In the creepy POW interview (check out his beady eye twitching!), Joe Maggot made the following statement:
- "In the last two years, the Cook County State’s Attorney’s Office has referred more than 5,700 cases for alternative prosecution. This is not a new or unusual practice," the office said in a statement. "An alternative disposition does not mean that there were any problems or infirmities with the case or the evidence.
Some commentators have suggested an FOIA blitz for some of these cases, seeing as how no one could recall any of these "alternative prosecutions." Either they inspired someone or the CWB blog has triggered some investigative reporting (click for larger version) by Dan Proft:
The actual Chief of Criminal Prosecutions for Crimesha can't recall any "alternative prosecutions" either and is actively seeking people on staff to help find even a single instance among the supposed 5,700 cases, so Crimesha can claim there is some sort of precedent for dropping the 16 felonies for a $10,000 bribe.
Crimesha's office is leaking like a sieve all of the sudden. Perhaps the Prickwrinkle Machine is in a state of revolt?

I'd like that too, but many of us are just staying fetal... prosecuting the cases we have witnesses and officers for, and avoiding involvement in the office BS. We support the Police. Many of us have been through several elected State's Attorneys.

There is nothing outrageous about this practice. Back in the days when grown-ups ran California they included the practice in our (now for me, their) penal code for financial crimes cases. The court was authorized to take into consideration the defendant's effort to make restitution BEFORE being charged with the crime.
Fraud inspectors would tell a swindler that they had two weeks to sell their house, sell their mom's house, or whatever before they were charged. The law requires the source of the restitution be identified. The defendant sentence is based on the amount stolen but also mitigated by the amount of restitution. This practice is much more efficient than court ordered restitution because as we know most people on probation or parole never actually pay all their restitution.
Now you coppers know when offered the choice of getting some of their money back or sending the defendant to jail for a longer sentence the choice is always "I want my money back." As they use to say, "do you want gold or justice?" Few wanted justice.
I read this "insignificant blog" every morning so I can tell my friends and relatives still pulling on the oars how good they have it compared to the conditions that you (CPD) labor under.

The Cook County State's Attorney's office is no longer a law enforcement agency partner. Those laws meant to keep communities safe remember. It is all about "restoring" the defendant to his place in society whether they deserve it or not. CCSAO requires herculean efforts to get cases charged and then they ignore all of it, in the interest of the defendant. Foxx is Preckwinkle's hand picked choice for the job as this is her idea of criminal justice reform. I'm seeing no accountability means no laws.Pack it up.

Was there a big layoff at the prosecutors office lately? Maggot said limited resources available to prosecute this case, how is that possible since the police arrests are down by double digit numbers and the SA are refusing to charge. So unless there has been a huge cut in staff there should be plenty of time to try a national high profile case. So if I understand the logic all Class 4 felony charges will nt be prosecuted in future? If so how about letting all the convicted Class 4s out of jail. THe CCASA fails to charge sex offenders who fail to register CONTINUOUSLY. This falls under their “court diversion” tactics set forth by none other than Crimesha.
You get a sex offender, usually a child predator, who is arrested and felony charges are sought by the detective from felony review for failing to register. Sometimes they don’t want to approve charges no matter how strong the case is. If charges are approved, the CC ASA will tell the offender at the first court date to “go register” & charges will be dropped.
Guess what, most of them don’t come to register and have absconded. Wtf.
The Asa calls the CRU office to see if the offender came in to register and then told no Joe Sodomizer did not come in to register & who knows where he is at now. Why isn’t he in custody ? It’s unbelievable and defies logic. It’s also a slap to law enforcement who are trying to keep these child predators from sexually assaulting their next victim. This practice of failing to adhere to the IL Statutes and blatant snubbing the law is rampant in none other than Cook County. If the offender was arrested in any other county in the state of Illinois, they would be in jail awaiting a trial. Chicago is a mecca for convicted sex offenders. Most claim “homeless” and fly under the radar which means they are living next to a school or someplace else they are not allowed to reside. Even if it’s proven the the offender is lying about where they are residing, the CCASA don’t want to approve charges. ASA will also advise the sex offender to “just register as homeless” knowing that this is not accurate and true. The CC ASA displays blatant disregard and judicial negligence in regards to the IL SORA. Why is this allowed to continue ?
