Prosecuted Politically

Charges dismissed after a judge finds zero probable cause:
  • A Chicago Police officer will not stand trial for felony drunk driving in a crash that killed two men, because a judge today found “no indication” the cop was drunk.

    Prosecutors had argued that the case against [J.A.] should proceed — even though the car the officer hit had blown a stop sign, and a bartender testified that the officer was not drunk.

    But Judge Don Panarese said he saw “no [indication] of impairment on the part of Mr. [A]” and found no probable cause for the case to proceed.

So this would appear to bolster the contention that this was a political prosecution in the heat of a hotly contested primary race. This would also seem to negate the State's Attorney's office attempting to use Administratively ordered evidence from being used against officers in violation of their Fifth Amendment rights and established Garrity Law.

And as the investigation determined (and the judge agreed) the other car was at fault (Unit #1), the evidence of someone making political hay out of this accident is indeed very likely.

Crook county is a joke. I was at Traffic ct the other day. It seams the guy I charged with a DUI had political juice. He makes some phone calls and gets the case nolle. Must be nice.

I will not get into the morality of the whole situation, but I for one am still in shock that a judge in county of crook demonstrated common sense, is learned and actually did not take the "he should know better" approach. Sorry 'bout the run on sentence. Stay safe y'all yee all!

If the SAO really wanted to prosecute this case (which they didn't...it was the prime example of a "political upgrade"), they would've sent it to the grand jury and gotten an indictment. Instead, they knew the case was horse shit and they passed the buck to the judge who got rid of a shitty case for them. Interesting tidbit...anybody hear that the Lt. who pushed for the felony upgrade was impeached at the prelim. by the F.R. trial sup. who intially rejected the case??? Just a rumor I heard...

I will not blow EVER... not criminally not administratively... Obviously, they DO use the forced BAC test in a court of criminal law... was the FOP at the hearing??? Why was this testimony allowed in? If certain pieces didnt fit right in this test would have fucked John. How was the state allowed to use evidence collected under duress into a criminal proceeding? Where was the city wide team on this one? I am confused and angry... this should be a warning flag to all... BLOWING EVEN AFTER GIVING THE DISCLAIMER AND DOING SO ADMINISTRATIVELY WILL BE USED AGAINST YOU IN A COURT OF LAW!!! The FOP was in court filing suit against the new practice of the States Attorney using administrative breath test in criminal proceedings. The FOP won the first round but the CCSA has appealed the decision and is going forward with that practice anyway.

The practice has to be challenged in court, and it is, and the FOP has to prevail. What do you think, the FOP can just say "don't do that" and it will stop?

Donahue sent letters to the CPD and States attorney's office, no good, this will have to be settled in court which is exactly where it is.

JA caught a break. Best bet for coppers, DON'T DRIVE AFTER YOU HAVE BEEN DRINKING. That way you don't have to worry about getting out of it, don't get into a jam in the first place. Drink in your basement or garage or back yard, not public joints with video cameras recording your alcohol

The Lt. did not push for the charges. It came from ADS McNulty who refused to let his name to be put on the arrest report. The Lt. was then "forced" to have his name put on it.

Whenever I have a case with a poor child of color as the victim, never an approval. It appears that the S/A attempted to use the breath test that was administratively gotten by the police department. Any evidence gathered as a result of Administrative proceedings against an officer is strictly prohibited by case law! Any lawyer (S/A) should know this basic fact! That is probably the reason the judge threw out the case. The problem for the officer and the city is that this type of evidence can be used administratively against the officer as swell as in any civil proceeding!

its sad how during the primary for state's attorney, all the candidates said they were prosecutors and not politicians. almost every case against a cop is politically motivated. abatte=felony agg battery for simple battery. herman=agg CSA for theft of service. the other bar fight=agg batt for simple battery. and theres countless more. everyone wants us held to a higher standard, then fine, make it work both ways. whenever a cop is a victim of a battery or an assault the offender should be charged with a felony per ILCS.

Simple lesson,don't ever bolw administratively if you are in danger of criminal charges. They have now set precedent whereby they will use administrative blows criminally. They can threaten you with job loss,take it. You will win in court.

It is better to temporarily lose your job than to be criminally charged and convicted on some administrative charges.

I work in the court system, and despite how I feel about drinking and driving, after seeing case after case of assholes getting out of their third or fourth DUI, I'm glad that this officer's case was thrown out. And for the victim's sister, she's just sorry she's not going to win the Chicago lottery. She was in court. She had to know that the stupid driving was the fault of her brother, not the off-duty officer.

What about the cost of a proper defense for the accused officer? They out him through a horrible time for political reasons. Another judge might have rules differently and he would be facing a very expensive trial.

The state can attempt to introduce anything they deem may help their case, the defense then has the right to object and the judge will then rule on admissability, which is exactly what happened here. Learn criminal procedure before you go shooting your mouth off.

None of you know the actual true story of the events. You have all been lil girls playing telephone and screwed up the truth. If you want to know what happened go read every report and transcript from court. Better yet find people who were there and can tell you the story. Quit complaining and placing blame. The only thing you got right is that this was 100% polictical, and the ASA were out to screw a PO.

The Officer refused the breathalyzer when offerred per Ch. 625. He would have to deal with that portion in court. The Administrative order to blow was given and he must comply under orders or face losing his job for refusing a direct order. This makes it a violation of his 5th Amendment right against self incrimination. You cannot be ordered to waive your Constitutionally protected rights. Using it violates his Constitutional rights and I assume a Motion to supress the evidence ( Administrative blow) because it was tainted evidence. Law states that the administrative blow is inadmissable for a criminal prosecution. If he would have blown for the criminal (501), this blow would be admissable for the administrative portion but not the other way around.

For Christ's sake. This poor SOB wasn't even at fault in this accident. The driver of the other car blew the stop sign and by preponderence of evidence (over 51%) he was the "at fault driver".


I'm happy that the Judge saw through this political boondoggle and found no probable cause.

You sir are exactly right about the thirty pending, however maybe just maybe you might be having chest pains and need to be rushed to the hospital for a checkup. Remember in those cases time is your friend. You see there are ways around the system just like the criminals do.

Thats an old one but when you arrive at the hospital, you can be ordered to submit to blood tests, so you are back where you started.

someone mention this guy making meritoris sgt in order to clean up the mess they caused love it remember all the nurses that did nada down at the med section, when they were dumped out to districts they sued the city and somehow they all became dicks sgts or Lts when i inquired once if they dropped their suits to gain these positions i was called everything but a anglo saxon just so you know
