You Are On Your Own

We've mentioned on a few occasions that everyone ought to read The Advocate. The Advocate is the Internal Affairs newsletter that highlights disciplinary process, proper procedure, and uses actual cases to outline how much time one can expect for various infractions. Some highlights:
  • 10 days for failure to report a parking lot accident;
  • 10 days for AWOL and insubordination;
  • 227 days (yes, two hundred-twenty-seven days) for having unauthorized control over Department radios reported stolen; another 270 days (not a misprint - 270) for numerous unauthorized court appearances.
Here's a section that everyone ought to be aware of:
  • Sworn Affidavit

    An officer issued a citation for loud music and impounded the vehicle of the offender. The offender contacted [IPRA] and obtained a Log Number alleging that the officer took numerous items from his vehicle including radios, speakers, amplifiers and televisions. The offender sighed a Sworn Affidavit certifying the allegation was true. The CR Number was investigated. The investigating sergeant unfounded the allegation based on statements provided by witnesses. The officer hired an attorney and filed suit against the offender for Slander Per Se. After a bench trial on July 2, 2008, the judge found the offender failed to meet a qualified privilege; had no basis for the complaint; was unable to provide any other defense or explanation; and that his conduct accounted to a reckless disregard for the truth. A judgment was entered on behalf of the officer. Even though perjury charges were not sought, this case demonstrates officers who are the subject of a false complaint have a remedy available in civil court.
A few points (and completely our opinion):
  1. Perjury, though proven in this case and provable in hundreds of others, is NEVER going to be prosecuted by the Cook County States Attorney. You cannot be the victim in the eyes of the CCSA. You are a non-entity.
  2. The Department will not back you and the City will not back you. That might offend reliably democratic voters. Any remedy to YOUR reputation, YOUR credibility and YOUR good name will be undertaken at YOUR expense, on YOUR time and completely at YOUR direction.
So the Sworn Affidavit is revealed to be completely toothless and was never passed to protect officers - it's a farce. Luckily, an intelligent officer figured a way to make it work for him, but The Advocate lists only a judgment. If you sue someone with no money, expect a lot of "judgments" to pile up and, unfortunately, any bankruptcy judge is going to put a slander judgment way at the bottom of a list of creditors should the offender actually get some money.

FOP ought to have a list of lawyers available for this type of work. Or farm it out. A couple of well publicized wins and bullshit CRs start to disappear.

As far as I am concerned the 277 day suspension should of been termination. The radio that P.O. Buford Smith was in control of was a radio that was taken from the 015th dist., furthermore another P.O. took 5 days for it for failure to sign it back in. And by the way P.O. Smith also was in possession of an IAD stix radio that belonged to a Sgt. And where was this found? Why in his house that he was being evicted from by Cook Co. Sheriff's for failing to pay the mortgage.

It makes me sick to know that we have thieves on this job taht would steal from other P.O.'s.

Of course most of the bullshit CRs come from people with no money and no source of income you can garnish. So, why exactly do they care? It's not like they're worried about getting an unpaid judgment on their records so they can't get into medical school. Mickey D's doesn't do background checks when they hire.

I applaud the effort of this officer to bring on this lawsuit. We can use more details though. Does anyone know a docket #, the PO, or anything else that may be helpful?

Also, everyone else sues the city, why can't we? Is there anything written anywhere that these affidavits are in place to protect us from anything other than disciplinary action?

If you are an attorney reading this blog and would be willing to take on one of these scumbags (city included), post your info. I've been sued several times and have NEVER done anything that any of the suits allege. City paid out every one of the plaintiffs. I serve-protect and get low class non working citizens PAID!
Not one of them had a job.

The two big cases there were probably separation cases and when the officers got their jobs back from police board, their 227 and 270 days respectively were probably considered time served. No one actually recommended a 227 day suspension. That is retarded.

Secondly, how many days should someone get for being AWOL? I have worked at other jobs where it is automayic termination if you fail to report to work without notification.

