Liberal Judge

From New York City. We'll break with protocol here and publish the entire article. It's only five paragraphs long:
  • A Brooklyn cop's "guesswork" in making gun busts could shoot down as many as 20 pending weapons cases, The Post has learned.

    Federal prosecutors recently dropped one gun case because of what a judge described as Officer Kaz Daughtry's flawed methodology, and now prosecutors from the Brooklyn District Attorney's Office are reviewing 20 pending cases on which the cop was the arresting officer, law-enforcement sources said.

    Daughtry had busted Anthony McRae in Brownsville last September after he saw him adjusting something on his waistband.

    His search found McRae was carrying a loaded .45-caliber Ruger and heroin - but it was the only gun he came up with in a three-day sweep.

    Brooklyn federal Judge John Gleeson found Daughtry shouldn't have searched McRae because the convicted felon "did not move in a sufficiently suspicious manner."

"did not move in a sufficiently suspicious manner." Just great. Look for judges to begin defining in what manner a subject may move before the Terry rules come into effect. Look for defense attorneys to begin questioning what attracted your attention to their clients. Be prepared to describe exactly what the "west side shuffle" or "shucked and jived" entail should you ever have to testify in court. And not just criminal court - civil court after the Cook County judges let all the future doctors and altar boys off.

Or you could just stop looking for those little indicators that make the hairs on the back of your neck stand up. We read something about it in a newsletter recently.

"shucked and jived". I've used that term all my life and at times, others have cracked up when hearing it from the first time. I get a mental image in my head when I hear that, and I know firsthand how this "furtive move" can mean trouble for the unwary cop.

This isn't news, you should always be able to articulate WHY you were paying attention to a suspect and WHAT that suspect did to warrant your attention.

A Police Officer knows when something isn't right by observing certain behaviors based on their training and experience. A GOOD Police Officer can also effectively communicate WHY.

SCC ... are you purposefully dumb or what? I am no apologist for the judge, and I haven't read the entire decision, but from the information given, the judge did not disallow a Terry Stop ... he disallowed a search. You know the difference, so my only conclusion is that you are being purposely deceitful and rabble-rousing. I will also make a stretch and assume the arresting officer would be allowed a Terry Stop, and, if and only if, he was able to see the illegal handgun, without a search, the arrest would be constitutionally sound. Admittedly, the pat-down criteria were not addressed. Again, based on limited information, I will take a leap and reason that the pat-down, for which different articulable criteria are required in regards to the stop itself, would have been allowed.

So often the copper is quick to criticize the courts' decision, when, admittedly, it does make the coppers job of arresting bad guys, more difficult. However this hardship must be balanced by the fact that we do have constitutional protections. If you need more light shed on this picture your grandmother simply pulling on her waistband and this officer performing a search simply based on that. Does that bring it home for you? I am a cop, too, as most on this forum are ... but I am foremost a citizen ... a citizen very proud of the protections of the constitution against a repressive government.

When the gun ban is stricken by SCOTUS our job, arguably, may becomes much harder and more dangerous. However, our 2nd amendment rights trump my desire to be a safer cop.

Let's get some perspective, SCC ... and stop your rabble-rousing propaganda.

Thank you in advance for deleting this post. You have shown yourself to be a coward in the past with my posts even when they are harshly critical, yet not insulting, when you disagree with them. But, all in all, you do a great job and we do appreciate it, at least I do.

NYPD radio Zone 22 which encompasses two precincts--the 7-3 (Brownsville) and the 7-5 (East New York) is arguably the most violent crime infested area in America. A while back, the two adjoining pcts. in Patrol Borough Brooklyn North had over 200 homicides in one year.

I work down in 001 and over heard Dep Chief Keating talking about some of the postings on this blog "J-FED WHERE'S OUR CARS". He was telling a LT. that there's nothing but a bunch of drunken blue shirts drinking in the downtown area and if he has is way; that they will all get time and he'll close all the bar's. Because the Mayor is unhappy with the headlines of drunken coppers. He seemed very up-set while talking to the LT about someone telling things about him on this blog.

