We don't know why cops aren't getting the message. You'd be an idiot to bet against this happening here:
  • Colorado Governor Jared Polis (D), a progressive, signed an omnibus reform bill into law on Friday to end qualified immunity for police officers in the state.

    “This is a long overdue moment of national reflection,” Polis said at the signing ceremony. “This is a meaningful, substantial reform bill.”
You can tell this is a big deal to the lefty media. Look how they define "qualified immunity:"
  • Qualified immunity for police officers was invented by the Supreme Court in the 1967 case of Pierson v. Ray in response to Civil Rights protesters who sued a Mississippi judge and several local police officers over their unjust arrest and imprisonment.
"invented." But point out that Health Care is not a Right or that Roe v Wade was "invented" and listen to them scream.

The Colorado law explicitly puts your assets (house, car, bank accounts, pensions, etc) in play for any lawsuit.

Can you imagine this in front of a Cook County jury?

Remember.. you can be sued for proactive police work... but you can just be sued equally as easy for INACTION of doing your job. It will be a very fine tightrope to walk. Inaction can be a very very bad thing in the eyes of a jury. Jurors hate a cop that is painted as “lazy”.. they hate it more than a cop that is painted by the officers attorney as “going above and beyond.” I’m just saying, either way you can get in a Joan but don’t automatically think that doing zero will win the day. The only thing that will keep you safe if by documenting the crap out of everything and following your every general order and law to the T. If you deviate from any of it then you open yourself up. Don’t cut corners and learn to write paper and learn that if you need to take action on a job that it’s done the right way and documented perfectly. Complaints signed by a real victim, on body cam who actually says, yes I want them arrested and they physically sign complaints. But there’s a catch, just because someone wants to sign complaints for something doesn’t mean a crime was committed. You need to make sure all of the elements are there for a lawful arrest. Time to actually use your heads on this job. Isn’t it all fun!!

I remember someone here posting about how folks should try to get on in Colorado Springs because, they for the time being, have a pro police mayor. I wonder what he is thinking now? That state was ruined by the liberal California flakes that began moving there years ago, raising housing prices and diminishing the quality of living. Everywhere they go, they ruin it. So let these shithole democratic states and cities burn. If you still chase and do anything more than you have to then you are beyond stupid. On the good side, all the kooks are in Denver and Boulder. Colorado Springs will pass them soon in population, it has five military bases, 100,000 veterans, and a massive defense industry presence. The Cops are supported.
They are building so fast, they don't have to advertise new houses for sale. They are sold. The huge influx from California got that Governor in office. He got a lot done for the Democrats. He also got rid of the death penalty and is angering the rural folk. I don't think he will be re-elected. He is pushing section 8, it will kill the rental industry. It will screw anyone that doesn't have 400k for a house. I think this State will swing back Red. It is much more Conservative than you think. The population tripled since 1990 but control was in Denver. That will change.

Hi People, Its Missy, the older and wiser former parking ticket guru in 0o1 district. I retired last year in the spring after 4 years as a Lt. at headquarter at a super dupa secret unit. My Uncle Tom Byrne said I should go cause he wont be able to get me my well deserved captains rank. I said Sure Uncle Tom. My Uncle Ben lives in Colorado and that he can have me hired as a Chief of Police in the city of Rice, Colorado.
Now I am a chief with a 10 people department. I made the policemen get rid their shotguns for parking citation books. The people in the city said they love me and police should only have guns locked in their trucks in a safe. I traded those mean looking automatic pistols' for used 1951 Harrington 38 special that only fire snake shots. We don't need the citizens getting really hurt if my policemen have to get this revolver from their trunk. But, they must call me first for permission.
You know what people, my policemen are following what I thought them from when I was a parking ticket guru. We got money in bank to feed the 3 or 4 arrested folks we make in a year. I am so happy here.
I now do a lot of walking so my city does not have a big petrol expense from Jesse' filling station and treats.
I can come back to Chicago wearing my chiefs uniform and meet Mr. Lighterfoot. I heard is likes policemen working for her and wants to take the weight of their belt and get rid of those troublesome guns. She is worried sick about you people.

