Time for Arbitration?

Anti-police "reporter" is laying the groundwork should Groot fail to "reform" the police Contract:
  • Four years ago, private citizen Lori Lightfoot led a task force that urged the city of Chicago to rewrite police union contracts to eliminate provisions that make it harder to discipline officers. Now, Mayor Lightfoot is under increasing pressure to make those changes a reality herself as protests triggered by George Floyd’s death at the hands of Minneapolis cops have renewed calls to eliminate some police protections here.

    At issue are clauses that allow officers to delay giving statements after shooting people, prevent the city from rewarding cops who blow the whistle on misconduct, and discourage people from filing complaints by generally requiring them to give their names.
We'll note that this is the one of the first times we've ever seen any reporter actually lay out which parts of the Contract the politicians want destroyed:
  • "delay giving statements" - we've stated this at least a dozen times before. We will gladly accept the rules the FBI  holds its agents to - the supposed gold standard - seventy-two hours. CPD allows a mere twenty-four, following one of the most traumatic event any human being can go through.
  • "prevent the city from rewarding cops who blow the whistle on misconduct" - we are unaware of any such "rule" and in fact, we can be charged administratively for not reporting misconduct. This is both fantasy and complete bullshit. As to a "reward," the City Council could pass an Ordinance tomorrow.
  • "discourage people from filing complaints" - this is part of the Sword Affidavit Law, passed in Springfield. It merely codified the legal ability to confront accusers guaranteed any citizen to also apply to police officers. Prior to this being passed, Officers could be accused of all sorts of malfeasance without the benefit of knowing the charges or circumstances and be expected to answer questions with perfect recall, even if the accusations were total bullshit. In the real world, we call this "slander" or "defamation" and there are civil remedies. If this was such an issue, wouldn't we have heard about Officers hunting down accusers and millions in city payouts? We can recall exactly ZERO complaints of this nature.
Precedent is actually our friend at the moment and Groot has an uphill battle due to her hardline stance on scapegoating cops and gutting protections. In fact, her recent moves against Officers flipping the bird, and the popcorn incident in Booby's office after being ordered to protect it, should only stiffen the resolve of the FOP to not budge an inch. The city (and Groot) have proven time and time again they are not be trusted.

Larry has a new unit for people interested in being part of her security detail..this is a time for coppers to make a statement by not putting in for this..but since there is no unity among our ranks nor a single voice in our FOP to make a stand, i won’t be holding my breath.

Watch Minneapolis and the Minneapolis Police Department Contract. The Boy Mayor and the Police Chief have already walked out of contract negotiations.

Also, During the Minnesota Legislature special session, the Democrats wanted to abrogate most of the protections in the LEO Labor Contracts and reimpose residency requirements on all the police state wide. Not just screwed up big cities Minneapolis and Saint Paul, but state wide. How does that work when you are on the police force for a 7,000 person city, and your spouse is on a police force in another county?

I remember this Hinkel wrote a lot of stories about the Officer Robert Rialmo shooting with the guy that had the bat. The stories seemed like he had it out for that officer. Then last year I read a story on the contrarian.com which comments on Hinkel’s bias in the stories. Took me a while to find the story but it is called, “Dan Hinkel’s Baffling One Sided Curiosity by Florian Sohnkie, dated July 28, 2019.”

Seems only teachers are worthy of contract. Cfd also no contract yet. I'm city employee not police not fire and we're going on 4 years without a contract. And now it's obvious with plan-demic there's no money. We had greatest economy ever seen to mankind ( people kind for snowflakes) and none of us received a contract. Now fungu you and libtards want to defund the police. Unfucking believable. I pray for you guys and gals every night. Being police nowadays has to suck. Stay safe and God bless all the 1st responders especially police who are vilified by everyone and it's bullshit. Hope you know there's citizens who love, respect, and honor police.

I have no qualms giving up the 24-hour rule or the sworn affidavit, but the cost of doing business just went up. Translation: The city better be prepared to offer raises considerably more than the CPI. Mayor Lightfoot needs to evaluate if political pandering is more important than a significant tax increase to obtain such givebacks. Given the economic climate of the city, I think she will be hard-pressed to demand even greater tax increases than what appears to be on the horizon. The true cost of the CTU CBA increases will not be significantly seen until the first property tax bill of 2021. When residents see their tax bills citizens will hit the roof!

Supt. Brown has no idea of the political landscape in Chicago. When Brown stated early in his tenure that he hoped to keep the homicide rate below 300 for the year the comment was embarrassing. Also, overtime is part of the cost of doing police business. It is ironic that in an effort to control overtime a pandoras' box was opened. Had the city paid the overtime the first two days of this crisis much of the upheaval would have been able to be quelled. The city is going to pay exponentially in its overtime costs because of its terrible police-management. Some may say the owner of the crisis is solely Mayor Lightfoot. However, she hired managers to give her answers to questions outside her scope of expertise. If the managers did not tell her of the vast potential negative consequences affiliated with her decisions, the leadership's lack of courage speaks volumes. Consider, the "rank and file" are supposed to follow these very leaders who rule out of fear, but are afraid to speak themselves. The thought is chilling. I say roll the dice and go to arbitration. At least maybe an individual who is not afraid of Cityhall could bring some reason to the process.

Well on the WGN morning news Downtown, without naming names, called out both Kriminalisha and Dart, saying we need to keep violent offenders in jail and to revamp the home monitoring program.

