Rush to Judgement - Atlanta

So does someone want to tell us exactly at what point it became legal and proper to fight, disarm and shoot things at the police? Because we must have missed that over the last fifty years. And get a load of what Atlanta has decided all on its own:
  • A TALE OF TWO INCIDENTS by The Atlanta DA's Office and the Atlanta Mayor.

    Incident 1) 5 Atlanta Police Officers fired last week for using a taser to remove two college students from a car. Officers were fired because the Atlanta District Attorney's Office deemed the Officer's use of the taser was DEADLY PHYSICAL FORCE.

    Incident 2) A suspect who failed a field sobriety test and deemed Driving While Intoxicated resists arrest, fights with police, steals the officers taser (robbery) and escapes. During the pursuit, the suspect turns and fires the taser at the officer's head and was shot and eventually dies. The Atlanta mayor calls for the Officer to be fired because he used deadly physical force against a taser.

    BURNING QUESTION: Why is using a taser considered Deadly Physical Force when it's used by a police officer but not Deadly Physical Force when used against a police officer by a suspect?
The mayor of Atlanta has unilaterally put the taxpayers on the hook for monumental judgements....in favor of police. Hopefully, they win big and retire in style.

Will this restart the shitshows nationwide?

A lot of areas are already all looted and burnt out. Are Downtown Chicago and the neighborhoods restored and restocked? Or are the criminal looters going to have to go farther afield to find loot worth stealing.

If I owned a business, I would be taking precautions right now, if not last night after seeing the Wendys. Move the cash and good stuff out, board it up. Decide if I had enough friends and family to go Roof Korean for 96 hours, or just hope and pray they leave you alone again.

District Attorney for Atlanta appeared on CNN Sunday and said the officer could be charged with murder or felony murder and that those were the two charges they are considering. Also said the body cam video was revealing because we heard the very first statement the officer made, which was “I got him”. DA says the officer said nothing about needing to save his own life. So what? Probably the most adrenaline fueled event that has ever happened to the Officer in his lifetime and the DA concludes this is evidence of murder? Why in the hell is the DA even being interviewed on television? Why isn’t a DA spokesman giving a statement saying the office is in communication with the Georgia Bureau of Investigations and will review all witness accounts and videos? The next day the DA sounds like the decision to charge has already been made.

You can see where this is going! The Fulton County District Attorney Paul Howard (Democratic) criticizes the Atlanta Police Officers handling of the fatal shooting of Rayshard Brooks by saying, “He did not seem to present any threat to anyone.” He said that charges against the police officer that could be considered later this week could be; murder, felony murder and voluntary manslaughter. The following is a short snippet from a story that appeared in, Law.com, Daily Report and dated June 10, 2020 giving some insight into Paul Howard.

“Howard has been criticized by Atlanta Police Chief Erika Shields and the International Brotherhood of Police Officers over his decision to charge six police officers for the violent arrest of two Atlanta college students who were tazed and pulled from their car during demonstrations over the death of George Floyd at the hands of Minneapolis police. Howard, in turn, accused the IBPO of “being out of touch with reality” and engaging in a politically motivated plan to influence Tuesday’s primary in order “to end police prosecutions in Fulton County.”

Howard’s campaign also has been challenged by accusations of sexual harassment and retaliation raised by two women who worked in his office—claims he has denied. He is also under investigation by the state ethics commission over alleged campaign financial disclosure law violations.“

As you can see the Atlanta Police Chief Erika Shields who criticized Howard Is the same Chief who just resigned over the Rayshard Brooks incident. Rather curious! Was she told to resign? There seems to be a pattern and practice with the Democrats who are controlling the major cities and that is they are now in the rabid mode to destroy police officers and police departments at any cost. The extreme left has taken over the Democrat Party and they have weaponized Antifa which has weaponized Black Lives Matter. Be extremely careful out there as you may think you are doing the right thing but it later blows up in your face.

Oh the pain and and anguish! Do you think she is speaking of the pain and anguish of the police officers working 12 to 14 hour shifts, getting pelted with rocks and bottle, being verbally harassed? One other thing, any time a police officer is dealing with an offender there is always a weapon present. If the police officer should get over powered the offender can take the police officers weapon. So in this case if the taser struck the police officer there is a good chance the offender could chance disarmed the police officer It is a shame that we are being called the problem. 25 yrs CPD can't wait to get out. God help us all in BLUE!!!!

