A Certain Win

This went mostly the way it was predicted to go:

  • A Cook County judge ruled Thursday that rank-and-file Chicago cops facing the most serious disciplinary charges can bypass the Chicago Police Board and have their cases heard by an outside arbitrator, but he found the proceedings should be held in public.

    In his 26-page ruling, Judge Michael Mullen said arbitrator Edwin Benn’s decision that such arbitration cases should be held behind closed doors “was neither arbitrary nor capricious,” but Mullen sided with the city in deciding that Benn’s finding ran contrary to “a dominant and well-defined public policy.”

    Mullen found that closed-door arbitration would violate a federal court order mandating sweeping reforms to the police department's policies and practices, namely a requirement "to increase and promote transparency in matters of police accountability.

To be realistic, we kind of expected something like this. Everything the city has done, said, and legislated for the past eight or more years has always been couched in terms of "transparency," so a hearing held out of the public view was going to be a stumbling block.

But the biggest issue, and the one the FOP wanted most of all, was getting cases away from the politically corrupted Police Board and in front of a neutral arbitrator who would actually be versed in the way Supreme Court decisions have been going for decades:

  • that an officer's actions must be judged on what "a reasonable police officer" would decide and not a political hack beholden to those who appointed them, along with the constantly shifting political winds.

Not a total victory, but a good win. It remains to be seen what form this process will take now. Video hearings where the public could observe, but not participate or interrupt?

Doesn’t matter about being in the public. Maybe the public needs to hear the officers side of the story and see some of the good testimony about the officer. The fact that the one sided police board no longer has teeth is a major win. Reasonable professionals will now handle life changing hearings that would effect not just an officers job but his life. Great work by the prior FOP administration for fighting for this years ago. Not a Catanzarra hater by any means, but he really should be giving credit where credit is due. I don’t think anyone will hold their breath for that.

This was not a win. The 6 arbitrators will now be harassed by mobs demanding they rule certain ways.
America has changed too much. The arbitrators will rule out of fear for their families.

The politicals will, reliably, strive to clusterfuck this as much as they can.

To them, every opportunity to turn anything rational, reasonable and fair into a circus of absurdities is their stale bread and rancid butter.

While this is a big win, the assholes will try to slime their way into the details, whatever this process is determined to be.

WBBM radio interviewed some ghetto anti police organization and they weren't happy with the arbitrators that would handling the hearings. According to this organization the arbitrators don't reflect the racial makeup of the community. Neither does Johnsons upper level city management team.

Bob Bartlett went to Labor Court and won over five years ago . The judge rules that when the contract was settled that it would become part of the contract . The first thing that happened that should have happened was ARBITRATION ! Kevin Graham was told repeatedly to go to arbitration by his Executive Board and dragged his feet and finally did file . The first thing Catananzero did was to pull out of arbitration which cost members four years of these cases being taken away from the Police Board . Have we heard Bartletts name mentioned once by this current President ? That would be a big NO ! Thanks Bob you did a great job !

Exactly, if they want transparency, then let them have video/zoom WITHOUT audio so they cannot interfere!!! Thats one right the accused should have.

So the solution to this issue is to do what the department, the mayor and all the social justice warriors in political positions want. You won't get in trouble if you follow their rules. Proactive policing is dead. Respond to all jobs safely, in a manner that will not jeopardize you or the public. If a situation seems dangerous, call for support before engaging. If there is a mental health component, call for the CIT unit. They have 5 brand new ambulance type vehicles, specially equipped for their role. But always wait for the support you need, like the incredible consent decree classes are teaching. Reasonable suspicion or probable cause? Make sure you absolutely have everything you need to establish both. Be sure in every action you take as a police officer in this city. A big part of that is being deliberate in you movement and actions. If criminals escape before you can positively establish that you have the legal right to take action, so be it. Justice takes time and needs to be absolutely correct. If the number of homicides and violent crimes skyrocket, so be it, for the sake of ensuring that we don't violate a single person's civil rights, or hurt their feelings, then the citizens of this city should be willing to bear the costs that come with protecting rights. I will of course continue to provide the case reports to document these events, but in good conscience will only make arrests or stops if I have 100% proof of a crime to the level that SA Foxx would be guaranteed a conviction. That will be my contribution to restorative justice that is so desperately needed in this city. And if hundreds more are murdered, that is the price we should all be willing to pay for justice. No justice, no peace. The added bonus will be, fewer cops will have to face arbitration in public, because they will no longer be violating citizens rights, and of course newcomers rights as well. This all begins with slowing down, step back, analyze everything you do, ensure you have the law and the department's support and legal justification before you take action. If you need to pull back and look up the law before you engage or take further action, then of course you must do so. Only through justice will there be peace,

R U F-ing nuts? Graham Crackers didn't do anything as President. He got caught in a residency beef. Rahn keep him from being fired. The city owned him. He did absolutely nothing on the contract. And when he lost his reelection did the city send send him back to a beat car? No they gave him Sgt.'s pay and a take home car. If he was an effective FOP President he'd be pushing a beat car on the mids on the West side until be could bid out.

Question is this going to be a big cash station for favored lawyers arguing to fire the PO or will the Corp Counsels office be exposed to the incompetence that inhabits the office?

Inquiring minds want to know if the City is willing to expose the Corp Counsel office which could start a drive to get rid of all the dead wood there?

The FOP could appeal this ruling in hopes of a total victory, but that might be a role of the dice as an appellate court might screw things up. But, I can see the city trying to make these hearings into a circus. And, will the arbitrators even agree to a public hearing? That might be a stumbling block. As far as I know, no Police Board hearings have been public events. There is one hearing officer and he sends a transcript of the testimony to the other police board members.

I want transparency with the aldermen and mayor, they should wear body cameras when making these million-dollar deals that somehow make their friends and family a lot of money. You know, just like the recording of ed burke saying "the cash register has not rung yet".

Bullshit. This victory was brought mostly by the Illinois State FOP. John Catanzarra has lost my confidence. He went to the Super Bowl via our money. Why won't he allow us, the members access to our accounting data? Why not allow a forensic audit so we can find out what happened to our money?

Man, even the city is calling the bonus the "FOP" bonus. That email was the best campaign ad for the 2027 Vision team....Catanzara just keeps winning for the membership. This week the frivolous grievance was not sustained. JCAT is having a pretty good week it would seem

What happened to mike shields when he lost? Back to the beat car. Graham was terrible as pres and probably one if the poorest excuses for a copper i have ever seen. A foot man as young guy on job.

All these JCat haters that want to give all the credit to everything that’s been accomplished in the past 4 years to the “prior administration” sound like fucken demoRATs giving credit to obama after Trump got the economy out of the crapper.

Change the eavesdropping laws in Illinois for starters. Go to a one party consent for recording conversations. Many states have this law. The two party law in Illinois is meant to protect the corrupt politicians.
