Beware the Dump

A comment provoking a lot of vitriol:

  • Hey SCC, off topic but my wife just gave birth and I informed my Sgt that I will be taking my 12 weeks which was fought for for years. I was informed that if I take the 12 weeks I will be dumped and told 4 weeks is what I will take. I have been hearing other officers being told the same thing. I’m taking 12 weeks, if I get dumped what recourse do I/we have? Anyone know if we can sue the brass for a hostile work environment ? My wife and I thank you for any advice

If you have enough money, you can hire a lawyer to sue anyone for anything.

And if the FOP got the twelve weeks family leave approved, it's certainly a Contract violation. We know the supervisors got it, but did the rank-and-file?

In the meantime, unit assignment usually comes with conditions. And certain units (Mounted comes to mind) are specifically exempted from certain Contractual protections (no summer furloughs). And if you make waves....we're assuming it's not a biddable spot....you make your choices and you live with the consequences.

Take your 12 weeks. Your wife and child are more important than whatever your current assignment is. You will be thankful in a few years when she doesn't divorce you. She will remember later on whether you put your family first before this job.

And think about this. What kind of sergeant tells you to put the job before your family? Here's the answer: one who doesn't care about you, one who only cares about himself and his spot. if your sergeant said that to you, do you think he or she really cares about you or your family? Go work for a sergeant who tells you to put your family first.

You can love the job, but it never loves you back. Get your priorities straight.

Everyone looks down on the beat officer, but part about bidding to a watch and just answering jobs, there ain’t shit anyone can say or do to you. Especially officers who bid to midnight and work a late car, hit the medical, call off, take your 12 weeks. What are they going to do to you, dump you to days?

Is this actually a copper? Another spoiled millennial that actually believes that they work hard and deserve 12 weeks off and come back and go back to the cushy job they had! Any copper with any tenacity knows how things work you get to a unit you get to a great position rules change you want to come back and push that big car in the seventh district on midnights welcome back you don’t deserve to go back to where you were, that spot will be open for somebody else 12 weeks off for a man. What kind of bullshit is this? This is ridiculous concept from the start plus that’s 12 weeks if you work any kind of special employment, you will not be able to work anything you talk about a what’s the word to put it mildly Hey sissy, type of generation men used to be men and you’re going to cry on a public bulletin board. Ever here this " the worst unit is better then the best watch" ? Keep your spot , my kid had been born on my RDO had no time off. There are two the departments - people in units & people on the watch - stay in units. Lot of hate here, that's concerning, city did its job making us turn on each other more than ever.

To all you company man out there, step up your game and answer all my calls while I enjoy doing fuck all, all day every day for 90 days plus my furloughs, which will be extended to the max.

Don't listen to these clowns.

Inform your supervisor in writing (email OK) that you intend to take the full twelve weeks and your projected start date. HR will be required to qualify you for FMLA and provide you with Rights and Responsibilities as well a Designation Notice within 5 business days. They won't do it, the department has no idea how to handle these things. This will be FMLA interference violation #1, don't complain if you don't get these forms, just keep the email informing your supervisor of your intent to take time off.

Take your 12 weeks and ask to be returned to you original position, in writing again. When they refuse, this is FMLA interference violation #2.

Find an employment law attorney or contact the Department of Labor and file your compliants.

FMLA is mandated regardless of what city policy or collective bargaining says and is a right that can't be bargained away. There was a Legal Affairs attorney who resigned and is working for a firm out west who takes these types of cases, see if you can find him or ask around.

Well...............If you are in a a unit, it is probably a non-bid unit. You knew the rules by taking that spot.
If you do not like the rules, leave. There are plenty more star numbers to fill your spot.

You should have planned your furlough around the birth of your child.....like everyone else did since time began.

Nothing in the contract guarantees anyone a non-bid position, and it never will. This isn't a FMLA or contract issue unless they actually prevent him from taking the 12 weeks off. As long as he still has the same job(police officer), the same pay, the same benefits, etc. when he finishes his stay at home daddy routine, there's no grounds for a grievance or a lawsuit. Being dumped from a unit or team or whatever special spot, because you weren't there for 12 weeks, is not a violation of anything in the contract. Non-bid spots typically have certain requirements, such as a certain level of activity. 12 weeks of no activity means they can dump him with no issues. I'm struggling to see the justification for a man taking 12 weeks off to care for a newborn, absent any major medical issues. I'm assuming, probably correctly, that this guy just wants 12 weeks off, since he's entitled to it. That's great and family first and fuck the city and department, but don't expect your special spot to wait for your vacation to be over. Take your 12 weeks and then try to earn your spot back. Then do it all again when you have another kid.

