Violating Confidentiality?

  • The department ordered [suspended officer Gerry] Callahan -- an alcoholic and manic depressive -- into rehab. The day before he was return to normal duty in 2006, supervisors smelled booze on his breath. He refused to take a Breathalyzer and was abusive to his bosses.
Correct us if we're wrong, but publishing a medical history isn't allowed - HIPAA and all that. Manic Depressive is a medical diagnosis. We recall signing all sorts of agreements every time we visit a doctor that limits to whom information can be shared.

Same thing with the professional counseling services - confidentiality is the watchword. Programs like these live and die on their ability to protect the anonymity of their clients.

And this is to say nothing of the Disciplinary process. Doesn't there have to be a finding of guilt before past instances can be used to influence penalties? Or is that only in criminal trials? Because everyone knows police have no rights.

We'd love to see a few reporters dragged in front of a judge and be compelled to reveal who in the Medical Section or Corp Counsel is leaking privileged information to the public.

NOTE TO TINY BRAINS: This isn't an expression of support for this officer or what he's alleged to have done. As far as we know, the investigation is ongoing. This is about his rights (and the potential for yours) being violated to satisfy a political agenda.

While I dont agree with what that officer is alledged to have done. I do stand behind that officers Constitutional rights as his rights to privacy as far as his medical history is concerned.

If John Q. Public's medical history was released to his employer it would be a diffenate violation of the HIPPA act. (Health Insurance Portability and Accountability Act) Title II? I believe.

Leaks like this should be investigated and prosecuted to the utmost.

Not sure about this.... But I recall reading the Callahan admitted to suffering from depression and alchoholism in his previous hearings at the police board

If he did and Im not saying that he did, and those hearings are open to the public, then I would think that they are fair game to the newspapers

Its funny to read how all the top brass suddenly want transparency in the way the department does business. So does this mean we'll get transparency in the promotion process? like standardized test and clarification on what "merit" promotions consist of? After all the police board does have to approve all promotions.

As always SCC, thank you for standing up for the rights of all of us. Yes there is simple minded people out there that don't understand that what happens to one cop can happen to all cops.

The release of personal medical and addiction records is a serious breach of personal trust. There actually should be a criminal investigation into this leaking of medical information.

I have seen more than a handful of police officers I have worked with commit suicide due to mental illness, alcohol or substance addiction or other problems. The key to getting help to these officers prior to them hurting themself or another is the trust that the help they seek will remain confidential.

It is sad to say that I have been to more officers' funerals due to suicide or dying young due to being intoxicated (i.e. DUI accident, alcohol poisoning or failed health due to abuse) than I have for officers dying in the line of duty.

Please fellow officers, stick together and push that medical information remain confidential. You may be saving the life of the person you are working with.

I am not an attorney. However, I understand HIPPA covers only confidential health care matters. I think once Callahan's lawyers put his health care issues in the public venue at the police board HIPPA no longer applied regarding those health care issues as they are a matter of record. Also, I understand Callahan's lawyers put his alcoholism and his mental health issues into the police board record to demonstrate mitigating factors regarding his behaviors. Callahan is not a bad guy. He made some mistakes. By the grace of G-d go I. I hope CPD members have compassion for Callahan.

I know management reads the blog every day. My suggestion to the Supt. is attempt to double the size of the EAP staff. Doublimg the EAP staff could only help at the minimum in outreach to employees of the CPD. The Supt. could present to the City Council via the 2009 budget doubling the size of the EAP staff as a mechanism to deal with employee problems. Supt. - please call Ald. Burke regarding this request should you attempt to impleament it. I am confident Ald. Burke would be more than happy to listen to your ideas regarding this topic. Traditionally, every dollar invested in EAP programs translates into $4 increased employee productivity. Thanks.

If his lawyer revealed at a hearing that he was a "manic depressive" then I believe that the newspaper could print it as thou the transcripts are public record. All the paper has to do is optain a transcript of what happened.

