FOP Win

Affecting the 006 District:
  • The Lodge is happy to announce that the Illinois Appellate Court ruled today that the City must arbitrate with the Lodge on the city's attempt to change start times city-wide and eliminate day-off groups in the 6th District.

    The issues must go to arbitration within 30 days of today's ruling.
Somehow, the City keeps violating the Contract and daring the FOP to take them to Court. The FOP seems to prevail most of the time, but we don't have actual numbers. What is this costing the union in legal fees....and just as important, what is it costing taxpayers that the City regularly attempts to screw over the FOP?

So will they have to re-bid all the furloughs, too?

Legal fees should be paid for by the liable party. That is usually how it
works. My ex spouse had to pay my legal bills for my divorce lawyer
when I sued for divorce and won. She made a lot more money as a,lawyer than I did as a LEO.

This is a victory. What now? What do we get for this and any previous “victories”? Didn’t we win on body cams? Everyone has one strapped on their vests. What actually comes from these “victories”? Perhaps a current or aspiring FOP representative can explain this.

Where does Graham get his statistic's, in the FLOP magazine his article wants to give u a attboy, for keeping the homicide count under 500, does he know about Heyjackass with the real count, and all those gun's seized, all bull shit????????

They should treat it just like a lawsuit. If it is determined that the city violated the contract then the city pays all of the FOP’s legal bills. If it wasn’t for the city violating the contract, the union wouldn’t have had to shell out the money. There is no putative liability on the part of the city to violate the contract when the only recourse is for them to reverse course. Hit them in the pocketbook everytime they violate the contract. Legal fees and putative damages.

I'll ruffle some feathers here, but it is not a contract violation, which is what arbitrator will say. Open your contract and show me where it delineates what the start times are...it does say that what ever time you start they can't change it more than two hrs either way without OT compensation. Whatever the listed times on the sheets are at beginning of period, they can't go two hrs past without OT. Then go look at the 'Management Rights' of the contract and read it. Should be an interesting arbitration

It’s amazing we are getting all these “wins” by this administration so close to election time. I’m enjoying watching Preib and Graham fight over who did what.

On the same subject, I heard Mark Donahue, when he was fired as a contractual lobbyist by the previous administration, filed for unemployment insurance from the Lodge even though he was still on the Board getting 700 a month and his detective pension. For those who aren’t familiar with how it works, the Lodge(our dues) would have had to pay Mark if his claim was successful.

If we keep violating the Rules, we get a Suspension... which effects the paycheck more ways than one.
The City continued for decades of violating the Contract (rules) and we’re lucky to get back even-steven ruling from the court for any loss. Isn't it about time OUR attorneys representing US should be seeking punitive damages for the City continually violating the a contract?
These violations are not complex 10,000 page, lost in translation and interpretation mistakes. They are orchestrated ploys of a pattern and practice the City has been long engaging in. Have the courts have yet to take notice or is it not being brought up?

This is the result of over 50 continuous years of democratic rule in Chicago! When the voters elect, or re-elect, people who have continually proven they are not trust-worthy with the public interest, then these same politicians/vermin put people in other offices and positions and the cancer grows to 2020 Chicago! Can we find Mrs. O'Leary's cow & start over?

Doesn’t always work like that. Here’s a case just settled against Madigan. A former campaign worker won a $270,000 settlement. She got $75,000, lawyers $200,000. Unless you have a sure win, they don’t take a percentage but bill hourly

The legal fees come on top of the $275,000 settlement Madigan ultimately paid Hampton last week. But $200,000 of that goes to Hampton’s lawyers.
