Pay Up Dart

And by Dart, of course, we mean Taxpayers:

  • The Illinois Supreme Court ruled that officers who were suspended while undergoing disciplinary proceedings can sue the Cook County Sheriff’s Office for backpay lost during their suspensions.

    In the 4-3 decision on Thursday, the state’s high court upheld an appeals court’s ruling allowing officers to sue Cook County Sheriff Tom Dart’s office over the legitimacy of the merit board before the decisions in their disciplinary cases were made. The merit board investigates disciplinary matters involving police officers.

    The court also determined that the officers can resume their lawsuit seeking repayment for lost wages during their suspensions, the Chicago Sun-Times reported.

Dart (and his handler Prickwrinkle) fall back on the excuse that all scumbag politicians do when doing wrong: 

  • The sheriff’s office bemoaned the decision, saying it will significantly increase the time it takes to discipline an officer for misconduct and make it more difficult to fire bad officers.

    “Today’s Illinois Supreme Court decision is a catastrophic blow to law enforcement accountability,” sheriff’s office spokesman Matthew Walberg said in an emailed statement. “The decision rewards employees who engaged in criminal, unethical and despicable conduct at the expense of Illinois taxpayers.”

Isn't this Walberg the guy who used to be Kass's go-fer? And now he's another one of Dart's six-figure former media goons? Has Kass disowned this tool?

But notice how they fall back on "accountability"? Not that they want to do the best investigation possible and come to a legally sound and just finding - they want the ability to undercut Contractual protections and shortcut due process in order to sacrifice accused officers on the altar of political expediency. 

It's too bad that Dart's stupidity is going to cost taxpayers tens of millions, but if he had followed the rules in place, none of this would have happened.

it's on par with a false arrest. so whatever , if he told the truth , his statement should have read " I don't believe in due process, or the rights established by law and in our nation's constitution which had been legally protecting people because it might make me look bad " I just want to say I fired that guy" - this basically what every politician wants to do .

Too bad an enterprising lawyer hasn’t figured out a way to sue Dart personally for the decisions he makes and not have the County be on the hook, though County would be since Dart is an employee. Oh to have a sexual beef against Dart, how sweet it would be to see him dangling.

Most of this is money the county should have paid these deputies all along, so the taxpayers were on the hook for it anyway.

Of course, that doesn't include interest, punitive damages (that Dart himself should have to pay) and legal fees.

Merit board suppose to be independent entity not for rubber stamp for Sheriff. Dart illegally removed member of board in 2011 before his term was up cause he was pissed at rulings guy made. Then replaced him with this guy. Just a minor detail left out by Slumtimes

campaign since 2012. Rosales is the $84,000-a-year director of Olive-Harvey College's South Chicago Learning Center, part of City Colleges. Rosales said Dart is a friend. Dart appointed him in 2011.

The main issue that Dart tried to bury is that the Sheriff's Merit Board was ILLEGALLY CONSTITUTED, thus denied the deputies legal due process, and issued legally null and void rulings. Dart's appointment to the Board itself was illegal, plus the Board was issuing rulings when it lacked the proper number of Board members (a "quorum" in legalese), so decisions made by this Board WERE ILLEGAL. So the ILSUPCT majority found the Board was illegally operating, therefore the deputies did not have any other recourse except their lawsuit to protect their rights to due process before discipline.

Dart crying about having to now pay these deputies their back wages, benefits, raises, health insurance, promotional opportunities, training time, etc. is a crock of liberal shat. The deputies are now legally entitled to every penny, because Dart tried to play a game, lost, and now has been called out by Illinois highest court.

It’s not Dart’s stupidity, it’s his ego, also known as hubris. When the Percy Taylor case came down, Dart could have resolved this immediately, yet he chose to ignore the law. His attorneys could not persuade him he was wrong, so he doubled down and kept doing it. The state’s attorneys assigned to the case were dealt a shit sandwich because Dart thought he was above the law. Scores of deputies lives, marriages, and finances were ruined because Dart could not possibly be wrong.

But he owns this mess and now, and in typical Cook County fashion, the taxpayers eat it. No other county operates like this; the threat of millions of dollars of backpay would have brought any elected officials in another county to heal and stop the bleeding. But not in Cook County. Preckwinkle owns this, too. For all her lip service about black and brown people being discriminated against, ask Cass Casper or Chris Cooper how many of the officers put off were black or brown? Here’s a hint: over 75%. Sure seems discriminatory doesn’t it? Once again, law enforcement gets substantively less than due process.