Also, in federal court, there's no cap on damages, and if a defendant loses, they're often ordered by the court to pay the plaintiff's legal fees.
For those reasons, most police cases are typically filed in state court. So, a state statute such as Colorado's which prohibits qualified immunity will have no effect on us most of the time...as we recently saw, qualified immunity is alive and well in the federal courts.

I knew a guy who worked for the city who was a complete moron, getting in all kinds of lawsuits. His attorney advised that he put as much as possible in Deferred Comp, cuz they couldn't get their hands on it. When he retired it becomes retirement income. He bought a fancy car and a restaurant, and lost it all, but it remained all his.

Oer USC 1983, I'm sure you've heard of 1983 lawsuits - they are the ones always filed against the police. Congress wrote into the law that the state pay the legal bills of the plaintiff so as to encourage lawsuits. Most police cases are filed in federal court, not state court. You have it exactly backwards.

Says the guy in Chicago, Illinois. We have open carry, we have concealed carry, we have "stand your ground", even in your vehicle. We have gun stores the size of Walmart. My town has at least 10 high-end indoor ranges and a massive civilian shooting complex on Ft Carson anyone can use. We have a full auto machinegun shoot here, every year. Everyone carries, 99% supports the Cops. 1/4 of the population of 450,000 is veteran. Denver and Boulder aren't Colorado just as Illinois is nothing like Chicago. Trust me, ranchers aren't liberal. We don't even have recreational weed in this town.
The protests in my town were light. College kids, manbuns and clueless little disappointments to Daddy. They lit a paper fire in the streets and the Cops gassed them. That's what I'm talking about! They never caused destruction, they were just annoying the Cops. A few nights back, a few dozen heavily armed men in full kit and "assault-style weapons" arrived and went for a stroll through the crowd. The manbuns headed home. Trust me, the hills are alive around here, they were just sleeping when Polis came in.
Don't judge a State with only the media as your guide. There are awesome, law-abiding people here that love America. They just didn't show up to the polls because they had it too good.

No one is taking retirement assets or pension. Put your home into an LLC or even an Illinois Land trust or just deed it over to your spouse, kids, whomever you trust. An attorney can assist with barricading your home from ever being seized and protect it also in the event of divorce. Be pro-active.

911 Opt Out - people can choose to opt out of paying for 911 fees, but they are no longer allowed to call 911 for help. The city can give these folks an 800 number to get ahold of an un-armed social worker if they have an emergency.

I imagine that police officers will now have to take out insurance for " errors and omissions" and for personal liability. I have a business of corporate investigations and my insurance for 2 million cost me under a grand a year. I am not sure if this even is offered for police officers, but it should be. Funny, that the move is to end immunity for police officers but not for any of other political class such as prosecutors and judges. Who in the hell in thei right mind would ever take a job of a police office with all of this hate directed toward them? If immunity ends and a court finds you liable for damages, your " wink wink" strategy will not save you. A judgement follows you for ten years and they can come after you right up to that time. Generally you house and a car are protected, but everything else is not.

We really don't need commanders, lieutenants, sergeants telling us what to do. They are there to make decisions about what we have done or are about to do, and to answer questions when we are too stupid to figure it out ourselves.

We take an oath to uphold the Constitution of the United States.

State law, municipal codes, general orders, special orders provide everything we need when we need to do something. Let these be our guide. Learn them. None of these have quotas on arrests, parking tickets, moving violations. Don't let any supervisor tell you that you have to make an arrest.

Give citizens their reports. Tell them to go get a warrant (unless exigent circumstances exist and the offender agrees to be arrested), or wait until a detective contacts them for followup (fat chance of that happening with the high volume of cases they have).

Nothing says we have to write tickets. Give those who do stop for you a verbal warning and wish them a nice day. Let those who don't want to stop flee away. Nothing says we have to chase and apprehend at all costs. Right now the balancing test is, "Will my actions to apprehend and arrest potentially cause me to lose my job?"

