ill-informed, unchecked by a brain or a conscience
dick beaters about.

Don't get me wrong, but Warner isn't really want I would call a hero...that term is thrown around much too loosely. I'd say moreso (describing his actions that fateful day) that he cleaned up his (and his partner's) f**kup...even having said that, it's disgraceful how the Department has played him. Glad that McCarthy didn't gain much traction in his quest to be mayor.

Regarding that incident from long ago in the 010th District, both officers weren't killed. One officer did survive that shooting, as I recall.

Two different issues here.
1. Given an award , then moved for firing. A recommendation sitting in Ed’s inbox, post McStreetlights. This issue is mind-boggling itself. The officers failed in finding the weapon during a pat down and may have handcuffed him improperly. Was he seat belted in ? If not, that’s 3 faults right there, basic police procedures in handling an arrestee. The entire incident was handled improperly on both sides.

2. Playing the PTSD card for too long. Really ? Can’t do a desk job if going back to patrol is so stressful ? Go work at Hime Depot, they’re hiring. Tell the officer who actually caught a bullet and is paralyzed from the neck down on a breathing apparatus about disability.

Know this. I work in 018. This guy is pissed off at the CPD for not being a merit pick for detective. He was told he was getting fired because he and his partner were cocktailing prior to the shooting. Yea, he took a round into his vest but it never went into him. When told he was getting 30 days+ his partner retired early.
Now this guy works as an armed security driver for the movies here and is with the teamsters. BW has been a self-serving fraud since he came on the job. We all know it but kudos to him for pulling a fast one on the media and those coppers who do not know his history.

He no more has PTSD than the man on the moon.

Pull the FOIA the list of terminations that McJersey signed off on?

I will lay great money you see a pattern of this ex superintendent signing off on terminations of Department members.

The only problem is the fact that almost 90% of these members were never terminated, after police board review.

Why? Read the police board findings? They will show the investigations that were signed by McShootout the lights,
were all flawed by bad investigation. And this goofy leader never read the allegations or charges.

You will also find that just prior to being terminated himself he was stuck signing off on terminations when he never reviewed the
Case?

But this is the Department they wanted, award a member then fire him? Builds confidence right

I don’t know anything about this particular case. What I do know is that PTSD in law enforcement is very real. EVERY mental health professional knows there is no possible way a person can deal with the horrors brought down upon you every single day for 20 or 30 years, and this job not have a devastating psychological effect.

The city is making it easier and easier for me to remain fetal. Whenever I think there just might be a reason to keep doing the job I love (or at least used to love) I read something like this which brings me crashing right back to reality. Our only practical options are to coast to retirement, take a cop job in another department outside of Cook County (preferably outside of Illinois), or learn to sell insurance. I'd almost rather sell shoes with Al Bundy than keep being treated like this. Fuck this city, fuck this county, fuck this state, and fuck this department. I'm truly a broken man.

I could just see the video now. Two officers in the 018th District having an arrestee with several layers of clothing strip those layers off while standing in the street we’ve all seen the way these homeless or mentally unstable people dress in the winter. That video would go viral and the officers who catch time for sure if not worse. You seriously can’t win on this job.

So they arrested this guy and from the back seat he was able to retrieve his handgun and takes a shot at the officers striking Warner. They have to return fire and kill the offender. Anyone who is A. Shot as a result of doing this job and B. Fires his or her weapon which results in the taking of a life might just have some serious issues with continuing on this job. Isn’t that why we have these programs? To allow people to use them. I don’t know this guy but if he says he has issues and seems medical treatment I would want to error on the side of caution and allow for the disability pension. This is not the case they want to use as an example of taking advantage of the system. Especially with what five suicides within the last year? Coppers are very stressed about making the wrong decisions. Working under a microscope every day to grueling. Now you have an officer who was involved in a shooting being fired and benefits denied because he drinks too much or has talked to the media. Great way to support the troops. I’m sure it makes officers safe asking for help.

Unfortunately you don’t have all of your facts straight....only one officer died and the other remained on the department until he retired.

An Officer is barely allowed to patdown an offender on the public way, so it allows something like this to happen. How often are guns “recovered” in processing areas or lockup? This Fuck Job stinks to high heaven, what a Spit on the Face. If he dies then he’s a Hero, because he lives he’s now a Burden. Bravery, is almost looked upon as a liability! Better off dead, or Silent. Sgt. of Det. is another example of Bravery against the Cabal. At some point there needs to be a call for a Massive BLUE FLU!!!!!

I do they both didn't die Eddie Jones died,Dobson was shot in neck and lived but was forced to come back to work even though he didn't speak right any more. Don't know what happened to him after I left ten. It was in Jan 92. RIP Eddie we still remember.

