Lawsuit Revelations
- Christina Eilman was at Midway Airport dancing in circles, ranting about the price of oil, and screaming at a woman who asked her not to play with a seeing-eye dog when Chicago police officers came across her for a second day in a row last spring, according to court documents filed today.
Eilman was abducted, sexually assaulted and suffered severe brain trauma in a seven-story fall from a Chicago Housing Authority high-rise shortly after she was released from police custody into an unfamiliar and high-crime neighborhood last May. - Police spokeswoman Monique Bond said today that department officials had not read the new court documents and could not comment.
The police department has protocols that require officers to transport mentally ill people who have not committed serious crimes to nearby hospitals for mental health evaluations, but police never sought any mental health care for Eilman in the more than 27 hours she was in custody.
27 hours in custody? For a misdemeanor? Hell, most misdemeanors that are arrested early beat the officers out of the station and are home hours before they are. This thing just gets uglier and uglier and we know the media doesn't exactly go out of its way to paint the Department in anything like a good light. But we'd like to see a little blame laid at the feet of the family that let this woman fly across the country for a questionable job. No one was watching her then.

Why was this woman, with obvious mental incompetence, according to her OWN FAMILY, allowed to "escape" the guardianship of that same family? Answer: Because she was not important enough until she became a dollar sign to the lawyers that took over. Say goodbye to another 100 million, City of Chicago. You can thank the lawyers. Yeah, the police are SOOOO gonna pay for this one!!! I'd be willing to bet that the "alleged offender" is an underprivileged African American who was simply returning home from work and was approached by this pretty blonde caucasian girl asking directions back to Sacramento, CA, which he gladly gave. However, this upstanding and sympathetic African American didn't want to see her begin her travels on an empty stomach, so he invited her up to his humble abode for a warm meal, which the girl gratefully accepted. Upon completing their well balanced meal, the girl excused herself, but tripped over the man's expensive oriental throw rug and unfortunately landed on his penis. Terribly embarassed by the event, the girl lept to her feet causing further inbalance and a secondary fall from the window. The well meaning African American then went down to the injured girl and performed CPR, which he learned in college. While performing the CPR, police arrived and proceeded to brutally beat him simply because he was a minority.

Wait a minute! Every person who acts like a jackass now needs to go to a hospital. Every person who refuses to be finger printed goes to a hospital. Give me a break. The family let this girl come to Chicago to be a stripper and now its the police' fault that something happens to her? By the way, who the heck would hire her. Bad stuff happens all the time it doesn't mean it should cost the taxpayers. Maybe all of the supervisors involved were meritorious.

KUDOS, truth hurts sometimes, I feel for those involved, but it never should have gotten there. Calls from the family about psych history, her behavior etc....take to the hospital and sign the paperwork to have her evaluated for 72 hours...Just watch though, lock-up keeper will be saying I told the Desk Sgt, Desk SGt will say I told the W/C....There is going to be a lot of passing the buck on this one...

How can anyone possibly say that the parents are responsible "for letting" this young woman come to Chicago. The story all along has been that when she was on her meds that she was perfectly competent and had been doing well in school etc. How many of us have let friends or relatives with mental problems travel alone or with others? Also, this nonsense about her coming here to become a stripper or whatever is just nonsense and even if true is irrelevant. Once the police take someone into custody, we a duty bound not to leave them in a worse condition than when we found them. There were multiple indicators that this girl should have been evaluated medically and no one took responsibility (i.e., no boss) for seeing that it got done. Part of the problem is transporting female offenders from one district to another for processing. Having been in the deuce for awhile, I know very well that many in the deuce see it as an inconvenience to have to deal with another district's offenders and they simply warehouse them with little review. Much of the time LU keepers don't do a proper admitting evaluation - I've seen people beaten and with broken ribs admitted to lockup and when the LU keepers complete the booking process the back of the arrest report would say - no injuries, etc. and no request by the LU would be made to send the prisoner to the hospital - absolutely ridiculous and a lot of times neither the sgt or the W/C would do a real walk-through of the lockup like they're supposed to.
We need to stop blaming the victim or her parents and imputting blame to them for our own lack of sensitivity and good judgment. This incident should never have happened and there is no one to blame but ourselves.

I love this department. If you get arrested, Bo Bo the lock keeper processes you, if your white you will get out in 25-30 hours. If your black 6 hours, but only to return in 5hrs. God Bless Edgar Mullin in his 12yr sentence for have intercourse with a prisoner.

I would have to agree with the last poster (11 Mar, 3:30AM). While I refuse to allow the family to be let off the hook for allowing an unbalanced (but grown) child leave California with some asshole who apparently abandoned her here, she should not have been allowed to walk the streets. Once her parents called and informed someone on the desk of her apparent mental instability, she should have been transported to a hospital, and signed in (and we all know we have the power to sign in people, RIGHT?). We then would have done all we were legally able to do to assist this family until her parents could have arranged for someone to get here and take power of atty. over this woman.
Like I said before, the parents are by no means off the hook with this, for allowing this messed up child of theirs to leave the state of California with what appears to be nothing more than a common pimp, but there is blame to go around on our end also. Sad.

The attorneys handling this case for the stupid white girl have been conducting their closing arguments in the press for months now. It is a clever attempt at jury tampering well before the jury selection. Now they hope to spure some frivolous debate on this website in order to place any dumb and slanderous remarks in the rags sheets and attribute those remarks to "officers in the know".

I do have a suggestion. Each W/C should have a copy of the DSM-IV. He can then interview each prisoner and deterime criminal charges or mental help.

not one to stick up for the city, but this one is not so clear cut. the G.O. on arrests clearly mandates that an arrestee is to be "let to bail/bond" ASAP. this usually translates to as soon as the prints clear. P.O.'s can only sign an individual into a mental health facility when that person exhibits bahavior that is dangerous/ violent. if the woman was not violent or dangerous the w/c had no clear obligation to obtain medical help for her. simply releasing an arrestee into a neighborhood that has a high crime rate does not constitute negligence or a violation of any G.O.

The only time someone needs to be taken to a mental facility is if they are a danger to themselves or to others. This girl was a little off, but not dangerous to herself or others. For Gods sake take a ride through the south side & you'll see plenty of people walking the streets talking to themselves. We just drive right past them, they don't get admitted. We let them go and play in their imaginary world.
The girl was from Cali, a stripper and possibly bi-polar. Who on this department was trained in mental illness diagnosis? Not me.

Don't know what transpired in the vacant apt., and it's tragic how the whole mess wound up, but I wouldn't go as far as to call her a rape victim.
