Lawsuit Tossed

Looks like the Courts (some courts) are recognizing the hamstringing of the CPD is pretty much complete:

  • A federal judge has dismissed Dakotah Earley’s lawsuit that tried to hold the city and a handful of Chicago police officers responsible for not pursuing a carload of armed robbers who later shot and nearly killed Earley during a holdup in Lincoln Park.

    The lawsuit, U.S. District Judge LaShonda Hunt recently summarized in her order dismissing the case, sought to hold the city responsible for “a policy that chills and hampers police officers from pursuing fleeing suspects.”

Remember - current policy is that an Officer cannot be punished for refusing to chase. It's not what most of us signed up for, but an out-of-control system of ambulance chasers, crooked pols and complicit judges has made the tort system too costly for cops to do anything but observe crime.

Notice however, that didn't stop the lawsuit from being filed:

  • Shortly before [plaintiff] Earley was robbed and shot, CPD officers found the BMW on Museum Campus Drive and tried to pull it over. But the driver sped away, and the cops let it go.

    “It took off. We tried to put a stop on it,” an officer radioed. “We’re not following. We’re not chasing. Show us heading into [the station] to do an eluding” report.

    Almost exactly an hour later, that BMW rolled up to the corner of Webster and Wayne in Lincoln Park. A gunman got out of it and ambushed Earley. Police believed the crew responsible for robbing the BMW’s owner and Earley may have robbed 20 people on the North Side in three days. Most of those occurred after police ended their pursuit of the BMW downtown.

While we can all feel bad for the plaintiff (who lost his leg in the ensuing robbery), this is the culmination of years of (what we believe to be) poorly thought out law:

  • Warren v. District of Columbia
  • DeShaney v. Winnebago County
  • Castle Rock v. Gonzales

These cases (and others) hold that police have no specific or affirmative duty to protect an individual from a situation that the police did not create. In this case, the police did not create the robbery or aggravated battery that resulted in plaintiff's loss of a leg. But we do see how police could be - rightly or wrongly - deemed partly responsible for not breaking the chain of events that led to the physical harm. 

Personally, we'd argue that the politicians hamstrung the police department's ability to break the chain of events by making it financially dangerous for the cops to do anything, but when was the last time you ever saw a politician held responsible for making bad law? 

The best way to level the playing field is stop imposing restrictions on citizens from carrying guns. A few dozen wounded and dead robbers would do far more than the Department ever could.

It shows that legally armed CCL holders thwart more active shooters than the police, and also accidentally shoot innocent bystanders at a lower rate than the police!

We need CCL holders out in public, with their guns, to make America safe again.

The city is getting what they deserve. Its a shame this guy lost his leg but if he was armed he might have ended up in a better position. As for the police not chasing.....after all these years its finally sinking in. Unfortunately all you officers are here to do is document the fall of western civilization. Taking any further action results in possible irreparable financial harm.

Tragic for the plaintiff, hopefully he is not struggling with medical bills. City of Chicago does not care about the safety of the citizens.

Where does Camryn Greens family go to get her multi-million dollar settlement? Ostensibly, the no chase policy led to her death by a crazed motorcyclist going 75 through an intersection and video footage of him going 150mph on expressways. How many cops did he pass? Police policies are leading to deaths....

Now there is something in the news about search warrants. I remember seeing a Marine Corps story about some absolutely ridiculous military policy that a Marine commander officer was being asked about and his response was something like "we will smartly and promptly implement the policy." Correct. That's his job whether he likes it or not. Same with us. We are stuck following the ridiculous policies of this city whether we like it or not. That's why this site is anonymous - we can't criticize our bosses (Snelling, BJ) like a regular citizen can with 1st amendment protections unless our criticisms are in regards to safety issues. So said the Supreme Court. So we can bitch about policy, and we make it an art form - and go for us, but we also have to follow that BS policy and shut up about it publicly.

We need a Chicago Kyle Rittenhouse or Daniel Penny. But there's a reason that CCL self-defense shootings have been decreasing in this city the last 4 years. Because as soon as that incident happens our Superintendent and local media will publicly condemn the citizen who took out the offender and our state's attorney will promptly overcharge that same citizen for 1st degree murder and add several additional charges. {Honk Honk}

So let me understand: CPD gets sued either way? That is, pursue and get sued, don't pursue and get sued. Is that how this works?

Why don’t they just pass a law that the only one you can sue is the driver of the other vehicle? The police or anyone can’t control anyone fleeing or eluding liability should end right where it starts with the offender. Oh wait they don’t have any money we have to get money from someone it’s the law.