I believe the 12 week deal is a Federal Labor Law issue. Double check my work. I even heard that the Feds reimburse the City 's payroll lose. So no harm is actually done.

Nothing in the contract guarantees anyone a non-bid position, and it never will. This isn't a FMLA or contract issue unless they actually prevent him from taking the 12 weeks off. As long as he still has the same job(police officer), the same pay, the same benefits, etc. when he finishes his stay at home daddy routine, there's no grounds for a grievance or a lawsuit. Being dumped from a unit or team or whatever special spot, because you weren't there for 12 weeks, is not a violation of anything in the contract. Non-bid spots typically have certain requirements, such as a certain level of activity. 12 weeks of no activity means they can dump him with no issues. I'm struggling to see the justification for a man taking 12 weeks off to care for a newborn, absent any major medical issues. I'm assuming, probably correctly, that this guy just wants 12 weeks off, since he's entitled to it. That's great and family first and fuck the city and department, but don't expect your special spot to wait for your vacation to be over. Take your 12 weeks and then try to earn your spot back. Then do it all again when you have another kid.


BNSF railroad was fined for discouraging emplyees from using flsa time. It was considered retaliation under that federal law. Doesn't the city prohibitedretaliation? Also, BNSF had to remove the use of FLSA used time from its computer program productivity program.

Are you a male? Do you have a admin spot? Caps spot? DCO? Tac or some spot in a unit that thousands of other officers would kill to get and are sitting on a list to get? If any of your answers are yes, then I agree, I would dump you also if I was a boss. Have a great spot and still need to get some more scamming in. Sorry, but the work needs to go on and while you go away for 12 weeks other people now need to pick up your slack and do your job in your nice spot. If you are management on 2nd watch I would also make sure you didn’t get management the following year. Sorry, it all sounds harsh but too many scammers on this job. My wife and I have had four kids while I’ve been on this job. Each time I’ve taken two weeks of my own time and it was time to get back. The break was nice but it also got us into the routine quicker with the baby incorporating work right away. Enjoy the baby and let the mom be the mom and you go to work like the man.. that’s how it’s supposed to go. Or will u need to stay home and pump milk??? No, that’s the wife’s job, you help out for two weeks and she’s able to walk and lift normal again, (yes two weeks is plenty, she’s done 4 C-sections) and been fine after two weeks. If you have a spot, four weeks is a gift. If you wanna push it, good luck. What recourse do you have???? Grow up and be a man and support your family by working hard. how about that recourse.

Gotta be a CPS alum right here. You do realize parental leave is authorized to be taken any time up to a year after the birth right? So if we use our thinking caps, 12 weeks is about 3 months which means you can spend roughly months 9-12 (or any earlier months) with your baby. You know, if you actually care about developing a relationship with the human being you brought into the world. There's many milestones a baby can achieve in it's first year. Those milestones are even easier to achieve with an interactive father to help guide them. You either don't have any children (which there's nothing wrong with and not meant to be insulting) or you had zero interest in raising a child. Because any father who cared would jump to be able to spend 3 months at home with their baby and still have all the bills paid.

People have been raising children and developing deeply loving relationships with those children without taking 12 weeks off from work to do so. You can have some great memories in that first year, especially with a first child. You can probably even experience some life-changing events. You don't need 12 weeks off to do that though. I'm not saying every single person who has a child shouldn't take those 12 weeks every time. If you're entitled to it, take it and enjoy. Just don't come on here whining that you got dumped from your special spot because you chose to be gone for 12 weeks. And don't act like those 12 weeks, wherever they occur within that first year of life, are somehow more important than the 17 or so years after, where you will truly develop that lasting and meaningful relationship with your child. I'd argue that people should be entitled to take those 12 weeks at any time during the first 18 years of their child's life. I doubt many would choose the first year if given that option. That was my point. Your position is that a father who doesn't take 12 weeks off during that first year is not an interactive father, has no interest in raising a child, and won't be able to form a relationship with their child? I'd like to see the data that supports that opinion. Your assumptions and condescension were cute though. Also, where did you receive your education? I did not attend CPS, but I was taught that "it's" is a contraction of "it is." I think you meant to use "its," which is possessive. I suspect they even teach that at CPS.