I don't have a problem with this ruling. Besides, we all know that this officer didn't see him "adjust something in his waistband". That's just textbook creative writing. These judges are catching on. This just makes us look even dumber than we already are. If you're gonna put it down on paper, then you better make sure it flies in court. Otherwise, next time you see Mr. McRae, just smile and wave "Hi." This officer would be lucky if there isn't a subsequent wrongful-arrest lawsuit.

I know it's frustrating, but look at it this way: The people voted this judge into office. They have every bit of confidence in his abilities to make important decisions like this one. So, if that's what the people want, that's what they should get. The next time you're driving through the jets and you see Ray-Ray standing on the corner minding his own business and you know damn well that he has a pistol and some dope on him, just tell yourself this, "Joe Citizen does not want me to stop this poor young underprivelidged youth and violate his civil rights. So, unless I see him pull out the pistol and start shooting, I'll just smile and drive on by."

It's gonna sting a little at first, but you become numb after a while. Then you eventually just smile at everyone and drive on by. The beauty of it is, we get paid good money for this shit!

I gave up looking for guns last year. Short story, My partner and I got a CR# for chasing a shitbird who had a gun in his waistband (I saw the gun). I caught shitbird a few blocks away, no gun (Looked everywhere, no gun). Shitbird tries to fight my partner and I take him down. Shitbird hurts his shoulder and goes to hospital. Shitbird gets CR# on us and signs affidavant. OPS makes it not sustained (I don't think this would happend with the new review board). Shitbird is sueing the city (city is giving shitbird money to go away).

The moral of this story

1. SEE NO EVIL
2. HEAR NO EVIL
3. SPEAK NO EVIL

I can't chase what I don't see. The blinders have been on ever since. I haven't gotten a CR# since either.

The courts are doing this more and more...case in point: Tac officers arrest a guy for PCS at Linder & Fullerton. The arrestee tells A/O's that he got the cocaine from a man that lives at 24xx N. Linder. They get a search warrant and find cocaine, marijuana, 7 pistols, 2 AK-47 rifles, hundreds of rounds of ammo, 2 sets of body armor and police scanners. The arrestee, a self-proclaimed "pachuco" gangmember, tells the A/O's "I go to gun shows, buy guns and then sell them."

The case goes to felony court (branch 50) and the judge and SA decide that (motion to fix!) the whole thing should be downgraded to misdemeanor.

025 Court Advocacy and the DAC all attended both hearings and were rightfully outraged that this "straw buyer" felon was getting nothing more than a slap on the wrist! Letters were fired off to the State's Attorneys office and the Mayor - without a response.

People (coppers understand this all too well already) need to understand that the biggest disconnect to reducing crime is within the court system. The lax sentencing and examples like the one I cited above, all do irreparable harm to society.

The criminals are shown first-hand that their actions will have little or no negative repercussions. There is therefore no disincentive to curb their criminal endeavors.

Keep voting NO to each and every judge at each and every election. (except those that are pro-police and/or tough on crime).

Hey 1:47:00 am, I'm sure you are a much better police officer than I am but I'm pretty sure that if I saw a "grandmother" tugging on her undies, I wouldn't think twice about it...other than to think to myself that maybe she should invest in some new underwear.
But when I see a gang banging dog, (that's me profiling, i.e., prison, gun, dope. Most look very similar) tugging on his waistband, I AM going to throw a stop on him, I AM going to search him because I AM going home to my children. This will probably get your undies in a bunch but, I'd also have my gun out while my partner searched him or vice versa.

These "officers" who I question whether or not they really are officers, who are claiming this judge made the right decision must have never worked in a high crime area. Can anyone who has, honestly say you couldn't describe the actions an offender that would be carrying a .45 in his waistband would make when he sees the police approaching. Most of them can't hide their actions when they are holding a bag of weed, nevermind a handgun. They know they are dirty. Based on the actions and movements of this guy and the location he was in, you have enough of a reason to stop and talk with him. If you seen him making other movements that would indicate he might be possibly armed, you have enough to do a Terry pat down. After patting him down, you find the gun. Enough said. Doesn't sound like a problem in my book. And in response to the "officer" who is probably a liberal defense attorney in disguise, ..... Are you nuts. Your theory sounds more like plain view and probable cause than anything related to a Terry Stop. This judges ruling essentially takes away any experience an officer has in being able to judge whether or not a crime is being, has been or is about to be (Terry) committed. Maybe we should have a ruling saying that judges can't use case precedents to make decisions in legal proceedings. Why should their experiences be relevant and not an officers. Goodbye proactive policing, hello reactive policing. Remembering to always articulate exactly what happened and be descriptive in your reports. It might save you later on.

