Big Loss

  • Chicago’s police union can’t enforce a provision in its contract for destruction of misconduct records, the Supreme Court ruled on June 18.

    The Justices found public policy outweighed the provision, which required the city to destroy misconduct records after five years.

    “While parties are generally free to make their own contracts, this court has long held that when a conflict exists between a contract provision and state law, as it clearly does in this case, state law prevails,” wrote Justice Lloyd Karmeier.

    He based his doctrine on a common law notion that, “courts will not lend judicial power to the enforcement of private agreements that are immoral or illegal.”

    Chief Justice Anne Burke and Justices Rita Garman, Mary Jane Theis, Scott Neville, and Michael Burke concurred.
Remember, these provisions didn't erase sustained cases of misconduct. Those were preserved forever. The agreement was to destroy Unfounded and Not Sustained accusations, which is to say cases unsupported by facts, witnesses or evidence. There was and remains absolutely no purpose in keeping these files. They have been investigated and cleared. It's the same in criminal cases - you can't use unsubstantiated accusations or findings of innocence in other court proceedings.

So once again, against all convention wisdom, Police Officers have been placed under the Law that protects every other citizen.

I teach business law at one of the top universities in Chicago and this ruling gives me a cold chill down my spine. There is no basis to interpret the law in this manner. Functionally, the Illinois Supreme Court pulled the ruling out of their ass. I do not see how this contract provision can be illegal or not moral. Courts will overrule contracts that are illegal or against public policy (like paying someone to vote for a particular candidate or executing a contract to have your spouse murdered). But this ruling is completely and utterly pulled out of their asses. Needs to be appealed to US Supreme Court, assuming the Union gets a Writ of Certiorari. Of course, with Chief Justice Roberts becoming more and more liberal with each new ruling, I would not hold my breath. Bottom line, baseless opinion from elected morons.

I’ve had three CR numbers in the last 12-15 years that I was never notified of until I got the dispositions. All three were for false/unlawful arrest filed by guys in Cook County jail. I got notified of the CR and the Exonerated disposition at the same time. So, that’s THREE PRIOR COMPLAINTS of misconduct on my record forever? It’s unconstitutional for a defendants PRIOR CONVICTION background to be mentioned during a jury or bench trial, let alone his arrest history, but our history of CR accusations that were not proven or disproven is relevant?

On a rainy Saturday night in Chicago, we lose a three year old, a thirteen year old, a sixteen year old and a seventeen year old in Chicago to gun violence perpetrated by people of color on people of color. This is one of the cities where the protesters claim that “Black Lives Matter” and Police should be defunded. At what point does Chicago have leadership who will tell these protesters that their efforts need to be directed toward the perpetrators of this violence instead of protecting these criminals with their intentionally misdirected nonsense.
The blood of the children lost to this violence on this rainy Chicago evening, is on the hands of Mayor Lightfoot, Supt. Brown and all of the protestors, politicians, reverends and those who continue to blame the Police for all of societies woes.
Without question, we in law enforcement have knuckleheads amongst us, and we need to do better to police ourselves. Regardless, the Police are not the scourge of the West and South sides, it is the terrorists who reside and are protected in the communities which are held hostage by this violence. Wake up people and place the blame where it belongs and demand action before it is too late for all of us.

One for seeing whom they meeting with and one on a selfie stick aimed at their face to see what they say. Did you know that pilots and train engineers have cameras trained on their faces while operating.

And speaking of Chief Justice Anne Burke who is married to Alderman Ed Burke, wouldn't you like to see their disciplinary histories? Well you won't because politicians don’t keep disciplinary histories on each other. But if politicians wore body cameras we could really keep tabs on them. Consider the two above. If they had to wear them we would learn more from their dinner conversations than Mob Attorney Bob Cooney was able to tell us.

Years ago a grievance was filed on this. The first steps were taken by FOP, but then it sat in a box in Ag-u-liar’s office for years. NO further steps were taken. When Angelo got elected they found a box of grievances that had not been completed. But when the McDonald shooting happen it stopped the court proceedings he had started. Ag-u-liar’s reward for incompetence was to be hired back as an un-elected Field Rep by Kevin Graham at captain’s pay on top of his pension.