You are a flaming retard. HIPPA? Are you fucking kidding? HIPPA does not give individuals the right to do anything (including suing). People can only complain to the U.S. Government. Oh, and guess how many HIPPA enforcement actions have been brought during the Bush administration. Hint: you can count them on one hand.

Additionally, the Police Board is a public forum. Transcripts there can be had by anyone. And, of course, in Callahan's case, truth is an absolute defense to defamation.

This is no endorsement of this guy Callahan, but I think most of you are missing the point here.

Even if it was mentioned at the police board and I don't know if it was or not. The story does not credit that information being gleaned from the police board's records so it seems that the information was obtained via a different source (the Supe).

Since the entire article was put out as a hit piece on the police it was actually a well designed attempt at a power grab by J-Fed.

By putting out this article J-Fed hopes to get the aldercreatures and the people behind his desire to have absolute control with no checks and balances in place to prevent abuse. (that means protecting clout babies and burning those without).

The authors of that article could've referred to the Officer in question as Officer X and got the same point across. But as you see they have no morals,ethics or common deciency. Doing the right thing does'nt sell papers I guess.

Then to follow up the next day with more of a hit piece that blazes anti-police headlines but is actually a hit piece on the people with clout taking care of their peeps and getting them on the job despite being nowhere near qualified, and as it gets more and more difficult to get someone to even apply for this job due to J-Fed and his cabal you'll find scumbags like them getting hired as they overlook their criminal past and associations with nefarious types because there's no one else to hire.

What a truly, truly sad state of affairs we find the CPD in these days.

Cmon FOP get on the ball and start bringing legal action against this punks, we're letting our Civil Rights and Constitutional Rights and Medical Privacy Rights be trampled under foot.

Obviously you do not know him personally. I do. I worked with him and our families used to socialize and our children played together. For the 15 years I've known him, Gerry has always been a bitter and sarcastic know-it-all with a generally piss-poor disposition and zero people skills. He has been offered help from friends as well as the department, but he alone has chosen to disregard the help and continue his self destructive ways. We all saw this coming and knew enough back then to cut our ties with the Callaghans and just get out of the way of this out-of-control freight train and not be part of the collateral damage.

I for one am glad that this article came out. Simple reason being that it may be the kindling to help light a fire under the Police Board to finally get rid of him for good.

If you honestly knew Jerry Callaghan then you would understand because he truly is a bad guy.

I've been following the "old crazy head" Callahan case for awhile because I unfortunately know the turd.

His attorneys put his mental health status out there years ago. I agree with the larger point SCC is trying to make, but I don't think it directly applies here.

As for Jerry Callahan he needs to be off the job one way or another. Medically retired, "psyched", flat out fired etc. He's "funny in the head" and should never have been hired. The man needs to be cutting grass at a cemetery where he can't harm anyone, but himself. Less stress, good exercise, perhaps it would help.

If you look at his eyes it is plain to see he is a few dots short of a dice. I've heard stories about who his "clout" is and if true that individual should be ashamed.

If you can afford it DO NOT GO to the EAP. That fat Frank C may have some concern for your well being but he is still there to protect the City from liability. He mainly wants to secure his nice spot in soft clothes and a take home car where he can adjust his own hours. If you need help by all means get it but keep it strictly between people you can trust and a private doctor. I'am speaking from experience.

I want to thank the Director of the Department's EAP for this ringing endorsement of her own program. Is that you, Bev?

Actually, what should be recommended to the Supt. is that the Department's INTERNAL counseling program should be completely shut down. The counselors at an INTERNAL eap are our fellow Department employees who are seldom trusted by the police. Yes, a PO might go to the Professional Counseling Program with a marital issue but they are not going to go in to address real issues that affect them on the job because they are not going to trust that what they have to say will not be divulged elsewhere (medical section, Supt's office,etc.). The police are not going to trust any Department civilian, professional or otherwise. The question becomes, "When push comes to shove, is a Department counselor going to honor my right to privacy or are they going to violate it by communicating with(fellow) Department supervisors?

