- Sixteen years after then-Mayor Richard M. Daley’s nephew Richard J. “R.J.” Vanecko threw a punch that cost David Koschman his life, newly released cellphone records reveal that one of the people Vanecko was with called the mayor’s brother just eight hours after the incident.
Long hidden from public view by a court order, the phone bill obtained by the Chicago Sun-Times shows Bridget Higgins McCarthy called attorney Michael Daley around the time that two Chicago police detectives had come to the McCarthys’ house. The cops were looking for two men who ran away after the punch was thrown, leaving Koschman unconscious on Division Street around 3:15 a.m. on April 25, 2004.
McCarthy’s husband Kevin, who’d initially been handcuffed at the scene, lied to the detectives, telling them he and his wife didn’t know the two guys who ran away. He didn’t tell them that he, his wife and those same two men all had been together at an engagement party for one of Michael Daley’s daughters earlier that night.
The detectives asked to speak with McCarthy’s wife. But he told them she was unavailable, and the police left.
About four hours later, the police investigation came to an abrupt halt, records show.
This sore will fester for years more yet.

Dan Webb did a terrific job with the investigation. No stone left unturned. We can expect a similar result with the Juicy Smellit fiasco.

Happens everyday at crime scenes. Here are the facts. Two independent witnesses saw two groups arguing and then the groups walk in opposite directions. The witnesses then see Koschman break away from his group and run up to the Vanecko group. The witnesses see Koschman get punched. The witnesses said it was Koschman who was the aggressor. Koschman friends say he was drunk and rowdy. Vanecko surrenders with an attorney and invokes his right to remain silent. Koschman friends looked at a lineup that Vanecko was in and none of them could identify Vanecko as the person who punched Koschman. The independent witnesses looked at a lineup and again Venecko was not identified. So nobody could identify Vanecko. He made no admission. Independent witnesses said Koschman was actually the aggressor. Felony Review is contacted and they tell Detectives they had no case. Media hysteria and case reinvestigated. Koschman friends reluctant to cooperate and/or refuse to cooperate on advice of law firm representing Mrs Koschman. Head of Felony Review testifies at Grand Jury that he was contacted during first investigation and told Detectives there was no charge based on the evidence at that time. He also testifies that was the right decision then, and the right decision now.
Is anyone surprised? And shame on those detectives and supervisors for letting the investigation to stop. You have mouths too. That could have been your family who was murdered!

Assuming you're a PO I have no idea why you're being so defensive of this man. If this was a fellow police officer, he'd be looking at big jail time and his life would be ruined. This investigation was obviously botched purposely for Daley's nephew. He clocked the guy and the guy died from it. There's nothing that indicates that Koschman escalated the altercation to a physical level. The term aggressor is used quite loosely here. Talking shit is not equal to being punched in the face. If you can't control yourself from attacking people who talk shit, you shouldn't be drinking in a Chicago bar til 3 in the morning. Did he mean to kill the guy, doubtful. But the man died as a direct result of his actions. If it was one of us, we'd be fucked. Fuck Vanecko.

In theory I agree with your assessment. I have seen stronger cases not charged by the ASA.
May I say that when this was punted over to Area Five to be reinvestigated I was a sergeant there and tho uninvolved, I was curious.
I read the entire investigation to date, and I must say I have never seen a more exculpatory narrative.
Basically the detectives concluded nobody could be identified, but even if they were it was self defense.
Yes maybe the victim brought this on himself but let’s face facts, the powers that be weren’t taking chances.

This case went all the way to IAD, After the Koschman family asked IAD why no investigation was done by CPD?
The Chief at IAD had thus CR closed after investigator started to collect evidence. (Isn’t that what an investigation is suppose to do?)
In 2010 IAD opens new case because of the media asking for reports under a FOIA.
IAD reviewed prior reports and knew there was no criminal investigation of the Death and no IAD investigation why?
That case was slammed shut again. Why? because the IAD investigator requested and opened the original case reports again!
The truth shall not been seen by anyone.
Then in 2011 IAD opened a new CR but give it to a Sgt in IAD that was retiring in weeks.......they did not want any answers!
The investigation was closed in three days Not Sustained.
So after three attempts to investigate the CPDs involvement in this Death, only one case is available and it was closed in three days....
Not Sustained......And Dan Webb agreed with all this Bull$hit....the Democratic machine just protected the Daley Family.
Again if this was any other Suspicious death on the street after a fist fight, detectives would have canvassed, interviewed and taken this evidence to the ASA for approval of charges or Grand jury.
That was never done and that is the crime of cover up.....to protect the Daley family.
The death of Koschmen was a street fight that turned into murder and should have been investigated.
The Detective Divison not investigating this Murder is also criminal and police misconduct.
The Facts that CPD and IAD could not investigate themselves shows the power the Daley machine controlled the CPD....
Look at Goofy Lt. Walsh of the Detective Area, who took the criminal case files home to hide them. WHY?
He was connected to Walsh construction. Who did major work for a City of Chicago under Daley administrations. Favors and conspiracy!
It proves that in the City of Chicago, you can get away with Murder if you are connected to the right political party!
Even if the Murder rate goes past 300 a year.....it only takes 1 Murder to show how to get away with it.

I had the privilege to speak with Mrs Koschmen back when the media brought this back in 2010.
All this Mom wanted was to find who struck her child and caused his death.....as it took so much time to answer this.
She became the only person interested in her sons death! That just broke my heart.

