- any provision in a CBA not directly related to wages and/or benefits is against public policy and unenforceable;
Guess what is included?
- deletes provision for Sworn Affidavit;
- deletes referals to the States Attorney for prosecution in the event of a Fasle Affidavit being filed;
- deletes any provision for required legal representation during investigation or interrogation (that means shootings);
- deletes all the Garrity provisions (that Administrative investigations, i.e. you must answer this or be fired, can now be used against you in criminal proceedings, meaning you will be compelled to give evidence against your own self interest);
- if we're reading the last lines correctly, deletes provisions that you can refuse to submit to a lie detector test and any refusals can therefore be used against you.
We've stated here and elsewhere, police shouldn't be above the law. This proposal puts police not only under the law, but under the bus and any train that happens to be around.

The Supreme COurt has invented some constitutional rights out of thin air, one being the 'right to privacy' which forbids prohibition of abortion. Another, and this works to our benefit, no matter what you think of the right, is the 'right to contract.' So a legislator cannot limit the 'right to contract' unless the government has a 'compelling interest,' which is hard to come by, generally. Here is the case that deals with the 14th amendment right to contract:

In 1902 a New York baker named Joseph Lochner was fined for violating a state law limiting the number of hours his employees could work. He sued the state on the grounds that he was denied his right to "due process." Lochner claimed that he had the right to freely contract with his employees and that the state had unfairly interfered with this. In 1905, the Supreme Court used the due process clause to declare unconstitutional the New York state statute imposing a limit on hours of work. Rufus Wheeler Peckham wrote for the majority: "Under that provision no state shall deprive any person of life, liberty, or property without due process of law. The right to purchase or to sell labor is part of the liberty protected by this amendment."

On her web page her number one priority is to “stop cash bails.” So now she wants to change the law so that any one can make any complaint against an officer and if found to be false there are no repercussions to the complainant. My husband is a retired Chicago policeman and we are free to move out of Chicago. The best thing to happen to us. We are a short distance away in Elmwood Park and spend winters in Florida, and what a world of difference. Police are respected and appreciated, lots of amenities and the schools (if you have kids) are top rate. Things are only going to get worse in Chicago. Stay safe out there.
I happen to live in one of those rare Republican districts in our state but if you post some thoughts on the best places to target with trying to counter this (for example, would county board pressure of the state reps in that county be an effective tool since this would impact county sheriffs and local municipal police?) This will lead into a very complicated bucket of lawsuits as the “against public policy” defense that would be put forth by the government has historically produced varying outcomes. The US government itself has been ordered to pay billions of dollars to partnering contractors when they attempted circumvent contractual rights and use the “against public policy defense” but failed. It should be noted that the government could legislate such restrictions for future contracts and avoid many lawsuits, but for current contracts they are on a very slippery slope. Maybe it’s good that we haven’t had a new contract for three years.

Here's one scenario I wonder about: they put cops on the ropes, get you into a situation where you are afraid your pensions are toast and where public support is not on your side. They now have you where they want you, vulnerable. Then they give you an order to do something horrible like help confiscate guns. If you don't, then goodbye pension. How many cops would comply, if not complying meant losing the retirement and benefits they've worked for? Do they intend, in other words, to bully you into a corner and try to force your participation in something you find abhorrent?
I don't mean any insult by asking, it's an honest question. I know that in a normal situation most cops wouldn't dream of complying with an order like that, but desperate times make for desperate people. I find it pretty strange that the only union on the democratic attack radar are the police unions. All unions do the same thing, protect the interest of their members. But, no mention of any changes to the democratic policy toward other unions. Let police officers strike and end any residency requirements for starters. I recall the days when police officers in Chicago were prohibited by regulation and rules from taking the 5th Amendment in any investigation. That finally was tossed out by the federal courts. He determined that the reason he kept getting pulled over wasn't because he was speeding and driving recklessly. No, the real reason was, you guessed it, racism. Synopsis As Introduced
Amends the Department of State Police Law of the Civil Administrative Code of Illinois. Provides that the provisions of the Illinois Police Training Act are applicable to the training, certification, licensing, decertification, and revocation of licenses of State Police officers. Amends the Illinois Police Training Act. Adds 6 public members and 6 retired police officers, appointed by the Governor, to the Illinois Law Enforcement Training Standards Board. Requires full-time and part-time police officers to be licensed rather than certified. Provides that the Illinois Law Enforcement Training Standards Board has the power to require local governmental units to furnish personnel rosters, employment status reports, and annual training plans to the Board. Provides that the revocation of a license or certification of a police officer is permanent. Provides that the Board shall, by rule, provide for the decertification or revocation of a license of a police officer who commits non-criminal misconduct that results in disciplinary action against the police officer. Provides that the types of misconduct that are grounds for decertification or revocation of a police officer's license shall be determined by the Board by rule. Establishes hearing procedures on decertification. Provides that the provisions are operative no later than one year after the Act's effective date. Amends the Local Governmental and Governmental Employees Tort Immunity Act. Provides that notwithstanding any other provision of law to the contrary, the Act does not apply to a peace officer as defined in the Criminal Code of 2012. Contains other provisions. Amends various other Acts to make conforming changes. Effective immediately.

Amends the Illinois Municipal Code. Provides that if the corporate authorities of a municipality wish to consider defunding the municipal police department through revising or eliminating its current budget or appropriation ordinance, stopping appropriations in current or future budgets, or ending or significantly reducing a tax or taxes that support the police department, the corporate authorities of the municipality must conduct no less than 2 public hearings prior to taking any such formal action, the sole purpose of which shall be to discuss the decision to defund the police department and to receive input from the community. Includes notice requirements. Excludes municipalities that have contracted for police protection through another unit of local government or other law enforcement agency. Limits home rule powers. Effective immediately.

Carol Ammons. The woman who was caught shoplifting and $80 purse from a charity thrift store in Urbana earlier this year.
The results of the investigation were swept under the carpet. She's always worried about the rights of criminals over the rights of the law-abiding. But given her and her former felonious husband who got a pardon from Quinn in exchange for a big campaign donation it's to be expected. The apples don't fall far from the tree.