Thirdly, out of the cases that SCC listed here, we have no idea what kind of discplinary history the officers had. They may have bneen horrible, thus increasing the penalty.

Having said this, I still think that the mutts out there have the upper hand over us with this BS LOG system that we have. IPRA takes every complaint no questions asked becasue everyone is afraid the one time they tell someone they are crazy, it is going to be the friend of a reverend or alderman.

As you can problay tell, I work in IAD, and I see the bosses first hand give every mutt the benefit of the doubt. The new thing now is to reopen cases that were closed because of no contact with the complainant. I have seen cases opened becasue a letter was sent to IAD saying, "I was never contacted about this complaint." I guess there is no statute of limitations. Complete chicken shit. Becasue that is what every boss on this job is. Chicken Shit.

UNBELIEVABLE, the legislative intent of the sworn affidavit is to prosecute offenders who lie under oath concerning complaints against law enforcement members.

It is a travesty that the CCSAO does not prosecute these crimes. Don't worry, keep up the good work and continue to do nothing and the CCSAO will be running out of cases to prosecute and maybe (just maybe) they will start prosecuting these offenses.

Prosecutors and defense attorneys have started to notice the lack of arrests and they are starting to cry about it. The taxpayers will start to wonder why there are a bunch of ASA's, judges and court reporters sitting around collecting salaries and not doing anything. In a time of such economic instability the is no reason to substantiate the CCSAO's office if they aren't working.

The media should start doing their job and start looking into the drop in arrests and why this is happening (hint, hint: you shit on the police and productivity goes down).

For too long we have provided that office with quality arrests and they have been allowed to pick and choose what cases they would prosecute. Maybe the City, the CCSAO and a large block of citizens of Chicago should stop using the CPD as their doormat and you would see a drop in crime and a safer community.

Richie, Give us a contract, stop trying to financially screw us over, restrict OUR constitutionally protected rights, and change our disciplinary policy. The average cop just wants to do his job and be left alone when he is off-duty.

Look in I-Clear- under Legal Affairs- you should find The Advocate and all the legal bulletins that are still in force. The department puts this stuff out in print in limited quanitites but maintains the pdf file on the intranet. Educate yourself before someone/something else does.

Copper was taken to district, blew .000 and then did a urine drop which was clean.

Copper filed suit against the civilian and won a high six figures.

Copper had a nice nest egg when he retired.

That judgement is going on every Section 8 application, every credit card application, every car loan, every mortgage application, and every student loan application.

The officer can file another suit to attach this judgement to any property this POS owns. Any property he inherits. Any paycheck he gets.

Even if the officer never gets a penny, it was well worth the effort and maybe even several hundred dollars to insure that the POS never escapes this lie.

And if the POS ever does sue on the bogus complaint, the city will settle, and the officer will get paid.

Thank you officer for taking the time and energy to do that. These POS's have endless amounts of time, but they don't have endless amounts of money. Word will get around.

The concept is based on the premise that those who lie, do so with the expectation of receiving a 'windfall' settlement from the city (taxpayers), via their lies being accepted as truth.

Success in placing a judgment on their expected 'windfall' will discourage those pesky lawyers, aka hired liars, from attempting to gain said settlements, via representing the aforementioned lie tellers.

If said settlements are made, the judgments will bear fruit for the aggrieved parties who take the time, and make the efforts, to seek same.

Jeez! "The Advocate" (as in Department Advocate), is one of those piles of paper that gather dust along side with all the piles of other papers at the station, like all the new General Orders(blue), Special Orders(yellow) and Department Notices (gray).

They gather dust until there is no room where ever the piles are stacked and then someone dumps them in the trash to make room for new piles to gathers dust and so on and so on as it always has been.

It’s probably sitting there at your station, next to the new G.O. on Helicopters Involved in Vehicle Pursuits. Why did this have to be split up with 3-4 addendums? Our eye in the sky can be a big help or hurt, if you screw up in a pursuit. Watch, the department will soon put numbers on our car rooftops.