It’s a good move on Brown’s part. Put the blame square on the politicians.

Adding to the "discouraging people from filing complaints" argument, the Illinois Supreme Court recently ruled that CPD cannot destroy complaint/disciplinary files because they are "public records" and that the police contract cannot have clauses that violate the law..... well the law in Illinois is you have to give your name and sign an affidavit to file a complaint against a police officer. Therefore, the contract cannot have a clause allowing anonymous complaints because it would be against the law and the IL Supreme Court would strike it down.

If anything, the law requiring an affidavit only discourages, and its intention is to discourage, people and folks from filing FALSE complaints against police officers, which then can never be destroyed. If the media would check the stats, the number of complaints against police officers went down when the affidavit requirement went into effect, not because people and folks were discouraged from filing TRUE complaints, but because they were discouraged from filing FALSE complaints.

Where is the data that says how many anonymous complaints were filed against police officers before the affidavit requirement went into effect?

And why does the media assume that every complaint filed is actually a legitimate complaint and not a lie? Does the media believe that criminals, gang members, and ghetto lottery players always tell the truth and would never lie? Kind of like that first big lie out of Ferguson Missouri, "he had his hands up and said don't shoot?" A statement later proven to be a lie under an African-American U.S. attorney general working for an African-American U.S. President?

Make them pay their pensions.....
Let them strike.....
If she can pay all city NON-WORKING folks FULL PAY
through this pandemic, rather than laying them off and letting
them collect unemployment, then it’s on her that the city
has no money......
These are unfair labor practices.....as defined by Federal law.....
She will have a lot to answer for......giving away money to made-up
entities while ignoring her obligations to actual workers.

Going to arbitration will still take some time and I’ll bet the City will still stall for the rest of 2020.
The City already planned a strategy and a woeful outlook on finances.
Best case scenario could be status quo, the best Contract is what’s already in place?
Larri wants Discipline reform and chop Art. 6. Arbitration will nix that and she can then continue her tirades and tantrums, all talk no action, and just blame police again and the proceedings for (her) failures.

This is corrupt city. I still think the City already shopped arbiters, offering them some interesting incentives.
Aside form Covid’s criminal and civil court overloads coming late this year, even small hearings are going to be backlogged.
Couldn’t trust ShortShanks and Rahm, there’s no reason to even think Larri the Loser LightFührer will be any different.

Unfortunately, Larri has most of the liberal courts on her side, if she can maintain some statesmanship and decorum.
But count on her tantrums and radical views to blow that, especially if she has to resort to point fingers at CookCo RëichsWrinkle and KimmëlFxxxxx.

I was a homicide detective and a supervisor for over 20 years. I personally handled more than my share of Police shootings and let me tell you something I did not have one single shooting where the police officer was not shuck up. Not one. In the vast majority of the cases the Police officer could not tell you the exact shots he/she fired at the offender. I have seen Officers completely break down worrying about what is going to happen to them and/or their families. I have had Police Officers actually try to convince me they were justified. The FBI has a 72 hour rule and when they do talk with anyone they have a lawyer present at any statement. In my opinion the 24 hour rule should be extended to the 72 hour rule like the FBI has. I know it will not happen but it should be. Your stance on sworn affidavits is also not correct. I have told this story many times but before the advent of affidavits I handled a Police Shooting where there was 7 eyewitnesses. What I got was 7 completely different accounts on how the Police Officer shot the offender. Each account were completely different. As a supervisor I had the occasion to interview many people who wanted to complain of Police Misconduct. In every instance I explained the complete process of a sworn affidavits. Every time I got to the part when I explained to the would be complainant that if it was found that they are not being truthful they themselves can be charged with a crime. in many cases the would be complainant would not go through or file the complaint. I was asked by another supervisor why I would bring up the fact that a complainant would lie they could be charged with a crime? My answer was because that is what is written in the law. There are law firms and/or lawyers who ask their clients if they made a complaint against the police officer who arrested them. If the client said no, these lawyers and/or law firms would instruct them on how to make a complaint, what key words to say, and to get other witnesses to do same. What happens then is these lawyers/law firms would sue the city and then instruct their clients NOT TO SPEAK WITH IRPA, OPRA AND ETC AND GIVE A STATMENT. they WOULD INTURN TELL THE JUDGE IN A CIMINAL TRAIL THAT THEIR CLIENT MADE A COMPLAINT AGAINST THE OFFICER AND THE CASE IS NOT SUSTAINED. At a civil trail the lawyer/law firms would tell the jury that a complaint was made and that no action was taken against the officer. The lawyer/law firm then would make the accusation that there is a code of silence, that the Police Department is protecting the Officer, and that the jury should come back and reward the complainant with a large sum of money. After a trail the attorney and/or law firm will then tell his client that it is not necessary for him/her to make a statement and the officer is left with a not sustained CR#. This not sustained CR# then can be used against the officer in future court proceedings and or news accounts on how bad the Officer is. You should rethink you position on this,

I'm realistic we will lose all of our current contract disciplinary protections in arbitration for a small raise. You can't live on $100,000+ with overtime? People live on a lot less in this city.

No I do not. I do not think any.of the people in power, mayor, governor, exempts, etc care how many are shot and kolled. I think they would move to discipline and fire cops.over blue flu, and it's against the law, and FOP is against it.