Just mention one name at his hearing. Sgt. Khalil-Drive-by-Muhammad! Expose the hypocrisy! At least this officer didn't shoot an autistic black youth for no reason. How does the punishment fit here? 180 days for a bad shooting vs. termination for a bad search? Has the city lost it's mind? Just another case for the politically unconnected and the double standard for the clouted here. I have never heard of anyone getting fired for a bad search.

That being said, know this...the Dept. has no machinery in place to deal with PTSD or many other health related illnesses the police suffer from. (I know!) They will only take care of you until some bean counter says, Hey! why are we taking care of this person? Remember Densey Cole? Once you are out of recent memory, they tend to forget your sacrifice. Make them Remember!

Most experts agree that most police officers have PTSD to some degree depending on how much they have seen / done (which means the CPD clouted have no PTSD, but I digress). That being said, was he so disabled that he couldn't even answer a phone at HQ or maybe work in the mail room away from all citizens and police work?

As for Gerry McCarthy, he is a scumbag of the highest order and this Department and city SUCK!

Mistakes are going to happen to everyone of every trade or occupation.
But Gmac’s philosophy of nobody should be killed over a mistake is utter pandering bullshit when it comes to the police reacting to an active shooter and they’re the target.

This wasn’t someone drowning in a bathtub because the plumber left failed to unblock a drain pipe when fixing a leaky faucet.

Mistakes happen and when it comes to the police, we have no excuse? All these feral mutts do is complain when handcuffs are too tight and still the biased COPA bends over backwards to vilify the police with excessive use of force for resistive and combative feral offenders.

COPA should not have any final say in this matter. The Dept was likely wrong and allows COPA to overrule.
Survival mode and the humane pysche, yes there’s a reaction, especially when trained.
Thinking about all the COPA bullshit what Rahm allowed, are things going it get any better after any arrest?

I retired under McCarthy. I had a one day trip on his desk. He wanted to raise the suspension. This was within a month of my retirement date. Nearly cost me my retirement seat and ID, conceal carry rights. Just so that he could micromanage a suspension. I went downtown on my last day, with no idea I would retire in good standing.

Everyone of us, at least those that actually work or have worked the street suffer from some level of PTSD. The city and pension board can never acknowledge this. The cost of treatment would be astronomical. The possibility that officers are working the streets with PTSD would be both political and departmentally damaging. You can't see what we see, experience what we experience and not have PTSD. Some police departments around the country are starting to acknowledge it, but don't expect it from the politicians and their cronies, the Superintent and department hierarchy to ever acknowledge it without city hall approval.

Totally agree. If you can’t stand the heat get out of the kitchen. This job ain’t for everyone, hence the weak turning to booze and other things to self soothe. But I blame the city and department for not weeding out the Sally’s in the application process. Some - A LOT of people actually should have never made it past the initial psych test let alone the follow up with the shrink. Sorry to hear you can’t sleep well and tip the bottle a little too much, but you’re 7 x 3, so figure it out one way or the other. And while you’re doing that you can work a desk or other admin spot and keep kicking into to pension that guys like me who did 30+ years in the ghettos (4 shootings, 2 fatal, dead babies, people burned alive trapped in a bldg while I heard them scream as they cooked to death, etc etc) contributed to without complaining. God speed brother, but suck it up and handle your business. It CAN be done without all the drama attached to it.

This officer got shot in the shoulder. He is being fired because they didn't find a gun. I am not a detective, but it seems to me if he was shot in the shoulder, then there must have been a gun somewhere.

For the poster who suggested that this officer be placed on desk or lawn mowing duties, that is not what he signed up for. Either position makes promotion impossible.

I know a couple of exempts who missed a gun when they were working together as POs in 024. Left it in the back seat of the squad car and didnt check after their tour of duty. They were lucky twice. The first time when the shithead didnt blast them. The second time when the department didnt fire them like they are trying to fire this cop. Bunch of BULLSHIT. The only ones who where unlucky where the poor cops that had to work for these exempts, they both suck.

The pension board is tighting the loose strings that too-long prevailed on this department with all the disability claims. PTSD is one of those claims. If you are physically able bodied, there is no reason a desk job of some sort along with continued mental health care counseling be in order. Was this offered? Was there a refusal ? Both sides handled this poorly.
This officer can probably find employment outside the department, but collecting a 75% check with no taxes is easier.

What's up with these "Gold Coast" warriors suffering from their supposed PTSD. There are dozens of them according to the Trib article trying for disability. Maybe they watched too much 1 ADAM 12 on TV when growing up instead of Gunsmoke or Dirty Harry movies and didn't realize the gun on their hip was more than a hat rack. What did they think the job was when they signed up. Did they never think they would run into "bad guys" in this profession or see terrible things? Maybe they should've worked some actual "high crime-violent" districts before being assigned to the cushier parts of town. I saw a few of these types over the years and while I could sympathize with their plight I couldn't empathize with their view of reality. I agree, however, that the department does a lousy job in counseling before hiring and after hire and that should be addressed. Not everyone is cut out for this type of work.

