In light of the recent "firework death" on the Eisenhower, a forward-thinking readers raises the following:
- Okay, If thats what had happened then are the firework shells considered deadly. So when there is a street take over with vehicles driving all crazy doing donuts inside a gasoline ring of fire and lighting firework shells and throwing them at the police its considered what ??? Where do artillery shells appear on the "use of force" chart ?
Any Use of Force Sexperts want to take a break from banging recruits and chime in on this one?

The order, when written, will say that even though fireworks can be deadly force, you must run, jump or otherwise move out of the way of any fired projectiles, just like they require us to move out of the way of moving vehicles.
Couple years back a mortar blew a fathers head off in the 25th district. Mortars can cause great bodily harm or death. Lethal force would be justified. Same thing if someone tossed a molotov cocktail on you.
Does the subject have the means to cause death or gbh?
Does the subject have the opportunity to cause death or gbh?
Are the subjects actions immediately likely to cause death or gbh?
If the answer to all three is yes. You are justified in using lethal force.
Avoid going into the middle of a street takeover. If you get surrounded and lethal force is your last resort and those three elements are met, you will be justified. You will also be made the villain on the news and by attorneys representing the family.
I've always considered those giant fireworks thrown at me to be deadly force...
And no, I'm not talking about some friend tossing a little firecracker toward me - but the full on bullshit tossed by the rioters, antifa-types, ghettorats....

Way back in the recession the
expensive rental house next to me started losing renters so they lowered the standards a few times and ended up with a smoking crater instead of a house. You know, the kind that goes way way up and shakes the whole hood when it goes off. Well lucky for them it went thru the 9 foot ceiling before it blew the walls outta the house. Miss genius only had a bra on and instead of going out the open window next to her she ran thru the burning house naked and barefoot. Sad sight. Mr huge passed out tattooed crackhead only had daisy dukes on and had a colorful glowing chunk of burning phosphorus burning in his stomach . Myself and a neighbor had to drag this dope over a ton of crap out of the open attached garage door as the place was fully involved in minutes. Both were life flighted out and never saw them again. Bomb squad came out and kicked us all out of the block overnight as they found more of the same in the garage right where we were pulling this loser out of the garage. Don't try this at home kids,there's a reason only trained professionals get to play with the big stuff. The land lord rebuilt and sold and will never rent again. Illinois just has too many assholes here. The end.

CPD should consider all Fireworks as Fragmentation Hand Grenades, and respond appropriately. There are two absolute similarities: (1) Explosive Charge. It does not matter that Fireworks are Black Powder and Hand Grenades are filled with something else. (2) Fragmentation. Any Firework can be “ enhanced” with a few finishing nails wrapped/ taped around it. This will definitely blind, maim/ cripple, and possible kill.
In a couple of Third World places I have been, the Local Police will shoot anyone throwing Fireworks. No Warning. And a very routine, 1-2 page inquiry afterwards.

In the mid 1990's some MORON was shooting skyrockets at airplanes landing at Midway Airport somewhere in the vicinity of 65th and Central Ave. What occurred was one of the skyrockets exploded near the co-pilots window temporary blinding the co-pilot. Lucky for the passengers and crew the pilot landed the plane safely. The zone operator instructed me to call the control tower in which I did and was informed of the incident. I ordered several beat cars to drive around the area in an effort to find this MOROON. Bedford Park was also notified of the incident. Later I got a call from the Chicago Field Office of the FBI who stated that if we find the individual(s) to ask the States Attorney's Office for Attempt Murder charges. Now, I realized that times and laws have changed since this incident occurred but even back then firing any type of explosive devise towards an individual(s) would be met with Attempt Murder charges.

Turned out it wasn't a dud, just a slow burning fuse. Blew part of his face off and one eye as well. He was actually pronounced DOA at the hospital. He eventually recovered and spends his time wandering around the neighborhood talking to the squirrels and birds.
