Air Chase

This still doesn't seem like a good idea:

  • Two men are sitting in the Cook County jail, accused of carjacking an Uber Eats driver near Goose Island. And they can thank one of Chicago’s most effective apprehension partnerships: a CPD helicopter and Illinois State Police ground units.

    Prosecutors said the 25-year-old delivery driver was targeted while sitting in his 2016 Toyota sedan in the 800 block of West Blackhawk around 8:45 p.m. on Sunday, December 8.

    According to a Chicago police report, Tayvon Andrews and David Brantley, both 18 years old, approached the car and ordered the driver out while Andrews was displaying a gun. The victim complied, and the hijackers, Brantley behind the wheel and Andrews in the passenger seat, sped away.

    It wasn’t long before CPD’s helicopter located the freshly stolen Toyota. Joined by two ISP troopers, the air and ground team pursued the hijackers until the Toyota crashed at 87th and State streets around 9:45 p.m., the police report said. The troopers arrested Andrews and Brantley at the scene and handed them over to CPD.

They still crashed, all while the helicopter was tracking/chasing them. 

And you can bet that ISP didn't just happen to be in the neighborhood - we're forbidden by General Order to parallel pursue, but is ISP? And what if ISP wrecked into an innocent passerby? The payout would come from Illinois taxpayers instead of Chicago, at least at ground level. We don't know if the chopper crew has been sued for anything like this yet, but give a lawyer a chance and they'll sue their own grandmothers.

ISP doesn't do payouts like Chicago does. They actually fight in court and win most of the time.

A lot of pretty soft what ifs here SCC.. we get it. You loath people who do police work and you hate chases. I can actually understand the chase part, too dangerous, but, it has to be done sometimes. But to clarify, ISP has a great pursuit policy. A carjacking, armed robbery or crime of violence where a weapon was used that is less than 6 hours old can be pursued at all costs without any restrictions. So yeah, in this case ISP has the full green light to follow, parallel and do a pursuit. Great police work by all.

Word is that Hawkins robbery task force kids were very sour about this and tried talking ISP out of taking the arrest even though they had zero to do with this and showed up 20 minutes after the fact. They walked around saying, “we can take the arrest if you want because we are familiar with all the detectives and cases and we are on the task force.” State police politely declined… the poor kids had to turn tail and leave with their little robbery egos dented.

It's extremely hard to prove a vehicle was fleeing because of a helicopter. Helicopters don't "chase." They just observe and follow from the air and direct ground units to the vehicle. I wouldn't put anything past an Illinois judge or jury, but helicopter "chases" are a relatively safe option. Even without a helicopter or car chasing them, these stolen cars almost always end up crashing. It can't always be the fault of the police, no matter how much they want to pin everything on the police. ISP'S chase policy is much less strict than CPD's, so they could've been chasing or following with the help of the chopper. I completely understand the point you're making, and agree that almost no proactive move by police is safe from scrutiny and potential lawsuits and criminal prosecution, but the helicopter tracking stolen vehicles is still safe for now.

The Fly Boys are always trying to play police. Loved it when you’d hear them call in what they “believed to be possible narcotics sales at 123 Sesame Street… can you send a district unit”?

Or when they called in the “suspicious vehicle repeatedly driving up and down the sidewalk”. What they couldn’t deduce with all their years OTJ was that the pickup driving on the sidewalk - AFTER A HEAVY SNOW THE NIGHT BEFORE - was plowing in front of a Senior Living Facility. Had district units responding lights and sirens because they didn’t have a lick of common sense.

They’re gonna wind up being complicit in getting coppers jammed up or hurt with their overzealousness with wanting to play police. And that’ll be sometime when they’re NOT down “for weather” or “maintenance” 😉

Stick to buzzing block parties or hovering over the lakefront in the summer as a visual deterrent, Fly Boys. Your success rate as a support unit blows.

I doubt they are prohibited. They are allowed to do the PIT maneuver. So I doubt parallel pursuing or whatever you call it, is prohibited. ISP has always done a stellar job on the cases I was involved in.

