Twelves Again??? (UPDATE)

This has to be some sort of Labor Law violation. Without an actual emergency, you can't just keep canceling days off when the weekend rolls around:

Anyone in Day Off Group 65 (midnight 66 we think) is working at least twenty-two days in a row without a break.

Anyone in a Sunday-Monday day off group (and there are hundreds of detectives, teams and others) will be working 28 days straight at a minimum, and most of those 12-on-12-off.

This isn't healthy. It's breaking people. There has already been one death most probably due to exhaustion and our birdies in Personnell tell us PAR forms to retire a miles ahead of last year, meaning big staff shortages on the horizon.

The FOP hand delivered a four page letter to Brownies Office yesterday outlining the Contractual steps and possible steps a lawsuit might take should this constant 12 hour schedule go forward. Looks like it's time to pull the trigger.

UPDATE: Fake? Or they're just waiting until 2345 hours Thursday night to cancel everyone's weekend plans like they did last week?

Sure would be nice if this applied to Cops:

Regardless, what do you think would happen if EVERY COP filed a complaint under this Act? 10,000+ complaints?

Might be kind of hard for the Legislature to ignore. Might start some kind of stories. Might be usable in a contract negotiation.

...just a thought...

I said it the Saturday the “protesting” and looting began, when Groot held a 8:30pm press conference and praised the police for all their hard work, professionalism, dedication... I said give it a few days, she will be back up at the podium saying how awful the CPD is, how it’s out of control, needs reform, racist, etc. True to form, she did that, multiple press conferences, going as far as telling protestors if they feel they have been disrespected or mistreated by a police officer to call 3-1-1, demanding the officer who gave the finger be fired, the cops from Brickyard be fired, the cops eating Rush’s popcorn be fired, the cop who made a homophobic remark be fired. Now she is forcing everyone to work 12 hour days with days off cancelled, as she holds press conferences about how broke the city is due to COVID, can’t afford to pay for anything, etc.

in a few weeks, once the dust settles and they tally the OT costs, watch for Lightfoot to hold another press conference, talk about how broke the city is, how no revenue from hotels, restaurants, trade shows, bars, tourism is coming in, then talk about all the “social programs” she has to cancel, how she is going to raise taxes on everything, cancel summer job programs for low income kids, then mention how much she has to pay CPD in OT costs, which we already know the alderman hate. Watch the manufactured outrage over the costs for all these 12 hour shifts and days off cancelled that they are demanding now.

It’s coming....

Everyone on this job needs to decide if their goal is to collect as much money as they can from the pension or have the highest monthly pension payment. You could stay an extra three or four years and maybe pick up an extra $1k a month in your pension check. Meanwhile, the guy who started collecting at 50 has four years and for the sake of the argument with a $5k a monthly pension has collected 48 payments and collected $240k already. It’ll take you 10 years of collecting to make up that $240k the other officer collected by staying four years longer, and for you to start outpacing what that other officer has collected. Imagine how long it’ll take if you only stay a year or two longer. I want as much as a can from the pension, but I wish people would give the math some thought dependent on their personal situation. I’d be shocked if 55 isn’t out this contract, so that probably won’t be a factor.

The sick, deviant Mayor is using an array of Deprivation Techniques to terrorize and ultimately destroy the police department. The Urban Dems are intentionally in an effort to use psychological war techniques that within 48 hours can unconsciously hijack your emotion, cognition and perception...imagine the psyche after 3 weeks of prolonged deprivation. You are being engineered, no different than a criminal detainee.