Food for thought... Shields went back to a beat car after his term as president. Where did Graham land? If Graham was doing his job he should have been sent to a sh!t hole. His landing was so soft they put a down pillow in his chair. So much for fighting for us. This new crew at Fop has done more in two months than Graham did in three years. He was just another Donahue puppet.

Look at the murder rate for all of the 70's and the 90's. 2016 would have been just an average year, even a little lower than average. In the 80's Jane Byrne was mayor so the rate was lower that period because she allowed the police to be the police.

If I am not mistaken you have to sue in lower federal courts first. It takes close to 1 million to get the US Supreme Court to hear a case

If you put your name in this search all the complaints against me, you and every other CPD member comes up. Your comment about "Who cares?" while complaints being unfounded are still out there for everyone to see is a bad idea.

What if you were an employer and were hiring someone and they had 25 arrests but not convicted any of them? Would you still want to hire the guy in spite of 25 not guilty findings? I'm not talking about what labor laws say, I'm talking about you as the business owner or a perspective client of a business owner. Would you push the resume or shit can it? I own a business and I can tell you how easy it would be for me to find another legit reason NOT to hire the person.

What if you want to get a job post-CPD in law enforcement? (God forbid) A Google search is all it takes to reveal this. Will that reflection of your career make a difference on getting hired elsewhere? You don't know what may used to disqualify you especially if you stay in law enforcement. All the aggressive cops I knew had a laundry list and the bitch desk jockeys have like zero complaints.

As an employer (without a fucking clue as to how the CPD works) you'd be more apt to hire the bitch desk jockey who was NOT the real police and not realize that he/she does not know how handcuffs even work.

Either way this is BS. Per the contract the files should have been getting destroyed all along and up until this point GONE. Now, going forward from here, that would be a different story. Either way it's a clear violation of the contract in spite of the court ruling.

Fortunately for me I was able to leave the shit show at age 50 and not have to look for another job in law enforcement due to my business.

I've spoken with two guys who retired and said they were asked about their https://cpdp.co/ profile and complaints and why they had so many "Not Sustained". They still got the jobs but again those are just two I spoke to.

Also try learning about the records of FBI/DOJ agents. They won't come on a Google search. You have to file a FOIA inquiry with the appropriated agency. What if you don't want anyone to know you were a cop once you leave CPD? I've had it happen more than once where someone Googles my name and I find myself explaining my search history to them.

You are that guy who will be STUCK on this job until you are 63. Watch and see.

This is not unusual.

Physicians negotiated with the state legislature for malpractice reform many years ago and the law passed and signed by the governor. There were SOME caps placed on non economic damages. In turn the physicians agreed for increased funding investigations for physician misconduct and a higher requirement for continuing education. The trial lawyers took it to the state Supreme Court and the malpractice caps were determined to be unconstitutional because it blocked the ability for people to go for unlimited awards. The state kept the increased fees for physician investigations and education requirement. the physicians vowed never to trust the state again

Now physicians with 4 years undergrad degree, 4 years medical school and a minimum 3 years after medical school formal specialty training can get an Illinois license. Further specialties require ar least 2 or 3 more years training. You have to take boards every 10'years to be certified to have a hospital practice.

Nurse practitioners get 4 year nursing degree, pass nursing boards, 2 years nursing job "experience" and less than 1.5 years extra training with a Minimal hands on experience to get a certificate. They have lifetime ability to practice medicine with no additional boards with a nurse practitioner license if they keep up educational hours which are less than doctors required educational hours. One day they can practice dermatology and the next they can be a cardiologist nurse practioner without any further certification or specialty training. The state now allows them to have an unsupervised practice.

So, it's not news that the state screws over professions.

There may be another headache coming for officers wanting to leave CPD as a result of this ruling. Since your Unfounded and Not Sustained disciplinary records cannot be destroyed, even the requirement of the Illinois Personnel Record Review Act that disciplinary actions older than 4 years not be released to employers is now null and void. All a hiring agency needs to do is FOIA your entire personnel/disciplinary record, and they get all of it.