I would file a police report and I would not cooperate with any internal investigation. The officers need to cooperate with those procedures but civilians don't. Better off hiring your own lawyer and filing your own lawsuit and let the ridiculous risk management office who's only real goal is to eliminate liability for the department, I mean, the people in charge of investigating CRs order their own records and do whatever they want to do with the file after a real judgment has been issued.

I told this TRUE story on here a few years ago. PO is accused of being drunk by a traffic violator, PO calls for a sgt. who takes the complaint and orders the PO to blow. PO blows a 0.00, PO sues complainant (who has nothing) but judge finds in favor of PO. Lien is in place against complainant. A few years later complainant wins a large amount of $ in the IL lottery, PO collects judgement of approx. $9000.00!!! You never know when the scumbag may hit a lotto or something!!!

SCC, your opinion here is right on:

Cops are just a necessary evil for the polititions...they can't live with us and can't live without us. They don't want us to rile up their constituants, yet they want us to keep them away from their front door.

For Daley and his crew, cops should only be seen and not heard...oh, and they should be his chauffer, his bodyguard and a source of income for the city as long as we don't try to claim any of that money for our own contract!

exactly, all the publication of this judgment is is a smokescreen for the dept's and SA's office inaction. Using the same logic in domestic batteries we no longer need to make an arrest becuase the victim can use an alternative action to end the situation. A perjury conviction with at least some time in county sends a message. The judgment that the issue refers to is no punishment at all, can't squeeze blood from a turnip, and . What you should also see in the same issue though is their decision in a "no response" cr# is no longer unfounded but is now "no affidavit" so they can keep it on your record and reopen it later

FYI: The number of BS complaints did drop drasticly when complainants were forced to sign an affidavit in order to obtain a CR. Even more so when sgts informed complainants they could be sued by officers if they lied...but no system is perfect. At least they don't take anonymous complaints anymore.

It would be a waste of time and money to sue these low-lifes for slander because you would probably have to burn time for court, and hire counsel with your own money just to get nothing in return. If this joke of a system had any sense, they would mandate prison time in lieu of compensatory damages owed to an officer for a citizen who was found to commit false allegations and reports. Why should it be any different for them? If you perjured yourself, you would do time, right? It's time to hold everyone to the same standard. Allegations against officers are very serious, and by the same token, if someone has made them in malice and spite knowing them to be false, they should suffer equally serious consequences for trying to discredit and strip an officer's credibility. The city should also stop rewarding these thugs by settling; prolong and continue the proceedings until they just give up -- like they do with our contract negotiations!

Yes, a guy I worked with left for LAPD, a few years ago. He did the academy then some time in the field. After a short tour in the beat car, they moved him to a job using his prior experience and college degree.

The thing he was most amazed with, LAPD treats their officers like adults!

He was single at the time of the move, and had 10 years on CPD.
He loves it.

On her outer garment, Ms. Duckworth was proudly wearing an oversized lapel pin of the American flag composed of glittering red, white and blue rhinestones. It was beautiful and appeared to be approximately 4" across and 2" high. There was no doubt that Ms. Duckworth wanted to display her patriotism. I left CPD to go to Houston PD and I have never been happier! There are better departments out there just do your research and talk to some coppers there. If you still have time to get a full pension somewhere else it's worth it.

Another thing about LAPD and why their officers only last about 7 years is because they are P.O.S.T. certified. (Police Officer Standard Training.) They can go to other California departments, where they are highly sought after. Their pension transfers so they don't lose. That is why they do 7 and leave.

After meeting & speaking with officers from NYC, LA, SF and Las Vegas I'm convinced CPD treats their officers with less respect & has the least amount of training provided.

I have 3 years on & I'm looking elsewhere. This is a great job but the city treats us like shit. And personally I can't believe some of the morons that have been hired.