LONG PERIODS OF STANDING IN STRESS POSITIONS

wall-standing: forcing the detainees to remain for periods of some hours in a stress position, described by those who underwent it as being "spreadeagled against the wall, with their fingers put high above the head against the wall, the legs spread apart and the feet back, causing them to stand on their toes with the weight of the body mainly on the fingers";

NOT HOODING BUT SUBJECT TO SHIFTS WITH CONTINUOUS NOISE, SCREAMS, HATEFUL RHETORIC BY ANGRY MOBS

hooding: putting a black or navy colored bag over the detainees' heads and, at least initially, keeping it there all the time except during interrogation;
subjection to noise: pending their interrogations, holding the detainees in a room where there was a continuous loud and hissing noise;

NO SLEEP FOR DAYS, OR SPOTTY SLEEP AT BEST, DENIAL OF MEALS, EVEN ACCESS TO RESTROOM

deprivation of sleep: pending their interrogations, depriving the detainees of sleep
deprivation of food and drink: subjecting the detainees to a reduced diet during their stay at the center and pending interrogations.

God help you against these evil politicians. They are doing immeasurable damage to you and your families.

Better now than later. Toss a stone at Larri and duck for the brick in return. Hopefully FOP has already hired out winning labor specific lawyers.
And This Is How It’s Gonna Be™️;
We shouldn’t be handing in anything to City, these correspondence should be delivered by process servers.
Wut-wut Hash Brown is not familiar with our Department G.O.’s, so the cubicle savvy house legal beagles in his office had to send this communique over to idiot flunkies at Corp Council, who has to sent a copy to a connected private law firm who then delegates an intern to review the veracity of the complaint.
So give that FOP letter of understanding until late December for a reply.

Remember that “food the zone” strategy she came up in here with to deal with violent deadly crime?
Med Sect must be filling up (anyone know the roll?) and her policing strategy savants are figuring this out.
There just ain’t nobody coming out of the closed Academy. Hashed Browns is running out of bodies.

I think at some point Toad stops hiring, house mice everywhere will have to backfill. What to do, what to do. Are Sworn Admin aides essential or not? Btw, NYPD is already reassigning their desk dollies.

Keep in mind FOP functions on membership dues that rise with contractural wage increases, no increase since Jun 2017.
The longer we go without a Contract, the more FOP is “defunded” and may have to cut back.
Then more you get wrapped up in ghetto affairs that go nowhere in CookCo the more you're likely to tap FOP Legal Rep (Art.22.2) to try to save your income, your job, your family and your future. The City knows this. It’s a vicious tactic.
Figure it out already and DON’T KEEP CHASING BULLSHIT CALLS.

Not a cop, but I'm definitely 100% on the side of LE ! You guys have a tough & seemingly thankless job, well .... I Thank & respect you guys out there. You may think that you're alone - but you're not. This IS by design.

As we all know, there is an ongoing nation-wide propaganda campaign to facilitate the collapse of the United States of America as we know it. With respect to LE, and particularly in Midwest cities like Chicago, this campaign is structured such that LE becomes emotionally, mentally and physically fatigued to the point that your demoralized and forgo your pension and resign posthaste. You old timers out there likely already suspect this. You can also gather this would then present an opportunity for the left to staff LE departments with their gestapo-hipster-social-justice warriors, which by design will most certainly "fundamentally change" LE departments through ideological saturation. The paramount goal of this "plan" as I see it, is to ultimately use their newly staffed & ideologically changed departments to finally, once-and-for-all confiscate legally owned firearms – among other goals of course. They (the left) know you won’t comply with these sorts of aspirations, so they will install their own people.

Did it ever occur to groot, fat-ass, et.al that there could be law abiding patriotic Americans, who are well armed, that are too also waiting for the “police” to …say take a 3 week vacation – all of them simultaneously? There are many many of these “well armed Americans” who aren’t resist, bigots, or supremacists of the sort and are really tired of being labeled as such. These “well armed Americans” are getting impatient.

Just a theory anyway…

So after the mass unplanned, unorganized widespread looting, graffiti, property damage and arson that this Mayor allowed the weekend of May 30th and 31st, her biggest deflecting worries to the thousands of rioters were: a). File a COPA report if you were treated poorly and b). rest up from your mayhem by self-quarantining for 14 days because there’s a scary virus out there. Since those 14 days have passed, we should have the ‘spike’ results by now. Either the positive numbers are through the roof from those without a ‘can’t identify me’ face-mask or there’s been no effort at all and this city can go back to normal. Are Governor Jumbo and Mayor F Y still fiddling with the results? There were thousands of ‘peaceful protestors’ elbow-to-elbow, yelling, spitting, trampling over each other to steal. You’d think there’d be a 1000% increase (especially in the ‘minority community,’.) If not, we’re just being played for fools by this entire lockdown...