If in fact you are a cop, even a casual observer such as II can see you're certianally not what is called the REAL POLICE. My guess is you're more likely a lawyer-like REMF.

People like you insist on the taking away of every human tool (and the hardware shotguns, etc.) which police use to police thus giving the criminal every advantage and forcing people in low income areas to live in combat zones.

I don't know anything about the Terry law or pat down protocol but I can see how a good cop can observe and sense where a threat to the public is.

It would be one thing if the guy was scratching his ass but it appears by the move the man made and perhaps the form the officer subsequently observed in the guys clothing the officer had a reasonable belief the man had a gun. As a citizen that's enough due dilligence from a sworn officer for me.

Look you can't be on the streets day after day in dangerous areas and not gain a sense where trouble just as I'm sure a judge can't sit on a bench day after day and not gain a sense when he's being told a lie.

For what ever reason this cop guessed right and found a criminal. End of story.

If he'd brought the guy in for packing a joynt and the New York Times you might have an argument.

People like you who insist we give criminals the right to tee-off on us before we have the right to protect ourselves all in the name of protecting our rights are a concealed threat to our safety.

I was away for a few days and just happened to read the post from the lost PO and the replies. I'm retired FD and my son is a young CPD PO. I want to say to each and every PO who responded to that young PO's post how grateful I am that my son works with people like you. I have never seen a more sincere outpouring of support for a fellow human being. I wish I could have you all over for BBQ and beer.

To the young PO. You are a lucky person to be surrounded by so many caring co-workers. Don't get down on yourself, the job, or on what you are doing. Have faith, my friend. You are exactly where you are BECAUSE God has a plan for all of us. And, because of what you are going through right now, I personally believe that you are going to be a GREAT cop.

Speaking of violence: A couple of nights ago in 023 a marked unit responded to gang members selling drugs call. Two officers arrived and began to interview 4-5 shitheads. At this time, 6 rival gang members decided to ambush the officers and the other gang with bats. Most of the offenders were caught and one officer was slightly injured. 023 3rd watch Sgt. BK, a merit puke, has the audacity to tell the involved officers they were partially responsible for victims' (gangbangers) injuries because they didn't protect them during the attack. Are we not supposed to protect ourselves first Bob? This guy is never on the officer's side and his stupidity is dangerous.

To the second amendment officer. Go hug a fucking tree or cougar! It is assholes like you that are bringing our country down and making it less safe to live in. Ever heard totality of the circumstances, experience of the officer, time and location, and officer safety. Put all of those together with the adjusting of an object on the waistband and an experienced officer should have enough justification for a protective pat down.
I had a similar incident like that several years ago. Stop a van with two gang bangers, the passenger was decked out in Spanish cobra colors, seemed very nervous, was wearing a blk. puffy coat in the summer, no where near cobra hood, and kept his left arm real close to his upper torso during the stop. Hey liberal copper, what would any seasoned copper think these two shit heads are up to and what to do with these guys???? That's right!!! maybe going to do a drive by and put the MF's on the hood and go through them. I found a loaded 380 on the CPS going to be a Dr. inside the coat pocket. No creative writing as you put on the report, wrote it down the way it happened. A finding of probable cause ruled in br. 50, go to Skokie and the liberal judge there finds the asshole not guilty because of no PC for the search. So how can one judge find PC to remand the case to trial and then the trial judge hear the same testimony and find no PC to uphold a conviction. The judge said all my police experience and observations where good but I still didn't have enough probable cause to search the CPS angel. I say the only reason I get a conviction was because the judge was a Liberal!!! and people want to know why the police are reactive oppose to proactive. We have to wait to get MF, punched, shot at before we are allowed to do anything to ensure our safety when dealing with these little angels.
See Mr. liberal copper you hit it on the nail with your comment, a officer didn't see the 70 yr. old granny in a nice neighborhood adjusting her waist band leading him/her to believe she has a gun. They saw a piece of shit gang banger/drug dealer on the spot fixing/adjusting his waistband in a manner which his/her police experience lead them to believe it might be a gun. Ask any seasoned officer what their conclusion would be with the totality of the circumstances or even a REASONABLE person who lives in the hood and they would all say " shit that @#&*^%% got a gun"!