Guys like "AZ" are functional morons but there are some people who are Chicago police officers who aren't fit to bag my groceries.

What makes you think they are not doing something every day? Suggestion: Ask someone who was here before we had a contract, before 1980, what it was like. Then ask them to compare that to now.

Negotiating team is meeting under a non-disclosure agreement. That means they can't talk about anything related to contract talks. No news is good news. I believe the FOP is in a very good position this time. These things never happen quickly. Just live your life, when it happens you will be notified.

You heard? From who, a friend of a friend who knows someone who said so?

Before you go, get a copy of their contract and read it. Especially the parts that say when you can use your seniority and for what.

Then take a week or so vacation in LA and go around to police stations and ask LAPD officers about their job. Specifically ask about working conditions, bosses, promotions and seniority rights. And don't forget medical issues, how long one can lay up with non-duty related sickness or injury, And how is their health insurance.

This is due diligence. Do your homework thoroughly before you make the jump.

The CPD Detective Division no longer has the resources to solve murders when the offender wants a lawyer and witnesses/family members/citizens do not cooperate.

Physical evidence alone is not enough. It is difficult to get and even if it is found it only proves the defendant's presence. (Semen proves he fucked the victim/doesn't prove he killed her.)

Physical evidence is best used to prove or disprove what someone TELLS the police. The police can't force statements, no one believes what the police say, and ASA's refuse to enforce grand jury subpoenas or prosecute perjury.

The public wants every case in Cook Co. tried like a federal crime. Can't happen. Don't have the people, the time, the money, or the will.

There will be lots more cases that end up like the Soto and Hudson cases.

This is the only thing I have seen that I do respect about him. He is refusing to pretend he is patriotic, and is showing his true feelings of hatred for the USA as evidenced in his autobiographies.

At least he is being honest, for once. Though it is interesting, he refused to wear the flag early in the campaign, it was made an issue, he wore it as he was afraid of losing votes over his true feelings, now he is elected and stops wearing it again. Hmmmm.

I've been there.

Lake Pend Oreille, Coeur d'Alene and the Idaho Panhandle in general, is God's Country, particularly for the outdoorsman. Good schools, friendly people and it's virtually free of violent crimes committed by strangers.

My friend think of Arizona as well, its a pro-police state where the cost of living is lower than LA area. They do take laterals and w/ 3yrs on you got nothing to lose. This place is terrible, wish I would of left to go elsewhere but now its too late. Good luck..

A few comments:
1st, IAD is not our friends, but they do have a much needed job within our department. The problm is the feds and lawyers there now and before that tae the word of mickey the mope on everything and the need they have to try and get sustained numbers for their statistics. That's why they do these pimpy crs and give time---Statistics.
2nd. As far as I know, the CCSAO can not be sued for failure to prosecute. They have prosecutorial discretion when it comes to cases and limited civil immunity as a prosecutor.
3rd. Ret Lt. Fitzsimmons has a site "Sue the City .com" or something like that. He sues the city on behalf of police officers.
4th: You don't need the CCSAO to prosecute criminally. The Grand jury system (although run by an ASA) is a Cook County system that is not, by definition, an arm of the States' Attoney's Office. You can go to the grand jury with your evidence and witnesses (expect them to make you wait until the end of the day - get there by 0730-0800 so you are first) and proceed with your case. The grand jury can come back with a True Bill or not, depending on your case (you know the saying about a sandwich. Once it gets to court, the State can attempt to drop it, but the Judge could rule in your favor if you persist.
5th: I voted for Alvarez just because Tony is a fucking idiot. He killed me with the County Board election and the mob bullshit. That being said, she will not change anything. She was specifically asked if she would prosecute these liars and she took Milan's stance of, "I'm not touching that."