Collect paycheck.

Last night on the North side a caravan of BLM protestors drove thru the neighborhood beeping their horns and waving their BLM posters, they were peaceful and well organized with at least 50 automobiles. My question that on a day where 4 young black people were murdered, nowhere near where we were, why no go there and beep your horn drawing attention to the problem and maybe stopping a murder in progress. Doesn’t matter how by-the-book, articulated and justified your actions may be, our court system is corrupt. Avoid court by avoiding the hostile, it’s easier said than done but remember don’t chase after resistance which always leads to shit.

I do not think that police officers can be effectively sued for inaction. Maybe a department can try to take some disciplinary action against them, but I believe the courts have ruled that police departments cannot be held liable for failure to protect the public. So, if you are smart, and some of the cops just are not getting the message, stand down. Do as little as possible. The democrats are not your friends and now they are all running scared looking for votes . I think you are dreaming, but hope you are right. As far as population, Denver is estimated to have 727,000 people in 2019. And remember, It will keep growing too. CS had an estimated population of 478,221 in 2019, and a metro population of about 738,939. The 10-county Denver-Aurora-Lakewood, CO Metropolitan Statistical Area had an estimated 2018 population of 2,932,415. That's where the power will stay. I think you are being very optimistic if you think CS will overtake Denver in anyway. I still wouldn't want to move to that state now and chance it. It's becoming a pot haven didn't help the state any either as more strange folks moved there just due to that. I lived in Denver for a time as a kid, it was nice then but that was long ago, I sure wouldn't live there or anyplace in that blue state now.

.......they can still garnish let's say 15%-20% from your every paycheck until the total judgement sum is paid off. So if you get hit with $1000,000 punitive damages expect a pay cut from every check until you basically retire or quit working (become homeless). I retired last year, but let me give you all a bit of advice...don't fall for the old notion of "my house is in trust", all that means is if you pass away, your family avoids probate court. it does not protect you from any punitive damages...that is the oldest and biggest myth on the job, If you are married you are protected by the "Tenacity by the entirety" law, if you are single you should look to put your house in someone else's name...but make sure its someone you can trust... if you are single a "house in trust" is not protected.... now more than ever GLAD TO BE RETIRED!!!!!!

If one is to continue in this profession talk to an estate attorney about establishing a trust or other actions to protect your assets.
You also should talk to an insurance agent who specializes in professional and Errors and Omissions liability insurance. You could be looking at up to $10K a year. Your FOP should get out ahead of this. As soon as the lawyers smell blood and this "community enforcement bureau" begins, if you stay, you WILL get sued.
Or worse.

Honestly Qualified Immunity should be eliminated, too many bad cops should have at the minimum lost their pensions.

Being a small business owner in Illinois I wake up every day with a target on my back. Having to be personally responsible for every employee actions, talk about unfair. Imagine having 50 employees and any alleged comment by usually a man taken the wrong way and I receive a certified letter from the Illinois Department of Human Rights. At this point you lawyer up to answer the claim. One the hearing is scheduled I (not the person who allegedly said something ) and my lawyer must go downtown and waste a day to be grilled by some bureaucratic dufus as if I did anything wrong. The female asked for $50,000 to walk away and they asked if I wanted to make a offer to settle the case. Talk about feeling extorted. I said absolutely not as I've incurred several thousand dollars in legal fees. Months later the case was dismissed. Life isn't fair.

Cops only have themselves to worry about and rightfully should.

Crimes are nothing like in the city. Residents DO give info to help as much as possible. Cities are quicksand. Suburbs are solid ground.

Look where the riots going on flourish and where they fizzle. Relocate accordingly.

As a huge supporter of cops I would refuse to do anything but answer calls and not much of doing that.

I don't think the Omaha PD is hiring but check state patrol and Douglas County Sheriffs. Cost of living is a lot cheaper here in Nebraska and so far we still have our great police/sheriffs/patrol.

