Bad News for Some Cops
- Chicago and two police officers -- the first to be called and the last to arrive at the home of murdered domestic violence victim Ronyale White -- can be held liable for her death, the Illinois Supreme Court ruled Thursday.
That's right - the COPS are going to be held liable. That means THEIR assets can be attached to satisfy a portion of any court judgment against them. Granted, it's still possible that they may win the case in court and not be on the hook for anything (their side of the story is that they were held up at the station for a vehicle inspection and after they heard the offender fled, they commenced a search for him before arriving on the scene).
The key words in this decision are "wanton or willful misconduct" can be proven. At the moment, we don't see "wanton or willful" in commencing a search outside the bounds of the original incident - we can relate a ton of stories about coppers flying to a scene and completely missing a suspect walking calmly away. An efficient search on the way TO an incident has caught many batterers, rapists and murderers. Hopefully, the coppers' story holds up to the point that they won't be losing houses.
Four words to live by if you intend on doing police work in Chicago - "Tenancy in the Entirety." At least it'll save your biggest asset.

maybe coppers have to incorporate themselves some kind of way in order to advoid some of these potential civil suits liabilities
This will be appealed to the U.S. Supreme Court, and be overturned.
Remember, Always give the location you are coming from if you are not close. Use that computer, hit the enroute, than the on scene. This will show how long it took. Also just so you know, they are installing GPS in all the cars. Now they will know where you really are. No more leaving the city for lunch. No more fake traffic stops. The data can be pulled. Just do your job!

Yeah SCC tell us about the screw up on the drug bust that had the police going to the wrong house and distroying it because nobody bothered to READ the search warrant? 5919 sure looks like 5921 right?

The city already gave these 2 guys their jobs back after firing them, so needless to say they would be happy to pass on the liability. That's fine, I'd also love to see every supervisor held accountable for feeding into this system of laziness....but these two guys were black-and if a white supervisor calls a dog a dog, he's racist. Lose-lose all around. Nice fucked up system created by democrats, pandering to blacks, causing blacks to die, blame whitey. Oh the irony.

Previous U.S. Supreme Court decisions have held the police cannot be responsible for your safety. Now the Illinois Supreme Court has differed.
This won't hold water. If allowed to stand, the floodgates will open wide and we may as well have the city file for bankruptcy now.
The Super Tough Guys...aka Swat assisted on a search warrant and yes the houses had addresses on them. They threw flash bangs into the houses via the (closed) windows and tore the house up for 45 minutes looking for guns. Was it at least a gangster's house. Nope! Only a couple of old folks. HaHaHa! They then high-tailed it out of 007 and refused to return, leaving the lowly patrol division supervisors to answer the family's complaints. By the way even though this is all true, I'm probably just bad mouthing these super heroes because I'm sooooooooo jealous of what awesome skills they possess.
