Clean Slates

  • Tens of thousands of cannabis convictions will be automatically expunged under a partnership between a tech nonprofit and Cook County prosecutors, part of an effort State’s Attorney Kim Foxx characterized as “righting the wrongs of the past.”

    Foxx said the collaboration with Code for America would help atone for prosecutors’ role in an overzealous “war on drugs.”

    “It is prosecutors who were part of the war on drugs, we were part of a larger ecosystem that believed that in the interest of public safety, that these were convictions that were necessary to gain,” Foxx said at a news conference Tuesday. “In the benefit of hindsight and looking at the impact of the war on drugs, it is also prosecutors who have to be at the table to ensure that we are righting the wrongs of the past.”
Um....dumbass? These were laws. Laws passed by legislatures. Prosecutors, believe it or not, actually are tasked with prosecuting violations of the criminal code. We know that's news to Crimesha, but once upon a time, prosecutors ran for office based on their ability to convict criminals.

Now, we realize attitudes have changed regarding weed use, and it's economically unfeasible to jail everyone, nearly impossible to fine everyone and too much potential profit to be made in weed cultivation, which is the actual driving force behind the legalization push. But that doesn't mean prosecutors were wrong for doing their jobs.

Is it just me, or do I smell a rat here and expect that the corruption that is about to happen because of "clerical errors"? Lots of felons are somehow going to get their convictions for more than a small amount of weed expunged. It's SJW, and free the victims of racism time! Hallelujah! it is yalls job to protect and defend our rights, not violate them and then claim afterwards that ya was just doin yer job.

Read the Declaration, read the Constitution and abide by yoir oath to protect them...especially when it comes to arresting the corrupt politicians abusing the Citizenry.

So let me get this straight. They are going to expunge records of people who broke the law and were convicted under the law by the courts. But they are going to keep records of police officers, which are on line for anyone to see (Citizens Police Data Project-Invisible Institute), of allegations of police misconduct most of which are unfounded, not sustained and exonerated. And these stay up forever. Something is wrong with this system and the people running it. Can you guess what it is? This is a movement all across the country by a certain political party to decriminalize crimes to gain votes. The majority of Americans are asleep at the wheel and have no idea or care that their country is being taken away from them.

Don’t forget a lot of those convictions for “the mere possession of cannabis” which sounds so innocuous, were actually plea bargains down from manufacture and delivery cases because the State’s Attorney wanted an easy conviction rather than going through the “bother” of putting a trial on. This happened on the federal level too when Obama started to release some high level drug dealers that were presented as minor drug possessions. Sometimes you win sometimes you lose in a trial. I am not speaking of cases which are obvious that you are going to lose on the face of it. The Cook County State’s Attorney’s Office is not structured to pursue justice, it is structured to win cases for the sitting State’s Attorney to have a high conviction rate so that they can be re-electable.

Code for America Brigade has some connection with Open Uptown which has a website but it really does not tell you what they do or support or where they are. Maybe you have to be invited in. But they do have a “code of conduct” list which tells you how to be “politically correct on what you say and how to say it”. It sounds like a lot of left wing progressive talk gone amok.

Fingerprints stay on file. It stays in the FBI database and law enforcement will still have access to your records. Heck if you apply for one of those TSA fast passes it will still be in the system and you can be denied security clearances. More PR than substance. Could have hired a lawyer to do the same thing on your own. If you had a minor conviction it could make it easier to get a job whatever. You did something stupid, paid the penalty, you should have a chance to get on with your life. Again this is more PR than substance.

A conviction for possession of small amounts ( personal use) of all drugs should, at the most, be a misdemeanor. Making these felonies was not a deterrent and does not work. However, selling drugs, or possession of a large amount, which means you are selling, and that includes weed, should not be erased from the record. But, if you have read the Illinois law on recreational weed, grants and loans will be given to formerly convicted weed dealers so they can open up a legal weed business, once their record is expunged. I believe that they are being given preference because they are an oppressed minority. Studies in states that have legal weed show that only 25% of the consumed weed were bought from legal shops. The remainder? Well , that is coming from the street dealers. It is cheaper.

I was never really a "dope" guy, but I sat in court a lot of time. I don't remember ever a conviction for cannabis, unless it was a huge amount taken in on a warrant, or just plain luck on a traffic stop. Mostly dealers, or gang members moving the product for said dealers.
My point is...anyone actually convicted of a cannabis conviction in cook county is probably a bad fellow, and deserves to be convicted.

Probable cause that led to weed possession, like robbery, armed violence, UUW, getting tossed as well?
DUI offenses, what about those related to weed.

When the 21st amendment repealed the 18th amendment (Prohibition) , did the people with criminal records under that law get their convictions expunged? Just a guess, but me thinks NO!
Maybe Mr. Capone could have turned his life around and gone on to a great public career if that was allowed?

Already done. CCSAO has prosecuted anyone for possession of controlled substances for years. When police bring cases involving possession of narcotics to court, the CCSAO "diverts" the cases into its non-scheduled "drug courts" where junkies agree to attend 2 classes in exchange for the prosecutors not filing charges. All carot, not stick.

If the cases involve deliveries of larger amounts, defense attorneys will simply opt for a preliminary hearing where a judge will conduct a hearing yet find no probable cause to arrest no matter the facts.

Narcotics have been de facto legal in Cook Co for more than a decade.

They weren’t arrested or charged with a crime. They were dismissed for a violation of a condition of employment which is not the same