Did you see the Atlanta DA on MSNBC, said those officers could of treated Brooks like a human being, parked his car for him and called him a cab or an Uber to take him home. That would have been the just and humane thing to do.

When all this reform is over officer will no longer be allowed to make traffic stops, it will simply be write down the plate and send them a ticket for the infraction, just like the red light cameras. There will be no searching cars, stoping cars for any reason whatsoever, which will make the anti-chase folks happy.

I can’t wait for the Tuesday after 4th of July weekend when the murder rate skyrocketed and Lari and Brown hold their press conference and blame the murder rate on the police and Brown says we failed again. If we aren’t still in 12 hour shifts with days off cancelled, he’ll say there weren’t enough police on the street again.

How can they want to defund us, yet at the same time apologize for not having enough of us available???

Spent a few years on CPD then left for greener pastures at Homeland Security, the Atlanta DA used to run the legal training section and teach the majority of the legal, use of force, 4th Amendment, etc classes at FLETC, where the vast majority of federal agents, Deputy marshals, ICE officers, border patrol agents, and just about every uniformed federal officer receives their training.

I believe this incident helps LE and hurts the protesters. The general public knows policing is ugly and uses of force are ugly. To me, this incident is a clearly justified police shooting. I think most members of the public believe it's a good shoot too.

People who view the video and aftermath are realizing the 'protesters' aren't really concerned about inequality or injustice - they are only concerned with how much free stuff they can get. The majority of the public are seeing evil for the first time - and they're scared.

ANTIFA is desperate, BLM is desperate, these rioters are desperate. And, desperation is a stinky cologne.

several cops reviewed that video and said it was
a "good shoot," meaning the Taser could have disabled
the cop allowing the DUI suspect access to his firearm.
Thus, he feared for his life. This, from an extremely
unpredictable suspect who smiled at police, was being

EVERY single incident where they claim excessive force/murder could have been avoided if the OFFENDER had just complied with legally justified lawful orders. From laquan to rayshsrd ! Then we have the Arabian store owners protecting their stores and then they are questioning why they have all the security, why everything is locked up they want everything removed the simple answer is because you steal whatever is not nailed down! It’s not racism when it’s realism stores open in your neighborhoods and what you do as you ruin them completely, you look at the huge Walmart that your people burned the store according to the Alderman was already wanting to close due to the extremely high theft rate, now that it’s burned out, God willing the investors of Walmart will not reopen that store!

The mayor is demanding that Walgreens and CVS re-open any other stores re-open so people can have a place to shop, animals have more respect for things in their purview, you’ve hurt the people in your community especially the senior citizens who need to get their prescriptions refilled quickly and are able to walk to such stores.

I am not a police officer. I find it very troubling that a new part of the false narrative that police officers kill blacks at an alarming rate has become even more absurd. Do we now call for the immediate firing of an officer who uses deadly force without all of the facts? Since when does a mayor of a large city call for firing an officer who made an obscene gesture or who used a gay slur? How does the DA in Atlanta rush to judgement based on a 2 dimensional video clip? How does the First Deputy of the Chicago Police take at face value the word of race hustler and race baiter like Bobby Rush when officers respond to looting at his office. Citizens need to wake up when it comes to “police accountability”. We are all accountable. Let’s just be truthful first. Perhaps our mayor will refocus her anger not at a few isolated incidents but at herself and her new hand-picked superintendent who has no clue and had no plan for the protests and subsequent looting of the city. Maybe it’s just easier to blame the police and not hold yourself accountable madam mayor.

It's amazing how a certain segment of society wants to live as if no rules or laws apply to them. From a CNN articles this morning, one of the advocates for Mr. Brooks suggested the police should have let him run away and sleep it off. This is so illogical. I'm dumbfounded by the rush to judgment reactions. Without any sort of review, without due process, without a fair and just trial, certain segments are calling for the officer to be jailed. The officer was already fired, the day after the incident, and the police chief resigned. Of course, we all know this was reactionary to try to reduce the riots and burning in Atlanta and has no basis in due process. The officer was 100% justified here in what he did. We live in the Twilight Zone.

It’s a damn shame what’s going on. Law and order is gone and lack of respect thereof, by a small group of agitators that are being praised by these city officials.
There’s a common denominator among the leadership and elected in many of the cities and departments experiencing riots and civil disruption, it’s not just pasty empty sack men.

Very poor decision making, moody and manic knee jerk reacting, placating the hostile restless with autonomy including restorative justice narratives. What’s the point of having rules, curfews, colonial laws when police are not allowed to enforce unless the person is cooperative and non combative. The point being these elected don’t want police except to protect themselves and their homes.

