As any cop knows, for a burglary charge to stick, there must be "an unlawful entering or remaining" within a property to commit a theft therein. If they were invited in (and it's looking like they were ordered to be there) then burglary is a legal impossibility. It also seems IAD knows who gave the order and is sitting on the info until the furor dies down before they kill the investigation.