Dan Webb refused to adequately investigate the case properly because he was helped out by the machine big time when he did something very bad a while ago. They owe him and they know it.

And exactly how are you related to the Daley crime family? A kid was killed by a Daley family member!! Now just reverse the roles and say that kid killed that jerk Vanecko. No doubt the states attorney office would have approved felony murder charges with even less evidence. Heck, the Vanecko family probably would have even put up his 8th grade graduation picture while saying he was a good boy. And if he was sooooo innocent, why did he plea guilty ???????

Daley crime family had this case from the beginning. Detective Walsh was bought and paid for and for all his crimes he got a nice pension after he finally retired. He should be in prison. And the poor mother of Kochman got a few hundred thousand dollars. If it was a kid of a different color than never worked a day in his life, the family would have received millions. I got on this job in 1996 and we used to have stickers on the back of every squad car bumper that stated "Bias Free City". It was such bullshit then and it is such bullshit today!

Very well put and completely agreed with!
The shame of this entire matter is the fact that it was written off as just a " drunken bar fight", disregarding the fact this young man lost his life. And, a cover-up directed , most likely right from City Hall and agreed to by department brass and detective unit leaders. Anyone along the way could have refused and blown the whistle, but many most likely afraid of retaliation.

As much as I dislike what the Daley family did to our city, Koschman was a drunk bully feeling his beer muscles. Most any of us would have hit the asshole because he deserved it. Sad that he hit his head when he fell, sucks that it was covered up but that doesn't change the fact that he caused his own death. So tired of hearing about the BS. There is a lot more that Short Shanks and his family are guilty of, but this is one that I cannot find fault with (except the coverup).

The phone call didn't go to a regular "lawyer". It went to Vanecko's Uncle who while a lawyer also happened to be the brother of the Mayor.
How come the CPD investigation didn't turn up the phone records? How come Dan Webb missed it?
Also your description of the encounter is BULLSHIT. That's the description the initial "investigation" chose to use.
How come no detectives looked for security camera footage immediately after the incident? Even later after Koschmann died no one looked.

With all the time and effort spent on this case in the end Vaneko got 30 days in jail. Sounds like the original detectives knew what the out come would be. ... basically no one was going to jail on this case. Hardly anyone has ever been charged with murder in this county for a bar fight and if they were they received probation form 2nd degree.

No one ever asked why Lt One N Walsh was assigned to Area Three just as this case was being re-opened and questions were being asked by reporters. He rose through the ranks at Area Four and was the only Lt. handpicked by the exempt elite to Area Three Homicide to "supervise" this and other high profile cases. The areas were combined so that he could access and lose important case files and he did plenty of that.
Daley's son was the killer and Vanecko fell on the knife for Uncle Mayor.
This case is the best example of why city hall controls all CPD promotions of Lieutenant and above. When the shit hits the fan as it did in this case, they want their people there to cover it up. Look at Lt. Walsh’s pedigree. Lords of the Manor all, with direct connections to city hall. Lt. Walsh should have been indicted and fired for the incident in Indiana, but city hall protected him and he owed the Daley Crime Family big time. Best thing you can say about this piece of shit is that he pays his debts, even if it means covering up a homicide, and making hard working honest cops feel dirty. Fuck you, Denis.

Lt. Den (1 and only 1) "n" Walsh was arrested for a sex crime in Indiana and rather than fire him the CPD chose instead to make him the officer in charge of sex crimes investigations in Area North. Obviously, this was not a good decision. He was the most obnoxious goof I have ever had the displeasure of meeting. Denis was in his own mind the only "real police officer" in the world. He was a complete fucking tool, a bully, a goof and a fucking liar!
He took pleasure in trying to make police officers feel inadequate, or insecure because they didn't come from the great and almighty "Area 4". His whole group of peers were cut from the same cloth. How many disgraced officers can we name who came from that same cabal.....and I'm not even going to include the Matt Cline study group or his fat daddy's corrupt promotion lists or the Superintendent Drunk Blow Job scandal....These Area 4 goofs are a disgrace to humanity!! Does anyone remember the incident in the 009th district back in the late 70s a wagon man was putting a prisoner in the wagon for transport and the village asshole in Bridgeport showed up getting into the coppers face one of the coppers pushed to drunk away from the back of the wagon and he fell hitting his head on the curb and died a short time later. His mother, upon hearing of his death dropped dead of a heart attack. The newspapers did a big story showing a picture of the dead guy in his boy scout uniform from 20 years earlier and stating that he never could hold a job but he helped everyone in the neighborhood. The copper was never charged but personally took the incident to heart and became a uncontrollable drunk and left the job. He later committed suicide.

Agreed Walsh and his asshole buds in area 4 were arrogant goofs and belittled anyone else who was not in area 4. The cover-up stories are vast and they got away with it thanks to the Daley empire.
Many years ago handled a similar incident with 2 citizens. Argue in bar, walk outside, one punches the other, his head hits sidewalk and rushed to hospital with brain injury.
So, unlike king Daley's relative this person who did the punching has no clout and is charged with attempt murder. So yes, Vanecko got away with killing this kid and if any copper helped in any way to help the Daley crime family go jump off a cliff will ya.....
There will never be another Captain John Farrell. As a sergeant he went out of his way to show young coppers the department way of doing things. He then showed you his way, which was always better.