Dart’s discrimination further shows toward the correctional staff. The vast majority of officers getting harmed by his actions were CO’s. Again, predominantly African-American and Hispanic. If CWB assigned one of its crack reporters to investigate this obvious discrimination, it would be a huge story: white sheriff illegally deprives dozens of black and brown officers of their due process rights.

The officers’ attorneys stuck with this case for years, despite ridicule from some unions and personal attacks by the sheriff and his merit board.

This is simply a lie. I doubt seriously things are that much different there, than they were here. If an officer is guilty of criminal, unethical and despicable (whatever the definition of that is) conduct, there would be no back pay as the officer would be fired and the suspension warranted.

Former copper, prosecutor, currently lawyer in private practice for many years. I have represented Cops in various matters. My humble opinion is most lawyers who work for government are arrogant, not real energetic & want to please their masters & not willing to tell the emperor he is not wearing any clothes. All assistant state's attorneys are at will employees. So rather than try private practice they suck their bosses ass at every opportunity. Doing the right thing is not rewarded seldom is loyalty....starting to sound familiar?

Like many posts above, Dart is the one who always, and I repeat always tries to be the smartest guy in the room. Back when he was in the Sheriff's spot for the 2nd or 3rd year, some leftist reporter included him among the 100 most influential people in politics. All this innovative bullshit, the constant whining about the jail being a substitute for mental health facilities, bitching about overcrowding, even though Sheahan had nearly twice the population to deal with (never heard him bitch, do interviews or complain about conditions or whatever). Dart continually involved himself with shit that had ABSOLUTELY NOTHING to do with administrating a correctional/holding facility for arrestees awaiting trial. He got into suing Craigslist, rehabilitating whores, rescuing puppies, overseeing capital projects like a quarry in Robbins, and goofy shit that has nothing to do with law enforcement in unincorporated areas of Cook County, overseeing security in the Circuit Courts or running the jail. Rather, he'd show up doing radio interviews in which he delighted in telling the interviewer how he has his Sheriff's police detailed to areas in Cook County that are as far away from their homes as possible. Who does shit like that? As posted here numerous times, he padded his payroll with relatives of media personalities by giving them titles like "director of policy" and other non-sense. At best, Dart should have been a social worker. His start in politics was working on an aldermanic campaign for a candidate who lost twice. As a 19th ward consolation prize he got a state senate seat for a retiring senator, and then when the district map was redrawn, became a state rep. Maybe it was the other way around. Whatever. Sheahan recommended him for the Sheriff's spot when he decided to retire, and the Sheriff' office has been nothing but fucked up ever since, with Dart trying to shift his shortcomings as an administrator to the previous sheriff, effectively biting the hand that fed him. That's all you need to know about this guy, all the qualities of a dog, with the exception of loyalty. So now, potentially the biggest fuckup of his time in office is about to bite him in the ass, and this time there's nobody to blame but himself.

That can't be actual. No Democrats would piss of the liberal base by working to only reduce police benefits (the Social Security amounts they paid into when they were not cops mind you) by just half... Only half? C'mon!

If those two were real progressives they'd make sure cops have nothing to retire on - pension or SS (before or after being a LEO) and that punishment will anyone racist enough to want to be a peace officer!

I’m incredibly relieved by this outcome. Not sure how many people will get relief now, but they ruined so many lives. The Sheriff is a huge assholes in this, as is the State’s Attorney and the private lawyers they paid millions to defend this loser case for six years. Suspending these guys without pay was the original sin. Those salaries were re-budgeted and available for redistribution as bonuses to an expansive executive staff, including attorneys employed to keep these guys off the payroll.
For a guy who postures himself as a good government maven, everything about this violated the provisions of Shakman. They treated protected employees like at-will/Shakman exempt.
The real question in this case should be: who pays? If a private insurer were on the hook, they’d disclaim liability because the SMB ignored everything. The County is obliged by ordinance to indemnify but this was willful. A friend told one of the private lawyers who defended this case in early stages (Taylor) that it’ll live in infamy as the worst public employment disasters in history.
Something about Dart is off. He’s never won a competitive election. He had an utterly unremarkable legislative career, if you exclude his bold pronouncement in the mid-90’s that he aspires to be Speaker. He’s the elected Sheriff and chief law enforcement officer but still insecure enough that he needs to fire an employee for reporting rumors that he beat his wife AND sued him AND HIS wife AND HER employer for defamation. That’s real amateur hour rubbish.