I was near there when that happened. Chicago and Franklin. The homeless piss bum easily hid the gun, multiple pairs of pants, shirts jackets. Easy to miss a small gun in all that padding without stripping the flea bagged body lice infested shithead. I used to work with Warner's partner in 014 back when there was 100 homicides a year in 014. Old guy has since retired, he didn't have to go through that shit. And OUR rep votes against the guy? I think the 30 days pending is BS & will be reversed by Stup-Ed (bank on it). I like Brian and I think he’s a great guy but why can’t he answer a phone, type emails, sort paper, look up case reports etc. at HQ. Plenty of limited duty officers at HQ, Academy & OEMC that are just administrative. I’ve been involvrd in 2 shootings, I’m not sitting at home collecting 75% with medical till 63. I sought help and still see Dr Sobol regularly. If Brian can function in his daily life he should be able to work administratively. There’s a Sgt at the academy and several PO’s at HQ who have had dibilitating injuries (with many surgeries) who were brought back to answer phones, why can’t Brian? At some point we have to stop milking the very system we will eventually depend on in our later years.

There's too much fraud to be able to identify legit cases. There are people ducking work while assigned to the mail room, as secretaries in HQ and every front office, as building security at loading docks and parking lots, and any number of other cush limited duty spots. Full duty officers should not hold those positions unless it takes some special skill set to perform the task, and a particular officer possesses the needed skill. Every one of those spots should be filled with sworn members on limited or convalescent duty and all the full duty members put back into full duty spots. PTSD is treatable and people are fully functioning and capable of performing many of the traits of their duty. Many need the work to heal, and many need to be forced to work instead of becoming lazy and becoming used to the idea of free money. Too many fakers, too many people gaming the system, too many people looking for the easy street, and that all has to get put to rest. They have to find truly professional and disassociated physicians to make credible decisions and take these decisions out of the hands of the corrupt and connected. Once we are able to get the medical and disability under control and remove the scammers off the system, those who truly need or have earned it can safely and legitimately use it.

to force disability and medical retirements.

Know a couple of Coppers who were forced off the job
because they were medically unsuited for field duties.

They said he couldn’t go back to work because he was too angry with the city and CPD. Shrink testified he did not have PTSD anymore, and the other one said he was too angry

Know this. I work in 018. This guy is pissed off at the CPD for not being a merit pick for detective. He was told he was getting fired because he and his partner were cocktailing prior to the shooting. Yea, he took a round into his vest but it never went into him. When told he was getting 30 days+ his partner retired early.
Now this guy works as an armed security driver for the movies here and is with the teamsters. BW has been a self-serving fraud since he came on the job. We all know it but kudos to him for pulling a fast one on the media and those coppers who do not know his history.

He no more has PTSD than the man on the moon.

I like where the Superintendent said you are culpable for your partner’s searching! If the officer died who didn’t search and the officer who searched lived. Could the searching officer be changed with a crime for letting the criminal keep his gun that he was concealing. This is getting to be a high stakes job! I want to finish out my time 99 so I’m not culpable for anyone but me! This job totally blows!

Totally agree. If you can’t stand the heat get out of the kitchen. This job ain’t for everyone, hence the weak turning to booze and other things to self soothe. But I blame the city and department for not weeding out the Sally’s in the application process. Some - A LOT of people actually should have never made it past the initial psych test let alone the follow up with the shrink. Sorry to hear you can’t sleep well and tip the bottle a little too much, but you’re 7 x 3, so figure it out one way or the other. And while you’re doing that you can work a desk or other admin spot and keep kicking into to pension that guys like me who did 30+ years in the ghettos (4 shootings, 2 fatal, dead babies, people burned alive trapped in a bldg while I heard them scream as they cooked to death, etc etc) contributed to without complaining. God speed brother, but suck it up and handle your business. It CAN be done without all the drama attached to it.


How do you handle it ? Church, EAP, talk to a counselor?

He was never shot. The round did not penetrate his skin. The round was recovered in the driver seat. This guy was struck by a spring in the seat that caused a small bruised to his back. The doctors at Northwestern had difficulty finding his "wound."That is a fact that can't be disputed. In fact this guy caught a flight to Miami the same night of the shooting. Everybody in 018 knows he's on BS.