A mistake she can then run with, plaster all over the media, get the public behind her and use to unilaterally reform the entire police dept. Don't give that to her. For God's sake be safe and smart out there. Stay calm & don't engage. No arrest is worth it.

Yes, you can decline the opportunity. An employee must volunteer for additional hours that would require he or she work 7 days or more. The One Day Rest in Seven Act provides for employees to receive a minimum of twenty four hours of rest in each calendar week and a meal period of 20 minutes for every 7.5 hour shift beginning no later than 5 hours after the start of the shift. A tort is a wrongful act in which harm or injury is caused to another person. The term “tort” covers a vast range of actions in tort law, and is divided into subcategories, which include “intentional tort.” Intentional tort occurs when a person intends to perform an action that causes harm to another. For intentional tort to be proven, it is not required for the person causing the harm to intentionally cause an actual injury, they must only intend to perform the act. For instance, if a person intentionally frightens a person with a bad heart, who then has a heart attack as a result of the action, it would be an intentional tort even though the person did not have the intention of causing the heart attack.

Simply put, both contract laws and tort laws are in place to address a breach of duty that results in an injured party. As mentioned above, in contract law, this breach is known as a breach of contract. It occurs when one party fails to adhere to their duties outlined in a contract.

In tort law, a breach of duty involves the failure of one party’s duty to harm another. For example, the most common type of tort lawsuit is one that is based on a theory of negligence. In order to succeed in a lawsuit based on negligence, the injured party must prove that the defendant breached a duty of care owed to them, and that the breach was the cause of their injuries or losses.

(820 ILCS 140/2) One Day Rest In Seven Act

Unless an emergency is declared, no days off is a violation of state law.
============
Read the law carefully. "Employers" are required to follow this law. The law defines employers this way:

"Employer" shall mean a person, partnership, joint stock company or corporation...

Government agencies are thus not covered by this law.

To follow up on my “Americans, who are well armed” theory:

There are indeed well-intentioned, upstanding, law abiding, honorable Americans of all colors, creeds and orientations that don’t subscribe to the chaos the left is inflicting. Along with that sentiment, I believe that there's likely a good deal of these “Americans” who WILL immediately fill / mitigate the commandeering of the power vacuum groot, fat-ass, et.al wish to create by dissolving LE. I’d venture to guess that these “Americans” aren’t going to be concerned with the complicated & technically bureaucratic legal precedents established by leftist Judges - that serve only to undermine our rights through abridging the basic text & meaning of the Bill of Rights, or the other enumerated amendments of our Constitution – which we genuinely hold dear.

Your going to need the OT just to pay your tax bill next year. Cost of living just went up in city and state. With the highest tax and fees in the nation you get to live in a dirty crime filled city filled with political corruption And clueless leadership. Terrible schools and liberal politics, with any number of police haters. But you do have the pretty lakefront working for you, sorry forgot your dictator closed it. Well at least you still have great restaurants, wait many will not be reopening. Finally there is the thriving south and west side ghetto drug outlets. Still going strong I see. What a utopia. Why are you even thinking of leaving. Bet there people from the surrounding state just waiting to take your place.

Be careful going down that path. You may lose your FOID card. Getting it back could be a PITA, if at all. And if meds are involved it may be harder.

But also research the Americans with disabilities act.

Lots of protests scheduled for downtown Chicago for Friday and Saturday afternoon. BLM and "defund" the police protests mostly. With the indictment of those 2 Atlanta police officers (who did everything by the book) these aren't protests but victory celebrations. Expect more looting and injured officers unless there's rainstorms and bad weather this weekend. We're gonna really have to earn that overtime and officers are gonna be abandoned with the clueless bosses we have.