This is literally me. Just shy of that 20 and hate to say it, but I'm literally scared to go to work. I'm frozen. Terrified of that next job that might be the end of my life. Was never afraid of the physical danger. Im now afraid of getting fired/jail, etc. FUCK this job, FUCK this city and it's people. Don't know what to do. Not long til 20, but a few more til 50... no income for a few years. What options? Literally on my mind every. Day. Don't know how much more of this I can take.

I wonder if you LLC yourself (Secretary of state paperwork, <$100 /year) EVERYTHING you buy for the job, every action you take as an officer is acting under the "LLC" "Officer John Smith LLC" for example. Now you step on your dick and get sued for huge amount... You declare Bankruptcy of the LLC and close the "entity" thus absolving the LLC (You) of any financial/legal responsibility. My understanding of an LLC (Have some experience) is as long as it's not an intentional "criminal" act, the LLC would no longer be responsible for financial judgements if declaring bankruptcy. So... Have any personal assets outside of LLC, anything job related or your actions "on duty" are under the LLC. Point of an LLC is to legally protect personal assets in the event of a business legal action. We're used to LLC being for traditional "companies" but what if police were to officially, legally, structure themselves as an LLC entity? Single person LLC is a "pass trough" entity for tax purposes, so even though you're earning the income as the LLC, it goes through to "you". Have paycheck deposited into the LLC business account, then take out any needed $$ as a "distribution" to yourself. I believe this might be a solution for all our legal concerns. Seems more air tight than a Trust. Hope a good lawyer could advise us on this LLC possibility. Small extra expenses worth it to protect all personal assets. You think the landscape guy or contractor guy with the LLC on the side of his truck loses his house, kids college fund and retirement savings if you due him? No. His insurance covers first, but if that's not enough, then just the "business assets" of the llc are fair game. Had an old employer tell me he'd close up the LLC/ and open under a different one if he was faced with bad legal troubles. Apparently legal. I think it could be a strategy to protect us.

I got boxes of them in one of my dreadful awful cells we never use.
You should visit our town her in Colorado. They are still in that goosey hard grease and perfect. One is waiting for you for free. Just patrol and walk with me for awhile. I can make you a police officer too if you want and you can work the station desk. Nobody ever
comes to the desk because the citizens rather do there own police work.
I found it strange that since my Uncle Tom and Uncle Ben came to stay at our motel, people are not nice to me anymore. Its always after they talk to my Uncle Tom. He is living on little money from the 3 jobs he worked for city for little money. Uncle Tom was so liked by the policemen in chicago and those other jobs he had. He told me he did wonders during a snowstorm and lake shore drive was stopped for the motorists to enjoy the Lake for two days in their cars. He said most of these people he helped were rude to him and called him bad names because he is little.

Besides Starbucks not backing the police and actively working against them, I would suggest that police officers bring their coffee and lunch with them to work. Do not trust any of these food places where you cannot see your food prepared. Plenty of instances around the country where morons and cop haters are putting things in the food of police officers. Read the bill. It does not appear to change anything with respect to what might be at risk.

Colorado law cannot change federal law and federal law generally protects retirement assets from judgements.

It would be best instead of spreading out and out falsehoods about things that the fop pay for a good lawyer to investigate exactly what the real circumstances are and publish it.

Is it beneficial for Law Enforcement to Transfer Their Primary Residence into an LLC?
Short answer. No. Not in Illinois anyway. But you can set up an LLC under the laws of another state, and that is done all the time, so look into that. This is addressing Illinois law. If you own your LLC and you LLC owns your home, your creditor might simply take your LLC to get at your home. In some cases, you might co-own your LLC with someone else. In those circumstances, a creditor might get a “charging order” against your LLC interest. Section 805 ILCS 180/30-20, “A charging order grants no other rights with respect to the assets or affairs of the company.” The creditor can ask the court to foreclose the charging order. Foreclosing the order would allow the creditor to sell the total interest as soon as possible so that the entire judgment can be satisfied quicker. However, if the judgment isn’t satisfied by the sale of the interest, the debtor would still be personally responsible for paying any remaining amount.
Another downside to putting your primary residence into an LLC is that transferring your primary residence will trigger due on sale clause of your mortgage, and now you will have to apply for a new mortgage in the name of the LLC. It may be harder to get.
There is a slight benefit of anonymity of ownership of the LLC, but the court will direct you to disclose your assets, including the LLC, upon commencement of a lawsuit.
I would advise you to look into Equity Stripping, and, hate to say it, and Offshore Asset Protection Trust. No judge in the country can compel a foreign trustee to release funds and assets to a creditor. No one is taking retirement assets or pension. Put your home into an LLC or even an Illinois Land trust or just deed it over to your spouse, kids, whomever you trust. An attorney can assist with barricading your home from ever being seized and protect it also in the event of divorce. Be pro-active.