Angry Toad Larri is on the verge of instituting her own version of reforms crafted by an angry bunch of twisted citizen groups. All this everyday crime and violence is happening in greater numbers the last year with Larri, SpecialEd, Hash Brown, KmmmFxxxxup, Prickwrinkle, Evans, JB Pigz, Durban’s, and many others. The goal is to maintain a steady disorder and still they failed because it’s getting even more out of control than they like. So blame the police that they’ve hogtied.

To go out there and arrest in certain hostile areas is going to very difficult, and I’ll expect the timid will sacrificed for the activity these department merit hacks demand.

Years ago in Chicago there was a case where an offender threw a knife at an officer. It missed. The officer responded with deadly force. The officer was charged. The theory was once the knife was thrown, it is no longer a threat. Once a taser is fired and misses it is less of a threat.

Here is the entire Body Cam Video of the 1st Officer that arrived on the scene. It's from 11Alive, I assume an Atlants News outlet: Rayshard Brooks shooting police bodycam footage YouTube, 43:01 long.

I watched the whole thing and these two Atlanta Cops could not have been more polite and professional. The fact is that dude (Brooks) was so drunk he passed out while the 1st cop was there. And all through the encounter Dude could not recall something from a few seconds ago, like how he got there, how the car got there, or instructions from both cops. Things had to be repeated three or more times, IMHO the cops had the patience of Job.

Note this Body Can Vid doesn't show the struggle, chase, or shooting -- it seems to have got knocked off the 1st cop's uniform. The action ends while the DUI Certified Officer (2nd cop on the scene) is trying to cuff Brooks. That's when the shit-show starts.

Bottom line, I don't see any way that any DA could even think for a second that this was anything but a Justified Shooting and a Justified Homicide (all Killings are 'Homicides' right?).

In conclusion, the way that dude Rayshard Brooks acted throughout this encounter, there is no way to rule out what he may have done if he incapacitated that officer with the stolen Taser -- like taking his sidearm and shooting him.

Please guys & gals, Stay Safe out there. Every two-bit chucklehead out there is after you.

District Attorney for Atlanta appeared on CNN Sunday and said the officer could be charged with murder or felony murder and that those were the two charges they are considering. Also said the body cam video was revealing because we heard the very first statement the officer made, which was “I got him”. DA says the officer said nothing about needing to save his own life. So what? Probably the most adrenaline fueled event that has ever happened to the Officer in his lifetime and the DA concludes this is evidence of murder? Why in the hell is the DA even being interviewed on television? Why isn’t a DA spokesman giving a statement saying the office is in communication with the Georgia Bureau of Investigations and will review all witness accounts and videos? The next day the DA sounds like the decision to charge has already been made.

I’m not police and I have nothing but sympathy for all you officers who have to deal with morons like these two in the car. Make sure the watch around the 12 min. mark when the female passenger is screaming at the top of her lungs “I can’t breathe,I can’t breathe” when she clearly was breathing fine and nothing was being done to restrict her breathing. I did notice that some of the other Chicago media like WGN only put part of the video in their story on this and did not include the audio. They described the woman as “saying” she couldn’t breathe. No idiots, she was screaming it like a friggin banshee for no good reason at all.

The good news is this was in DuPage County so hopefully these two mutts will be fully prosecuted. Imagine if this was in suburban Cook County like Schaumburg. Crimeasha would have already refused to prosecute and dropped all charges and would already be negotiating the settlement to pay these two losers.

From my understanding; a CNN camera crew was chased away from the scene. Their camera destroyed. From what I understand, two "white girls" set the "Wendy's" on fire, and it burned to the grown. Years of stripping policing powers in the name of reform have led to a disconnect between respect/fear for police power and criminal behavior. Cops are told to stand down against kids robbing stores, no car chases, no batons, no force. Where did they think this was going to lead?
And why even bother arresting someone if the courts don't prosecute and there's no threat of jail time? The Progressive Democrat politician is endangering public safety with these policies. And for what? To get re-elected. And its working for them, so they aren't going to change.
I don't wear a bullet proof vest, strap on a gun, or carry around 20lbs of equipment on my job. But I know to respect the person who does.
And I also know when the police go away, my world becomes a dangerous place.
Maybe people need to be taught how to respond to police or what the consequence will be. Make it part of Home Economics class, or is that gone to?