A state-based lawsuit against the State or its agents can not be filed in COOK County Circuit Court, unless a specific statute or the State consents. Otherwise, it has to go to a Court of Claims downstate. So its much harder to sue the State or its agents for negligence. They also have real pursuit training.

They fight the bullshit lawsuits instead of automatically paying like Chicago does. Costs more at the time, but prevents frivolous lawsuits every 5 minutes like we have in Chicago, so saves a lot in the long run.

Sure sometimes they call out a fast moving car on day shift right at the end of the shift. But those guys do work. They regularly get eyes on hijacking and robbery cars.

Tort Law is how these people receives these crazy settlements from the city. The Tort law in Illinois changed in 1986. "Alvis v. Ribar" making it very easy to win cases against cities even when you were in the wrong.

The FOP needs to launch an effort to change this. We need to be like Texas: Under Section 101.023 of the Texas Civil Practice and Remedies Code, damages for personal injury or death are capped at: $250,000 per person, and. $500,000 per occurrence. Stop the bleeding of Chicago money to scumbags. This would also allow the CPD to do their job without the fear of financial ruin.

Long past the time to shift the liability to the CRIMINAL(S) where it belongs. If you're getting arrested and decide to try and escape - that should be an additional 5 years - MANDATORY.

Someone gets injured? Mandatory 10 years.

Someone gets killed or maimed? Mandatory 20 years.

Used a firearm during this bullshit? Tack on another 15 years.

Caused property damage? Fuck you - you're responsible for it. Name the shit head's insurance carrier. If shithead didn't have insurance - add 20 more years.

Stop blaming cops for doing their jobs - blame the fucking criminals.

One of the PH operators is too aggressive, giving out orders to cars the zone like it's his skin in the game. That being said, a strong aerial component without bozos might help catch criminals, and ultimately, even if you hate Chicago, lead to a healthier Chicago. Which means a healthier pension. Or bitch about it and hope yours doesn't run out before you're dead, and fuck the next guy. Or even worse you fuckers hoping it runs dry for some reason.

100%. They get these kids all wound up calling out the location of wanted vehicles and these kids take the bait and wind up getting involved in chases that wind up in crashes. And how many times have you heard them follow a car and they lose it or have the wrong car from the get go? Answer: at least 50% of the time. Overall they are a useless unit. I agree, stick to block parties.

Usually ISP wants Chicago to take the arrest. Usually it is the opposite - CPD shuns it but, really, it is a Chicago crime and CPD should handle it. Problems occur on midnights because a lot of the midnight Sgts. in the D don't want anything the do with it - but they have to because ISP is just not equipped to hold the offenders until days. ISP is then stuck in the lurch without the help of the D Unit. CPD charges these cases, not ISP. Surprised ISP took it.

You should go to ISP Chicago HQ in Des Plaines, you'll soon find "the boneyard" with all the destroyed cars from "chicago" chases. It's all fun and games until someone gets hurt. Oh wait, we have! Dude in a chase hit a freaking building in his caprice last year or year before. Only a matter of time before "chicago save cool kids" are ended due to liability.

ISP chases for forcible felonies and anything that is a clear/present danger of folks at the time with articulable facts available. The amount of "bad" chases we have is astounding. Mostly from folks that worked elsewhere with zero pursuit policies unfortunately. Doesn't help our CMD says "we got your back" (keltner, chicago detail) .....until they don't! (insert all the folks that had bad pursuits and command did not have their back) ...... lololol

YES! ... that's WHY we finally can pursue. I think we had like 3-4 people DIE as we just followed along radioing location for folks with stop sticks to actually do it. I want to say it took someone like Tim Sweeney (the captain of isp bloomington area) to PIT the rockford killer and detain them without loss of life. I want to say the same guy PIT some other killer on 55 or 39. Regardless of what I remember, only reason ISP can PIT is BECAUSE of lawsuits when we didn't help the situation resulting in someone else dying. I'm happy to learn how to do it and other stuff, but I don't want to unless I absolutely need it.
