Polluting the Jury Pool

Notorious criminal defense attorney Ed Gensen all but assured that R. Kelly defense team will have plenty of grounds for a trial outside of Cook County (via wife beater Steinberg):
  • “He was guilty as hell!” Genson said. “I don’t think he’s done anything inappropriate for years. I’ll tell you a secret: I had him go to a doctor to get shots, libido-killing shots. That’s why he didn’t get arrested for anything else.”

    I wondered if this statement might violate attorney/client privilege. But 1) Genson volunteered the information; 2) Kelly is no longer his client; and 3) attorney/client privilege doesn’t hold if a client is engaged in ongoing criminality or is perjuring himself. Both might be the case if Kelly is indeed found guilty.
Gensen is dying of cancer, so he probably won't live long enough to face a disbarment hearing. And now, Kelly's people can make a pretty good argument there's no way to seat a jury that hasn't heard at least part of this - which might actually backfire, seeing as how his base of support runs deep here.

#3 is wrong slightly.. Privilege isn't removed just because someone is no longer your client. Disclosing you instructed your client to get libido suppression injections because of "insert allegation here" is a Law License Losing Statement Right there.

Privilege only fails to apply IF you are currently their Lawyer and you Knowingly Engage in a Criminal Conspiracy to further the etc...yada yada yada.

It is Genson's opinion. Many lawyers defend clients they know are guilty. A good defense attorney asks the client, "tell me the truth, if I defend you I have to know the truth." Then,they only try to raise reasonable levels doubt, no more. Genson did nothing unethical and will never be disbarred.

You gotta have testosterone to do that. Also,

He miraculously got an acquittal here in Crook County a decade ago.
Moving the trial would most likely backfire on the defense.

Finding an ignorant jury pool won’t be a problem, but trying find and choose a stupid is, and better for the defense.

Although it took 6 years to get that trial to a jury of peers, I wonder what the case had stricken under S.A. Devine’s office and why.
Celebrity immunity...here?
How likely were Corrupt Crook County officials had their campaign coffers filled?
Under restorative justice it might be even a better deal, foregoing lengthy trials in exchange for a plea program.

Forbidding the entire prosecutorial and judiciary from accepting campaign donations and see what happens.
There would be no incentives and maybe the Courts would just have do their jobs by the book - or not.

Gotta wonder, who’s really staying fetal us or the County prosecution.
Who really cares.
No arrests and we could one day put them all out of business.

at one time eddie was a very good attorney but if you looked at some of his cases later on in his career he lost way more than he won. I remember him in the old days he would never hurt a police officer especially if he saw you in the different courts every day.
