Chicago Federal Judge Did What?

This seems....unusual:

  • As a five-time convicted felon, Glen Prince was facing a mandatory minimum 15 years behind bars when he was charged in federal court with being a felon in possession of a handgun stemming from an armed robbery on CTA train in 2021.

    Instead, Prince’s case was tossed out earlier this month by a federal judge who ruled the statute barring felons from possessing handguns is unconstitutional in light of a recent U.S. Supreme Court decision.

    The ruling by U.S. District Judge Robert Gettleman is the first of its kind to come down in Chicago’s federal court and joins a host of other similar cases that have thrown the decades-old law into a sort of legal limbo as the issue works its way back to the high court.

And what about pending cases?

  • The implications are particularly large in Chicago, where there are hundreds of pending felon-with-firearm cases stemming largely from the U.S. attorney’s office efforts to throw federal law enforcement resources into the fight against the city’s relentless gun violence.

As many might recall, after the lack of comprehensive prosecution at the local level by Crimesha, the US Attorneys office stepped in and started prosecuting Federal Law violations. When applied ruthlessly in Virginia years ago, violent crime dropped by something like 40% overnight. Criminals heard about Operation Exile and didn't feel like doing 10 years in a Federal pen a thousand miles from home. It never went that far here, but it was the only game in town.

Now it's all on hold? We had a couple gun cases go through the US Attorney's Office here and the prosecutors were very thorough. VERY. Multiple prep sessions, intelligent questions, and they seemed to know their jobs as opposed to Crimesha's shit show. And although this was under a democrat administration in a democrat city/county/state, we did end up batting .500 with the cases and the bad guy did get sent away for quite a while.

One HUGE difference between the 1790's and today? They rarely needed to restrict a convicted felon's rights to arms, because most of the convicted felons sentences were completed after their dead body was cut down from the gallows. Dead men do not need access to weapons anymore.

I'm a Second Amendment absolutist. Every individual in the United States has a right to bear arms. When it comes to constitutional rights, we have to take the good with the bad.

Or else they take away our right to own guns gradually. Soon, they take away the Second Amendment rights of: people convicted of misdemeanors, people accused of crimes but not convicted, register your guns and ammo or you can't carry, a social credit score that determines if you can or can not carry a gun on you, etc...

Remember, the left is very cunning and ruthless. Their main method of operations to take away fundamental rights is to do it gradually.

I have to admit I agree with the judge here. There are too many restrictions and I favor removing most of them. In fact the only one I would keep is an adjudicated case of mental incompetency.

How about we take whatever time you typically get from "possession by a felon" and just tack that onto the time given for the actual crime committed with the gun?

Call it double-secret aggravated murder/robbery/assault/etc.

The question is a good one that SCOTUS finally brought to the forefront. Where in the Constitution does it say that conviction of a crime causes one to lose their God-given rights as spelled out in the Constitution? The answer is: Nowhere.

Off-topic: I heard Johnny Boy tried to play Mr. Nice Guy at last night's FOP meeting. Instead of his regular performance of hurling insults, derogatory remarks, and implicit threats towards members, he decided to put on a 'human' act. I bailed on these meetings a year ago as they became less about useful information and more a stage for John and his cult to self-congratulate and suppress dissent. At first, I naively thought maybe John had seen the light, thanks to some soul-searching or an earful from an outsider. But nope, it turns out the big guns from the National FOP were in town. It seems John got a reality check from the National Lodge and is now being tightly reined in, especially after his grandiose threat to splinter off and start his own union sideshow. I bet he was itching to launch into one of his infamous rants, especially with all the chatter about him in the recent SCC Blog post. It has been argued that once you've committed certain crimes, you've forfeited those rights, regardless of conviction & sentence serving.

One of this year’s other murder victims was also killed after being punched in the head and falling to the ground. Russ Long, 53, died about two weeks after being attacked outside the Cartier store, 630 North Michigan, on the afternoon of June 29.

A man is awaiting trial on murder charges in that case.

On Monday, a 23-year-old woman was critically injured when a man struck her in the head with a log directly across the street from where Long was attacked. She remained unresponsive with head and brain injuries on Wednesday as prosecutors filed charges in the case.

Yesterday was the dedication of Lodge 7 as the "John Dineen Lodge 7." John was a bubbly, if that's possible, over the COLA bill and contract. The National and State guys were there yesterday for Dineen. There were meetings before the dedication.

In WA state, they have given voting rights back to felons, and gun rights. An iffy proposition at best, but they do so when they are no longer in permanent lockup. So if and when they are released to a parole officer, they can vote and carry a weapon. In my mind this puts great power into the hands of the government to influence and even pay for the votes the PO wishes. Something like, "let me see your ballot, vote this way and I will overlook this violation." The government is in total control of prisoners, and parolees, until the finish all the terms of their sentence.

If you're charged with a crime that could result in felony sentencing, even if you take a misdemeanor plea or get probation, you are by the Feds thinking a convicted felon.

100% true. King Kitten was visibly disgusted having to tell the truth about Erin Jones sacrificing months of her family and personal life for the betterment of the membership when we FLOP strategists slated her vs. Martwick. He had to put on an act for the National Boys as they were in the back of the room for the meeting.

Twice he called her by name, saying especially because of her Martwick and other politicos discovered within themselves a newfound respect for the Lodge 7 constituency, which in turn compelled Martwick to champion our COLA pursuit.

The best part? They are all well aware of what a piece of shit he is. Well aware that he and us other board members openly refer to her regularly in derogatory terms. Completely untrue statement here. Trump was sworn in January 20, 2017. CPD's consent decree was approved in federal Court on January 31, 2019. Note that's two years after Trump was sworn in. I hope your GOCRs are more factual than your blog posts.

Yeah. Well aware of it. John took credit (again) for things whose foundation were set during previous administrations. All the heavy lifting was already done and J-Kitty and his band of merry nut huggers just so happen to be the ones in office when the city decided to play nice because they need us for the DNC. "A week before Inauguration Day, President Obama’s Justice Department released a shoddy report declaring the Chicago police guilty of a pattern of unlawful force. That report lacked the most basic statistical integrity and transparency; it failed to disclose any data that justified its conclusion. The feds recycled fabricated calumnies about the department, such as the outrageous claim that officers in Chicago do not care about solving black-on-black crime. It found police racism through the usual trick of ignoring crime rates."‍


The consent decree was almost temporarily undermined with the unexpected election of President Trump, whose first attorney general, Jeff Sessions, immediately predicted the dire outcome if it were implemented:‍


"...These lawsuits [that lead to the consent decrees] undermine the respect for police officers and create an impression that the entire department is not doing its work consistent with fidelity to law and fairness, and we need to be careful before we do that."‍


Sessions’ words sounded like the end of the consent decree, but Chicago mayor Rahm Emanuel and then-Illinois Attorney General Lisa Madigan, kowtowing to the increasingly extremist factions of their Democrat Party, implemented the consent decree when the Sessions declined. Sessions’ predictions about undermining respect for police now appear prophetic..."