the "community" is getting the kind of Police Department they want. Proactive policing is the only why I have seen that will cut down and deter crime. We have now become a department that cannot do this. Why should I risk my life, my health and my job for citizens who do not want me out there doing my job. Ok... you got it.
Let the ministers come up with a program to reduce crime.
With violent crime increasing, where are the ministers and other community leaders????
The solution is with the community and its leaders. They tolerate crime and look the other way. Juries are a joke. O.T... State Trooper wrote my kid a ticket down state in Bloomington where he goes to school. It's not even a hazardous violation.Kid mentions that he's the son of a Chicago P.O.. Troopers reply- "thats' great". He goes back to the car and comes back with the ticket. I gave up looking for guns last year. Short story, My partner and I got a CR# for chasing a shitbird who had a gun in his waistband (I saw the gun). I caught shitbird a few blocks away, no gun (Looked everywhere, no gun). Shitbird tries to fight my partner and I take him down. Shitbird hurts his shoulder and goes to hospital. Shitbird gets CR# on us and signs affidavant. OPS makes it not sustained (I don't think this would happend with the new review board). Shitbird is sueing the city (city is giving shitbird money to go away).

The moral of this story

Like a lot of folks in this state, I have a job.I work, they pay me.
I pay my taxes and the government distributes my taxes as it sees fit. In order to get that paycheck, I am required to pass a random urine test with which I have no problem. What I do have a problem with is the distribution of my taxes to people who don't have to pass a urine test.
Shouldn't one have to pass a urine test to get a welfare check because I have to pass one to earn it for them?
Please understand, I have no problem with helping people get back on their feet. I do, on the other hand, have a problem with helping someone sitting on their butt, doing drugs, while I work.
Can you imagine how much money the state would save if people had to pass a urine test to get a public assistance check ?

Prosecutors say Stephanie Grissom of Columbia paid $310 in fines for speeding and negligent driving. She also received three points on her driving record.

In March, a county grand jury declined to indict Grissom on automobile manslaughter charges.

Police say Grissom was driving 71 mph in a 55-mph zone on Route 32 when she struck Officer Scott Wheeler. The officer was working a speed enforcement detail and had stepped into the road to flag Grissom down when he was struck.

Don't be selective about the consitutional amendments you enforce. Yeah, I like the 2d, and can't wait until the Supreme Court says I can have a pistol for my own protection (only criminals have them now, and I feel naked.) But I also like the 4th, about searches and seizures.

Will the crime rate go up if you do it by the book? Yep, big time. But that's not so much your problem as ours (taxpayers.) If we want good policing, we have to pay for it. We have to pay officers more, and give them more people and resources to do their job by the book.

As a woman and mother of twenty-one years, I totally understand that statement. Intuition and experience make a nice combination for preventing disasters. Isn't that what life/job experience, accumulated knowledge and education is supposed to accomplish?

So as a non-police law abiding citizen, using those "tools" is exactly what I'm counting on you all to do. It's a miracle that any of you continue to go to work everyday in this anti-police climate. I am no apologist for the judge, and I haven't read the entire decision, but from the information given, the judge did not disallow a Terry Stop ... he disallowed a search. You know the difference, so my only conclusion is that you are being purposely deceitful and rabble-rousing.

The judge disallowed the search based on supposedly inadequate grounds for the stop, to wit, an insufficient amount of "suspicious movement." What is so hard to see about that? The entire stop becomes invalid and Terry doesn't apply anymore. Now judges are going to again legislate from the bench and define how much and what type of "suspicious movement" affects our safety and the safety of the public? We can hardly wait for these guidelines.

I will also make a stretch and assume the arresting officer would be allowed a Terry Stop, and, if and only if, he was able to see the illegal handgun, without a search, the arrest would be constitutionally sound.