____________

Sorry for the typo, fat fingers. Sticking around extra years to make an extra $1k a month would take an officer 20 years of collecting a pension to catch up to the officer who already collected $240k from the fund. Not worth sticking around imo.

Very true and I’ve been contemplating this dilemma. I’m 50 and am dying to leave this ungrateful hating city but health insurance is the kicker. So, having a family makes it about them. Also not maxing out or at least staying till 55 means you need to find a decent paying job with benefits. You can’t just work at a golf course. Also, we’re out of a contract AGAIN pushing 4 years soon, so there could be things to wait for but doubtful. For a single guy leaving at 50 is a no brainer.

Black as the Pit from pole to pole,

For my unconquerable soul.

In the fell clutch of circumstance
I have not winced nor cried aloud.

My head is bloody, but unbowed.

Beyond this place of wrath and tears
Looms but the Horror of the shade,
And yet the menace of the years
Finds, and shall find, me unafraid.

How charged with punishments the scroll.

(820 ILCS 140/2) One Day Rest In Seven Act Unless an emergency is declared, no days off is a violation of state law.

---- all you fools who refused to swipe screwed yourselves. For those of you working near a swipe machine, you should have been trying to swipe anytime you had a chance. Why, because the supervisors went back into the overtime system after you submitted your slip and changed the times and added lunch. Swipe reports don’t lie. I asked my supervisor to print my swipe report from the start of 12-hr days to the present. Then I went in, and printed copies of all the overtime slips the supervisor changed. I compared the original slips submitted to the time swipe report and then to the changed slips. I kept detailed notes of my entire days work. My notes include start and end times, watch and watch changed, time on posts, bus number and driver and if available CTA Supervisor and change of locations. I made a note of washroom availability and access to food and water. I also listed refusals for lunch and breaks. I have the rosters of every platoon I was on with personal cell numbers I have a list of the sergeants assigned to the platoon, including Lieutenants and above for each day. If we were told to watch business, I made sure to speak to the manager at the business and take note of his or her name, time of conversation, and why we were there. I have enough documentation to support a lawsuit. How many of you can say the same? This job is like a game of chess. If you want to win, you better play by their rules and beat them at their own game. I suggest you all ask for your swipe reports if you swiped, and hopefully, you created some type of log to track your days worked. I have been screwed over before, and I have vowed never to let that happen again. Oh, and a big FU to Lightfoot.

Not to mention a second, and likely less stressful career while collecting that early out pension. And figure that the average used to be 7 years post retirement till mortality status start rising. I personally wouldn't stay on without captain's bars past 50. We aren't guaranteed anything, and spending an extra 5 of my Golden Years on the beach beats the hell out of having someone like Groot just waiting to put the rug out from under me.

I am a citizen and just spent the last half hour reading every comment from the post with 250 comments and this post all re: LE not having any days off. I was crying. What the fuck kind of world do we live in that you cannot take days off working 12 hour shifts. I It is INHUMANE! Listen, I live part time in Chicago and my neighborhood (11) was ruined. I will not come back except to pack up the condo and get the hell out of there. There has to be somewhere else you all can go for work. Some other town, maybe a small town, you can go. Or quit and start your own damn police department. That evil thing, I can't say what I want to here, that beast, that non-human POS that is pretending to be a mayor is going to burn in hell for what she is doing to you all. I don't know, nor do I want to know, what happened to her in her life that made her so full of hatred, rage and ugliness, but she has a much right to be mayor as one of my cats. You are staring evil in the face very single day, for people you do not know and this is how you are repaid? Honestly, please stop working for this POS. I pray for all of you every single day and I thank you for all that you do. It's not much, I know, but as I sit here reading this, feeling sick to my stomach, I just don't know what else to say. God Bless! Stay safe. Go on Medical for weeks. I am sure you have the time coming to you.
