You have no Rights as a police officer?

  • A federal judge has dismissed a lawsuit in which the union representing front-line Chicago police officers accused the city’s police oversight agency, COPA, of flawed investigations that violate due process and equal treatment rights.

    U.S. District Judge Jorge Alonso found that the officers have no constitutional right to a fair and impartial investigation. Furthermore, Alonso found that none of the officers have suffered employment consequences because they either successfully defeated COPA’s recommended suspensions through arbitration or their arbitration decisions are still pending.

We understand the second part of that paragraph - if you've suffered no harm, you don't really have a case to bring before the courts.

However, "no constitutional right to a fair and impartial investigation"?

Look, we get it that when on-duty, in uniform, as the lowest functionary of government, you have very limited Rights, like no Freedom of Speech and your peace cannot be violated. That's understood.

But no right to a fair and impartial investigation? What kind of message is that sending to everyone, police and citizens alike? In this age of weaponized law-fare, the process becomes the punishment (OT denials, restricted promotions, etc), and the process sucks ass.

No Freedom of Speech? I highly doubt that bc I’ve many, way too many, “bosses” take a knee for St Floyd or other expressions while On Duty. Seems like that was their freedom of speech to buckle like bit&@es.

Unfortunately this is karma for JCant allowing the city and department to circumvent the canine test and promote people who should not be bomb dog handlers. FOP made a deal with the devil getting who knows what in return. They threw out mine and over a dozen other grievances “because we can”. When you allow the process to be compromised, and participate in the corruption dont be surprised when it comes back to bite you in the ass, JCant. The city owns you clowns regardless of the tough guy persona act you put on. You’re a phony and they knew it, called you on it and continue to punk your ass out regularly. Don’t like seeing good coppers suffer but it makes me smile to see this pretend union defeated. Fuck you John, your getting just a small taste of what you deserve.

No right to a fair and impartial investigation can mean that two officers can commit the same offense, but after considering complimentary and disciplinary histories the punishment can be different. One officer can be a repeat offender and the other officer can commit an act of omission without intent.

I remember when Alonso first made judge and was assigned to traffic court. Hr always ruled for the defendant. Kind of surprising since he's anti police since he is Cuban and from Florida.

I don’t get the second part as officers in callback are “suffering employment consequences”. They are missing out on overtime, experience and promotions. There is also the mental anguish of being on the island and having to fight those commies. It’s an exhausting uphill battle that most do not walk away from unscathed.

Would like to see other decisions this judge has made as I cam bet what side of the aisle he’s on.

While I understand the reaction to the comment about no constitutional rights, I think this is the other side of the Implied Immunity coin. If LEOs can't be held accountable for harm to an individual person when performing their job, then you would expect a cost for that immunity.

It can also mean that copa can go back a few weeks and look at every traffic stop you made and use that against you.

I guess you haven't paid attention to the last 10- 15 years of LEOs being fired, sued and incarcerated. I.E. Chauvin, VanDyke, The Memphis P.O.s etc... Illinois and Chicago do not have qualified immunity for police. States and municipalities that do have some level of qualified immunity can still punish officers for wrong doing. Thinking it's OK to not guarantee rights of police from biased investigation will only create more "US Vs. Them" between Police and the public.

Officers CAN be held accountable for harm to a person while doing their job if it’s shown they knowingly did something improper with malicious intent. The term is also qualified immunity. So many civilians think qualified immunity means we can do whatever we want and there’s no civil repercussion's, that’s not at all what it means. There’s been plenty of coppers who have been hit with punitive damages in court. What qualified immunity grants is that as long as you’re doing your job, in good faith, you can’t lose your house and all your money. I’m chasing a murder offender, I tackle him and he smacks his head on the ground and gets a brain injury, I was acting in good faith within the bounds of my job, he can sue all he wants, but he’s not getting my personal money or assets. That’s what the immunity is. If I tackle him then stomp his head a few times, not only am I going to prison, I’d also open myself up to be paying punitive damages. So, this isn’t the “cost” for the immunity. So because police have qualified immunity, therefore that means we can have malicious investigations opened up into us and get us fired for whatever reason? And then you immediately chime in about how awesome that is and that’s what you get for having qualified immunity. And you wonder why police in this city do nothing and we are several thousand of positions short. It’s very much so because of people like you who think that it’s great if cops have malicious and biased investigations done against them. With that being said, whatever, I haven’t made a traffic stop or arrest in years at this point, and I plan on keeping it that way. So next time you see someone blowing a red light or doing something stupid in front of a cop, and the cop does nothing, just remember, it’s your fault. As long as those checks keep clearing twice a month, it’s all copacetic big dog.

But in your example, all of the evidence regarding those two officers was taken into account, which by definition would be "fair". Wouldn't the judge's statement mean just the opposite? That if we don't happen to like you or your methods, or your race / ethnicity doesn't fit our ideological template, then we'll just ignore certain facts or evidence or conversely, apply certain facts and evidence, in order to achieve a specific end? And that's okay because officers aren't entitled to "fair and impartial" investigations?