Wow. That's a helluva stretch. Good luck with that one. No one has ever had to "see the gun" to effect a Terry stop. Did you ever take Bob Stasch's class on weapon detection? Five minute video of a school parking lot in Florida and you have to pick out the behaviors that might signal a gun. We picked out two the first time and if we remember correctly, we missed 3 of the 5 guns that police recovered. Not one gun appeared on the video and cops didn't spot them until arrests were made.

See a gun for a stop to be legal? You're nuts.


Admittedly, the pat-down criteria were not addressed. Again, based on limited information, I will take a leap and reason that the pat-down, for which different articulable criteria are required in regards to the stop itself, would have been allowed.

Again, we're arguing based on not knowing the entire circumstances, so the circular logic dooms us to talking past one another

So often the copper is quick to criticize the courts' decision, when, admittedly, it does make the coppers job of arresting bad guys, more difficult. However this hardship must be balanced by the fact that we do have constitutional protections. If you need more light shed on this picture your grandmother simply pulling on her waistband and this officer performing a search simply based on that. Does that bring it home for you?

A couple of issues here..First and foremost the guns were taken off the street.
Second, when writing your case report and/or testifying you have to make yourself perfectly understood. Why is adjusting your waistband "suspicious" especially in a day an age where a lot of these knuckleheads constantly hold their waist bands to keep their pants from falling all the way to their ankles.

It was suspicious because he clearly moved an object and wasn't just adjusting. In addition he was a known gang member or in a known gang location or he abruptly turned that side away from my view as I approached..Etc..He adjusted something to the left of his middle and my training tells me most gun toting bangers carry their guns to the left for a cross draw...These are the type of things we need to state.
The Chicago Police Department for years taught officers to keep their reports short and stupid. Those days are gone but the CPD is so terrible at training and on going training that many officers are left scratching their heads because all of th sudden the rules changed. You have to be clear, concise, and complete in your report writing and testifying..Maybe someday these politicians that have the responsibility to train us to be "professional" will stop stealing enough money that can then be redirected toward training a modern, more professional police force... In the meantime, this shit ain't hard and who cares what they throw out...I know, lawsuits..You can be sued any day for any thing...Times four for me...

It's all in the words. Judges and lawyers use nothing but words to push their bullshit and this is all they have to deal with. All P.O.s should learn this. They should teach this in the schools and not taught by some idiot who has been hiding in the school for 10 years.

Once you put it on paper you have to live with it forever. If you do not put work into your report and it is ovverturned don't beef. If you feel you did your best in writing your report then OK that is all you can do. Read, then re-read your reports. You write your reports you do it in about half hour to an hour.

THE SHYSTERS AND JUDGES HAVE MONTHS AND YEARS TO TEAR YOU AND YOUR REPORT APART. Take your time, ask for advice and do it right.

The days of stopping people before they commit crimes is over.

The Constitution never intended to have police stop cime before it occurred. Over the years, crime has been so out of control that courts have allowed all kinds of exceptions to search warrant and probable cause requirements, so coppers could take dope dealers and killers off the street before they committed more crime.

The legislatures jacked up penalties for gun and drug possession crimes, rather than jacking them up on people who are caught after killing someone.

It was a mistake to do all this. Dump this shit back onto the community and do investigations AFTER there has been a crime.

The Department should rid itself of these BS attempts to grab gangbangers before they kill and put more effort into grabbing them after they're done.

Get rid of all these Gang/Narcotics units and split the entire department into two, and only two groups.

Patrol Officers and Detectives.

Patrol Officers respond to calls, obtain info, and arrest named offenders.

Detectives try to identify offenders after the fact.

The rest of this stop-search bullshit should go by the wayside. The drug war is over.

Anyone else receive their City of Chicago water/sewer bill?

I received mine today. My bill went up $22.27 from last November's bill. I have a small single family home and live alone. This sucks. Everything is going up except our pay!

The vehicle city stickers also went up.

One more thing that went up..Emil Jones and the other corrupt politicians pay. Emil told the Slum-times last week that he works hard and deserves his automatic $7,000.00 pay bump! The State legislators pay raises are automatic unless they vote NOT to give themselves the said raises!

UNFUCKING BELIEVIBLE!

Well I'll pay this water bill. BUT I will keep my hose on full blast all summer just like its a fire hydrant in the ghetto!