In the place of our Internal EAP (the Professional Counseling Service) it would be possible to have, at a much reduced cost, an EXTERNAL counseling service that would be managed by a local hospital or a corporate employee assistance program. Because the corporate eap staff are not our fellow employees and because they are already are functioning in a professional corporate atmosphere I believe that there would be a much greater likelihood that the police would actually use the service. In a hospital run program there is also the chance that someone actually earned their job instead of getting it because their juice is an alderman, but I digress.

When Jerry Bolger and Rory Gilbert were running St. Michael's House we had a program outside of the Department that really offered officers privacy and confidentiality. When Jerry passed away (RIP) that spelled the end of St. Michael's House and the opportunity to go outside of the Department for free counseling. An EXTERNAL counseling program would offer a PO a chance to take their issues outside of the Department where they would feel safer that a brick was not going to be placed on their career.

I seem to recall that some of this stuff was published a long time ago, so its not as if it is private anymore.

Besides, HIPPA rules only apply to health care plans and providers. Not police boards.

The real answer to some of this stuff is a lot more transparency in the police discplinary process. The average citizen just does not trust the current system in Chicago.

To be fair, I don't have an answer for making the system better. On the one hand, you need a system that deals harshly with those who deserve it, while being reasonable when that is called for. The difference between the two situations is not as stark as one might at first think, and minor differences in circumstances can cause a wide disparity in outcomes.

Earlier today, I spoke with several NYPD homicide detectives assigned to Brooklyn North, the Bronx, Manhattan South and various precinct squads. The WTC 9/11 attack occurred in the 1st Pct. (part of Manhattan South). I also spoke to members of the Detectives' Endowment Assn. (DEA).

DNA:
As SCC writes about "violating confidentiality", all the bullshit about collecting each officer's DNA is a transparent subterfuge by Shortshanks, J-Fed and their treacherous suckholes.

NYPD mgmt. didn't even try to use such a preposterous 9/11 DNA bullshit ruse. The NYPD guys were amazed that any P.D. would even attempt to subject officers to such an outrageously absurd and invasive practice.

GPS:
They also unanimously agreed about GPS. If you've got a "rabbi" or a "hook" going for you in the NYPD, you could drive up to the Catskills on-duty in an unmarked car to play golf. You'd never hear a word about it. But God help the lowly precinct guys resting their eyes in a desolate industrial area at 0400 hrs. on a slow tour.

RESIDENCY:
Like Chicago, the cost of housing in a decent neighborhood within Manhattan and even the outer boroughs is off the charts. Most of the NYPD commute from their homes in Westchester, Putnam, Rockland, Orange, Nassau and Suffolk Counties. However, they can't live across the Hudson River in Jersey or in Connecticut.

No other big-city P.D. requires its members to reside within the city limits.

I will phone FOP with this information tomorrow. Don't be fooled by the City's bullshit. They're only scheming for more ways to crucify the unclouted.

I will also urge that the FOP Newsletter start enlightening our guys to police policies and practices in other major cities. It should easily document that the CPD is the most corruptly managed, dysfunctional major dept. in the entire nation. I assure you that publication of such data would be a real eye-opener as to how miserable the job has become.

Almighty CLOUT is the cancer that has destroyed the morale of the CPD.

As a cop, and an attorney, once Callahan and his lawyers disclosed some or all of his past medical/substance abuse/mental illness issues at the police board hearings they remove the protections of confidentiality. They knew, or should have reasonably surmised that since the police board hearings are PUBLIC forums, that produce public records, that any information divulged at those hearings is subject to dissemination beyond the hearing participants. He cannot voluntarily release the information in such a hearing to curry some sympathy from the board and then expect some protection from its release to public parties, IE the media. Besides, in laymans terms, hes a fucking jag that should have been bounced YEARS ago. Note to self, DO NOT divuldge anything at a PUBLIC HEARING that you do not want made, well PUBLIC.