Classic case of terrible timing. Officer must be prosecuted or city might burn. Fetal policing is order of the day. In watching the video, it looks like BROOKS turns & fires something directly at the officer. At that point, the officer appears to holster a weapon (taser), transition to his firearm, & immediately return fire. So I’m assuming this officer was in fear for his life after a violent confrontation with the offender. He was likely unaware of what type of weapon the offender had gained access to during the fight with him & his partner. He likely believed it was his partner’s gun. Doesn’t matter if it was a taser or a gun fired at his face literally point blank; it was a good shoot. But if it was the partner of the cop who’s taser was taken, he likely did not have the time to decide if the weapon being used against him was a gun or a taser, making the case for the officer being 100% in the right even stronger.

There was a case last year in Eugene Oregon where a suspect grabbed a taser from the officer trying to arrest him. The suspect then shocked the officer with his own taser. The officer somehow managed to get to his own firearm and shot and killed the suspect. The city government of Eugene Oregon did not fire the policeman. The city officials ruled the shooting justified.

I don't understand why upright,Constitution supporting law enforcement officers do not move from these inner city hellholes and go to live in a small rural county in a state where you only investigate a couple of burglaries a month, catch a few speeders each evening, and get the dui drivers who leave the local VFW club off the road each weekend.

Yes the pay is a lot less, but so is the stress and the cost of living. You could probably buy a nice house in a red state outright for the money left over from the sale of your home in a blue state. But, if you decide to do that, you better do it quick since I suspect the property values in blue states are about to drop pretty fast.

Oh,and only law abiding cops should do this. We don't need jack-booted thugs, just mainly peace officers to man the traffic as the buses enter and exit the three or four schools in our county each morning and afternoon. For a very long time this qualified immunity inventionshielded coos from the Right and Proper individual prosecutions of those officers who violate criminal 18 242 and civil 42 1983. But No more! And Rightly no longer so. Officers are to be shielded from mindless nonsense and fake, fraudulent and especially vicious and malignant lies, but then SO IS EVERYONE ELSE.

I call for Police, all Law Enforcement, to operate only on Warrants. I demand it actually. I ask for officer safety, I ask for safety for the accused i ask for safety for All!! In deed I ask for respect for the Rule of Law as well as the EQUAL application of it.

Please reread our Constitution and our Declaration of Independence, the document that our Constitution rests upon. Please arrest the Traitors, it is your job. It is literally Your Job to do so.

Shocked but not surprised by the mayor's rush to judgment. As an attorney she should know better.

I discussed this with three attorneys who have reviewed use of force: former Cook County ASA and now a defense lawyer, retired Wisconsin DA (ex-cop) and a former federal prosecutor. All three said exactly the same thing: can't rush to judgment without the investigation being complete. Brooks resisted arrest and fled, making him an escapee, and, having stolen the Taser by use of force, he also committed a robbery. While being chased on foot he stops, turns toward an officer and deploys the Taser at him. (Had the officer shot him at this point it looks like it would have been a clean shoot. The Taser is a less, but not non, lethal weapon. The officer could have been neutralized and his gun stolen had he been hit.) Brooks is now running away with his back to the officer and gaining some distance. He appears to be swinging his right arm backward toward the officers and at this point he is shot. The videos we've seen do not show the ground view of the officers and any review has to be on the basis of what a reasonable officer would have done under the same circumstances and not Facebook Monday morning quarterbacking. We don't know the status of the Taser (the officer probably is in the best position to know this). Without more the experts who have had to make these reviews say they can't say what the mayor said without further investigation. If Brooks could have deployed the Taser and disabled an officer it would likely be justifiable.

Bottom line, I don't see any way that any DA could even think for a second that this was anything but a Justified Shooting and a Justified Homicide (all Killings are 'Homicides' right?).

In conclusion, the way that dude Rayshard Brooks acted throughout this encounter, there is no way to rule out what he may have done if he incapacitated that officer with the stolen Taser -- like taking his sidearm and shooting him.

Please guys & gals, Stay Safe out there. Every two-bit chucklehead out there is after you.

The only dem politicians that were crying were the ones getting thier cities looted and burned. There was no outcry from the usual suspects to stop any looting. Pelosi and Schumer were as quiet as mice. I hope the Republicans remember and run with this...

