Arbitrator Re-Run
So much for Conehead being a friend of unions. We guess it's only if you're in the correct union.
As promised, Arbitrator Benn affirmed his previous decision, saying cops have a Right to what every other unionized city worker has:
City Council members violated their state constitutional oaths by denying Chicago police officers accused of the most serious wrongdoing the right to bypass the Police Board, risking a costly court challenge the city is destined to lose, an independent arbitrator warned Thursday.
Independent arbitrator Edwin Benn had already affirmed and reaffirmed that state law guarantees that when Chicago police officers are recommended for firing, or for suspensions of over one year, they have the right to take their cases to an arbitrator who might be more sympathetic and would hold proceedings behind closed doors.
Thursday’s second reaffirmation was no surprise and sends the matter back to the City Council for a second vote.
But the tone of Benn’s second reaffirmation was unexpected.
Well, when you're dealing with children, sometimes you have to be firm.
And sometimes you have to swat them on the ass:
Fraternal Order of Police President John Catanzara was so emboldened by Benn’s harsh tone, he’s heading straight to court to request for a summary judgment immediately enforcing the arbitrator’s ruling and a temporary restraining order to suspend all Police Board cases impacted by the ruling.
“I’m not gonna wait for a very simple reason: I don’t trust the City Council and the mayor. ... They think political cover is more important. They want to do the easy thing instead of the right thing. That is the definition of a terrible leader,” Catanzara told the Sun-Times.
“You’re noticing a trend here. [State’s Attorney] Kim Foxx gets to arbitrarily decide what the threshold for shoplifting is, even against statute. They think they get to arbitrarily decide what labor law is. They don’t. They’re supposed to uphold the current law. But they’re saying, ‘No. We know better.’”
That's the thing about democrats and "progressives" (but we repeat ourselves). They always know better than you little people and if you just listened to them and didn't demand a seat at the table, everything would be hunky-dory in their little totalitarian dictatorships.

Here we go again the same old playbook, bastardized the police, the states attorney the judges the city Council. All of them are all part of the evil cabal. The states attorney and the judges have a very simple job. It’s elementary as they say if they did their job, all they have to do is open up the law book that says what the crime is, then the punishment is right there in the book criminal law do your job do what it says that’s what you do but they don’t they meter the law as they want to. They don’t follow the law they make up stuff.
When the states attorney and the judges break, the law do not follow the law there is no law. There is just a struggle for survival.
Does anyone know if this is just for PO’s? Does this include the PBPA? No one seems to give me a straight answer including the PBPA.

All I know is JC and the fop did not negotiate new cars in the contracts. When they came to roll call and spouted off about new cars a few years ago I told one fop rep he was either stupid or a sellout. I do think every fop boss before JC had been owned by the city or sold their soul for future or current benefits. I’m sure he has his flaws but I don’t think he’ll sell us out for personal gain. And if mette runs next I’ll vote for him. We can’t have sellouts running the fop. Without the ability to stoke we need a real voice in charge of fop.

I think that these types of situations where politicians intentionally act outside the scope of their position should be punishable events.
I get that we all have different opinions, and sometimes unpopular decisions must be made. But that’s not what we’re talking about here.
Willfully and intentionally acting against the laws and statutes MUST have some consequences. If it can be shown that actions outside this scope were taken, punitive civil actions must be allowed.
Countless times an idiot politician in Chicago makes the taxpayer foot enormous legal bills on issues which are an attempt to prove a personal point, but have no legal justification.
Keep it up J-Cat ! Thanks for all you do. After years and years of “no voice” we finally have someone that steps up to the plate when needed. Nobody will be right the first time, but at least everyone knows we won’t go down without a fight and a voice.

If arbitration really is a state constitutional right, the legislators in Springfield cannot change this on their own. It would have to be put on the ballot on the next election for governor.