I know the media still does a terrible job after all the fact checking but, the best the media can use this site for is rumors that they can try to confirm.

I have emailed the media multiple times. The media never replies. I have called them and they are not interested in talking with a real police officer. The media has their own personal sources at 35th st. They don't want to hear the truth from the working police.

I have seen more than a handful of police officers I have worked with commit suicide due to mental illness, alcohol or substance addiction or other problems. The key to getting help to these officers prior to them hurting themself or another is the trust that the help they seek will remain confidential.

When you go to be evaluated for substance abuse on this job they make you sign an agreement that states the findings are not going to be kept confidential.
Remember boys and girls on this job once you admit you have a problem they will not help you, they will make you carry around that stigma for the rest of your career.
If you do have a problem get help by any means just do not use the department, because they will use it against you.

To those of you commenting about the EAP office you don't have a clue what you are talking about. I have personally had contact with this office dating back to about 1989 when Jerry Bolger was in charge up until now. I do not work there. I came in contact with them because I needed help. Both jerry's "crew' and the guys there now have but one motive and that is helping out department members who ask for or need help.

I have 1st hand knowledge of dozens and dozens of department members and their family who have been helped over the years. I was not told about this by people in the EAP office but saw it first hand.

The few cases that I am aware of that members didn't get help and were not able to "straighten" out their situation with the job has been with those who refused to take the help or advice offered.

Over the almost 20 years of experience I have with people from the EAP I have NEVER seen anyone hurt who was at least marginally able to accept suggestions. If their situations didn't work out it was no fault of the EAP.

This is not meant to pass judgement on those whose situations didn't work outand were unable to accept help, or to those who have commented on this blog negatively about the EAP office.

These are either people who just like me wouldn't listen to those around me who told me I was sick for years and years or friends or family of those individuals who are upset that their sick friends didn't accept the help that is there through the EAP and elsewhere.

I read this blog on an almost daily basis and this is the first time I have responded.

I am doing this not to force my opinions about the EAP on anybody but to let other police officers know that if they think they need help they can get it at the EAP. But most importantly if you or anyone you care about needs help get it SOMEWHERE. We have all seen to many of those around us get hurt or worse because we couldn't or wouldn't get help.

Here's the deal folks - it is NOT a violation of federal HIPAA regulations if the alcoholism/bi-polar condition is a matter of public record i.e. mentioned in a court record. Those records are public information once the statement makes it into court transcripts unless the record is sealed by a judge. If he or his attorney or a member of our own department speaking on his behalf (like one of those EAP fools) stated in either court or a police board hearing the nature of his condition, then HIPAA rights go out the window as it is then public record.

(I know from where I speak as my girlfriend does this HIPAA compliance/labor relations stuff for a living and she's explained it to me in detail so I don't misspeak here.)

Don't get me wrong, I do not approve of what this guy's done or approve his behavior, but I still think it was really crappy to have his personal medical/mental health issues printed in the paper. Yet, it wasn't illegal.

Bottom line, once it's mentioned in court, it becomes fair game.

I am not a cop but I have been asked by several cops who read this blog to provide commentary on this question of HIPAA compliance and whether this officer's HIPAA rights were violated.

They were not violated.

If he or any of his representation publically states, in a court or hearing venue, his condition(s) or any aspect thereof, then it becomes a matter of public record and HIPAA protection would not apply.

If he openly discusses his condition, even outside of a legal forum, on a regular basis, then he risks setting precedent that he does not want HIPAA protection and is, essentially, allowing others to use his personal information.

Ironically, the defense that this gentleman wants to use "I suffer from a disease that adversely affects my behavior and therefore I should not be held accountable for these actions" is now the very thing he wants to claim he's been violated on in an effort to make himself a victim. Can't have it both ways.

OTOH, problems police have might be unique enough that having them handled by people familiar with those problems could be beneficial.
