Drew Charged?

  • ...it was the size of a short-barreled rifle police seized from Drew Peterson in November that prompted authorities Wednesday to file a felony weapons charge against him.
Maybe we are misremembering the time line. Can someone correct it if we're wrong?
  • Stacy disappears, Drew is named a suspect
  • Authorities seize Drew's guns during the course of a number of search warrants, including the "short barrel rifle"
  • Drew retires under a cloud of suspicion
  • Drew asks for his guns back, is refused, appeals, loses his FOID card, has his guns turned over to his son for safekeeping
The sticking point in our minds is the time frame of the seizure (if we remember it correctly). If the allegedly short barreled gun is his SWAT weapon, and that's the gun he trained with and qualified with, what's the problem? It wasn't sawed off - it was a barrel manufactured for the gun. Bolingbrook qualified him with the weapon for years, so they didn't have a problem with it. SWAT persons are allowed to modify guns for their missions, including much shorter rifles for clearing buildings and such. If the gun was legal when he was a cop, and he hadn't quite retired when they seized it (including contractually allowed time off), then the state is liable to give Drew a bunch of money for malicious prosecution.

For the tiny brains, we'll repeat, we think Drew is guilty of a number of things. But this is getting stupid, and you and we as taxpayers, are on the hook for State Police missteps in this case.

where were they when they seized the weapon. No one had a ruler then? He was still a active cop, he retired after the search warrants. ATF would have handled it federally if it was a legit charge.

All the suburbs allow you to buy your duty weapons from the burb. When i left a neighboring suburb of Bolingbrook I was able to keep my city issued Moseberg,which I purchased via a ten dollar pay roll deduction twice a month from the village.

Even the state police who are almost as anal as the CPD allowed the troops to keep there state issued nine mls when they switched to the 40 cal.

Either secure an arrest warrant charging Peterson with murder(s) or leave him alone. The latest "too short barrel" beef is nitpicking chickenshit that only shows your frustration and desperation.

P.S.: Stacy was recently seen at the Cannes Film Festival. Check the beach at Antibes or St. Tropez. She's invariably sipping absinthe topless with just a blue thong.

Minimum barrel length(rifles) is 16" per Federal and State law.

Departments can have SBRs short barreled rifles,civilians(except FFLs)cannot in Illinois.

If it was a Department issued gun, Drew would have had to have turned it in.

Officers cannot take an AR15 and put a barrel on it less than 16",only Departments can.

Department SBRs,SBSGs,MGs SMGs must be registered with BATFE,they are tax exempt from the $200.

Officers cannot build their own SBR AR15,Shotguns,machine guns or submachine guns.

So,did Drew build his own SBR AR and Bolingbrook allowed him to carry it illegally?Or did he build it on his own for personal non-duty use??

Is the barrel less than 16" in length? Under Federal law, part of the 16" can include a PERMANENTLY attached flash hider or muzzlebrake.

If so, it's illegal for him to possess NOW without registering his ownership of a short barreled rifle (SBR) with the BATFE.

If there's a "FORMER Law Enforcement Officer" exemption to the provisions of the National Firearms Act of 1934 (NFA34), I'm sure a lot of people would like to see you cite it. So far, I haven't seen anybody produce any evidence that Peterson either planned to register that firearm as an SBR OR that he planned to transfer it to someone lawfully entitled to possess it.

If you want to repeal the NFA34, you'll get a lot of support. If you want to just give somebody a pass on its provisions just because they USED to be a cop, not so much.

It's measured from the breechface to the end of any PERMANENTLY-AFFIXED (meaning welded, brazed, or blind-pinned) muzzle devices.

IL does not allow private citizens, even cops, to own SBR's, period. Cops can POSSESS them in the course of official duties, but ownership remains with the department.

There is no "retired police" exemption to NFA '34. Believe me, I've looked.

The proper way to determine barrel length on a Rifle,Shotgun,Semi-auto pistol is to place a rod of somekind down the bore/barrel.

When the rod hits the breachface,mark the rod at the muzzle(end)of the barrel.

(revolvers:rod goes to end of forcing cone,not through cylinder to recoil shield)

Measure the distance between the two point,you now have the barrel length.

Flash hiders/suppressors do not count unless they are permantly affixed(welded,brazed,blind pinned).

Bollingbrook's Chief said that it wasn't a dept. issued rifle, that Drew purchased it privately. The pic that I've seen of the rifle (if it is the actual rifle in question) has a far shorter (at least 2-3 inches) barrel than the mandated 16" barrel.

I'm ISP (father was CPD) and I agree. But, I'm sure it'll come to no surprise to CPD officers here that ISP is now more political/department/clout heavy and who you know/blow than ever before. Been like this since the Gainer Error.

Couple the Peterson fiasco with the Riley Fox debacle and it's easy to see that the ISP is beginning to reap what it sows when it comes to promoting or transfering those who have no business doing what their new job entails.

Sounds like they are grasping at straws. In this case, for the sake of P.O.s everywhere and the 2nd Amendment I hope he wins his case. I am sure they are checking his .223 ballistic sample, and every gun he owns against every other homicide, drive-by, dead dog case nationwide. It wouldn't surprise me if they were checking to see if he killed the Northside Cougar or was the mysterious gunman on the grassy knoll.

Like I said, for our sake
I hope he wins this case. As far as the rest of it goes, I would like to see:

(A) Ideally, but not likely, Stacey is found alive and well and living with...

(B) Some really excellent police work finds out what actually happened; if foul-play is involved, they build a good case, and convicts the guilty party, whoever that is.

we are indeed a fucked up organization. then it only makes sense that we would fuck this investigation up too. We used to be somebody, with some great investigators that could kick ass with the best of the big city departments be it dope, guns, gangs, homicides, crime scenes, etc. We now specialize in seat belt details for uniform, and the only investigation skills we have mastered is internal affairs, and are our guys are great at that. Law enforcement is a fucking joke in this day and age, and the taxpayers of this city, county, and state are paying the price. Your moral is bad, ours is bad. You say fuck it, we say fuck it. Or is the issue the fact you don't really know what your talking about? Where in the statute does it give any exemption for police officers to have a short barrel?
Let me spell it out for you.
(c) Subsection 24‑1(a)(7) does not apply to or affect any of the following:
(1) Peace officers while in performance of their
official duties.

The guys not on the swat team, and I guess the rifle at his house was performing an official duty.

Statute of limitations? Drew hasn't even been retired 6 months. Statute of limitations is at least 2 years and the point wasn't that the statute of limitations was approaching - it wasn't. Our point was he was charged for possessing the gun while still an active member of the force.

Um, how about the issue addressed in the post? That Bolingbrook qualified him on the weapon while he was an active member of the force, he was still an active member when they took it, then they charge him for having the weapon they authorized him to have?

The photo of the weapon does indeed appear to be less than 16"However the flashhider is reoved and it appears to have something light in color around the thread shoulder.

Could ISP or BBPD removed the silver brazed flashhider from the weapon??