Off duty is on expressway and was pulled over by the state. Trooper asks for DL, insurance card, and goes back to his squad to run the plate, name and make sure everything is kosher. When everything is all good, the off duty asks the trooper why he was pulled over because he wasn't driving like a jag or anything else. The trooper points to a vehicle that is also pulled over to the side of the road and points to the vehicle and says, "He wanted me to pull you over." Guess who was in the other car? J-FED.

Dude was checking to see if the copper with the FOP medallion was 501 and ready to jackpot him.

I really hope this story is bullshit, but if it is true that is FUBAR and open to a ginormous lawsuit.

I wouldn't put anything past this guy.

To 7:14 :15 Yrs ago I was in a Probable Cause hearing in which the Honorable Judge Fox was presiding. Same cause (Flashing Gang Signs ) was used for my stop, after which the shithead gang banger tossed a pistol out of the window. Judge ruled I had no probable cause for the stop. I might have prevented a shooting, but the Jagoff was free to try it again.These days you might get sued for this Police action.

Judge Fox is one of the best judges at 26th street and is pro police even though he was once a public defender. Well FYI if Dude loses his "weight or money or gun" and gets away and lets say it is a big loss to somebody else interested in the lost paraphernalia.......Then upon his (non-arrest but property being inventoried of course as per General Orders) then Dude may wind up DEAD.

Why lock them up "seize their shit" inventory it and give them a pass yourself as the judge would do anyway. This way they may wind up violated or DEAD! Log them in as the person turning in the drugs or guns but only as a citizen trying to change their evil ways.

Your doing your job using discretion by releasing them and taking the items away to be inventoried and disposed of by custodian etc. or whatever!

Thus dude loses and maybe his life too and you stay out of CR trouble. You also stay out of Court where you are usually humiliated and pissed off by the incompetent political ASA's and liberal judges as they toss cases and plea out to less than what they should get etc. etc..

who was running parking at the St. Jude parade. I brought my family down there and my mother was in from out of town. I've never seen it so disorganized. They had cars parked all over the placed and blocked several of us in. I had to wait at least 2 hours after everything was over for the cars blocking me in to move.

My daughter just got stopped by an Indiana Trooper. She was going way too fast. Trooper was professional. She mentioned that her father is a Chicago police Officer, as I have instructed her to do, all the while being polite. Trooper responded that he saw the FOP medallion on the back of the car. The trooper also said Chicago guys usually blow right by them and flash a badge. My daughter said she didn't think her dad was one of those guys (he isn't). The trooper gave her a warning ticket. Thank you for your professional courtesy Mr Trooper. It is really appreciated. If I knew who you were I'd call you and thank you. I salute you, sir.

About three years ago 009 had an officer on Midnights who wore violet sunglasses at night. Po's in 009 thought he was crazy. I remember a disturbance call where gang bangers were fighting with baseball bats and the po got right in between the fighting. He broke up the fighting by himself without incident and took the main fighters in. Once the gang bangers got to 009 you could see they were visibly shaken. When asked why they looked nervous one replied I don't wanna be on that cop's badside. He was pointing towards the sunglasses guy. Don't know what happened to that po, but rest assured he would have been a thorn in the 023 sgt's side.
Personally, he was the nicest copper I ever met in 009. A little odd, but nice. In 009, that is a rare quality.

First of all: why are the gangbangers still alive? I don't know who is more questionable, the 6 six gangbangers that bring baseball bats to a gunfight, or the coppers that allow themselves to be injured when they had superior weaponry.

As for the coppers being responsible for the first group's safety, sadly, he may be right. When ever you stop someone and he is not free to move freely, you are responsible for his safety. Numerous case ruling on this, tho most are from vehicle stops that later crashed into.

I know-it sux but such is life....

A frisk is not a search. How the fuck could you NOT know that? You need reasonable suspicion for a frisk (or a patdown it is called). You need probable cause for a search. You gotta at least know the basics here. You don’t.