And if they peeled off his 5 shirts and 2 pairs of pants IPRA/COPA would beef that the officers conducted a totally intrusive strip search they were not entitled to perform without a warrant. Anyone remember the two tact officers in the 010th district that were shot by an arrestee in their back seat? Happened in the late 80’s or early 90’s if I remember correctly. The bad guy gets arrested, transported, processed and put in lock up. He wants to help himself and says he has info on a drug house. The officers take him out of lockup so he can show them the house. He’s handcuffed and put in back of tact car. He pulls the gun he had on him the whole time and kills both officers in the car. Both officers were rightly given full honors funerals and their stars placed in the honored star case at 35th Street. How is this any different?

Not a copper here, but CPD should supply all officers with metal detectors. The kind they have at the airport security check points so you guys can scan all your prisoners. Should be standard equipment for all officers making arrests.

The department does need someone to be following up on situations as such. Look into this type of crap when an officer is put in for an award and is also given a CR number for the same incident. There is no cross checking done and it does make the department look stupid and liable.

As far as this particular incident, this cop should not receive disability pay. He is disrespecting all working cops who do have PTSD from past military experience, yet they work through their issues so that they can continue to be good police officers.

To all cpd officers , write a to from to your district commander requesting that metal detector wands be available and in working condition as per lock-up procedures. After a reasonable amount of time has passed, file a safety grievance, you could save someone's life.

Think you misunderstood the comment. He didn’t say that. The shrink said he was below the threshold for PTSD, then the pension board psychiatrist said he was too angry at the city to be allowed to go back.

This is actually a very good idea. I’m retired and never worked the lockup but I think I remember seeing these used in lockup. Maybe not but no matter. How much can these things cost? Would they be sensitive enough to work with someone with 5 layers of clothes on? If so it’s a no brainer imo.

He's over 50 with more than 20yrs of service, so he's eligible for a regular police pension either way. That is assuming he loses the court fight to regain his disability pension, which I think he will win.
The pension board never should have awarded him a disability for ptsd to begin with. That is a slippery slope that every single officer could eventually claim. Disability pensions should never be given for mental reasons, because how do you quantify somebody's alleged stress? It's not possible and is ripe for abuse.
On a side note, why the fuck would anybody feel bad for killing somebody that was trying to kill them? Would you feel better if the shithead would of succeeded? It's policing in the ghetto, so what did all these morons expect when they took the job?

If they wear layers of clothing, you remove layers of clothing and go thru them. No one meant getting a person naked on the street. If you cannot be smart in figuring out a way to thoroughly search a bad guy before putting him in your car, then you may be a dead man.

I'll preface this by saying I am a Desert Storm veteran with two tours in Iraq, injured in field, losing 3 when our Humvee was blown up by a roadside bomb.
I have PTSD, I know it and I deal with it. I don't deal with it by drinking to excess (as admitted by Warner), by crying about how I don't know how I'll react on the street (as admitted by Warner), and by complaining that my benefits are being taken away because I won't go back on the job (as admitted by Warner). I enlisted in the Army of my own accord, as Warner did with the CPD, knowing what the risks were and agreeing to take those on. In jobs like this you don't only get to bask in the good days, you have to take the bad ones, too. They are part of what you are getting into when you decide to make the Army, or the CPD, your chosen line of work.
I get it, people need help with PTSD, thousands of veterans deal with it on a daily basis; if something or someone doesn't work for you, you have to keep looking until you find someone or something (healthy) that does. Drinking isn't going to be your answer. Neither is going to the media every time you get an answer you don't want.
Take a step out of the spotlight and take care of yourself. Once you get yourself together, you can step up to help other people.
Go ahead and say I don't know what I'm talking about because I might be a "desk jockey" or that I haven't been on the streets of Chicago but remember: I did fight on the streets of Iraq to ensure the freedom you have to say that. You're welcome.

Guns are missed. It's messed up and unfortunate but it happens. We are all human on this job and in the winter the layers that these shitheads have on are endless. It's not something that should be brushed off but an honest mistake like that doesn't instantly erase years of good honest work and make a guy a bad cop--nor should it be grounds for termination. I'm speaking more in general than I am about Warner. The reality is you cannot search someone on the street the way you once could. The block can and has emptied out on myself and others if they see you are doing anything that resembles old school police work(i.e tossing a car, peeling back layers, stripping etc.). Even further troubling is that with these BS ISR's, you have to make sure your protective patdown was JUST THAT and that alone! I know good coppers who have made the mistake of missing a small pistol concealed somewhere deep within layers of disgusting clothing. The pistol in these cases was found in lock-up when the same coppers did the type of search they WISHED they could have done on the street. The guilt and apologies that came from them for putting themselves but more importantly other officers in danger was real. I love the metal detectors idea, it hadn't occurred to me that this was an option. We should push that, it would make us safer.