Sounds like a domestic situation gone bad and if so leave it alone. IAD looks into everything`- phone records, calling other officers for statements, and every other way of violating your privacy. You and the officer(s) you got beef with.. and innocent officers / bosses involved.. will take time for any department violation. Not worth the headache or the money or getting other officers involved. Take it from a PO who went through an ugly divorce and had the same problem.

It was beautiful and appeared to be approximately 4" across and 2" high. There was no doubt that Ms. Duckworth wanted to display her patriotism. Patriotism is not shown by jewelry placed on one's outer garment, however loud, expensive or attention-grabbing. Patriotism is evidenced quietly, purposefully and respectfully.

Time will tell as to Obama's patriotism. I should think the act of swearing to the oath of office will indicate much as to his views of service and loyalty to this country.

Excellent post.

The CPD Detective Division no longer has the resources to solve murders when the offender wants a lawyer and witnesses/family members/citizens do not cooperate.

Physical evidence alone is not enough. It is difficult to get and even if it is found it only proves the defendant's presence. (Semen proves he fucked the victim/doesn't prove he killed her.)

Physical evidence is best used to prove or disprove what someone TELLS the police. The police can't force statements, no one believes what the police say, and ASA's refuse to enforce grand jury subpoenas or prosecute perjury.

The public wants every case in Cook Co. tried like a federal crime. Can't happen. Don't have the people, the time, the money, or the will.

There will be lots more cases that end up like the Soto and Hudson cases.

I wouldnt judge the actions of the U of C too harshly for filing a complaint against pos there. The 021st District has to be called out on the carpet every now and held accountable for all the blown off jobs they are part of. I was there for a short period of time and suspected alot of jobs/arrests being blown off or just loose paper just to not have to go to court. I had to go or get out of Police work. Pos can get hurt like that..... So 30 days might be a wake up call over there. Dont believe me? Ask Area 1 Detectives what they think about the District. I apologize to the small group of hard working Po's in 021 for being included in this general statement. The good ones know, or should know, who they are....

You are correct ,was the subject of a CR# from po during a bad split up. Said CR# claimed I left items at this persons back door this person wrote a very moving statement of the fear she was in and IAD investigated this all on a confidential for months. Well lo and behold when I was served I had a document from another state proving I was there on the day this poor scared for her life po was so intimidated: meaning it was impossible for me to have left anything at the back door and this poor abused po had made the story up along with several other allegations all disproved during the investigation. Bottom line IAD and the department did nothing to this nut job for all the bullshit she pulled and believe me all you "experts" good luck finding a lawyer who will take a case like this to sue. IAD rats will never help you unless you have clout and IAD will sand bag you if they so choose.

It was about the moment, the place, and respect for our Veterans. He was not just walking down the street, he was presenting a wreath at a Veteran's Memorial on Veteran's Day as the Commander-in-Chief elect for cripe sake.

I do not give a shit if he was wearing a flag pin before he got in front of the memoral or after he was done presenting the wreath.

I do not even give a shit if ever wears a flag pin, but he should show respect, not allegiance because he has none, during a few ceremonies every year, however the election is over and he will not wear it because his open disrespect is obvious to all but someone like you, but when he is pretending to honor the brave, he should wear the flag pin out of respect for the men and women that fought for the flag.

If he cannot even muster up enough courage and conviction to show that respect, why bother to show up at all? Fuck you and fuck him.

IAD investigator is ordered to fire him, based on positive surveilances. Investigator INVESTIGATES and learns the guy is only living there because he's rebuilding wife's bathroom because the upstairs neighbor flooded the place and the ceiling caved in. Investigator exonerates the officer and everyone lived happily ever after, selling the condo, moving back into the city after repairs were done and making it to pension.

Investigators/Agents/whoever closes out the case... make the 'recommendation' for SEPARATION. That IS the punishment.
The only way someone else affects the punishment is if they don't concur with the closing officer's findings. Then they write their comments and investigatory findings up and send their commentary through chain of command along with the original documents.

Then the superintendent usually does whatever he damned well pleases, anyway. ;-)