These "officers" who I question whether or not they really are officers, who are claiming this judge made the right decision must have never worked in a high crime area. Can anyone who has, honestly say you couldn't describe the actions an offender that would be carrying a .45 in his waistband would make when he sees the police approaching. Most of them can't hide their actions when they are holding a bag of weed, nevermind a handgun. They know they are dirty. Based on the actions and movements of this guy and the location he was in, you have enough of a reason to stop and talk with him. If you seen him making other movements that would indicate he might be possibly armed, you have enough to do a Terry pat down. After patting him down, you find the gun. Enough said.

If in fact you are a cop, even a casual observer such as II can see you're certianally not what is called the REAL POLICE. My guess is you're more likely a lawyer-like REMF.

People like you insist on the taking away of every human tool (and the hardware shotguns, etc.) which police use to police thus giving the criminal every advantage and forcing people in low income areas to live in combat zones.

I don't know anything about the Terry law or pat down protocol but I can see how a good cop can observe and sense where a threat to the public is.

It would be one thing if the guy was scratching his ass but it appears by the move the man made and perhaps the form the officer subsequently observed in the guys clothing the officer had a reasonable belief the man had a gun. As a citizen that's enough due dilligence from a sworn officer for me.

Look you can't be on the streets day after day in dangerous areas and not gain a sense where trouble just as I'm sure a judge can't sit on a bench day after day and not gain a sense when he's being told a lie.

For what ever reason this cop guessed right and found a criminal. End of story.

If he'd brought the guy in for packing a joynt and the New York Times you might have an argument.

People like you who insist we give criminals the right to tee-off on us before we have the right to protect ourselves all in the name of protecting our rights are a concealed threat to our safety.

Ok … out of respect for the citizens who read this blog ... I am a cop first of all. I’ll sum it up in a nutshell … you don’t need the search to arrest that bad guy … not at first. You stop the guy and frisk him on separate articulable reasonable suspicion (that just means you can verbalize why you suspected him of committing a crime – in this case possessing a handgun). This yields the probable cause for the search. Now you don’t have simply an arrest, but you have a case that will stand up in court. You start playing fast and loose with a 4th Amendment right and you will lose. Period. Your post was a little insulting … but I can see how you may have thought I was defending the gangbanger. I was not. Perhaps my tone was wrong but my intentions were sound. Lock the guy up AND put him in jail. If you don’t hell be right back out in a day or two … this time a bit more cocky. If you are going to do it, do it right.

CPD is their own worst enemy. They expect breaks anywhere in any state. They flash a badge speeding by exepcting a break. At least stop and show respect. I will not automatically extend courtesy to family members unless I know them. Anyone can claim a father is the police. Medallions mean nothing. Easy to obtain. How about not speeding or driving DUI? It is so bad that I leave certain expressways for several hours to avoid stopping off duty PO's leaving taverns. On LSD it is terrible between 2-4am.

My daughter just got stopped by an Indiana Trooper. She was going way too fast. Trooper was professional. She mentioned that her father is a Chicago police Officer, as I have instructed her to do, all the while being polite. Trooper responded that he saw the FOP medallion on the back of the car. The trooper also said Chicago guys usually blow right by them and flash a badge.

And your daughter was speeding how fast? FOP medallions that are soo easy to buy or given away by police? Her father is the good guy, not like the other hundreds of PO's that fly by without stopping? Sorry, but life sucks. Slow down and teach your daughter to obey the law.

He brags that he will DUI 10 coppers before he retires, so far he got 4 The last victim was a Sgt. from 009 returning from a retirement party who pulled over at the Mcdonalds. I understand your frustration. You have no idea how many CPD are stopped for speeding and DUI and given a pass or other service. Amazing how CPD is everywhere and demand a pass! At least show some respect and courtesy when stopped. Or "I am the real police"! Does anyone in CPD actually do not drive 30 miles or more over the limit or not DUI? Imagine if every one actually received a ticket? You would be amazed. So quit complaining and be graetful that other departments still give a pass despite the lack of respect by CPD.

Word in 009 is that the good sgt FL got ratted out by his very own DC Roy. Roy called RA to go after any 009 copper drinking and driving. FL got dui'd because his DC wanted him to get caught. Roy is currently working with J-Fed to hammer any 009 po's caught drinking.
Ask anybody in 009 about how shady Roy is and you will see why he is not respected!