It's no wonder that anyone has any faith in the courts in the Illinois. The courts are full of shit and are tainted with political corruption. From the clowns in Timmy Evans Crook County Criminal Courts to Anne Burks Black robes in Springpatch, IL. Worthless they are in word and action. They are guardians of the Socialist Democrat Machine. Problem with the old records, especially the unfounded ones is they can be used in licensing hearings. Saw a discussion on TV where they said officers are having unfounded cases and staying on the job. Further stated that in licensing hearings the total number can be used like where there is smoke there is fire. Further was stated just be the number of complaints, even the unfounded one an officer could lose his license just because of the probability he will get more. Typical, officers in busy districts get more complaints just because of the number or jobs they get, number of arrests and the number of citizens the come in contact with
Others who go right from the academy to 016 , go to inside jobs slide for 25 years.

On a rainy Saturday night in Chicago, we lose a three year old, a thirteen year old, a sixteen year old and a seventeen year old in Chicago to gun violence perpetrated by people of color on people of color. This is one of the cities where the protesters claim that “Black Lives Matter” and Police should be defunded. At what point does Chicago have leadership who will tell these protesters that their efforts need to be directed toward the perpetrators of this violence instead of protecting these criminals with their intentionally misdirected nonsense.
The blood of the children lost to this violence on this rainy Chicago evening, is on the hands of Mayor Lightfoot, Supt. Brown and all of the protestors, politicians, reverends and those who continue to blame the Police for all of societies woes.
Without question, we in law enforcement have knuckleheads amongst us, and we need to do better to police ourselves. Regardless, the Police are not the scourge of the West and South sides, it is the terrorists who reside and are protected in the communities which are held hostage by this violence. Wake up people and place the blame where it belongs and demand action before it is too late for all of us.

CCSA removes all marijuana arrests from African americans when marijuana became legal . Most would be arrested today for the illegal possession or use of marijuana because of the new law of when , where and how it can be smoked or carried .
Just her way of rewarding criminal behavior .
Right Now today Mayor Lightfoot , Police will not respond to any mental calls , domestic disturbances , recovery of personal belongings , get armed police out of cps . Are black children criminals , is that what our Mayor thinks about black youth ?

Back in 1986 or so, with 8 years of LEO experience, I actually tested for the ISP, and was very surprised when I was actually offered a spot in their next academy. After much debate and discussion with my wife, I turned it down. One of the better decisions I’ve made in my life. Illinois has turned into a swamp. Even downstate, between the courts and the legislature, y’all are just screwed.

True. State employees took their case of retiree health care to the Illinois state Supreme Court and won. Two years the CPD Filed a similar if not exact case the mirrors the states case. Supreme Court has a problem because of their ruling in the state case and would have a hard time ruling one way for the state and the opposite way for the city. They figured a way out. They just refused to hear the city case. Just refused to hear it. That’s the sukk OK Rene court

We will never know how many cases were fixed.

But if a U.S. Attorney General ever gets around to examining a correlation between campaign contributions made to the members of the Illinois Supreme Court and/or Ed Burke with the results of various cases, they would know one way that modern cases are fixed. (Others involve favorable land sales, art auctions, hiring of family members and friends to be consultants or employees, etc.)

If some LEO wants to use their initiative to find out how some important pending cases are going to turn out, they can examine the campaign contributions. It would not uncover every fixed case, but an examination of the public records would be a start.

Sheriff Toupee Tommie Dart has plans to defund Sheriffs budget .
All Deputies assigned to Court Services will be assigned to corrections as correctional deputy officers .
Courts will have unarmed security Officer from a private security company . This will save Sheriff budget millions in salary , health insurance,vacations, and pension .
Security at jail will be beefed up as it should be for officers safety . Many old timers will take an early retirement because they will now be working nights and weekends .
It will be interesting . This is all from good sources in 19th Ward .

Memory Lane time. Cook County used to have a court in an old school in Chicago Ridge. New lawyer Ann Burke tried a DUI case there. Both the judge and the prosecutor knew her. They did more to help her win that case than Lil Kim would do now.