Once upon a time perhaps, but certainly not now. Who can you really trust? Your dog! But then I've become a bit cynical of the human race. How many marriages even last today. You hear of people being married 20 years and chuck it all. Knew a copper had that happen, boy was he surprised. There wasn't even anyone else, she just wanted her freedom. Liberal bs. She waited till their last kid was through high school and poof. I'm sure he trusted this would never happen. Check and triple check but how do you know for sure you can even trust that the lawyer is doing it all right. Some really stupid, inept, but still pompous, expensive lawyers in this world. As a huge supporter of cops I would refuse to do anything but answer calls and not much of doing that.
The silent majority people like me that do NOT want chaos and love cops have got to wake the hell up otherwise social workers will be answering calls but of course you will have to go with them to protect their sorry asses.
I worked with cops for over 20 yrs..hate the union mentality but love the cops and it disgusts me when I see a poll saying stupid people support blm. Have they all gone brain dead?
Anyhow stay safe........but start looking to get out of that hell hole of Chicago. I am from Nebraska and cannot stand your mayor or governor. I don't think the Omaha PD is hiring but check state patrol and Douglas County Sheriffs. Cost of living is a lot cheaper here in Nebraska and so far we still have our great police/sheriffs/patrol.

How does your state rate on property taxes? Illinois ranked 45th, Nebraska 40th. Not much better really. I remember people calling Nebraska the tax me state decades ago. Omaha is cheaper and an okay place, some might say boring, I guess that depends on one's own life. But they have their problems too and with the usual suspects. Ernie Chambers, that pos, has been making trouble for decades. I think it's better to avoid the bigger cities if thinking about a move, if at all possible. They rioted in Omaha too (had to use rubber bullets and pepper balls) and when the business owner shot a scumbag protester that attacked him the community wanted his head. Wanted him charged with murder. Facts don't matter to them. They didn't charge him but he's still a marked man to the BLM thugs and the other white guilt liberals. The family doesn't talk about how this fool attacked the business owner. I remember that poor young child shot and killed by a stray bullet while eating breakfast, two gangbangers shooting at each other at 8 am on a weekday. What no job or school? Of course no protests and calls for reform from within the community. And North Omaha is the same. Same thing on a smaller scale. So a traffic stop could go south much the same way as in Chicago and the officer would be in it up to his neck. The BLM scum are in Omaha too. I remember years ago when a cop saved his partners life by shooting a criminal dead that they had been chasing, they gave the cop a medal for his actions and the black community were livid and whining their heads off. Even my black optometrist friend couldn't understand giving him a medal. Cause you know they killed the black criminal. I said no it wasn't for that it was for saving his partner from being killed by the criminal. Still he thought it was wrong he should get a medal. So it was the cops that were wrong, no mention of the scumbag criminal and him shooting at the cops. I just shook my head in disbelief. Better to head to someplace more rural and without a militant black presence.

If one starts looking for Professional Liability and Errors and Omission insurance your corner insurance agent, in most cases, will have only heard of it in classes. Find someone who specializes in it. Doctors and specialized medicine professionals know where these people are. At the time I needed this, only 3 companies would write 10 million E&O and a 10 million liability rider. That was over ten years ago.
I have a feeling if this becomes common in law enforcement these level of policies will become impossible due to federal liability limit.