I was stopped by ISP and given a pass, the young trooper was nice but I was 20 over! My wife was stopped and written a warning ticket. I was also stopped in Indiana 28 over and given a ticket yes I was pissed but then again he may of saved my life, as i was going way to fast! Get over it it happens even to us, most times we get a pass like myself and others have many times!

SCC, I believe tha you are a little off base in your reply to 5/07/2008 01:41:00 AM. You seem to have deduced from the finding that the judge threw out the actual stop of the person. I don't read it that way. He only threw out the search following the stop that discovered the contraband. Too many of you guys, apparently including SCC, fail to remember that the decision in Terry v. Ohio and in the Illinois Law, which is modeled on that decision, states that when you detain someone for temporary questioning a search is only allowed when the officer reasonably suspects that the person stopped will attack the officer or another person. The officer may then search for weapons. That is pretty clear to me. It should be obvious that the officer must be able to articulate why he thought the subject may attack, as well as why he stopped the person in the first place. These are 2 separate issues. Read what you included in your post: "Brooklyn federal Judge John Gleeson found Daughtry shouldn't have searched McRae because the convicted felon 'did not move in a sufficiently suspicious manner." It sounds to me like he disallowed the search, not the stop. Obviously any evidence found would then be suppressed. Maybe the fault lies with the officer, or us in general in not being able to express things correctly.

Since this thread started there has been a lot of terminology thrown aound. Remember that a Terry stop only requires REASONABLE INFERENCE FROM TOTAL CIRCUMSTANCES that a crime has been, is being, or is about to be committed. If the officer REASONABLY SUSPECTS that an attack may occur, the frisk may be done. I don’t believe that the Supreme Court or Illinois Law uses the term probable cause anywhere in relation to Terry. Incidentally there is nothing that says that you cannot use your police experience in making an inference from the total circumstances. A lot of the talk about reasonable belief, probable cause and such is really just about semantics. However, it has always seemed to me that the term “reasonably suspects’ as used in the Illinois Stop and Frisk law is a lot lower standard than the rest of the terms that have been thrown about.

I know, I know nobody wants to hear this. It is much easier to blame the courts, judges, state’s attorneys, the public and the media than it is to try to understand the rules and learn to use them in the proper way. In many cases, if these circumstances are presented correctly the stop and search can be allowed. You can’t just play a guessing game, and, as 01:41 AM says you can’t just selectively decide which amendments in the Bill of Rights are important. What I see way too much of here, and on the blog in general, is that most of you that post seem to be saying, “WTF, I’m a cop! Nobody should expect me to play by the rules, and if you do make me play by the rules I will simply stop working.”

Just out of curiosity, does anyone know why this was in front of a Federal Judge? Doesn’t sound like it was an appeal, but rather an initial hearing with a motion to suppress the evidence. Does anyone know if New York City is one of the places that a lot of gun cases are going directly to Federal Court? Since this was in Federal Court, it would appear that the ruling was in accordance with a Federal standard, not New York law, which probabaly has a similar statute to Illinois governing temporary questioning.

bloomington complainer: don't be rapping the State Police. I also was stopped near Bloomington for speeding. Trooperwrote a warning. All it means it don't commit another violation for 6 months. be grateful the trooper didn't write what your son was actually doing. two sides to every story.

Answer: He is now Deputy Chief - Strategic Deployment. When the Bureau was created there was only a Deputy Superintendent of Strategic Deployment - John Risley and now Mike Shields. Then when Mike Masters from City Hall became Chief of Staff a spot was created for the bumped Patrick Daly as ADS Strategic Deployment. Now they've added another layer naming Brian Murphy as Deputy Chief of Strategic Deployment.
As much as it changes, it still remains the same game.

I have to jump in with SCC on this one. Civil evidence is much more liberal than Criminal Evidence Rules.

One Example:
In a criminal trial, in an affirmative defense, a self-defense case, such as this one, i.e. "we killed him, but we were justified..." You can bring in the offender's character of violence, of drunkeness, of aggression on past occasions, of fighting with the police. You can say "Ya he tried to run us over .. in 1996 he tried to run over Pacho ... in 1998 he struck a police officer ... in 2000 he hit someone with a B Ball bat." In a civil trial you could not bring in any of that.

So, there IS a difference.