I know nothing about employment law in Georgia or any contract for the Atlanta police. So, I do not know what the options for the fired officers are. But, it seems to me that there is no just cause standard in that city where the mayor can fire an officer overnight without a hearing or a chance for a real investigation. Will they get their jobs back? I don't know. Will any prosecution be successful, again, I cannot predict that. But, I do know a few things; a prosecution will cost the officers dearly even if they are found not guilty. Their career is over and the legal cos will be huge. If found not guilty it would be in their interest to find employment elsewhere and avoid the damaged work environment. Who is going to take the job of police officer in Atlanta, Minneapolis, Baltimore, Seattle and now Chicago? You would have to be nuts

Well, IF what we are seeing from the financial reports trickling in from just the 1ST quarter of 2020 (and this is just from the effects on the COVID-19 lockdown; does not take into effect the riots & looting), - IT'S NOT LOOKING GOOD for 'restore & re-stock' option.

In this vein - a couple guys I work with do off-duty security at a big box retailer here on the west coast. At the outset of the Wuhan Flu, the retailer went to walk-up only. They are a couple doors down from the most stolen from Home Depot in the western U.S.

Since going to walk up only, handing merchandise out a window once it's been paid for in advance their theft rate has dropped to zero. The store is basically a giant warehouse now, guarded by armed security. Anyone wants to buy something, they're handed a menu at the door. Once they select, it's brought up and they pay for it. The retail theft has gone to zero. They're thinking about duplicating this with all their stores - secured merchandise, customers don't come in the store.

Oh, and my friends have run off multiple homeless, pro shoplifters, druggies, etc. who insist they need to go inside to "look at things in person."

A Taser is an instrument assigned for use only after the person carrying the Taser is trained to use it safely.
This "bad guy Brooks" after breaking away from the police with a Taser, in hand, aimed and fired it as a handgun while aiming at the upper torso of the officer chasing him.

It's deployment certainly did threaten the officer with great bodily harm.
..."bad guy Brooks" was not unarmed.

That Taser, in "bad guy Brooks" untrained hand my well have struck the officer in the eye.
In a split second the officer dropped his Taser and used his firearm to protect his life.
Excellent job by the police in an incredibly dangerous flowing situation.

The threat to the officer was only a few feet away.
He did not fire until fired upon.
Good work.

The Atlanta shooting was a justified use of lethal force against an assailant.

I'm not a LEO, but I've trained under one of the leading lawyers in self-defense law.

Lets do a quick rundown, the five tenets of self-defense and how they fit into the Atlanta shooting.

Innocence - The officers were doing their duty, responding to a call. This clearly falls under lawful conduct of a police officer.

Imminence - The threat was immediate once the cuffs came out, and the perp wrestled with the officer, grabbing at his belt for a weapon.

Proportionality - The officer had no way of knowing exactly what was being aimed back at him. Its a split-second decision in a adrenaline-filled moment. As others have pointed out, a Taser is just as bad as a gun in this scenario since the perp could use it to obtain his primary firearm. In this case, the use of lethal force is justified.

Avoidance - Being in pursuit and putting your life on the line is unique to law enforcement. To this end, it wasn't a matter of "letting him run off" as the officer didn't know what weapon the perp had, and what he'd do with it if he had made good with his escape. At this point it was on the officer's shoulders to counter the threat to himself and the public at large.

Reasonableness - It was a reasonable view from the officer's eyes that the perp was going to use force, and that required a lethal response. Given the short timeframe from when the perp raised his weapon to when the officer fired, the officer clearly perceived the gesture as a threat upon his life and reacted according to his training.
Again, there was no way the officer knew what weapon was being brought to bear upon him.

That's how I see it. Perhaps the DA will learn that trying to persecute a cop doing his job isn't as easy as he thinks it is.

Shifting police funding to social services will not solve crime. For decades, New York City was the welfare capital of the United States, spending one-seventh of all government welfare dollars. Crime continued to rise. Crime started falling in the city only when the New York Police Department adopted the data-driven policing that has now become the norm across the country.

But the most urgent task before this committee is to repudiate the narrative that law enforcement is infected by racism. The atmosphere in which officers are working is becoming more vicious and volatile. The attempts on officers’ lives, some successful, that we have seen in the last two weeks will increase. And under the pervasive charge that they are racist, officers will back off of proactive policing in minority neighborhoods. The victims will be overwhelmingly black.

In 2015 and 2016, when officers also retreated to purely reactionary policing, an additional 2,000 black males died, the largest two-year increase in homicide in half a century. Harvard economist Roland Fryer, University of Utah law professor Paul Cassell, and University of Utah economist Richard Fowles have recently documented what I have called the Ferguson Effect: the sharp rise in crime during episodes of pervasive anti-cop rhetoric and depolicing.
